7:00 pm
to watch us every night. 6:00 p.m. you never want to miss an episode. stay tuned, right here, right now, lou dobbs is next. always keep it on fox business. lou: did evening, everyone. president obama facing a firestorm of criticism for breaking the law and trading five taliban terrorist detainees at guantánamo bay. but the president insists that he will not be making any apologies. here he is in brussels today. >> we had a prisoner of war whose health had deteriorated. we were deeply concerned about only saw an opportunity and we seized it. i make no apologies for that.
7:01 pm
>> that is quite a statement from the president considering that he began his presidency as though he would never stop making apologies. do you remember those days? at least he apologized for previous presidents. here is president obama talking with us and 2009. >> my job is to communicate that americans are not your enemy. we sometimes make mistakes. we have not been perfect. lou: it is clear that this president has broken a law that was passed specifically to prevent the release of terrorist detainees from guantánamo bay. and then he ignored each and every one of the intelligence agencies that he did commands as president. what are the consequences of his go it alone conduct? well, this in the past 24 hours alone. the secret documents obtained by fox news show that during his five years in captivity, at one point he converted to islam and
7:02 pm
fraternized openly and declared himself a warrior for as long. according to eyewitness accounts, he became so accepted among his captors that one point he was allowed to carry a gun. and those fears that they would embolden the taliban, they are now a reality. a taliban commander telling time magazine today that it is better to kidnap one person like this and kidnapped hundreds of useless people. it has encouraged our people and now everybody will work hard to capture such an important bird. we will be taking of these events and issues with the kernel. also tonight, shocking evidence of a massive humanitarian crisis at our southern border created by president obama's promises of amnesty. which have encouraged tens of
7:03 pm
thousands of children to flee central america and cross into the united states. we will be talking with an investigative journalist who were among the first report the crisis and some much-needed good news on this economy. a new report finds record-breaking low for american households. art laffer on what needs to be done to keep propelling this economy forward in restoring prosperity for our middle-class and those who aspire to it. my first guest tonight says the obama administration's effort showed a total disregard in the military. joining us tonight is our fox news military analyst. it's so good to have you with us. let's start with these developments. a president who will not apologize for what is already seen as an incontrovertible
7:04 pm
breach of law that was designed to keep this from happening. >> indeed. and you for having me on the show. one cannot help but wonder whether the president will be apologetic when some american soldiers, sailors, marines, or civilians are taken hostage or captive by not only the taliban and economy network, but other terrorist and insurgent groups around the world and expect themselves to have some kind of great deal negotiated with this administration or whatever administration follows behind it. the president has set a terrible precedent as many people have been saying on this, for what he has done by treating these people. i was around and i have watched all of this. i watched them participate in that for years. the standard rule always was you don't negotiate with terrorists and give up.
7:05 pm
and our allies were going to take consequences for this. >> the united states military and has been concerning because of some of the statements especially when we look back three years at an article in tone and see a very correct, at least as far as we understand the facts today, a very correct profile of sergeant bow bergdahl and his situation at that time, three years ago after being in captivity. >> it's unfortunate if you want to stay in this position, you have to toe the white house line and that takes away the credibility and all of the things that many grew up with is
7:06 pm
a military man, knowing that integrity and principle and character, those are the real traitssthat you want to exhibit is a military leader, most of those things are out the window these days and if you want to get ahead, you better be what the white house expects you to do. no creative thinking out there, it doesn't matter what fact may be, you just have to go out there and make this story that saddles up with what the white house is saying. >> it says a lot, what this administration is saying at this point. no apologies, citing bow bergdahl, his health, which turns out to be a questionable statement if not an outright unsupportable statement. leon panetta saying straightforwardly, i'd like to share with our audience at this time, leon panetta on the proposal back in 2012. i said wait, i have an obligation under the law.
7:07 pm
if i send prisoners from guantánamo, they have to guarantee that they don't go back to the battlefield. i have serious, serious reservations and concerns. what are your thoughts? >> yes, indeed. behind closed doors there are a that have very seriousntagon reservations about what was done. as none of them remember in the loop as this deal went down. kind closely as you might get one story, leon panetta no longer serving this administration, there are people who wish they could do the same. but they just can't if they don't want to be fired as other military men have been since this white house became part of power. people can say what they want to say. all that evidence, all those reports, all of those things that they are coming out with, a lot of people have seen these things. if the white house doesn't like what is being said, they will
7:08 pm
put a spin on it, including calling these men swift voters for having anything negative to say. >> yes, that is something that the kernel is referring to, tweets sent out from the white house, actually questioning the integrity of some of the young men who served with bow bergdahl. they have since recanted to the extent of apologizing. but it is eggs despicable and pause to see this. lou: thank you so much for joining us. >> it is my privilege. >> interestingly enough, one of the people that he was referring to was vice president joe biden. he has not come to the president's defense on the bergdahl view. here's the reason perhaps why. officials telling reuters that
7:09 pm
vice joe biden was neutral on the idea of a prisoner exchange, biting his tongue at least this hour, maintaining his silence on the issue. coming up next, the humanitarian crisis on our southern border. children trying to make an illegal crossing into america at the urging of their parents. in the urging, in fact, of the mexican government and our government not saying a word, nor to our forces on the border. the situation exposed and pictures by breitbart. the voter expert who brought us the story is coming up next. wondering what that is? that, my friends, is everything. and with the quicksilver card from capital one, you earn unlimited 1.5% cash back on everything you purchase. not just "everything at the hardware store."

lou: the pictures you're looking at, on your screen, visual evidence of the massive humanitarian crisis that is building at our country's southern border. the department of homeland security estimating that 60,000 children under the age of 12 years old will be trying to cross the border without their parents this year. it is not an accident that this many children at this time are moving to our southern border. they predict the number of children will double next year to 120,000. the same department of homeland security today giving even more illegal immigrant children and others, to make that dangerous trek through the sands of northern mexico across our border. secretary jay johnson winnowing president obama's non-deportation policy for
7:14 pm
so-called dreamers for two more years. homeland security, already overrun with so many illegal children, a legal immigrant children that they are forced to put them in sometimes unhygienic facilities from texas to san diego. the border patrol council and border patrol union, in san diego, preparing to release as many as 500 illegal immigrants each week into the country. humanitarian agencies investigating why these countries are shipping these children to our border. we decided to reach out to you for some answers. the answers are truly pitiful. their response is thank you for reaching out to us, i'm sorry we cannot help you with this topic. the united nations high
7:15 pm
commissioner for refugees did initiate an investigation. are you ready for the conclusion. that report included the children from el salvador and guatemala and honduras face drug cartels, human traffickers, and sometimes members of their families and their own homes. but the high commissioner dismissed any responsibility to deal with the victims of the brutality of the drug cartels and gangs and denied that corruption in those countries, including government corruption was a significant role in creating this crisis of children dumped on our southern border. the commissioner had this to say. the persecution experienced by the children is not usually state-sponsored, so condemning these countries is not needed. so could we go back to that just for a moment. i'd like to do that one more
7:16 pm
time. the persecution experienced by the children is not usually state-sponsored, so condemning these countries is not needed. and i say the high commissioner is higher than anyone might reasonably have expected. joining us now include the photos taken. sylvia longmire, he breitbart contributing editor and the author of the book, order and security. thank you both for being with us. sylvia, let me turn to the photos in the pictures. why are they not being seen seen by millions of americans in this country? >> i think fortunately putting these photos on display, we are
7:17 pm
taking a stab in the right direction. we have not better prepared, seen this coming and prepare for this crisis to make sure that they don't come in the first place, that we understand what the conditions are an established order security strategy to prevent this from happening in the first place. and also not to have a reactive strategy or an emergency strategy in place for dealing with this influx of people to make sure that they are not just overwhelmed for border patrol. >> they are clearly overwhelmed right now. these pictures were not taken by a photojournalist, but released by someone who is in law enforcement along the border. >> yes, i would call this person a whistleblower within the border patrol is something those
7:18 pm
images and verify that they were authentic. and wanted to get the word out about not only the conditions of people within the facilities, but also how overwhelmed the border patrol is, those who are out there now and many of them inside of the facilities leaving the border wide open in some places. lou: as i understand it right now from immigration and customs enforcement and border patrol agents, they have been hold back and are being held back from aggressively enforcing immigration laws and voicing border security. so what do you know? >> well, as far as being pulled back, i'm not entirely sure if that's completely accurate. but i know there has been a lot of controversy, particularly that over border shootings and a revision over the policy of how
7:19 pm
agents respond in any kind of arms confrontation of smugglers who are driving in vehicles. and i think that even though there are some concerns about how agents are handling the situations, we also have the worry if agents are going to sit there and overthink every situation or are they just going to, you know, not react properly that the way that they should. possibly endanger themselves more than necessary. >> okay, i have to stop. you're basically you are basically asking the question, can we protect our border patrol agents from their own incompetent selves. do you mean to be saying that? >> if you do, i just want you to understand what you're saying. because i don't -- in regard to border patrol, it seems that there are a bunch of agents that you're saying our hapless.
7:20 pm
>> at breitbart we have been a consistent voice for the men and women of the border patrol. oftentimes just like the border patrol union, the national border patrol you council has reported to us multiple times that there is a huge division between the political point of leadership and the border patrol. and the actual men and women serving on the ground out there on the field. until oftentimes what has happened, the border patrol council reports to us, we have covered this extensively. lou: if you guys say this one more time, i'm going to have to keep count. [applause] >> we are delighted that you want to do that. but i would like you to just give me an answer. lou: we have spent a lot of time on the border. they are concerned about our border patrol, those agents in
7:21 pm
those conditions for those children and why they are there. do you know what why those children are there in those conditions? sylvia? >> absolutely, their parents are afraid for them. they want to provide better educational opportunities and the better life. in places like congress to have the gangs and recruiting children as young as seven, eight, nine years old. in some cases -- >> it seems that it's permeating our society. 250 cities in this country. >> we have a situation where -- where they are being threatened with death. and if that was happening to our children here in the united states in a certain city and your child or family was going to be killed by a gang of your child and go and join -- lou: what i asked was how do those children into the border
7:22 pm
so how do they get caught? >> by the drug cartels, with coyotes. lou: okay, that is many of the children. your thoughts as we wrap up here? what are we looking at here, is this an orchestrated effort to overwhelmed the border patrol borders themselves? >> i do believe it is. i believe that some people are exploiting this. they are doing this from a position of need. i think a lot of them are the ones that traffic these children end their overwhelming the border patrol so they can continue this in the united states and across the united states. lou: we appreciate you being
7:23 pm
with us and documenting the hardship and frankly the jeopardy that these children are in. as well as the assaults on our borders. it's certainly an interesting agenda. one that isn't necessarily sensible for these children were this country. we thank you both. see i think you. lou: it is time for a look at our online poll. we asked chuck hagel, did he die to rescue sergeant bergdahl? you believe that? 95% said no. and as president obama driving the migration of illegal immigrant children across our southern borders? cast your vote at loudobbs.com because we would love to hear from you. coming up next, my commentary with a predictable reaction. the white house scandal coming up next. stick with innovation.

economic report. a record high, we will be talking with a former reagan economist art laffer. and defense secretary liam fox gives us the new look at his new book rising tide, his analysis as to how the information age is providing steep challenges for global leaders. and the president says he will not apologize for the bergdahl terrorist exchange. and few people expected them to. the president, it seems, prefers to apologize for previous presidents, and for america. certainly before it was obama lead. we are becoming very familiar with the obama white house manual on handling dental and controversy. step one, deny there is a scandal. here is the president's response when asked if he was surprised by the controversy over the administration's deal to free sergeant bergdahl. >> i am never surprised by controversies better with that
7:28 pm
in washington. that is par for the course. >> par for the course, and it seems that he spent a lot of time on the course. and if at all possible, insinuating this into the discussion and playing the race card strata. a politico report providing an example. all of this, they say, is in their minds for the hatred for the president. the new approach is another example of republicans complaining about something just because of this. that is deeply within the lexicon. a sharp dog whistle, they play it almost every opportunity. step three, the obama scandal
7:29 pm
recommends that all principles say they learn about the scandal whether it through news reports or the media. unfortunately for the white house, there have been so many scandals now but the sheer number of times they have been in one within the administration that is noticeably pure nonsense. even their own supporters can't stomach many more efforts claiming ignorance of just about everything that has happened in the administration. and i believe the american people no longer require any proof that president obama has acted in ignorance. i believe that the president has managed to build a national consensus on that issue at least. but now i would like to share with you the location of the evening. the sentiment that i love. it's power and strength and hope. this from booker t. washington,

>> what would race have anything to do with it? stick with what you want to go for it and stick with that. it's kind of like the legend to me. it's a good excuse for not getting there. lou: joining us now is a contributing writer. it is good to have you with us on the broadcast. judith miller, wrapping up a new book that we are waiting for. your reaction to morgan freeman. >> i love him, i think he's wrong on this point though. because i think that there's plenty of data. showing that outcomes for people of color are different if you were born in a certain zip code. that determines how successful you can be. and how unfair is that in this country where hard work should pay off. >> so you think outcome should be equal?
7:35 pm
>> yes. you should have opportunity if you put in the same amount of work and. >> i could and should be all day to ebony magazine and not be as good as you. should i make the same amount of money? >> if you are doing the same work, yes, you should. >> what are your thoughts are. >> i think we are talking about equal opportunity. until this gap eliminated between races, i think that morgan freeman is one of the gifted actors that i know. lou: what about the other? i think he is exactly right, this country, it can be a terrible thing. >> you had your shot, i'm going to take mine. my view is that this country is,
7:36 pm
well, 60 years further along. and we need to take note of it. the platitudes in the construct of language about race and the outcomes. they constitute, to me, a revisionism that is unacceptable to let me tell you the story. my mother is not six years old and went to segregated elementary. that is my mother. so when you say that we are 60 years, not something a long time. the one i'm talking about my mother, who's not even six years old, just retired, went to elementary school in the north, north, i think we really have to take accountability to the reality of the history of the country and the fact that the opportunity is not there for everyone. so it's an ongoing struggle. it's not something from the past. and it should be everyone's struggle. lou: that is your view.
7:37 pm
lou: if i may, i was there in the 60s. >> i read the book too. lou: so you can dismiss my history, but i can't dismiss yours? >> no, no, no -- it is my experience. lou: and how long was that experience? >> 32 years. lou: so it's half as good as your mother's? >> maybe we should talk with your mother. >> sure. lou: that might be more awesome in perspective. turning to the president, not apologizing. >> i think that the president is the chief of the country and the military and it's his job to make sure that people come home no matter what. >> we bring them back and then he faces this. >> he's doing well, he covers
7:38 pm
his eyes and ears, ignores the law that was written specifically to prohibit this outcome. >> no, no, no. it is not illegal. no, no -- i went to law school, i understand. >> he has the authority. >> unilaterally? so the law that is written by congress to prohibit exactly this outcome? >> he simply did not give them the notifications. >> who knew about this? when dianne feinstein, when she is the head of the senate intelligence committee. excuse me, let someone else talk. when she was told the details of the osama bin laden raid, she was not given aavance notice. >> like i just said they walked
7:39 pm
out of the briefing. so i really have a that this is part of it. and they knew months in advance of this negotiation was taking place. >> you get the last word. >> i think there are many questions about this. why the president did what he did. but one thing is pretty clear. what he has done has not gone over well with the american people what susan rice talked about as describing his service, the american people want some truth. >> for the second time in a moment of national concern
7:40 pm
misrepresented the truth. thank you both for being here. come back, bring your mother, i want to hear her perspectives as well. >> you are a lawyer and i treasure lawyers, i really do. >> i can understand sarcasm. >> i would love to have you back and her mother. i'm being very sincere. thank you so much, both of you. and a reminder to vote in tonight's online poll. do you believe president obama is driving the migration of immigrant children across our border. give us your response comes we are coming right back. >> stockmarkets at record highs. and the job picture is improving

philips sonicare lou: we are back. america's network climbing to record levels. i hope you can feel the love. household wealth hitting 81.8 final is in the worst quarter. largely because of prices and believe it or not, higher stock prices as well. herewith the outlook for this economy is art laffer. a former member of the economic advisory board. author of the nature and causes of the wealth of states. >> thank you so much. i watch your last segment. i don't know how you do it at
7:45 pm
times. >> i think we have to find out what is it in this case of art laffer? >> the whole conversation, i've got morgan freeman's quote, which is very beautiful and nice. but the question is how do you rectify it. you do it by the way obama does creating the unemployment rates? large disparities among black and whites? or with economic growth? including far better opportunities and chances for people to better themselves. so it's really the solution, not this argument over whether there is or is not racism. if there is come the question is how to solve it not by beating people up, but by creating opportunities. >> i think the reality here is that we have to acknowledge
7:46 pm
history and history is over $8 billion spent for the war it on poverty. we have a history of affirmative action, we have pushed the country along whether it works or doesn't work. the experiment has not resolved the problem that we sent out to solve. so as he suggests, jesse jackson and i talked about this and he and i agreed on one thing. a rising tide lifts all votes. this president will not listen to jesse jackson or other leaders. it's extraordinary to me. >> i wrote something about this a while ago. creating tax-free zones and the most poverty-stricken areas, giving them the advantage of economic growth and prosperity
7:47 pm
that will really do a rising tide. i testify before the civil rights commission on all of this. once they understand it becomes clear that that is the answer. kennedy understood it, reagan understood that, and most of all we understand it. >> you are right. lou: what does this president understands our are differences in our business leaders, over $2 trillion on offshore account in perfectly legal accounts. but we need to bring it home and we need to get invested in we need to incentivize business to do so, but we need at the same time to make it clear that this is going to be about creating jobs. so we don't have that comprehension with either party. >> that is for sure. the reason why is that they bring it home and will pay a
7:48 pm
huge tax on it. so why would you ever want to have that so high that they don't ring the money home? is another example of counterproductive government policies. even though they know it's true, they still don't change it. obama hasn't really gone for a much lower corporate tax, which he could easily get past. bringing all of that money home. but he just won't do it any wonder the pipeline either. lou: you have to be thrilled about the minimum wage, right amax. >> i used to guarantee that it's just atrocious. >> it's not only minimum wage of these direct dealers in the stock market going on. people are anticipating a big change coming this november.
7:49 pm
>> 83, 84, 300,000 new jobs a month and they have a much larger population. doesn't that just say it all? >> yes, the new normal under this president, promising radical transformation has achieved at least one element of it. take you so much. >> thank you. lou: up next, rising tide, how technology is making the world change faster than anyone could have imagined or how we struggle for global leaders. liam fox is coming up next.
