4:00 am
and what do you mean by a little bit? >> anyway, sometimes you sound like a 7-year-old. well, sometimes you write like . coming up next is lou dobbs. lou: it evening, everyone from a , a number of developing stories at this hour. the irs commissioner was defined as he appeared before the house ways and means committee today. the irs had refused to give any apology for failing to tell congress that for five months these lois learn enough have been lost. and the only reason the internal revenue service admitted that her hard drive had been destroyed, was because congress finally asked. >> what i didn't hear and that was an apology.
4:01 am
>> not a single e-mail has been law since the start of the investigation feeling thousands of children coming across the border from mexico cannot remain. including the deportation executive order and that spurred the humanitarian crisis in the first place. end jay johnson finally heading back from texas to see the it extent of the crisis. his first visit to the border since january. and this includes his crisis and not waiting for the national guard to protect the border.
4:02 am
and back home the pentagon mimicking the presidents talk about returning our troops to iraq. the pentagon spokesperson. >> we have a lengthy stay in certainly not participating in combat action. this is a discrete measure and it is temporary as an arrangement to get eyes on the ground and figure out what is going on and get a better sense of it. lou: began with accusations with the house ways and means committee that this is the most corrupt and deceitful internal revenue service and the history of the agents you. the truthfulness directly
4:03 am
challenged. chief congressional correspondent with our report. >> this is a pattern of abuse that is not giving us any continent competence of this agency is being impartial. i don't believe you, this is incredible. >> i have a long career. it's the first time that someone has said they don't believe me. >> more than two years of the e-mails of lois lerner were lost in a computer crash. they blessed irs commissioner, and he testified that her hard drive was recycled and destroyed and backup was only kept for six months. then the chairman saw something more basic. >> what i didn't hear and that is an apology to the committee.
4:04 am
i don't think an apology is owed. not a single e-mail has been a single a single e-mail has been law since the start of this investigation. reporter: suggesting that a special prosecutor was constantly called a monumental waste of taxpayer funds. >> this has been conducted blesses a hearing is it had been as an inquisition. you deserve better. you certainly are obligated to give us truthful answers, and we appreciate that you are trying to do so tour there are references to this letter. in it, the white house was told by the treasury about the missing e-mail issue in april. he wanted to know why they weren't informed until two months later. >> they kept it secret from the congress, who is conducting an investigation. >> we were not keeping it a secret. it was our public report that
4:05 am
provided this information and there's been no attempt to keep it a secret. reporter: he has only been on the job for six months, but kevin brady suggested that the agency has hit a historic low. >> this is the most corrupt and deceitful irs. reporter: to say that this is the most corrupt irs in history ignores a lot of history and seems to me a classic overreaction to a serious problem that we are dealing with seriously. reporter: he continued to unleash over the timeline. >> you told us on monday because we asked you whether any other hard drives crash. this is unbelievable. told us you're going to give her all of her e-mails and he learned in february that this crash. >> i did not learn in february. >> i'm not asking you a question, making a statement. >> and peter rossen suggested that this be used to. >> i think the administration came to you as a white knight.
4:06 am
and someone of a sterling reputation. and i think the administration is trading on your reputation. so i think you've made a bad choice for max several sources confirmed the treasury inspector general is now investigating the circumstances surrounding the missing e-mails and the related information technology issues. lou: mike emanuel from capitol hill. our first best inside the contentious hearing joining us by phone. congressman mike kelly, a member of the house ways and means committee. congressman, to imagine you're about ready to spit nails as you listen, basically playing word games with the committee. >> i'm i met with him on tuesday for over an hour. we both agreed that this is a reputable damage to the irs and its reputation. when i saw him today and i talked to him after the hearing, i said this is exactly what we
4:07 am
talked about. you're not being able to give us clear information. not just us, but the american people and we are talking about a violation of constitutional rights. we were told we were looking into it great we didn't know when this would be done, but they knew that these e-mails were not available. it was 2011 that they knew that the e-mails were lost. so why now? why did you wait until last friday, about 3:00 o'clock in the afternoon to let us know and then come back again on monday when there were others that we need to know about. well, there may be six or seven. okay, when you finally going to tell us exactly what is what? and i think that that is the way the irs has handled them. before him, there was miller, and these folks have stalled ant they just never come clean with what we are asking. i think they've done great harm to the american people and they
4:08 am
have violated first amendment rights of americans listen. but more importantly, they have continued to grow this gap and a government that absolutely relies upon it for any type of situation. you cannot think, my goodness, they can't tell you the full story where the truth on anything. >> i take your point. i do believe that they could tell you, but they are by refusing to do so in the face of the committee. telling him whatever his reputation before, he has just trashed it. and so i am taken aback by the failure of the administration and the committee to express utter outrage at this administration. he was playing word games and being cute. and he is for the administration, i think some members of the committee have observed that he is a useful
4:09 am
tool for this administration. but the committee has got to go well beyond saying that i do not believe you, in my opinion. the american people right now are furious and any timidity here to go after the truth, i think it would be, frankly, it is unforgivable as the act of this administration. >> where is the investigation now, and do you know what is owing on with the hard drives and the backups and the e-mails that are in any other part besides the federal government or the executive branch? >> that is why we say we won a special prosecutor now. because we cannot get to the answers that we are told consistently that we are still working on this, we will come back to it as soon as we get the information, you will know. when you look at what is going on, and i'm not disagreeing with you about taking too long, but
4:10 am
when you go through the process that we are asked to go through and this comes back to us, that's why the chairman has asked for a special prosecutor. saying enough with this, we cannot rely on you. you're not giving us any answers. and that is what we are pushing for right now. lou: how long do you think before that happens? so how quickly can now process be struck? >> well, we do have the support of leadership. i would also say that what you are doing tonight what the american people do, there needs to be an outrage expressed by the american people and i have to tell you that there's a lot of people who think what we are doing is over-the-top because we don't like it. and that's the part that holds you back. enough is enough, we have watched six years of this action and this man reduce the office of the presidency.
4:11 am
and so now we need a public outrage to go along with it with the republicans in congress, as you know. a group of people are just going after this guy, they say, because we don't like him. but they keep talking about this as a political game. there's no truth trick to it any need to stop doing this. so where are the american people? they should be asked about this. >> i think they are waiting to express outrage. >> i have to applaud what you and the committee are doing. and i believe you have come to the correct conclusion without question. but there comes a time irrespective of what people are saying about you on the margin. the fact is that 65% of the folks think that this president is doing a lousy job in for a lot of lousy reasons. so good for you, and hopefully
4:12 am
we will get to the truth very soon. >> very clearly on us. we don't have prosecutorial powers. we are asking right now for a special prosecutor to come in, that it goes to the next level because we have been stonewalled. but we have to push and go through a special prosecutor to get to where we want to go and leadership is behind us on this. >> we appreciate what you and the committee are doing. >> thank you, sir. >> the obama administration today announcing new measures to fight the crisis on our southern borders, the critics say this is the administration's making. it includes more immigration and attorneys to quickly deport adult whose claims for asylum are rejected. almost $10 million in new economic aid to help central american countries repatriate
4:13 am
those who are deported. but the administration today, outright rejected any cause that house leader john boehner, other republicans calling out the national guard and senator national guard troops to the border to stop the absolutely biggest flood. a thousand a day in the rio grande valley sector alone in texas. most of the 52,000 so-called unaccompanied children that have been apprehended this year. originating from al's all the doors, while amada and mexico. which is why vice president biden is in guatemala. meeting with the president of that country and el salvador as well as senior officials of honduras and mexico. as for the president himself as we reported earlier, he called his mexican counterpart yesterday to talk about a strategy to address the crisis.
4:14 am
according to the white house, president obama stressed that those who have crossed the border will be returned. they will be deported, but it's unlikely to spend widespread criticism about the handling of the crisis, and in fact, there is some doubt about anything that he does say about the crisis. so in fact, a new gallup poll finding 65%, two out of three americans that disapprove of the president's handling of immigration. it is the worst ever reading from president obama on immigration since gallup poll the subject. and by the way, according to the white house description of the president's fall with the mexican president, the two did not discuss injured him a receipt. he has now been confined in a mexican jail for 81 days without the slightest public effort from this administration. this president and getting him

could mean less waiting for things like security backups and file downloads you'd take that test, right? well, what are you waiting for? you could literally be done with the test by now. now you could have done it twice. this is awkward. check your speed. see how fast your internet can be. switch now and add voice and tv for $34.90. comcast business built for business. trwith secure wifie for your business.

it also comes with public wifi for your customers. not so with internet from the phone company. i would email the phone company to inquire as to why they have shortchanged these customers. but that would require wifi. switch to comcast business internet and get two wifi networks included. comcast business built for business. >> our next guest says the federal government's inability to secure the border is putting the safety of texas citizens and communities at risk, giving the drug cartels a clear path into our country. joining us now is the attorney general, the great state of texas, greg abbott. it is good to have you with us. >> thank you. >> you have decided to move your
4:19 am
department of public safety officials into a surge to try to control what is happening at the border. described as a crisis by our president. >> yes, we have, first, we are doing it because, as you point out, this is an administration made disaster. because the obama administration has not only failed to secure the order, but basically giving an open invitation. >> you're not going to be sent back are prosecuted. and it basically open up the gates to the doors of the united states. and that has led to a flood of more than a thousand people a day coming across the border. lou: and that is just the rio grande valley sector? >> yes, you're right.
4:20 am
it was representing less than one third of the mexican border. >> last week i had a request from jay johnson for the federal government to provide $30 million to secure the border. he hasn't responded. and this is something that they have proven it in the past and have the capability of doing. whenever they engage in these operations, they proved to be very successful at minimizing the border traffic. lou: this administration has brought you to the nail all the way. with the state of arizona in particular and this is a president, irrespective of what he says, is committed to open borders and you're going to put
4:21 am
yourself in the state of texas in direct opposition to the will of the president. but he will be on the side of the law. >> speaking on the side of the law, that on is the lack of the enforcement of the rule the. but dealing with the administration, securing this for the remainder of the calendar year, it would cost a little bit more than $30 million. today the vice president was in central america handing out $93 million to guatemala and rejecting the request for the $30 million to we need to protect our own borders and citizens. >> is a president lying when he says that those who cross illegally but will be returned
4:22 am
and deported to their countries of origin? >> we are going to hold him accountable without representation. it will be whether or not they actually for fill their commitment to do that. and until the president of some to that representation, there will continue to be the spread of people coming into the country here without authorization. so the president must for fill that commitment, otherwise we are living with a very dangerous thing. and it's not just women and children, but we are dealing with one of the most dangerous things in the entire world coming across the border, border patrol sees them and must allow them in because they are 17 years old, people that will filter throughout the country. lou: be called in detention centers, where we are putting many of these people right now, over 40 of them, we are told, across the country, three military bases being used in
4:23 am
these bases will quite disbursal centers, as do these detention centers and this looks like a fairly considerate plan when there's more at organization internal to the united states about dispersing the illegal immigrant then there is organized effort to secure the border. >> yes, you hit the nail on the head. the federal government is organized in securing the border, if they were, we wouldn't have to engage all of these assets across the ground across the country applying to deal with the catastrophe that we have and the humanitarian issues that we have because we have so many people across the border. the federal government simply have to assemble the resources and deploy the more they have to be deployed to does secured in the first place. lou: greg abbott, we thank you so much. >> thank you. lou: a quick look at our online
4:24 am
poll results. we asked a foreign policy track record, more than 20 millions americans onboard, should congress be going along with any proposal made by this white house? 97% said no. vote in tonight's poll. the question to answer, which part of the obama administration three eyed monster do you find the most difficult? the immigration policy? the iraq policy, or the irs stonewall? cast your vote at loudobbs.com. coming up next, my commentary on the white house decision to change the definition of illegal immigration instead of fixing the problem. coming up
4:27 am
4:28 am
andrew mccarthy joins us here as well. very close to reality. the media ceo on one job creation and prosperity will follow. that is coming up next. and the obama administration. they have come up with another expression for illegal immigrants. they have come up with a new word and phrase and it becomes our word and phrase of the evening. courtesy of the white house, of course. it is unlawful migration. is apparently the white house's preferred term instead of the more common terms legal immigration. unlawful migration is how they describe the border crisis. in order to keep track of the efforts to control the immigration issues. let's take a look at the most
4:29 am
recent list of entries to be used, which is perfectly serviceable and descriptive. first, illegal alien. it's too strong an offensive into clear. so next, then came undocumented worker. and then came illegal immigrant. but that, too, it was to clear and therefore offensive to the left and those that hide behind the curtains of rhetoric and political correctness. and the left trying to push the generic term migraine. no law, no problem, no relevance, known difference between illegal and legal. but that didn't hold up very long either even the compliant national liberal media. so instead of enforcing our immigration laws, securing our borders, the white house has committed itself to more. including deception strategies and outright propaganda.
4:30 am
that is outright lies to the american people by refusing to enforce our laws were our border security. the truth is that i support immigration reform, but immigration reform as defined by the house judiciary committee that it has moved to the house. i made it clear that i support the enactment of immigration legislation that has been advocated and sponsored by the house judiciary committee chairman horsman bob goodlatte who has moved those bills out of the committee that represent, in my opinion, an outstanding commendations for solving illegal immigration and allowing illegal immigrants now here under certain circumstances that are well-defined to have a past not to citizenship that to the mind of those who seek legal status in our country legally. no difference between them at
4:31 am
all. the bills addressing border security and interior enforcement, all of the concerns and bob goodlatte favors a commonsense step-by-step instrumental fully public approach. the congressman points out that the president's plan to deal with the border crisis is, nothing but smoke and mirrors, and he is being fined. he has orchestrated this crisis on the border and with every passing day it worsens and his poll numbers plummet even further. most of those at our border have been encouraged to travel hundreds of miles from guatemala el salvador, honduras, transporting done by the drug cartels who are southern states. a dangerous trip of more than 1800 miles. many taught how to fraudulently
4:32 am
claim asylum when they get to the border. the president's response has been to turn his back on the very civil rights that he says that he stands for. his refusal to enforce the law at our border is crushing the civil rights of american citizens in with his every cynical hollow word, he crushes the civil rights of all legal immigrants, those who lawfully come to our country. mr. obama has moved well beyond being a disappointment, and that is a downright shame for illegal immigrants and citizens as well. the chairman will be with us on monday. please be with us. we're coming right back. stay with us. >> the irs commissioner wayne kyu with congress says that he will not say he is sorry and stands by his position that the agency is simply incompetent. agency is simply incompetent. andrew mccarthy joins us

4:36 am
>> my next guest says the benghazi ringleaders should be detained as an enemy combatant. i'm joined by andrew mccarthy and his new book is entitled picklist execution and it analyzes very carefully the political ramifications of impeachment of president obama. it's good having her. >> thank you for having me. >> let's begin with the internal revenue service and what i saw as a smug and defiant irs commissioner, basically offering nothing more than responses and not answers to the committee today. what did you see? >> i really think the of noxious this of his demeanor was shocking, frankly.
4:37 am
and first of all, if he were in private industry instead of a comparable government position, and you have these indicators of obstruction of justice, potential perjury and omissions of information from congress under circumstances where they obviously know it is a high-profile investigation going on. i doubt that he would be that smart. someone in private industry would be treated very aggressively. >> pointing out and reminding me that they don't have prosecutorial power and at this point do you think that there's any chance that they can succeed in getting a special prosecution? because this is beyond what it calls for.
4:38 am
>> congress is doing the best they can, they should have a select committee and i think that they should expand the jurisdiction of the select committee that they are to have. but if i were the president, i would appoint a special prosecutor with and they had to be someone that reported to hold her and the president. >> there is a congressional citation of congressional content. >> let's turn to benghazi very
4:39 am
quickly. on his way to our shores in a civilian court. why is that enact. >> because this administration is philosophically of the mind that we should be back to the paradigm for counterterrorism. and they will not treat people as enemy combatants. but criminal defendants. lou: do you think guantánamo as part of its continued strategy? >> there is no question, they are pushing people out, not bringing them in, but he should be interrogated as an enemy combatant detainee. because he could provide information for months and not yours. >> makeuse he could provide information for months and not yours. >> make you very much, the because he could provide information for months and not yours. >> make you very much, the book is faithless execution. a reminder to vote not all tonight, we want you to know which part of the three eyed monster that you find most

troubling. >> the iraq strategy is where the ire of stonewalling? go to loudobbs.com and tweet your response at lou dobbs news. stay with us, we are coming right back. >> the dow jones at all-time highs, closing in and the forbes media chairman on where are the jobs and where is economic growth. where's the return to

thank you for having me. >> let's turn to this. forecasters and druze alike, with great regularity and constancy. what is going on here? we have so many problems in the economy and the market seems to be anticipating a much better time. >> part of is a market strategy looking to the future, anticipating a great result in november and this includes the damage the industry second in 2015 and 2016 and american companies are still doing okay even though they got off to a rocky start. lou: janet yellen suggesting that we could see this low level for a long time to come and well
4:45 am
into certainly next year. perhaps even longer. so food costs, jumping significantly. i mean, we looked at the largest increase since 2011, meet, poultry, fish, eggs, all of it up about 1.5%. it's an interesting prospect only see prices rising like this. >> even washington notices when starbucks starts to charge a little bit more. sometimes it can spiral out of control. and they should be able t they o navigate this, but they could easily capsized the ship. >> i think it will do better as the year goes along and we will get the average to 250. lou: a quick political question.
4:46 am
these scandals now are consuming the white house. what is your reaction? >> it's an outrage. you put them together. there's nothing like it in american history. the irs scandal long as the worst in american history. worse than watergate, worse than scandals of the early 20s. the fact that there's been no outrage in the part of the media and congress, it is just, it is astonishing. people are looking back and saying when they rise up? lou: steve forbes, it's always so good to see you. coming up next, polls suggesting america has given up on president obama. but has mr. obama already given up on his presidency? the "a-team" is coming up next
4:51 am
>> he had no respect and it was absolutely chilling. in america, where we have the right to assemble to petition our government, where our government is completely trying to kill this. and this is the irs, the irs that will hunt you down for the most my new penny of your back taxes. and they tell us that they don't have as? >> in this case, the man that was brought in six months ago, and who had a reputation as a
4:52 am
successful businessman and had public service, he did not look like a man of his steam and integrity there before that committee. >> it sounded to me like the modified limited hangout of the nixon administration. and you and i, you and i we have to keep seven years of records to be prepared on a moments notice to reconstruct them. and that could happen if our server goes down, that is to our detriment. >> first of all it is unclear as to why the committee is not expressing knowledge of what we know. and that is that in every e-mails to some there is a backup. in the case of the internal revenue service an extraordinary
4:53 am
number of backups. so it's going to be revealing, i believe. it's going to go further into this inquiry. let me turn to the administration that reversed itself and did so in one speech by the president this week when he said he was not going to put boots on the ground. and then he said he would not send 300 new advisors over there for combat and then said yes, they would be there for targeted combat should be desire. so this is such a peculiar time for this president. >> it's really shocking. but frankly you cannot talk about what happened in iraq without what is happening in syria. these are hottest are calling themselves the islamic state. so the president has failed to negotiate an agreement and they would have a reasonable ability to maintain it.
4:54 am
if this perfect cauldron of terrorism and it poses a threat to us here in the united states. >> andrew mccarthy has a different take and he believes that no one would question his conservative credentials. and i think that history is important here. that there is a legacy. and the president has made the world mistakes since then. >> it succeeded. we have stabilize the country. but the fact that we were unwilling, whatever the nature of the status of forces was, not to leave a residual force there, it is a dereliction. lou: i have to say that i have no appetite for another one of our troops to go to iraq.
4:55 am
i tire of the generals who didn't get the job done, who sound like they want to do some kind of makeover or a do over or amy good of things. what we couldn't do in eight years, i don't know that we could do in a matter of months with a limited scope. >> i think it's time for us as americans to say, if we have an enemy, destroy that john enemy. what are we playing our? and what is our military putting out two what our civilian leaders playing up? we have to rise above this. >> you have been very clear that if we do send in forces, if we have air strikes coming needs to be very strategic. to have a clear containment of goals here. lou: if we are there, it should be in our national interest and we should be killing our enemies
4:56 am
>> i think it is a smaller word than not. and i think that word is obama. this country stands for great things in great deeds. but what this president stands for, that is quite a different thing. we thank you for being on the show. we appreciate it. time now for a few of your comments. joe said on the confusing iraq strategy, he must focus on our own borders, this white house is too incompetent for water. and steve said, i understand if you voted for president obama the first go-round, but you are the whack a mole if you voted for him the second time. and bill in washington state e-mails us on the irs hearings, saying i have never seen a more condescending collection of statements by any federal official in my life. and yes, i watched the nixon administration. tonight's commentary guest, we
