kill them, our future will indeed be the good new days. that's our show. see you next week. lou: good evening. president obama today in a speech blamed republicans for the commander terry in crisis at the southern border. president obama insisted republicans pass the senate amnesty bill or fee, she said, would act alone on immigration. the president neglected to acknowledge it has been his rhetoric on illegal immigration in his refusal to secure the border with mexico that has led to what he now calls a humanitarian crisis. mr. obama's declaration of support of so-called dreamers has caused confusion, great confusion for many central american people.

tens of thousands of people on an 1800-mile journey to our border. which they cross now with impunity. here is the president in the rose garden today effectively declaring immigration reform to be dead and requiring them to abandon their constitution and simply pass a bill the president's sole design. he means to go at it alone. president obama: there are others in the house who say they cannot act because they're mad at me about using my executive authority to broadly. i take executive action only when we have a serious problem, a serious issue, congress chooses to do nothing. the failure of house republicans to pass a darn bill is bad for our economy, bad for our security, bad for our future.

so, while i will continue to push house republicans to drop the excuses and act, i hope constituents will too, today i am beginning a new effort to fix as much of our immigration system as i can on my own. without congress. lou: also tonight the supreme court issued another ruling, a blow to the president once again the nations top court fighting with hobby lobby in a ruling that a business does not have to provide contraceptive for the female employees if it violates their religious beliefs. the president's spokesman called on congress to again d to what e president insist they do. and this time pass another law on the contraceptive mandate that the supreme court might one day accept. >> because of this, congress should act to address the concerns of the women affected by this decision.

senior judicial analyst judge andrew napolitano. >> good to be here, lou. lou: this decision is a clear win for hobby lobby. a failure for the administration again. but what is the effect on women across the country? >> the effect is profound, lou. this decision basically says that the owners of an entity, i will describe that in a minute, believe providing contraceptive and abortion services for their employees against their views, they don't have to do it. here is the entity. nonprofits, those entities provided in the united states from 90% of all america. so where is the money going to come from to pay for these services. that number would be so large it will require a congressional appropriation, which is not going to come from the republican-controlled house so

the president has made a mess of things by promising women he would compel their employers to provide all this and the supreme court said he can't do it. lou: this definition of the so called a this is enterprise or corporation. the amount of money individually involved here is so small, we're talking about $10 per month here, most businesses are not going to be too concerned about that unless they have true, honest, bona fide religious objections. >> it is interesting you said that. the first obstacle he addressed in the 5-4 majority was a corporation of person. does a corporation have rights? they have already it is a person and in the citizens united case

i don't belong to an organized political party, i'm a democrat. the democrats are better than republicans at this sort of unity. lou: it is to be seen. we face a general election here, the president has been rebuked again by the supreme court, he has lost 12 unanimous decisions. it is worse and worse for this president. >> two of those decisions were this week. on wednesday we had the case involving police search of cell phones. there was a companion case that was a federal case in which they can coincide with the california decision. they said you need a warrant to search a cell phone. lou: facing unanimous decisions, more unanimous decisions over the course of the past year and a half then we have seen previously including two obama appointees.

they were supposed to be committed but never rise above their partisanship to render it. >> this shows us how expensive it is, the president can go out as he wishes, so much so even his appointees said we can't go along with that. the court is so divided, so controversial. i hope they are happy. even left-wing liberal justices saying no to obama. >> the interesting thing is the conservative justices were going much further to strike down recess appointments as they have been done since the 19th century. i think they had a good argument based on the language of the constitution but what the other democratic appointees said was we have respect for the historical record, but obama and obama alone tried to make

settlement last august, but the presiding judge was concerned that wasn't enough. joining us now, one of the men leading the charge to educate this country and the nfl about the dangers of concussions, pro football hall of fame linebacker, new york giants legend, great to have you here harry. >> it was before it was really hot button topic in the media's i appreciate the opportunity to be here. lou: thank you for those kind words. everybody has to be grateful to you and others, talking about this issue. reaction of the nfl was, and i think most americans, more we have learned year after year. >> think about what we don't know about those who have

already played the game have already passed on, i would venture to think it has been around since the beginning of football and had, and so forth, players have played through and have gone on to deal with neurological abnormality later in life, but there was never really a tie in between later in life and what they did in their past. i can firmly see so many cases of men of being senile, dementia, alzheimer's, lou gehrig's disease. but it was never documented because there was no tie into the past of what they did. lou: when we think about the nfl, the guys are big, but this affects kids in high school who

are playing "lights out." and sometimes it is lights out. >> kids have a tendency to imitate what they see on television, players they admire on monday night. whether it is in pop warner, high school, college, it is amazing how i have done your shows in the past and have gotten so many around the country, talk about their relatives, the husband and sons who have had neurological problems and they never played in the nfl. while the spotlight is on the nfl, it is about the game itself, but it is not just football. it is other sports like ice hockey, girls soccer, cheerleading. i don't want to be a debbie downer, you have to protect the

brain. you cannot replace the brain. once it is injured you don't know how it will affect that person down the road. lou: what would you say to a mother or father writes now with a kid coming up through pop warner. would you say to wait a while, let him mature a little more, what would you say? >> i think with all the information that is out there from the last few years whether it was the congressional testimony of the commissioner, whether it is doctors who have done studies and so forth, and whether it is tying in the suicides of players who have played and reality of head trauma. parents have to wake up and understand what they are signing their kids up for. there was a su summit of the white house on concussions about spreading the awareness of concussions. you have to really understand

physically you can get hurt playing the game, but neurologically consisting injuries that you might not ever get over. parents really need to be aware of what they are signing their kids up for. lou: we have about 30 seconds here. the nfl raising the cap. are you surprised they were so agreeable to do that? >> i was surprised, but i also know roger goodell. i know his job is to grow a league and you have to get this in the past and satisfy the complaints of players who have suffered as a result of concussions and so forth. if you are a player, you really don't want the money because as a player, if you need this money it is because you legitimately have dementia, alzheimer's and so forth, so what price do you put on being normal.

klein out with his explosive bestseller entitled "blood feud." it is already number three in books on amazon. great to have you with us. this book, "hard choices." >> i think they should retitle it "heaven's gate." it is like the movie back in the 70s which everybody thought would be a huge hit, she was everywhere on television and radio. lou: is it because of the gaps in her campaign, your book forpr deficiencies? along with those for the obama's? >> it is a combination of two things, the book is a big yawn, there is nothing it.

signifying nothing. the second thing is even more important, when she goes on television, she invents herself, it is not fun. lou: is there something about that is different this time? talking about 2008. she doesn't seem to have the same confidence, to me at least. and you go into her health issues, but i don't know what is going on. >> that is an interesting point because she isn't as sharp as she used to be. she is certainly less sharp now. they could be because she is not as healthy as she should be an issue is not as up on things.

we say the things she said about being poor and not being really wealthy, we made a note of this, they spent $50 million on travel since the clinton global initiative was formed. since the global initiative was formed. lou: that is an extraordinary amount of money. the clinton global initiative as you have documented, the way it is managed. this is going back to may, a certain elitism about hillary which may have always been there, i don't know, but certainly one in the media picking up. >> there is a victimization about her when she is put in a

corner and asked a slightly difficult question, she immediately place the victim card because she is a woman, because she wears pantsuits, because she doesn't do her hair, but it has nothing to do with that. that is not why people are asking her these questions. lou: the president, usually protecting, supporting her, whatever position she finds herself in, that doesn't seem to be happening. lou: he doesn't look to be ready to rock 'n roll like he used to be. from my reporting, among the clintons they are reeling about this book rollout because it has been a disaster for them.

lou: is it in your judgment and analog for the campaign to be that others might judge she is not the candidate for 2016? >> i have been picking up vibrations that some of the democrats out there saying maybe we have a better chance at knocking her off during the primary campaign than we thought. lou: i thought we were watching the clintons from the public glare while all this was going on but then out comes bill trying to support his wife talking about watches. >> i was surprised at that interview because the clintons are generally very good at that kind of a thing and he was unconvincing of supporting his

wife. from my reporting, from inside the inner circle of the clinto clintons, i think they're in a state of shock and they don't know how to recover. lou: are the president and first lady gloating at this moment? >> i am sure michelle is, whether barack obama is paying attention given the fact he doesn't pay attention too much else, i don't know. lou: i want to go back to mr. clinton, president clinton, he has run up quite a tab for himself wherever he is speaking, but he is making a lot of money. he hasn't eased up a bit on the money machine. >> he went to nigeria and made

$700,000 not only just for giving a speech, just for showing up. they are worth the vicinity of a couple million dollars now. they recently spent $900,000 putting a dance floor into their mention in washington, d.c. lou: a washington mansion. it needs a dance floor, my goodness. how strange is that relationship to give some balance? >> when they go on vacation i'm told by the housekeepers they have separate rooms and they don't really do things together. he is encouraging michelle to take separate trips often because in her presence he is often lectured by michelle, often told he is not doing the right thing. i think it is getting worse.
