and his peach coat and m.k. hammer, i'm matt welch, thank you for joining us, and have a very pleasant evening. and geopt gone away. lou dobbs will tell you when you lou: at good evening, everyone, the federal aviation them in the nation has just prohibited all u.s. airlines from flying to and from israel's airport. the decision comes after hamas rockets came within 1 mile of israel's international airport. the directive stretching up to 24 hours as the fighting on the ground intensifies. hamas has launched more than 200 up to and israel over the past two weeks and many air carriers have taken it upon themselves to suspend israel bound flights indefinitely. those include delta air lines
10:01 pm
and u.s. airways and many european carriers are following suit after last week's malaysia airlines disaster over the eastern ukraine. air france and klm also suspending flights to israel indefinitely. this includes air canada and all canceled flights for at least the next 24 hours. the israeli hotel association forecasting up to a half-million dollars in lost tourism revenue because of the conflict of a 35% decline of last year. and the white house once again giving the public and correct information. here is the past and turn press secretary one hour before the faa announced the prohibition on flights to tel aviv. >> it's my understanding that they have not issued any notices related to the ongoing violence in that region of the world and
10:02 pm
we have individual carriers that make a decision about their flight plans and whether or not to alter specific routes based on the. lou: meanwhile, a humanitarian individual saying that hamas is hiding weapons stockpiles in schools and weapons and other civilian centers and the israeli government saying that they have taken the idea of soldiers hostage. we'll be talking with john bolton here in just moments. also tonight to federal appeals court rulings putting the future of obamacare very much in doubt. the dc court of appeals ruling the people that buy their insurance to the federal health care exchange are not eligible for subsidies. but the court of appeals in texas ruling the officer. the heart of obamacare tonight
10:03 pm
likely on the fast track to the supreme court. we will be taking all this up with lis wiehl and are dried on. also the relationship between president obama and president clinton is anything but friendly. daniel harper joins us here tonight. and an egyptian cease-fire as the death toll tops 629 israelis killed in the writing. for more on the crisis, i'm joined by john logan, thank you for joining us. the fight and gaza against them,
10:04 pm
the rocket fire seems to be a relentless and not diminishing. what do you make of it? >> the israelis have an enormous difference in turn difficult task. hamas has a huge set of rockets buried in deep and well protected tunnels, using shields around the operation. this would never be anything more than a two or three day operation speed on that is very clear from the outset. >> but is at the case when they have already agreed to a cease-fire and the objectives are not met? this is not just hamas as a terrorist organization but them as a surrogate for the longer range and more active missiles coming directly or indirectly from iran and their way of pressuring israel and there's a
10:05 pm
lot more at stake here than just hamas a terrorist group. lou: that seems to be a sufficient immediate order of the day with an estimated 10,000 rockets, 2000 have been extended in the first two weeks. this conflict, hamas has rejected these are proposals that were accepted by the israelis and secretary john kerry and the president making it clear that israel has the right to defend itself. so what do you make of the administration's position in what is your reaction? >> the most benign thing you can say that it contradictory. but the reality is that they don't mean that israel has the right to defend self. when you look at a nation that has been attacked like this and insist that their military response can last five days or six days, you're basically saying that you have to be to go
10:06 pm
to the threat from hamas forever. so i think that israel is clearly within its rights to conduct this operation. the hamas approach is barbaric by using civilians as a shield. but otherwise israel loses and hamas is able to get away with it. lou: the use of the word rights on the part of israel to defend itself, it seems it goes without saying that israel has been attacked and attacked each day by 100 or more on average rocket attacks being shot at random, it seems like, into civilian areas. israel would be suicidal if israeli leaders to simply say that we are going to concern ourselves. and i don't hear anyone mildly thing that in this administration. even though there has been many voices that support europe, i
10:07 pm
don't hear european leaders saying that the past is not. hamas must stop attacks. >> the right of self-defense includes destroying that your country. if we think back to pearl harbor, who would've argued that it was disproportionate for the united states to limit the threat and that is really what israel should do. they are under such pressure and i don't think it's going to happen. as of 2006 when they said they eliminate hezbollah, the real objective ought he to eliminate hamas and the threat once and for all. the united states under obama, the europeans are not letting them do that. lou: do we take prime netanyahu at his word is upon the counteroffensive against this? >> i think that's what we'd like to do, but i don't think that the order happened accidentally. i would like to know who talked
10:08 pm
to the faa because the clear consequence will be to impose economic harm on israel. bolstering in their minds the obamacare argument and cease-fire. and i think it actually proves the exact opposite but you can't live in a situation where the economy is being held hostage not only by a bunch of terrorists, but those in tehran as well. lou: ambassador john bolton, thank you for being here. and u for obamacare and the nations dc court of appeals. dealing a potentially fatal blow to the health care law subsidies that are critical for making coverage affordable. two hours after that decision another federal appellate court sided with the obama administration on the name issues saying that the subsidies were lawful. reporter correspondent shannon bream is in washington and has the latest on what could lead to
10:09 pm
a showdown before the u.s. supreme court. >> one issue but to federal courts look very different with very different opinions. the dc circuit's it's just one step below the u.s. supreme court topped out the interpretation of the affordable care act, which uses subsidies for states that have not established their own exchanges. in a two to one decision into how big this case works, the court agreed saying that one interpreting the statute, we want to ascertain the meaning duly enacted through the formal legislative dossett. >> just last week i told congress that the torpedo just hit. reporter: a short time later, the fourth circuit issued its own ruling on the issue where it found a lot to be ambiguous, as
10:10 pm
part of the interpretation. we are satisfied that the irs rule is a permissible construction of the statutory language. >> the fourth circuit made clear today that when you look at the statute as a whole than the administration's provision must prevent all. >> they must petition for a hearing and in dc that would include three new obama appointees rushed onto the court after senate majority leader harry reid change the rules, forgetting the president nominees confirmed. >> he hasn't had a chance to pass through lelia. some competent but they will have the last word iraq over the last several months supreme court has handed down numerous defeats in cases where it's decided that the president or federal agency has used its power to go around the law. exactly what the irs is accused of doing in this case.
