phone conversation with russian intelligence that proved otherwise. and also tonight, reports that the fbi is investigating the breach of the u.s. banking system according to those reports, russian hackers attacked and successfully infiltrated jpmorgan chase and at least one other unidentified major bank over the past two weeks. the russian hackers were able to obtain gigabytes of sensitive data, that according to jpmorgan chase officials but declined to be identified. the fbi identifying breaches possible retaliation for western economic sanctions levied against russia. the fbi declined to comment with the investigation ongoing. we will be cooking all this up and we have reports that president obama is considering whether to broaden u.s. assault against the radical islamist

we seem to have lost sight of this as a superpower that needs to exert our influence on behalf of our interests for the good of the world. >> i totally agree with you. we have moral principles that guide us in our actions around the world and this is the united states of america and we have very strong values and we believe in them. we should not be looking the other way. we know for a fact that they provide assistance to hamas and they have been doing that for years. those rockets that rained on israel by the thousands are directly linked to the funding that came out of that country. we should not look the other way. we should remove those that this behavior doesn't change and we do a lot of business and a lot of american businessmen, we have to take the gloves off once and for all.

lou: coming up, stonewalling at the internal revenue service at the white house. we will be talking with the attorney that is representing some of the conservatives that the arab press targeted. and president obama talking about climate change initiatives. richard fowler joins us tonight. and now a few comments on our young republican senator who isn't afraid to change his mind when new realities emerge. the senator is marco rubio. the same fellow who upon stepping into his senate office for the first time, was immediately and instantly hailed as an indisputable luminary in the presidential hopefuls and possibles.

before a place can be reserved for him, he fell victim to naïveté and hubris. he was slated to join up with a combination of other senators. republican and democrats seeking the path to so-called immigration reform. or as it is more accurately understood, amnesty. slightly slippery to the left, chuck schumer held the centers senators under his spell. but the house of representatives broke the spell and saved the country and even a few of the senators including marco rubio who is much the wiser for the experience. the former gang of eight individual has shared some wisdom in a letter to president obama saying that after the experience of the last 18 months, i have become convinced that there is no realistic path

forward on a comprehensive immigration reform for the foreseeable future. senator marco rubio is not only free of this evil and grace, but he now recognizes the house house of representatives superior immigration reform to securing our borders and reforming our immigration laws and enforcement. the incremental approach to immigration reform that i have supported here for the past two years. he also warned president obama against taking executive action on amnesty. the senator said that it would close the door to any chance of making progress on immigration with warm in the foreseeable future. according to "the washington post" more than doubling the annual ceiling of 366,000 green cards. even though we already bring in a million people each year as

permanent residents. president obama also considering, we are told, an additional 200,000 visas for high-technology workers. even though the shortage of workers is actually a myth. and that the number of science and technology and engineering and math that immigrants submitted each yearhere in this country is 20,000 students higher than the 105,000 created each year. "the new york times" today reported that republicans have a 67% chance of winning the senate this fall, compared to winning just two days ago. i believe another obama run around this congress and our constitution will take that number to very near 100%. now the quotation of the evening. this from the nobel peace prize

one-and-a-half percent down from a february estimate of 31. turning to the irs starting scandal, my next guest represents more than 40 organizations in a federal lawsuit against the irs and says the obama administration is doing everything that it can to stall its own the investigation. joining us now, chief counsel for the american center for law and justice. a pleasure. let me start with this back-and-forth nonsense about missing e-mails which we have said by the way on this broadcast from the outset according to our experts they were retrievable, were not lost, and it is pure bunk that has been spewed. and to find out that lawless of martyrs by jerry was destroyed, was wiped clean. somebody needs to go to jail here. >> a classic case of

obstruction of justice. by the way, our blackberry was cleared out after litigation had been filed in a companion case alleging targeting. and after the congressional investigations already started. the irs, brunt of justice, everybody was on notice but amazingly her computer crashes. they then say her documents are not retrieval. then, of course, you have the ambition, pursuant to a freedom of information act request there were discussions that there is a mass backup unit which we all know exist. too burdensome to get to. and then miraculously 41 and the fbi and department of justice and the president to per e-mails are wiped off of her blackberry. nothing there. no one can believe this. it is lying, lying under oath to congress. and when you look at this, what took place between the

lawyer litigating the case of, a companion case were a group that had been targeted, the lawyer that was representing the irs had actually been involved in the targeting when he worked for treasury and then went over to the white house counsel's office where he worked for the president. then department of justice. now he is also mysteriously no longer involved. this is a cover-up, and obstruction of justice of proportions we have not seen in my lifetime. lou: what is it going to take to get to the heart of this case? now the evidence is conclusive. i mean, to me. i am not talking in legal terms the head of the irs was supposed to be clean and then at -- and is as dirty as you can be. >> she went to congress. you are right we did everything we could to retrieve it. we were not able to perry that was not true. what is going to take is a call for special counsel.

there have been congressional hearings. i testified. a classic case. the department of justice is incapable of investigating itself. in fact, they are involved in this other scandal as part of this mess where they were part of an irs attempt to make criminal cases out of what they called -- lets pc it a false claim cases, fall supplication cases. no evidence of any fall supplications. what they were going to do, they were participating. the idea that the department of justice can somehow review itself is absurd. in federal court, and this is a good development. a companion case 12 very similar -- in u.s. district court judge has allowed the case to move forward. and in other cases the irs is being put on notice that no one including federal court judges are buying this destruction of evidence accident that the irs seems to still. lou: as you say, that is

good news and it is progress and it is positive, yet we have been now with the next development, pushed off to the month of october. still -- i mean, the american people have been staring them straight in the face. this government is corrupt. the internal revenue service is being used as a political tool, hammer. >> absolutely. lou: against innocent people is only problem was that they were on a different side of the political spectrum than the people running the internal revenue service. >> they exercise their first amendment rights of free speech. that was a government problem. you know, this points to a deeper problem. how are they getting away with this? a fact of the matter is, if they're is a change in the senate and the second start holding hearings as well and you have a house and the senate making demands that contains the entire scope. i don't think that the

attorney general can just ignore the reality of what would be bearing in on his department of justice. right now he is not acting like an attorney or a general. lou: we have been talking about this for years. about a year-and-a-half. the reality is nothing has changed. the facts of the same. we are just discovering more of them. the administration continues to cover them up, as you said. at what point does this dam break and the truth flow into the public? >> when we get our first discovery order. that may be months ahead get him but when the discovery starts and lois -- lois lerner is put under oath and asserts the fifth amendment. in a criminal case you can do it. in a civil case it means will we have alleged is true then you see a domino effect . frankly, i would be looking at giving her some form of immunity to get to the bottom of this.

i don't believe for a moment -- my first job of law schools a long time ago in the office of chief counsel of the irs. and i am proud of the agency has changed a lot over time. i tell you, the reality is this does not start and stop with lois lerner. this connection between this lawyer that was at the white house, the department of justice and that irs. all these people need to be put under oath. we know we've got. lou: thank you very much. we will be following you as we have throughout carefully. thanks. general motors showing economic patriotism shifting production of its cadillac crossover from mexico to a plan in tennessee. it is unclear what percentage of gm cars are being assembled by manufactured in mexico because they stopped providing information last summer. i am sure we will find out because i am sure general motors wants to be transparent about these things.

to do this? >> you know, i don't know. i think there's a pretty good chance. when he passed the original -- past as the wrong word. when he declared the original executive amnesty in june of 2012 it was our before his presidential reelection. we have another election coming up. he seems to be motivated by politics rather than law and the fear that he will probably try to do something similar. lou: you think you would get away with it? >> yap. you know, the first one, the dreamer direct june took -- june 2012. he has been getting away with it. i represent ten ice agents who have sued him. the directive violates federal law. he is ordering ice agents to break the law. we are tied up in procedural issues and the court of appeals right now. the wheels of justice grind slowly.

what in hell are we going to do here? >> we don't have a lot of options. one is taken to court. another is impeachment which it doesn't look like will happen. lou: everyone wants joe biden to be president. that's a brilliant idea. >> the third option is for congress to exercise the power of the purse where there would actually say mr. president we're taking away all the money from your department. lou: marker rubio now talking straight to the president saying don't do it talking about the fact that the house incremental approach is a wry wit ago which i have supported for two years. your thoughts about the conversion? >> it's great that he's no longer supporting the senate amnesty bill but he has been converting back and forth for a while.

were last year we would have, you know, bombed a sought. clearly. lou: he would look -- i mean, it's going to look pretty peculiar either way. he is allied with the man he said three years ago has to go. there will be fighting the islamic state. i'm sorry. go ahead. >> this president has no idea what he's doing. he as the joint chiefs of staff chairman who says there is no direct threat to the united states. we have people getting their heads cut off. think that is a direct threat to the united states. so what does that mean? and their planning to attack, which she should be doing. i have to get in bed with syria. i mean, this was the guy you said was a bad actor. this is what brought about us to keep his nose out of foreign policy.
