stuart: look at this, down we go, a 165, close on 1%. there are 30 stocks in the dow, two of them are up, home depot and cisco, up barely, a fraction, that is it. airline stocks are lower all across the board, ebola concerns, that is what is hitting this group, crisis of confidence, secret service, isis, ebola, hong kong, you name it, there's a crisis in believe the government can perform or do anything right. guess who's here? judge andrew napolitano who never thinks government should do anything and can't believe they can do anything right any way. judge napolitano: a bit of an exaggeration but an interesting summary. i have had much exposure to and interaction with the secret

service in my work in and out of the government. i am really surprised at the revelations of incompetence because secret service agents with whom i have had interactions strike me as consummate professionals, selfless individuals who quite figuratively and literally would take a bullet for the president or anyone in their charge, they protect a vast array of people in addition to the president but what has come out lately is unacceptable and unforgivable. i would suggest not that the military protect the president, the white house look like the kremlin if it was surrounded by the military but entirely new leadership from outside the agency. i would not promote somebody from within. i would bring in a new culture from outside. these things just, it is mind-boggling how they could have happened. remembers the crazy -- nelson mandela's funeral? the crazy sign language guide? he was crazy and entering

gibberish, it wasn't legitimate signing, he was within two feet of the president. we don't know what danger he posed but it is an example of the blacks attitude. we learned two serious things, a, that the president was very close to an individual who could have harmed him and beat, the secret service doesn't always tell the truth. that is really damaging. exaggerated the amount of danger he and his family were in when this guy ran halfway through the white house, misrepresented exactly where the guy was and he was tackled by an off-duty secret service agent conducting a tour of the white house for his friends who ordinarily wouldn't have been there. stuart: how about this? lot of unanswered questions on ebola. we do not know the name of the patients now being treated in dallas, we don't know the airline that person came in on and we don't know the flight number. do we have a right to know these things?

judge napolitano: we absolutely do. i don't know if we know his name but we need to know where it's a came from, how they got here and to the extent we can, what kind of a danger they pose. if this causes loss in shareholder confidence in this particular airline or causes people not to fly the airline guess what? we have the right to make those choices ourselves, whether we act out of fear or reason and the government does not have the right to keep that from us. stuart: the government is telling us there is no danger, that he was not suffering from the symptoms when he was on the flight. stuart: tell us where the flight was. judge napolitano: we will trust the same government that can't protect the president? now we know they can't protect the president? can't stop ebola. stuart: that is a crisis of governance, if they don't do much of it very well you have a crisis. judge napolitano: you sound like ron paul. stuart: i want to know where you stand on this.

a new california law, family members and law enforcement officers can now ask the judge to seize guns from someone they suspect may pose a danger to themselves or others. judge napolitano: only a crackpot like governor brown would sign something like that. the motivation behind this is the same as the president's, do everything you can under the constitution to make it difficult for people to own guns. don't violate what the supreme court says the second amendment means but do everything right up to the line. stuart: look at this in practice this week could surely have stopped some of the mass killings which america has seen over the past few years if the law enforcement authorities have the power to take the guns away from people who were clearly posing a danger to society. judge napolitano: i look at it this way. we could stop the mass killings in the united states if the victims had been armed, they would have blown away the mass killer before he could become --

when is this going to change? you have the highest rate of poverty in california, 24% of the population lives below the poverty line, an extraordinary thing to happen and they continue to win. the left continues to win. >> 30% of the nation's welfare recipients are in california. there will be a referendum on the plastic bag ben. it will be on the ballot again in 2016 but the reality is these incremental steps towards regulation again and again in the economy are not being seen the ways they should be seen. there is a disconnected among voters with these environmental rules and the brown administration's regulation, that will become apparent over time. eventually these voters have to see the rampant poverty the high taxes and overregulation are causing terrible problems to our economy. we have a drought in california.

stuart: hold on a second. as a californian i can't give up. we had some very bad decisions. we had governor schwarzenegger had a wonderful opportunity to change the state when he came in and he didn't and the reason he didn't, the deal made with the california teachers' unions. unions have tremendous political power in this state. over the course of the last 20 years, half a billion dollars on politics, they control the state, they control the state legislature. people need to understand by getting this information out so they can make changes but the reality is the drought conditions are only going to get worse, regulations will only cost for people more. this state is going deeper and deeper into poverty and people have to wake up eventually.
