dierdre: opting -- melissa: released from the quarantine after showing no signs of the ebola virus. this nurse worked with ebola patients in sierra leone before flying into new york and was an outspoken critic of the quarantine calling it quote, inhumane calling it legal action. christie's reversal odest in comparison to new york governor andrew cuomo's. he started a weekend touting mandatory quarantine as a common sense solution. >> voluntary uarantine, no. almost an ooymoron to me. this is a very serious situation. melissa: oh, but by sunday, reportedly after pressure from the obama administration, cuomo was singing a, kind of a different tune. listen. >> from a safety point of view the preferred option is to ask them toostay at home. the hilt care worker will come to the house twice a day. they can have their family, whoever is normally there. not that they're stopping their life. they have their full life.

nicole? >> so much going on with oil. it has been something we followed so closely. down about 25% in the last five months. as you noted below the $80 mark here and sitting at 28-month lows today at one point. right now at 80.86. we're watching energy names that go along with it. on this day goldman sachs and deutsche bank cuuout looks for 2015. breaking down the goldman sachs call in particular where they see west texas at $75, rather than $90. that was their previous assessment. taking down price targets on some of the names as well. while they still have buy ratings on eog and range resources, they put some sell ratings out there particularly on laredo and parsley and downgrading names like anadarko and continental but the big picture here everything that we've seen moving, oil including, global demand story that has been weakening. also the fact that we're producing it right here at home, strong dollar, alllof this is really factored in.

boy is being monitored for ebola. the boy was admitted to bellevue after returning from guinea over the weekend. he wasn't experiencing any symptoms before being admitted, but he has since developed a fever. we are going to keep an eye on all of these situations for you. an embarrassing u-turn for governor christie and governor cuomo after pressure to relax a 21-day quarantine. do you feel confident in how the government is handling ebola? >> pretty confident. yeah, i'm not really worried about ebola. figure wash my hands -- i do think we should be quarantining, but i think we should stop people from entering the country in the first place. >> i don't envy that position, and i think they're doing the best they can. >> i like they're being safe and cautious, but i'm not into this whole mass panic thht the general public is falling into. >> we're basing it on their reliability and who they're in

contact with, so it's hard to say, you know? i don't know. >> i'm very comfortable with the government handling ebola the right way because it's all science at the end of the day. >> we nearly went to the meatball place and the bowling ring, so ebola's two steps ahead of me which is fine, as long as it stays those two steps ahead [laughter] melissa: the nurse threattned legal action for being held in quarantine in what she calls inhumane conditions. as we watch for more cases of ebola, could we be facing more cases in court? of course we will! it's the american way. seth, i'm going to start with you because it is the american way. as soon as something happens, everyone lawyers up. i am not surprised this nurse is sue ising. also thomas duncan's family is saying they're going to sue for hall plaques and wrongful depth. -- malpractice. >> this nurse who has left new

jersey today is really, essentially, a hero and was out there saving lives, with all due respect, i don't think the cases move forward. on the federal and state level, there is plenty of authority for a quarantine for these kinds of diseases. on the federal level, you have a statute in an executive order specifically for ebola, and the states have the authority to do that as well. that's been established since at least the '50s and '60s. the problem is you have an imbalance because the federal government's supposed to be issuing the rules and regulations, that's their legal mandate. washington still has not issued broad and responsive regulations to this, so governors such as governor christie have been coming in walking a tight rope. it's created confusion and anger, and therefore, we have these legal threats. ffankly, i think this nurse should be more upset at washington than new jersey. melissa: what do you think? do you think 14erbd have been let out -- she should have been let out of quarantine? there was a reason to have her there, no?

>> yes. i think you make a very good point about the conditions which may, actually, have been the basis for her anger more than anything else. the trouble is that the nurse came into, a i arrived at the airport and was noted to have a on the ebola barometer, a temperature plus exposure or history of dealing with sick ebola patients means quarantine until proven otherwise. i think that without that kind of approach, you're going to have patients walking around who have been exposed to ebola and could be a risk to the public at large. melissa: we have a doctor who exposed at least three other people, but there were folks that were exposed to him that wouldn't have been had he been quarantined. seth, legally -- now it's a battle between the federal government and states. where do you think they go from here? >> well, in the short term, the states have to step in because the feds have been completely

inactive. given the lack of leadership in washington, governors cuomo and christie have got to step in and apply reasonable and limited quarantines, and the law is clear if they do that and, of course, in a compassionate way, they will be supported legally. the courtt will probably reject the due process rguments of these cases that are coming down the pike. but in the long run, the federal government has got to wake up and get these regulations out in a broad and uniform way. melissa: yeah. >> that's going to be the biggest remedy right now, and it's going to stem the crisis and instill more confidence. melissa: doctor, medical professsonals are heroes for deaaing with this disease, but we've seen them prove that hey are not able to be self-quarantined, that they do go out into the community. isn't it too great of a health risk? >> well, i think that's more to do with fact that so little is known about ebola at large, and there aren't definitive guidelines for the approach. i mean, doctors without borders itself does not ask for a quarantine from its members.
