10:00 pm
bein legal. kennedy: sad story, beautiful girl, a great topic. >> tomorrow, fox business will have live election coverage, i will be on with neil cavuto. do. lou: good evening, just under 12 hours the first opening of polls in this year's midterm elections, and white house statements have taken on today a less arrogant tone, less emphatic content, rhetoric that is almost, only almost manureed and mature. we gib begin with vice president joe biden who claims that white house stands ready to find common ground with congressional republicans, also saying quote, look, we're ready to compromise. white house press secretary josh
10:01 pm
showing some signs of reform himself, going one step further than the vice president today, president pokes man told -- spokesman told white house press 84 that mr. obama is suddenly willing to change his tactics. >> we're also going to be willing to -- signaling an openness to working with anyone whether a democrat or republican to advance your agenda means an openness to changes your tactics. lou: what has prompted white house change? white house more than likely looking at devastating new polls and forecasts that senate democrats will lose enough tomorrow to have to give up control of the sense sat to their republican -- senate it their republican opponents, washington posts giving republicans a 96% chance of retaking the senate in tomorrow's elections. raising its possibilities and

probabilitys to 74%. and even "new york times," revising their forecast, of a republican control senate, those odds now rising to 70s% in view of the esteemed times, republicans in key races across the nation, either widening or maintaining leads in polls with election day nearly upon us, brand new meris poll, finds georgia republican senate candidate david perdue with a 4. lead over democrats michelle nonenuninn in antwan luce -- lon off with republican bill cassidy on december 6. in kentucky, senate mcconnell holds a 9 point lead overall son lunder grand grimes, carl
10:03 pm
cameron is in louisville, kentucky with our report. >> reporter: it has been a bruiseing battle in kentucky, as it has been across the country in 1 10 highly competitive senae races, no more than here in kentucky in misc mitch mcconnel, stands if reelected. and republicans pick up 6 seat net to be majority leader, there are allegations of voter intimidation and race baiting, grimes went after mcconnell. >> this is rock bottom, this is desperation, this is a scare tactic, this is voter intimidation, this wrong. >> reporter: mcconnell's mailing reads violation on outside. inside, only -- attack ads as misleading and obama policies as
10:04 pm
liberal failures, by contrast, po help grimes shows mcconnell on one side with a black family on the other, saying that merrill lynch mcconnell -- mitch mcconnell is targeting our community. mcconnell is now focused on the president. >> spending, borrowing, taxing, over regulations of slow growth, threat to the next stkpwhrepb generation, these people need to be stopped, it starts tomorrow night. >> reporter: potential run offs in louisiana and georgia could day lay for weeks a determination for which party will croa control the senate net year, alaska guarantees it will be a late one with sullivan and begich. very difficult to pollack ratly, it could take days to count.
10:05 pm
nonetheless, airwaves are jammed with a blizzard of out of state attack ads. if the majority is to be determined tonight, we could probably get a clue in north carolina where kay hagen is in a tough battle with thom tillis. in early voting republicans have an advantage, not as big over democrats as in the past, some things it could go to the wire, and perhaps democrats could hole s could hold on, if hagen loses it could signal a lot of big wins for republicans coming after that $100 million has been spent on advertising in north carolina as in kentucky. we still have a few mor hours of ads. lou: this campaign has been something, all folks attending these events, what are they
10:06 pm
saying about the nasty attack ads by both candidates? >> grimes was here, a democratic audience they are complaining about the republican and out of state conservative attack ads that have been beating her up, it depresses democrats and makes them angry about the republicans and the process, same is true at mcconnell rallies, what it does it validates voters anger at washington, their cynicism about the process, they know a lot of these attack ads are not honest and often misleading, they don't know what or who to believe. they come up thinking i don't trust either, i will vote for the one i hate the least. got a good way to slow the. vote. lou: carl thank you so much. >> in iowa, final campaign day of one of the most closely watched senate races filled with divergence poll numbers and comments on attractiveness of the republican senate candidate,
10:07 pm
joni ernst. >> reporter: depending on which you believe, ernst is broken with the lead or still a dead heat in iowa, it has been an interesting race since harkin announced he is retiring, harkin committed a error saying it does not matter if ernst is as good looking at taylor swift, she would still be wrong for iowa. >> he is a sitting u.s. u.s u.sr who should be supportive of any female that is running, he does not have to agree with my ideas, but he compared me to taylor swift that is okay. >> i want to make it clear, i hope senator -- i never intended to, tpepbg offense her or anybo.
10:08 pm
>> reporter: brailley said he is feeling confident but he knows that ground game in voter turn out could mean everything tomorrow in a race this close, quinnipiac poll shows that women favor brailley, and men favor ernst. independence broke for ernst by 12 points. lou. lou: shannon thank you. >> a reminder to join us tomorrow night, for special election coverage here beginning at 7 p.m. eastern, neil cavuto and i will be here with the whole fbn team until the last vote is counted. fox business' special elect coverage tomorrow night. >> homeland security officials today announce that united states is boosting screening procedures for folks traveling into this country on western passports that move done out of

australia's footsteps suspending visas to people from 3 west african nations where ebola is widespread, we're coming back with much more stay with us. lou: polls open just hours from now, it is nationwide the own river den rum -- referendum, get out of vote, and alltel vision advertisininininin
10:11 pm
10:12 pm
10:13 pm
lou: well less than 24 hours until first polls close, joining us tonight, juan williams, republican poll ster. kelly ann conway, thank you,
10:14 pm
let's st-r start with white houe when asked about what message message this will send. >> it would not be wise to draw as broad a conclusion about the outcome of this election as you would from a national presidential election. simply by virtue of the map and the fact of the states where this contest is taking place, that said, this elect is important. lou: what was he trying to say? juan? >> i think is trying to play the expectations game, he was not doing it well. you see, on one han he said, you can't draw a large conclusion but he said this is very important election, it is important for his boss. because of the last two years of his boss' term. that implies legacy, president obama said as much. but on other hand, i think that he is not far off, played on red
10:15 pm
states but going to have a political impact on our country, no question. lou: what is the likelihood. that we'll see this wave elect that so many republicans have been talking about, that big a deal tomorrow for the republicans? >> they will have a good night tomorrow, and a good year, after you get past the run off in louisiana, and in georgia after whoever the victor in kansas. by end of the year will be a better year, but i think josh should have said, if democrats lose it because they did not campaign with my boss, they did not e embrace obamacare. >> i love it. >> obama made this country humorless, beginning with his ples secretary, it does have a big impact.
10:16 pm
contrast to way president obama reacted to elect in 2010, and 2014. and he is -- his party actual dewell in 1998, he did well in 96. president obama does not see it that way, he lacks self awareness gene. >> enough of beating up on obama, but something that lou said, where is the wave? republicans have a lot of advantages in this year, i don't see a wave coming. >> wave came in 2010. >> okay. >> you can -- they already won 63 seats, you can't rewin them. >> i'm talking about the senate. >> you know they are taking senate. >> i don't -- i -- you think it is likely but i don't think it is certain, i think going into this year, going to 12, thought it was certain, they should have won it then. lou: president's poll numbers have been underwater for a year and a half now, his unpopularty is historic if you will.
10:17 pm
look at what the result of that is, though, because to juan's point kelly ann. looking at screens to look at the vote, shaheen right now leading brown in new hampshire. 49 to 48% in unh poll after an 8 point lead last week. ernst and brailley tied at 47 in quinnipiac ac poll. but right now. that is tight as it can be. and gardner in colorado. sullivan over begich just barely, this doesn't look like a wave. >> it does not need to be a wave to actually take senate, they will take the senate, why would
10:18 pm
we need a wave? these folks were on ballot in 2008 with president obama. lou: you believe shaheen will win in new hampshire? >> i don't know that. the three states, new hampshire, ohio and colorado are not red states, the question is, why are his candidates, why are democrats struggling so much in states he carried just two short years ago, the answer circumstance his policies are -- answer is, his policies are on the ballot. you have to run against immigration through the jobs say, that we have stop giving preference to people, illegal immigrants. >> before we run out of time, i think you are makingiic excuses, republicans should be having a great year. >> they are having a great year, they will take senate tomorrow, and they will add to gains in house, democrats will probably be under 200 seats, and president obama will over take
10:19 pm
eisenhower as third. >> were you a cheerleader ever. >> feel hockey -- field hockey, i was a tough girl, you know they are going to have a good night, they will have most house losses third highest, over take eisen howard to suffer most house losses. lou: do you think that obama is sincere about wants to work with all these republicans. >> no, are you kidding me. >> juan thank you, and kelly ann thank you. lou: looking at our poll results, do you believe that obama administration was aware that terrorist released from guantanamo bay intended to fight alongside islamic state, 94% said, yes. vote in tonight's poll, do you believe that republican party will gain control of senate in tomorrow's midterms? cast your vote at loudobbs.com. >> up next, u.s. trained and armed rebels in syria.
10:20 pm
defecting. to al qaeda. and the white house sounds like -- well, maybe they don't know what is happening with the moderates so-called moderate rebels. >> i know we've seen some reports and photos that likely see food baskets that we provided. but i am not in a position to give a definitive account of what happened, we're still looking into it. >> also new reports of islamic state advance within iraq, we take it up next with general robert scales.
10:21 pm
you can't breathe through your nose, suddenly, you're a mouth breather. a mouth breather! well, put on a breathe right strip and shut your mouth. cold medicines open your nose over time, but add a breathe right strip and pow, it opens your nose up to 38% more. so you can breathe and do the one thing you want to do, sleep. add breathe right to your cold medicine shut your mouth and sleep right. breathe right. and look for the calming scent of new breathe right lavender, in the sleep aisle.
10:22 pm
10:23 pm
lou: coming up a new report predicting a spike in u.s. case ebola cases by the beginning of the new year, canada initiated a travel band that u.s. has not, why not? that also coming up tonight. moderate syrian rebels who were armed and trained by u.s. defecting en masse to theaals. >> ratheal -- joining us, robber scales former -- robert scales, fox news
10:24 pm
military analyst, general good to have you with us, administration said they will not confirm those reports but saying it will double down on its so-called syria strategy. >> we certainly are aware that moderate forces in syria are engaged in a multifront conflict and that conflict is taking a toll on them, there is no doubt. that is in part why you have seen the administration discuss the need to ramp up the training assistance that u.s. is offering to syrian opposition fighters, moderate opposition fighters. lou: moderate syrian rebels, general, they can't communicate with, to find out whether they defected to al-qaeda. but they plan to arm more of them if they can find them. is that your take away from what he said? >> basically, lou, my sources at
10:25 pm
pentagon say this is game, set, match, cia and other government agents have put all their money in to northern portion of this resistance group up in city. they have collapsed. andure trying to escape across the turkish border that seals turkish border with syria, breaks away any abilit a bill ad a u.s. coalition. but problem with that, you know, in war, geegraph joe's geograph. this is hundreds of miles from isis center of gravity, they are nowhere prepared to defend themselves, it will be years, if ever that we see any offensive against isis in their heartland
10:26 pm
in syria. lou: and in iraq. meanwhile, how goes the air campaign? how effective is it? what are next steps in the obama strategy? >> oh, boy. you know, a quick military term, there is a term called a culminateing point, where the attacker expands a territory and the defender is not strong enough to counter attack. that is anywhere we are right now, problem is that isis is taking time to consolidate their gains in anbar province to continue to expect their control of the cities and the iraqis are a long way from creating enough combat power with will to win, to take the offensive against isis. in this war, time and the initiative are on the enemy's side. it is up to the iraqi forces and american advis advisors to do something about it, it will be
10:27 pm
months if not a year or more, before they have any hope of retaking territory that isis now controls. lou: 36 sunnis killed by the islamic state, and anbar provinces, a 4th mass killing, since last thursday. >> remember, now this is how isis consolidates control. they don't win the hearts and minds of the people, they kill officials, they kill soldiers, they kill officers, they kill bureaucrats, and whole purpose is to freeze the sunni population, and hold them fast, and to pull them over to their side during this, before the iraqi for the councounter, this is a war of w, right now, because of their brutality, isis is winning. lou: to russia, russian government certifying the
10:28 pm
elections, and united states and nato, sort of shake their heads and wring their hands and that is the response. >> yeah, i'm afraid that is over too, i feel sorry for president poroshenko who took this bad deal for a ceasefire in september, putin has one thi thg in mind, that is to go against in ukraine what he did in crimea, in georgia. he is going to expand his sphere of influence and do what hitler did in '30s, so far he has been successful because nato and united states are doing what great southern california great britain and france did in 1938, and 39. i am a frayed that russians have gained neutere new territory, wn opportunity to reinforces ukraine army to station
10:29 pm
significant american forces on the periphery, and squeeze putin more economically, but unfortunately, nato and united states are just, setting back and watching this happen. it is tragic. lou: general robert scales, good to have you with us. >> thank you, lou. lou: marine sergeant tahmorressi is reportedly stays close to his family in south florida, enjoying his new freedom, after his 7 month imprisonmentment in a mexican jail, that ended friday night. mexican judge demanding his release on humanitarian grounds. because he suffered from post-traumatic stress. tahmorressi, home thanks in large part to efforts by two republican lawmakers, including congressman salmon who'll join us later in the broadcast, we're coming right back stpaeu wit st. >> a new report warns of a surge in deadly ebola cases, doctor and congressman michael burgess

10:33 pm
one pill each morning. 24 hours. zero heartburn. lou: a expert, now says there could be as many as 130 ebola cases in the united states, by the end of this year, a worse case scenario, joining us now, congressman michael burgess, a member of house energy and commerce committee, and g.o.p. doctor's cac -- caucus. is u.s. government, and hospitals now prepared to deal with an ebola crisis? >> you know, the difficulty is the way in which it comes to us, interesting those modeling projects, no one is predicting that number to be zero, there is likely there will be additional ebola cases before the end of the year, but do they come to us
10:34 pm
asd brantley did in august or as mr. duncan did in end of september, if it is latter case, iing is that hospitals are not as prepared as we would like to believe, they have learned a lot. these past weeks, but it is so disruptive to have ebola in your community, i say that haveing had it in our backyard a few weeks ago. it affects everything, your school system, waste disposal system, it is a big deal. lou: has folks at health presbyterian found out, you were there, you within to th to -- at have been to the hospital to see how they are recovering from the two cases of ebola, among their staff, and patient zero, duncan, died, after being in the hospital, how are they coping
10:35 pm
now? how prepared for they, in your judgment? >> they are likely better prepared than any hospital having been tested by fire. but, i am telling you, if a patient walks into the backdoor of a hospital anywhere, tonight or tomorrow night with this diagnosis, unknown, not anticipateing coming in as most of other ebola patience patiente been, this could be disruptive. as we saw in texas just the ability to put your hands on the personal protective equipment which is necessary. it is stock pileed and distributeed among hospitals and how quickly can the hospital can they put their hands on those additional supplies, they are unknown at-this-point. and what we know, i think one thing we have learned, it does not always behave as you think.
10:36 pm
lou: humility seems to be, doctor, if i may say, short supply in certain instances, it was at cdc, dr. frieden displaying none of that and nurse hic hickox resisting a quarantine but has acquired some sense of responsibility for her fellow citizens is now within a voluntary quarantine. but we have an administration that will not put on a ban. i was talking with reverend graham last week, and samaritans purse, they have people on frontlines, they have a quarantine. they have facilities set aside, 21 days for their people as they return.
10:37 pm
as reverend puts it, it is comfortable but enclosed and separate, it achieves its purpose. why is there any question on part of this federal government, note to do the same -- not to do the same? >> this is, i cannot ex plane. we talk about travel, we have been travel for people who are united states citizens, there should be a ban on elective travel from people from western africa to this country, suspend the travel documents until we get a better handle on this. we have learned 6 weeks ago that we really were not prepared. and yet, the a bill to keep the next -- ability to keep next patient zero does not exist. it is interesting that military, his own general, said, you know what, we're going to hold you for 21 days before you go to your family, that is the sensible thing to do. lou: we should credit the army
10:38 pm
for makeing that decision. the first quarantine period was 10 days for military, i asked for -- here, this it be 21 days, not out of matching anyone else's numbers, but because, our folks deserve as much protect as possible, our military, and if we are not taking care of them who do we take care of. >> and their families, who will be affected but people you come home to. >> your attorney general, is going to prevail what do you think? >> i don't think there is say question, we're all looking forward to when general abbott is sworn in as governor to will be a happy day in texas. lou: i assume for a lot of other reasons including your own
10:39 pm
reelection, congressman. >> thank you. lou: you get it all done in texas, it seems, good luck, and we'll see you in days ahead. >> yes, sir, thank you so much. lou: appreciate it. congressman michael burgess. i never know whether to call him congressman or doctor. with all due respect, it seems like a far merimportan more impe these days. >> on wall street, stocks were mixed. carmakers reports besto in years, sales up 6%, and listen to my financial report 3 times a day coast-to-coast on salem radio network over week, box office, universal, "ouiji " held

lou: a few comments on tomorrow's midterm elections, president obama may not be on the ballot as he has told us, but tomorrow will be a referendum on his presidency, acknowledgeing last month when he said this. >> i'm not on the ballot this fall. michelle is pretty happy about that. but make no mistake, these policies are on the ballot. every single one of them. these policies are on the ballot, every single one of th them. lou: in a weak sense republican candidates have surgeed in the polls hammers home the president's positiveage,. >> for democratic candidates has been almost comical how they have tried totion the president. >> did --tion >> did you vote for president obama.
10:46 pm
>> this elect is not about the fropresident. >> did you vote for president obama i in 2008 and 2012. >> would you leave her alone. >> do you, prove of the job that president obama is doing, there will be a clan to follow-up, but -- chance to follow-up but this is a yes or no answer, do you approve yes or no. >> in some ways i approve, some things i don't approve. >> those answers, by democratic candidates fairly predictible. given the obama presidency condition, which could be described, in shambles, politico, not flattering with quote, president is sullen resignation, basically irrelevant, unhappy camper, body language, religateed to a sideline parya. and polls showing 44% of
10:47 pm
republicans are motivated to vote this year's midterms compared to 25% of democratic voters, i saw we have the perfect set up for a wave elect tomorrow if there is to be one as it the dems can wave good-bye to control of the senate. >> now our quotation of the evening from american journalist. a good politic is quite as unthinkable as a honest burglar. this seems cynical to me, but interesting. >> up next, marine sergeant tahmorressi is free at last, one of the men responsible for his freedom is our guest tonight.

been in that prison a day much less 7 months, it took so long, i think that mexican legal system is so complicated and judge was so paranoid, he was getting pressure from mexican press he didn't give a special considering. because we were putting political pressure on mexico to do so. lou: it is now that we have rationalizeed, i guess a sort of this neighbor of ours to the south, why in the world done the president of united states demand his immediate release, he is a decorated war vet, u.s. marine, suffering from post-traumatic stress. >> lou, i can only speculate, i have not a clue why the president would not lift a finger to help the american hero, when he stood in rose garden with burg dal's family -- bergdahl's family and said as commander in chief, he would leave nobody behind, he clearly
10:53 pm
left this young man behind, the fact is, that there was a lot of people across america, that stood up for this young man. for me personal, i saw one of the best parts of america over last several months, that i have been involved. this ordeal was harrowing to andrew himself, he said, that time he spent in afghanistan, two tours he did were nothing compared to the ordeal he welcome through in this mexican prison. two mex in an prisons, but, i want to tell you, he is an american hero just like you said, he is a wonderful young man, but, his ordeal is not over. suffering from post-traumatic stress disorder has been greatly exacerbateed i believe by his 7 months in incarceration, and i think that american people need to continue to be vigilant and praying for his family, and doing everything we can to send our love and our thoughts.
10:54 pm
lou: i think our love our have you othoughts our respect, our gratitude. without question will be there for the sergeant, our prayers. i have to say, i am not one who is pleaseed that this government has been so desill, so passive with -- so docile, and so passive with the merkes merc n n government. >> i don't disagree with you, ed royce, and i are going over to mexico in the next couple of days. we'll meet with many top left mexican officials, we will meet with the president as well. and there is going to be some dialogue on this i had an our-long conversation with the

to the will of the people, if they do not get out there and do everything within our power to secure the borders, and start reporting the rule of law again, we'll pay a price in 2 years, americans don't vote for us because they like the elephant over the donkey, they want someone that goes to washington and does something. i am ready to be bold, i think our party in house and senate, we need it take it to the president, put things on his desk daily that he has to answer to. lou: congressman matt salmon thank you. >> thank you. lou: time for a few of your comments now, linda tweeted, i think that no matter how the elect goes, president will use his pen like crazy before january. unfortunately, i think you are right. >> darlene. left wing media blackout of midterms might be a good thing,
