on real criminals and terrorists. that's our show. we'll be back next week to report on what economists call the tragedy of the commons. it almost killed thanksgiving. th the best lou dobbs, fox business. >> good evening everybody, breaking news, we're now less than an hour from the most sweeping unilateral change to our immigration laws in this nation's history. president obama about to legalize more than 5 million illegal immigrants. the decision comes less than three weeks after the people soundly reputeiated this president's policies and his agenda. president obama has said more than 20 times that what he will order is against the law and beyond his powers as president. the white house today was asked how he could turn so swiftly from his own words. predictably perhaps, they blamed republicans. >> so we should be clear

about what the president's view is as it relates to the treatment of those individuals. the fact is: the legislation that was passed, again, with bipartisan fashion through the senate. supported by the business community. the labor community president evangelical community. even law enforcement. that is the piece of legislation that would deal with these individuals in an orderly fashion. unfortunately it's house republicans who have blocked that legislation and prevented us from deal with them. it's house republican leaders that have perpetuated the problem. lou: john boehner blasted the president reminding him, we don't live in a monarchy. >> instead of working together to fix our broken immigration system, the president says, he's acting on his own. that's not how our democracy works. the president has said before, he's not king. and he's not an emperor. but he's sure acting like one. he's doing at a time when the american people want nothing more than

for us to work together. lou: a clear problem for this white house is even members of its own party disagree with the president. democratic senator joe donnelly of indiana said i'm as frustrated as anyone. the congress isn't doing its job, but the president shouldn't make such significant policy changes on his own. and the american public is not on the president's side either. a new wall street journal poll finds 33 percent of americans want president obama to set the nation's agenda. compared with 56 percent who want to see congress making those decisions. the tales of what president obama will announce tonight are becoming clear. he will grant amnesty to illegal immigrants who are the parents of those who are american citizens or hold green cards that have been here illegally for over five years. he will grant up to a

quarter illegal waivers for illegal immigrant farm workers as well. he's eliminating the age requirement for the so-called dreamer program. those folks would have to submit fingerprints. pass a background check. prove how long they've been in the country. the federation reform estimates the cost to taxpayers will top $2 billion in government benefits. medicare, medicaid, social security, food stamps and eventually obamacare. the house appropriation committee said they won't be able to block the president's action through defunding or rescinding. ed henry with our report. >> they tell president obama made a final decision to move forward with unilateral action this week after returning from asia. his speechwriters put the final touches on his prime time address. the president tried to wrap himself in the american flag.

come into power is to spop this illegal action from taking place. >> what they're trying to stop are executive actions focused on protecting 5 million illegal immigrants from deportation. including the parents of us citizens and green card holders if those parents have been in america at least five years. and expanding a 2012 action program that will allow more young people called dreamers to stay in america. giving democrats a chance to cast it as humanitarian. >> homes are being broken across the nation. >> the second part will be border security. to blunt g.o.p.'s attack he's been weak in that area. he will assign a memo to shift resources for border patrol agents and ice personnel to prioritize tracking down people who have felonies or tied to terror. that's a move to the

lou: we're less than an hour away from president obama's announcement on executive amnesty. joining us now to talk about the ramifications. ronnie. and i notice he has a big smile on his face tonight. >> just saying hi, lou. lou: chris. and the immigration law reform institute counsel, chris, good to have you with us. i think, first of all, i have to begin by saying,

congratulations. you've gotten what you and a lot of other activists have been working toward for the better part of a decade. what do you expect to be the ramifications? >> oh, lou, great to see you again. thanks for having me. what's happening tonight is not ideal. we didn't want the president to act on his own. we would rather have congress act in a bipartisan fashion. we'll work toward that solution. what's happening after tonight, nearly 5 million people who are in our communities who we don't know what their names are, what their backgrounds are, those 5 million people will come out of the shadows they'll pass criminal background checks and they'll start paying their taxes. that's a win for everybody. >> chris, your reaction. >> well, lou, what will happen tonight is unconstitutional, illegal and very bad for the country. we already know it's illegal, as you know, and many of your viewers

know. i represented the ten ice agents and continue to represent them after they sued the 2012 amnesty. the federal judge says that violates law. only congress can grant the benefits and the legal rights of an amnesty. congress chose not to do so. the president thinks he can legislate. it's bad for the country. we're talking about the ultimate unfunded mandate. 71 percent of illegal immigrants are using some kind of government benefits. a huge number of additional benefits will be opened most of it paid by state taxpayers. some states will probably want to sue the federal government over this illegal executive action. lou: i think it's fair to say, that the american people right now could be forgiven. if they think they're hearing much the same thing they've heard for ten years. and that the president's taking action today and there's been posturing by republicans, as you know, about it's illegal and it's unconstitutional, which

i happen to believe is correct, that the president has not acted with consensus, but the reality is, the republican party has gotten pretty much what it wants here, whether it has articulated it or not because there have been two voices missing from what has been a meager response from the republicans. we don't hear anything from the business roundtable and the chamber of commerce. they've been clamoring for this for years. is this a play we're quachg unfold before us. >> i think that republicans are actually in a great position going into 2015. people don't like the process. they hate the politics. people are fed up with washington, dc. there are folks in our communities who want to come out of the stoadz. a republican congress has the opportunity to get credit for fixing the system. they can fix the system and tell that to the

business round table. tell that to the hispanic voters they clamor for or they can get credit for dismantling something. in which case, business, growers, tech, the hispanic voters, they will say, you know what, he wanted to believe in. you didn't take the opportunity. >> that would be a more convincing argument if the president had issued this executive fiat before the midterm elections instead of after it. >> that's exactly right. the reason he did it after the midterm election is the she lacking the democrats would have took would be much worse. it's going to be so unpopular. last time i checked, we're still a republic. and the people who are us citizens should have some say in a major national policy like this. now, you have essentially a lame duck president unaccountable to anyone making an

executive imperial decree that this shall be the law. now, we're going to try to fight it the in courts. the law is the on the side of those of us who want to fight it. this is outrageous. the idea that republicans by rolling over and agreeing to this and ratifying it afterward with legislation, no, look, the american people were clear about this. they do not not an amnesty. we saw the ramifications of the 2012 amnesty this summer. lou: we heard you say that a judge ruled it was unconstitutional and illegal. the american people are pretty much fed up with two parties. the choices before them as of tomorrow will be to go with what is an increased authority aaron republic rather than a democratic one in which a president can rule unilaterally. turn it over to the business roundtable and the chamber of commerce, which seems to be the affect on both parties as a result of the decision taken unilaterally by this

president. woulwould either of you like to argue with the conclusion i've offered. >> i would offer two things. one, nearly every president for the last 60 years has taken some sort of executive action with regard to the immigration system. two cases -- i'm not a lawyer like chris. but there are two cases. the united states versus nixon in 1974. which affirmed -- and then the other thing, lou, at the end of the day, this is going to be about people. over the coming weeks, we'll hear stories about people in the elevator. people who will say, you know what -- lou: we've been friends for too long. we can conclude, i understand you're expansive as a result of what the president is about to understandably so. chris, thank you. fox business news will have complete coverage of the presidential address on immigration tonight. immediately following "lou dobbs tonight." neil cavuto covering it all at 8:00 p.m.

that is what we saw play out in the last few weeks. a crude and disgusting video sparked outrage in the muslim world. it is indisputable that our economy is stronger today than when i took office by every economic measure we are better off now than we were when i took office. lou: why do we not feel better off? in part, our economy in the past five years hasn't created as many jobs as the number of illegal immigrants who are about to receive unilateral amnesty by executive fiat because our military budget has been cut repeatedly. our president and his military leaders have failed in iraq and afghanistan. our commander-in-chief did not seem in the least defeated. and as we wait on a ferguson, missouri, grand jury to decide the fate of a policeman and perhaps a community, perhaps a nation, the president seems

satisfied with whatever will be. a community desperate for leadership and reassurance and this president and his familiars seem to goad rather than guide. to agitate rather than propitiate. the national media comforts this white house. he's unconstrained by regard for truth. the result, he could be the washington post fact checker sole focus full time. his latest about the keystone pipeline. obama: i understand what this project is. it is providing the ability of canada to pump their oil, send it through our land, down to the gulf where it will be sold everywhere else. lou: the post gently gave him three out of four pinocchios.

(?) how can it be as admiral rogers said this nation with the greatest technology, the strongest economy, can't defend itself against an infrastructure attack from china. >> well, the issue, lou, is that these systems that he's talking about our critical infrastructure systems have been around for a long time. when they were put in place, a lot of the vulnerabilities and abilities of other countries to attack them didn't exist. we're talking about engineering language. it's called skater. which is supervisor other control -- they control a large majority of our infrastructure that are out there. they were originally built as stand alone systems. now, that they've been wired to the internet, the vulnerability -- the opportunity to attack them and take control of them have greatly been

increased (?) lou: the admiral making it clear we're in a defensive posture and i read that we effectively had no way in which to retaliate at least in the virtual world. is that your conclusion as well? >> no, sir. and i'm not in a position to really talk about what the -- our government can and cannot do. but i am of the opinion that this country needs to understand that in my opinion these are acts of war. and as an act of war, these have consequences. any country that attacks our critical infrastructure has violated this nation and needs to understand that we will respond and we will respond fiercely both in cyber force and on the ground. lou: these attacks are frequent. they're constant. they have become more adventurerous and more

damaging. to rise to this level without a foreign policy response in terms of articulating precisely what you did, if you will, a cyber doctrine for the united states is preposterous. >> well, i mean, there's no. [no audio] for a long time. called an action. we should stop talking and do something about it. the admiral speech today, we still need to outline what is offensive and what is an act of war. we've been fighting since 2001. we should know what these acts of war are, and we need to articulate those. put them in doctrine and defend them when they're violated. lou: and corporate america, i mean, it has become the customer, the consumer basically understands that he or she is basically at the mercy of corporate america when it comes to their personal information, their privacy, and it seems corporate americaing no more luck than the admiral

lou: the grand jury in ferguson, missouri, set to meet tomorrow a decision possible we're told even likely on whether darren wilson will be indicted in the police shooting of michael brown. law enforcement told to expect advanced notice before any decision is announced. six protesters arrested in ferguson overnight calling for the indictment of officer wilson. joining us to talk about all this is alveda king. niece of daughter martin luther king jr. great to have you with us. al sharpton prepared to mobilize activists following the decision in ferguson. here's what he had to say in ferguson. >> i think that the role of the parents and leadership is important, to keep a tone there. i also must say how

disappointing to say to hear the governor of missouri lecture the demonstrators and not deal with the problems of the provoking and the outright misbehavior of some of the police. lou: does al sharpton have the standing to be the ashor of conduct in ferguson? (?) >> well, you know, lou, there are several african-american leaders, several civil rights leaders such as myself. i did march in the '60s and was jailed for open housing. i remember my father was beat up on bloody sunday. at that time the true mark of a real leader of authority will be calling for peace for orderly conduct.

i really do not hear that from al sharpton. i think i heard him say -- lou: how about the attorney general? >> the same thing with the president and the attorney general. i don't see enough emphasis on calling for peace and for order. certainly, we all want to see justice. but you can't try a situation by public opinion or you should not, and i think that is basically what al sharpton has been doing, relying on public opinion. lou: i've been -- as i've been discussing this with various folks, one of those activists, a professor at st. louis university said that this was about greater -- greater wounds than simply in ferguson, but talking about an expanding narrative around the experience of african-americans in this country over history. with that kind of language and with that kind of perspective,

healing wounds is almost impossible, isn't it? >> if you're going to deal with systemic issues and there are some, we do not address those with violence, upheaval with exas baiting a situation. those kind of situations need to be dealt with calmly, sincerely, deeply, extensively. we can only do that with reason. violence, one, will not bring michael brown back. so we have to remember that. and i remember, as i say going back to the '60s and bringing it up to today, if everyone wants to get violent and emotional, how will we deal with the systemic problems in our country that are causing these things to continually happen? that being only be done with peaceful dmangs. with reason. with condition that is bent on solutions. that's what's required,

matt schlapp, and great to have you here in new york. >> great to be here, lou. >> republicans looking a little foolish, if i may say candidly, boehner saying this isn't a monarchy. somebody needs to tell the president, going to stop it through rescission, somebody needs to explain how the legislature works. and this government. what's going on with the republican party? >> the one thing that has to happen is saying we can't do anything is not a very good answer, and the other problem is, that, as you know, this is happening in a lame-duck congress. the american people sent a clear message to president obama which is stop, and sent many more republicans to the house and gave a republican majority in the senate. that all begins in january. there are simply not the votes to do anything on limitation of funds. the president knows that, which is why he's acting now. >> acting now, and those who may be despairing as you listen to us talk about this, and what's going to unfold with

millions, by the way, five million is what the president is talking about. we don't know how many illegal immigrants in this country. and the president isn't saying there will be five million visas. he's saying there will be at least five million folks. >> we should call mr. gruber, maybe he knows what's going on. >> what is unfolding is a clear manifestation of that doctrine within this administration that the american people are stupid. >> that's right. >> and if the republican party doesn't react, it's going to be pretty clear that they're still falling the guidance and dicta of the chamber of commerce and the business roundtable. you haven't heard a word from tom donahue at the chamber of commerce because he's quite pleased with the result. >> let me tell you, americans have had terrible results with shutdowns of government. they are shell-shocked with the idea of shutdown of government. there is another side to this. this is executive fiat. this is the president doing

something we've never seen in our lifetime. it's extraordinary, they have to do something to demonstrate to the american people they get how serious it is. the president has boxed them in, but to do nothing is not a solution, and i think they know that. >> not a solution, john boehner is obviously very upset with him. with it being incorporated into whatever the decision will be. i personally don't see a way forward for the republicans. i think all of this is -- i will say it out loud. it looks like pure bluster on the part of the republican party. i see no will, a business roundtable, u.s. multinational, the national chamber of commerce have any interest whatsoever in stopping what they have been seeking for so long, that is continue the cheap labor. >> lou, you are assuming they're the number one constituency of the republicans in the house. these republicans in the house realize what's going on in the districts, and the american people want to see real change in washington. they are not in support of what the president is doing, there's
