"the willis report" is next. david: see ya. gerri: hello, everyone, i'm gerri willis. is your stroller a danger? that is now the fear for parents and for grandparents. more than four 1/2 million graco baby strollers are being voluntarily recalled. they are being recalled for pinching or even cutting off a child's finger, horrible. with more on this attorney debra broom bloom. great to have you here. describe for us if you could what is the safety hazard? how does the stroller work or not work? >> well, graco recalled the strollers, approximately five million strollers have been recalled. due to the fact that the safety hinges are defective of the so let's keep in perspective, less than 1% of children have been

injured due to these defective safety hinges. gerri: we've got a slow motion video of actually what happens. i want to show people, we're seeing it right here. so this stroller, when it comes apart can grab a child's finger and smash it. that is the scary part. so now graco, and federal regulators are saying for the love of god, if you have a child with one of these strollers get them out prompt toe. don't let them linger in the stroller, if it folds up it will be a hazard. they have a kit coming i out, right? they will help parents get the situation fixed. is the kit a real solution? >> the kit doesn't come out until decent 2014 which i find. they should have the bring the stroller into a repair site. to me that is not enough. gerri: the repair is just a cover for the hinges. i'm wonder if that will actually work? >> there is no proof that it will work.

they have issued a statement that the repair kit has been tested. we don't know the result what that will be. gerri: graco has history of problems with recalls. i want to show you history, problems with glider rockers, the harness buckles. a lot of different things that haven't worked. what is going on here? and why aren't there goodness, more obvious things coming out from the government, the consumer protection safety commission, saying goodness, avoid these at all costs? >> in 2005 graco had to pay $4 million for belatedly reporting the defects in their products. so they do have a history in the past of not reporting the issues with their products. and the government should perhaps take better control of this company because children are most important. and they're -- gerri: look can they fine them? can the company be fined? >> the company can be fined. and company can be sued by these

families whose children suffered. gerri: so they have voluntarily done the recall which is interesting because they're doing it on their own accord. what should parents be doing if they have one of these strollers? be clear, these strollers have been around since 2000. you may have one sitting in your garage and not realize it. >> good thing, online, you can see if the stroller you have is one of the strollers being recalled. even if you don't have the serial number or product name you may be able to determine if that the is stroller you have. now what the families can do use extreme caution when concern children are put into it. make sure the safety hinge is locked and be very careful. >> want to tell you on our website, gerriwillis.com you can find a complete list of models and model numbers. you find the model numbers by going underneath the stroller looking on the model there and match to numbers on our website.

these airbags? >> you know it has been a moving target since back in 2009 when this, what they call rolling recall started. the thing they have been trying to get their arms around it. they have recalled a lot of these. senator nelson's hearings talked about yesterday, it is a still debate which one of these need to be recalled so yes. gerri: i want to talk about your client, cory, has two children. of the six months ago, it wasn't even a horrible car accident, was it? it was a fender bender and his airbag blows out and he gets injured. tell us about that. before you do, i want to tell our viewers i have graphic images we'll be showing. if you have small kids in the room you might want to take them out. this is really a story worth hearing. rich, go ahead. >> cory was on his way to work. he is a forklift driver. he left his house that morning. was going through an intersection. his car stalled. there was a fender-bender as you

can see some of the pictures you show your viewers. should have been something he walked away from. instead when the airbag blew, like you said, a slashed of metal 3 1/2 inches long went into his face and destroying one of his eyes. he has a pretty serious, not only lost his sight but disfigured. he will have to live with that the rest of his life. gerri: he said in a story i read about cory, you can see the stitches here. you can see the extent of the damage, he said i thought i was going to die as he sat on the sidewalk waiting for help to come. this is going to affect him forever, right? this is an accident that could, cap his earnings. it could inhibit his ability to interact with his family. the ramifications are pretty big. >> you're right. for his little family, cory works for a living to support his family. as i said he drive as forklift. he is typically loading ballots -- pallets 35 feet up in

the air. when you lose sight in one eye it affects your depth perception. it makes it harder. his company has been great. he is still working. it has been hard and obviously affect continue to doing that for a long time. gerri: so what is the status of his case? what kind of damages are you seeking? >> well, it is early. obviously in this case we filed it recently and we're still in the early stages and we're going to try to get compensation. i think one of the things that cory has said, and was underscored yesterday by senator nelson, maybe, maybe this case gives opportunity we can make the process better. it really helped spark a conversation about the problems with our recall system in the wake of of course not just this case but toyota and general motors ignition. this will continue to happen unless we take this opportunity to change the rules. gerri: that is my next question for you. >> yeah. gerri: which is this. are there going to be lots more cases filed? this is a problem according to "the new york times" is 10 years old. and the folks at takata knew it.

>> right. gerri: and have done nothing. do you think thrill will be more cases? are you filing more cases? >> you know we're looking at cases for a few other clients. you know, i'm not sure how many serious injury cases are still out there that haven't already been resolved. as typically happens, when ever there is very public recall like this, clients who didn't realize they had a case may come forward. so you know, that still has yet to be seen but, the good thing, like i said, is that, it is going to hopefully lead some change so we're not here again six months from now with another company, with another defective product and more people being needlessly hurt and killed. >> we'll continue to cover this story, rich. let us know of any developments. it is a tragic story for cory but, maybe we can see some changes long term to nhtsa and regulators and companies themselves. thank you. >> thank you so much for having us. we appreciate it. >> takata airbags and gm ignition switches, we covered them a lot, right?

they are far, far from the only problems on the road these days. the government is cracking down on chrysler, telling the auto maker to speed up its recall of 1 1/2 million older jeeps. chrysler says the gas tanks can rupture in a rear collision. nhtsa sent a letter saying only 3% of the jeep grand cherokees and liberties fixed more than a year after the recall began. jeep owners complain turned away by dealers due to lack of parts. at least 51 people died in crashes due at problem. meanwhile toyota is recalling nearly 420 lexuses to repair leaks. some of lexuses were also recalled in 2009 for similar problems. -- 423,000. still a lot more to come this hour, including your voice. your voice is important to us. during the show we want you to sent me an email. go to gerriwillis.com. at the bottom of the hour i will read your tweets and emails.

gerri: as the town of ferguson, missouri awaits a grand jury decision in the death of michael brown, his father, michael brown, sr. and officials are preparing. >> destroying property is not the answer. no matter what the grand jury decides i do not want my son's death to be in vain. >> if there are protests, we expect some protesters will be disruptive. they will likely try as they did in october, to inconvenience people to make a point. if protesters are northern violent -- non-violent, police will not be aggressive. but in some protesters turn violent and threaten, or are threatening police will respond to keep everyone safe. gerri: joining me from ferguson is jan lalani, his store was ransacked by looters in august

when this all began. welcome back to the show. great to see you. what is the mood there and how are people feeling as we await for this decision to come down? >> well, it is a tense situation and people are just kind of waiting to see what is going to happen. a lot of people are just talking about, it might be crazy and, i even have people coming in that are still hoping and praying for peaceful protesters. gerri: are you worried, nervous, anxious, about what might happen? >> yeah. i mean, of course. i mean, i don't want anything to happen like it did back in august. and, we're just kind of, preparing ourselves for good or bad. we're just kind of hoping that nothing is going to happen and that, we can get through this peacefully and let the court system take its course. gerri: august 9th, your store was hit, looted, with and we have unbelievable video of it because your security cameras caught it.

i think a lot of people have seen this video, of the looting that went on at your store. we're seeing it right now. i can't imagine that, are you going to be open all weekend? will you keep your doors open? will you serve the clientele? will you serve the community? will you be confident that you can stay open? >> well, as it is right now, the plan that me and my dad made was we'll stay open until the verdict comes out about what is going to happen. and how it turns out and then, just kind of take it from there and if it, if it turns bad, we're not going to open and we'll have to stay closed until the situation has calmed down. we don't want to go through all that stuff that we went through back in august. gerri: fingers crossed but you're showing some confidence in the community by staying open. at least until that time. are you seeing more evidence of increased security on the streets? >> we, i'm a little bit, i'm about a mile 1/2 from ferguson.

i'm in delwood which is neighbor city. up there where my store is, we don't have any, there is not a lot of people or security in the streets right there. and to be honest with you, i haven't even been down ferguson or down there because i wanted to stay away from it. gerri: so you're staying out of any potential harms way. what are your fellow store owners tell you? what are they doing? are they staying open? >> i think a couple of the people that i have talked to, they want to stay open for the community and, just kind of hoping that nothing is going to happen. but i also have heard a couple of guys talking about, might even just close down from tomorrow and then wait until, if it is going to happen this weekend, then don't open until it is over. if it is not going to happen this weekend, maybe open again on monday so. gerri: how much money have you lost, having to be closed or shuttered part of the time because of all this violence.

gerri: now to a consumer nightmare. imagine answering your phone and hearing this on the other end of the line? >> what is wrong with you man? are you lowlife piece of [bleep] >> if i don't hear from you i will have the sheriff's department at your door. >> that is a real call from a real debt collector and though they may seem intimidating they're breaking the law. so what are your rights? here with the dos and don't of debt collection is fox news legal analyst bob massi. bob, welcome to the show. great to have you here. >> thank you. gerri: are those calls legal? >> no, they're completely illegal. both civilly and criminally by the way. they violate federal law and violate state law and violation of a criminal code. assuming they ever find who did that, there is no question they

could be prosecuted for that kind of activity. gerri: so, it is coming up because there is a recent case here. i want to know what you make of this case, the feds cracking down on thieves who posed as debt collectors, saying they were debt collectors. in fact they were not. they just wanted to con people out of money. what happened? what do you make of it? >> you know what, actually, gerri, these kinds of things going on for years, particularly through the real estate crisis we saw a lot of collection agencies doing things that were illegal but in this case they're not even real debts. goes to show you vulnerability of people when they're contacted by somebody saying, you owe me $100. that is what they do, by the way. go after $50, 150, oh, gees, i didn't owe that debt. gerri: why do people pay? >> because people are afraid. they will absolutely grow exploit senior citizens. they will exploit young people that are vulnerable. they know what they're doing.

these people are pros. as a result out of fear and anxiety and idea of credit the idea of having good credit, gerri, absolutely close to who we are as people they pay and it is a numbers game for them n this case, finally the feds have gone after these people. i think they were out of georgia. they will prosecute it. good for them. gerri: they will prosecute it. >> yeah. gerri: i have to tell you there are also people in the cross-hairs of legitimate debt collectors. >> yep. gerri: in fact i'm astonished at this number. i covered this stuff for a long time. one in three, one in three adults have debt that is in collections. that is astonishing. how could that be true? >> well, look, i sort of look at the way you and i covered everything that happened in the last several years with real es stay and all the bankruptcies. i just think when this real estate crisis hit, people got in over their head. they borrowed against credit cards. as a result never thinking that things would go bad, figuring to save their home.

there are a lot of different reasons for it. but the bottom line is, they just built it up. then they lost their job. as a result, they either go bankrupt or just don't pay the debt. so there is a lot of different things that happened in the last seven or eight years resulted in the amount of debt, billions of dollars worth of debt. gerri: billions of dollars. >> that people have. and wrung people, young people which is ridiculous. gerri: talk about guidelines on debt collectors. what can they not do? what is ten stepping over the line? >> they're not supposed to call you before 8:00 a.m. or after 9:00 p.m. in the earning. not supposed to call you at workings if you give them notice you don't want them contacted at work. can't contact you continuously during the day. they can't call neighbors, masscy owes x-amount of dollars. they can call neighbor to say, hey, does he live out at home. they can't give out proprietary information unique to me, call coworkers friends, family members. those are violations. and what happens is this.

for the economy and it is good to have people working here. here is the positive i have the big problem for constitutional reasons as an economist what is the cost to the american taxpayer? i will give you a couple of examples. he said specifically they will not be eligible for obamacare but i don't believe that for one second. gerri: but he said that. president for repeatedly sidestepping congress. house speaker gators sues the administration on behalf of the house republicans saying the president has overstepped his authority to implement parts of obamacare but do they have a case? we have our guests. is the president over stepping his balance? >> not legally he has great authority talking about executive order to deal with deportation. lin case goes back through 1988. the court failed looking a deportation the orders are very broad. so legally he has the right to do this. gerri: republicans say there are two aspects of unconstitutional.

what are they? >> basically the president's delay of the mandate forces employers to provide health care has been delayed and there is no provision. and they say the appropriations for medication expansion will not be appropriated by congress but through health and human services to use $175 million. >> also let you talk about is that this is how congress can fight back. that if it is legal now congress can come back to say we don't have the money to go forward with this program. >> in terms of the obamacare situation comedies cases usually don't work on behalf of congress because it is not the entity that is hard with the person industry who
