stuart varney and here is how we pick off the second hour of "varney and company," the growing rift between the democrats, senator shimmer admitting passing obama care was the wrong thing to do saying democrats failed to focus on the economic recovery in president obama's first term. there is senator harry reid's tax reform bill. the white house threatened to veto. the results, the bill was dead. and the executive order and immigration was the reason why. another hour of varney starts right there. ♪ adam: a huge admission. senator chuck schumer admitting earlier this week the passage of obamacare was a mistake and congress should have been pressing different issues during the president's first years in office. >> democrats blew the opportunity the american people gave them. we took their mandate and put

all of our focus on a wrong problem. health-care reform. americans were crying out for the end of the recession, better wages and more jobs, not changes in health care. adam: ambassador john bolton joins us now. is this another example of the problem, the rift between democrats, and what does senator schumer again by taking legislation he voted in favor of passing? >> it is a very significant remark and it is a harbinger of splits that exist within the democratic party that the media hasn't focused on but we will see more of. he is basically right as a tactical matter politically. obamacare proved very unpopular and gave many people the feeling that the president and the party were doing an ideological obsession rather than focusing on what was key to most people. which was to get out of the

recession. i don't agree with the senator that often bought on politics his assessment here was exactly right. neil: 3 he is referred to in new york as senator sunday because he is all available sunday after a coverage on tv channels but what does senator sunday gain by doing this? he has to have a political motive. >> that would not be unusual. i think it is a reflection that the democratic party as a whole or elements of it realize president obama only has 32 years left in office and given his low approval rating, the unpopularity of things he appears to be poised to do or has just done like the immigration executive order many people in the party now want to look to the future and whether they want to stay on the left side of american politics or, as some would like to see, move back towards the center and this could be senator schumer could be here a surrogate for hillary clinton. this is the opening wedge of

trying to separate herself from the obama administration because she is perceived as running for obama's third term she is in real trouble. adam: could there be something more insidious going on? could the senator be preparing for the testimony we will get from jonathan gruber who called the american voter stupid and was instrumental in the creation of the affordable health care act. could the senator be playing the game in which he is shifting the discussion so you have democrats, maybe even hillary clinton able to attack obamacare? >> it will be hard for hillary clinton to do that. others will have any easier task but it would take a magician to distinguish between obamacare as it was enacted by congress and so called hillarycare from 1993-1994. some of the specifics may be different but the intent, the motive, the bigger picture is entirely the same.

because they won't increase production or cut production, prices for a barrel of oil below $70 a barrel and that means the price of gas keeps falling. national gay average for a gallon of regular $2.75, falling at a rate of a penny a day. here's the math we love to show you. we, the $2 club. 40 states paying an average less than $3 a gallon. falling oil prices might be putting more money in your pocket but it is bad news for energy stocks. exxon mobil, chevron and halliburton taking a beating on that news that opec will not cut production. ambassador john bolton is with us. what do you expect the lower price of oil will have on places like russia. it can't be good for vladimir putin or russia. >> for vladimir putin and russia in particular these prices will have a significant impact. a lot of vladimir putin's domestic popularity in russia which emboldened him internationally is based on his turning the oil revenues russia

gets from its exports into bread and circuses for its citizens. and i have to say contrasting with the monarchies of the arabian peninsula which budget much better against fluctuations in oil prices russia by all accounts pretty much spends it as it comes in on modernizing its military and these economic benefits for its citizens so this decline in oil prices we have seen over the last several weeks will put a crimp in to vladimir putin's budget and affect how he behaves internationally. adam: what about iran and isis? the enemy of my enemy is my friend. iran and isis are not friends. they are enemies. the low price of oil and the cuts here and. would we not want them to at least have all little bit of ability to counteract isis? >> i don't think so. isis also depends on its export of oil from the territories it has conquered although its revenue isn't that much to speak

of when you look at iran. i do think iran is more similar to russia in the sense that it spends what it gets in. it has got a reserved but it has been dependent on these oil revenues being at high prices as the sanctions have squeezed them over the past couple years so i have to believe in part that the arab side of opec, saudis in particular look at this decision to hold output constant and not pull it back to drive prices up. at least in part may be in substantial part as aimed at iran to reduce their revenue, redos their flexibility. adam: does it bring some stability in the middle east tour will we still see it volatile regardless of the price of oil? >> you will continue to be volatile because there are different interests among the oil producing countries but the saudis probably are among the most significant budgeters when it comes to oil revenues. the other monarchies there do as

well and i thing they see all those they are losing revenue themselves, the bigger hit has been felt by iran. adam: thank you very much. you brought bread and circuses, we can't talk about what the ancient romans did when they debase the currency and cut the amount of silver but another time we can have that discussion. we have done that in the united states. all the best to you. earlier this week, a new menu labeling policy in an effort to fight obesity. chain restaurants around the country have to list a calorie count for all of the items on their menu. joining us is unaffected by these new regulations andy, thank you for being here on a holiday for most people. is this an overreach by the government? people like information but it seems to me restaurants listing the calorie count on everything, a place like pizza hut could have hundreds of thousands of different combinations. how do you do it?

>> it is really a perfect example of many state overregulation. this is an absurd rule. it will make the menu boards and quick service restaurants basically unreadable or make the drive for a menu boards unreadable if it proceeds in its current form. it is expensive. there was an article in the washington post a couple years ago that said the evidence continues to mounts that disclosing calorie count doesn't affect the calories that people consume. people that don't need it use it. the people that do need it are often finding more products because they are surprised how low the calories are after the bad publicity for fast food. it is a horrific results based on that many state approach, people telling us what we should be, how much we should be. we have healthy product to our restaurants. we are happy to sell them. we have chicken breast, you can put a turkey burger on any of

our burgers, with lettuce leaves, low carb style, we have a lot of healthy alternatives. people don't buy them. if you don't know going in a hamburger restaurant that hamburgers and french eyes are high in calories you are living under a rock. this is not something that needs to be on the menu. adam: this focus on calories. i am guilty. i enjoy going to the grocery store and reading the labels but i am a geek. this focus on how this comes out of the logic we use to approach the week issues in our country about calorie control and what we are learning is it is.com the nation of so many things, processed foods and sugars and not just calories in calories out. is there a better way to do this? have the restaurant have a book somewhere if someone wanted to know quote i have the book as opposed to putting it on every menu? >> i am glad you asked that question. we have posters on the walls. there is nothing to read this.

calories, total fat, saturated fat, natural trans fat, artificial trans fat, cholesterol, sodium, dietary fiber, sugars and proteins. that is already posted. we also have pamphlets available in the restaurants to tell you that and if you go in our web site, you can construct a meal. it will tell you all the nutritional information right there on the web site. even i can doing so my kids could do easily. there are better ways to do this. the appropriations committee that funds the fda recommended the fda allow posters on the walls. i testified in front of congress on this and congresswomen deg t degette was receptive. what we're doing already we should get an exemption from the nutritional labeling, there are better ways to do this. everybody knows it. this was put together much too quickly without input from the business community and it is a

disaster. adam: an article in the washington times says this creates an incentive for businesses to hire undocumented people, illegal aliens over citizens because it is a $3,000 number because there is an exemption from the health care requirement. do you think your competitors or businesses, smaller restaurant franchises might take advantage of that? should this be fixed and looked at? >> i just read the article this morning so i can't give too in-depth analysis. of the 5 million people that the president's executive order applies to if we just hired 200,000 of them, american businesses would save $600 million. of american businesses hired 2 million of those people at $3,000 a person, that is $6 billion so the odds of american business is not taking advantage of the opportunity for hiring people legally because these people have been made legal and save $3,000 the idea
