close. this is along sixth avenue. this is live pictures that you're looking at us coming to us outside of fox news hq in midtown manhattan. the mood has escalated in the last few minutes, the protests were peaceful, they began about an hour ago. in the last few moments, pushing and shoving, and as we were coming to air, we witnessed new york police officers pulling someone out of that crowd. we believe, could be an arrest, we don't know, all we can tell you is what we're seeing as you are looking at the pictures live on your screen at home. the mood in midtown manhattan changing in just the last few moments. protesters are upset. with regards to the eric garner case. this was the alleged chokehold that officer daniel pantalleo after he was arrested for selling loose cigarettes on

staten island. new york city mayor bill de blasio came out encouraging unhappy new yorkers to protest, but pled with them to remain peaceful. we're not seeing that happen right now here on the streets of midtown manhattan. de blasio confirming he spoke with attorney general eric holder within minutes of the grand jury investigation and the investigation is underway. >> i received a phone call from u.s. attorney general eric holder and u.s. attorney loretta lynch. they made clear that the investigation initiated by the u.s. attorney would now move forward, that would be done expeditiously, and it will be done with a clear sense of independence, and that it would be a thorough investigation. >> and again, president obama just weighing in on the staten island grand jury's decision. listen to this. >> some of you may have heard there was a decision that came

out today by a grand jury not to indict police officers who had interacted with an individual named eric garner, in new york city. all of which was caught on videotape, and speaks to the larger issues that we've been talking about now for the last week, the last month, the last year, and sadly for decades. it is incumbent upon all of us as americans, regardless of race, region, faith, that we recognize this is an american problem and not just a black problem or a brown problem or a native american problem, this is american problem, when anybody in this country is not being treated equally under the law, that's a problem, and it's my job as president to help solve it. >> former obama justice department attorney christian adams among our guests here

midtown manhattan. sixth avenue which runs right near the rockefeller tree, that lighting is tonight, it's supposed to happen in one hour from now. they began downtown, other parts, times square, but the protests, remember mayor de blasio encouraged people to protest over the death of eric garner. let me catch up and this is very much a new york city story. there was no indictment in the death of eric garner. the case that happened on staten island several months ago. a staten island grand jury voted not to bring criminal charges in the death of eric garner. he died after being placed in a chokehold by a white police officer caught on tape. and video we've shown you many times. it was caught on tape. officer that performed the chokehold daniel pantaleo gave testimony to the staten island

grand jury, an autopsy had been conducted on eric garner by the city's medical examiner and they ruled it a homicide, resulting from that chokehold and the compression of his chest, and in the video you can hear mr. garner say i can't breathe, i can't breathe. i can tell you from firsthand knowledge because i was watching the protests, many were saying yes, indeed, i can't breathe, they were chanting i can't breathe. anyway. i'm being told that we're waiting for any moment now, attorney general eric holder, u.s. attorney general eric holder, the live shot at d.o.j. fox news confirming that eric holder is going to announce a civil rights investigation into the death of eric garner. a civil rights investigation that has been confirmed by department of justice official to fox news. we're going to of course monitor several of those that

we're watching, monitoring what's happening in new york city and, of course, monitoring attorney general holder's announcement. fox confirming there is a civil rights investigation into the death of eric garner. let's turn our attention to another top story we're following for you. 17 states attorneys general filing a lawsuit to stop president obama's executive actions to grant amnesty to millions of illegal immigrants. greg abbott leading the charge claiming the president's move is unconstitutional. fox news correspondent casey stegall is live in dallas, texas with the latest. >> reporter: good to see you, texas is leading this coalition of 17 states total. 16 states and then one of course being texas. so 17 total challenging the constitutionality of president obama's controversial executive actions on immigration. so this lawsuit was just filed earlier today in u.s. district court in texas, republican state attorney general and governor elect greg abbott believes more states will join

in. at issue is whether the president will have full legal authority to bypass congress and shield as many as five million illegal immigrants in this country from deportation. abbott says most everyone agrees the immigration system is broken, but says the executive fiat mr. obama pulled out is not the right way to fix it. >> he himself is saying she not trying to fulfill the will of congress. instead trying to enact laws himself because congress will not act. the president does not have that authority. >> reporter: but the president and his administration have stood by the legality of the executive actions. homeland security secretary jeh johnson was testifying yesterday before the house homeland security committee saying he is, quote, fully comfortable with the executive branch having the authority to implement the executive actions. >> and i'm satisfied, as a lawyer, myself, and the person who has to come here and defend

these actions, that what we have done is well within our existing legal authority. >> reporter: this slaughtnot seeking any damages, we should point out, instead, they're seeking an injunction to stop the executive actions from taking effect. this is a rather large development to be continued on how this lawsuit pans out. cheryl. >> casey stegall reporting live out of dallas, texas. thank you very much. over on capitol hill, the house overwhelmingly voting to extend $45 billion worth of expiring tax breaks through the end of the year. it's just one piece of business congress has to address before the lame-duck session comes to a conclusion next week. mike emanuel is live with our report. >> a huge bipartisan vote. 378 to 46 to provide relief to taxpayers and businesses. there is frustration they cannot do more now. hard working taxpayers deserve

to know whether these tax policies are there year in and year out on a permanent bases. >> reporter: facing a massive retroactive tax hike house with a price tag of $45 billion. >> america's small businesses and taxpayers are looking for congress for certainty before they file their taxes in april of 2015. >> reporter: lawmakers expressed disappointment with another temporary fix. >> this bill says to the american people that congress is up to its old tricks. meet the new congress, same as the old congress. congress says one thing, we need tax reform, but congress does another. kicks the can down the road. >> reporter: senate majority leader harry reid working on a 10-year package with house republicans which died after president obama issued a veto threat irritating speaker john boehner. >> the president killed them,

period. >> reporter: reid sounded cautious tuesday about the smaller fix. >> take a look at it and see what else they have in the one-year extension. >> reporter: for individual taxpayers mortgage debt forgiveness, higher education reduction and state and local sales taxes are included. there is extension of r&d credit, benefits for renewable sources and credit for hiring qualified veterans. speaking at the quarterly meeting of the business roundtable, president obama favors a temporary extension and eventually something permanent. >> more broadly, we'd like to see if some of the tax extender provisions, including things that i strongly support like research and development are incorporated into a broader comprehensive tax reform package. >> reporter: to do that, the president will need to work in a bipartisan fashion with the next senate majority leader, republican mitch mcconnell whom he met with privately at the white house today. as for the tax extenders,

democrats in the senate prefer alternative plan, with time running short before the christmas holiday, all indications senators vote on the house passed plan next week, cheryl. >> mike, thank you very much. former health and human services secretary kathleen sebelius is admitting obamacare's role that was severely botched. >> i was a ceo of a big company with an important program, and healthcare.gov promised to work smoothly, to work like you were buying an airline ticket, you know, using your app on your computer and instead it worked like buying an airline ticket on a fax machine. >> sebelius is rebuffing claims that m.i.t. professor jonathan gruber was integral to the process of creating obamacare. >> is he somebody you met with a lot? >> i did not. i know our staff did and i think he met with various advisers but i did not meet

with jonathan gruber. >> never? you never met him? >> maybe in room, a large room, he could have been on a phone call. in terms of small meetings, discussing policy, that never happened. >> gruber is set to testify before the house oversight committee on the series of videos where he claimed obamacare passed thanks to what he called the stupidity of the american voter. meanwhile, another democrat is expressing buyers remorse over obamacare. outgoing democratic senator and obamacare co-author tom harkin telling the hill, quote -- harkin's comments a week after the senate's third ranking democrat senator charles schumer called obamacare a mistake. >> we took their mandate and put all of our focus on the

wrong problem. health care reform, but it wasn't the change we were hired to make. americans were crying out for the end to the recession, for better wages and more jobs. not changes in health care. >> one small bit of good news, health care spending in the u.s. grew last year at a rate of 3.6%. that amounts to about 2.9 trillion dollars or $9200 per person. that increase was actually slower than the 4.1% growth we saw in 2012. we're coming right back. the incoming senate majority leader gets audience with the president as the house republicans try to close out the lame-duck session without shutting down the go

. cheryl: we continue to follow the breaking news here in midtown manhattan. you're looking now at live pictures of midtown manhattan. this is just outside a fox news headquarters, 48th and 6th avenue, midtown manhattan. this seam that you're seeing is the result of a decision made a couple of hours ago. the staten island grand jury declined to indict an nypd

officer for the chokehold death of eric garner. the rockefeller christmas tree lighting is also taking place across the street from these pictures that you're seeing right now in midtown. this has created an incredibly chaotic scene. we're in the studio, we can hear noise from the streets inside of the studio. this camera right now is a fox roving camera that we placed outside on 6th avenue to give us a sense what's happening on the ground. it seems -- we've been watching the pictures the last few moments -- things are starting to calm down. they knocked them down and flooded 6th avenue. police seem to have things under control, nypd, so you expected large crowds in midtown manhattan for the tree lighting, then the eric garner decision came down and protesters began to flood into this area. obviously, they knew they were going to get attention, and they've had it. so we're going to continue to monitor the live pictures and

want to let you know we're monitoring what's happening in washington. waiting on this announcement from attorney general eric holder, he has not come to the podium. there is the podium at the d.o.j. in d.c., and we have confirmed this here at fox, they're going to launch a civil rights investigation into the death of eric garner. a lot happening in midtown manhattan and washington. let's stay in washington. president obama remains confident that the current congress will avoid a government shutdown of passing a new spending bill before the current one expires on december 11th. >> no one benefits by the government shutting down, and it is entirely unacceptable for us not to maintain the full faith and credit of the united states government. we just cannot afford to engage in that kind of brinksmanship that we saw over the last couple of years. cheryl: here to discuss the latest wrangling on capitol

hill congressman jack kingston, representative thank you for being with us tonight. a lot has been happening in the last few moments we should say. let's talk about the gop leadership on the house side. there seems to be a little argument going on within your fellow republican congressmen and women how to best deal with the rest of the session before everyone leaves for the holiday break, do you think that there is cause in the house to frankly block the government bill and end up in a government shutdown. does that make sense to you? >> i think what's happened is the president after the election wanted to take a play out of clinton playbook, and what that did is when the republicans took over the house and the senate, clinton was midterm on the government shutdown came and clinton was relevant again. i think what president obama has tried to do with his immigration mandate, the executive order is dared us to

defund it and shut down the government in the process. that way he could become relevant again, and i think that what our leadership is doing is saying let's resist taking that bait. let's have the fight. we're going to pass a bill probably thursday authored by representative ted yoho, what you've done is illegal. in all likelihood, the senate is not going to touch that. we will short-term fund the department of homeland security which will allow the new senate and congress to take it up. that's the reasonable step that we will take. cheryl: okay, so stay within reason, obviously if you try to bring up the issue of funding on the immigration side, that doesn't make sense because the overall funding bill doesn't affect funding on that side of the coin, correct? >> that's right. there's an argument that says since that's a fee based program that we cannot defund it. now i don't agree with that 100%, they're actually within

the bill they're considering, 16 other fee based programs that we are addressing and modifying. to say we can't do anything is not completely accurate. i believe that there is flex niblt flexibility in there. should we wait for the calfary arrive. >> let's move to something else here, you're in favor of extending, a lot of corporations and small businesses are watching this. you're in favor of extending the $45 billion package to the end of the year. john engler who heads the business roundtable says it is unworthy of the world's greatest economy to have a tax code for two weeks and january expire all over again, what do you say on the issue. >> i think everybody agrees with him. we did not want to have a retro active one year tax extension,

and as you know, the senate democrats and the house republicans did try to do a 10-year package. it was the white house that torpedoed that. when the white house torpedoed that we did not want to leave the middle-class families and the businesses in a lurch. we have to do this in a short-term measure. one thing i'm encouraged with in the house and the senate is to have total tax reform. paul ryan talked about let's reduce the corporate tax rate in america to the level our competitors are at, moving it from 35 to 25% and let's look at the other taxes that we have and see if there's a better way to simplify our tax cut. that would be what we want. and you played earlier democratic congressman peter welsh calling for that. i think you would find bipartisan unity. cheryl: we listen to the president today speaking in d.c. and he basically said that corporate tax reform was on the

president george w. bush karl rove and fox news contributor. karl, great to have you here tonight. what do you make of the "gallup poll"? >> well, traditionally in the aftermath of big swings like 2002, towards republicans, 2006 towards the democrats. 2010 towards the republicans. there tends to be a change in the partisan identification, the party that won the election becomes more popular. how long the popularity lasts depends how well they do in subsequent months. how well the republicans do in january, february, march and april could have a big impact determining whether the republicans go into the 2016 with a head of steam up or not. cheryl: you are the one who seems to me it's timing for the announcement. whether it's hillary clinton or jeb bush or chris christie, take a pick of the names, politico is reporting she's got cold feet. what do you make of that? >> i've always thought this is a more difficult decision than

most people think. she'll be 69 in october of 2016, if she were to be elected and serve two terms, he would leave office at the age of 77. do you want to go through two years of running for office after you finished being secretary of state, have a new grandchild, a husband not in the best of health. is this really what you want to do? but on the other hand, i think probably this is more likely to be hillary clinton finally making a smart political decision and realizing a shorter campaign is better for her. there's no need for her to rush into this thing, declare herself a candidate. i think she made a terrible mistake putting out the book this year and tossing herself into the 2014 election. was there a single candidate she rescued on the campaign trail? a big mistake for this year, this is politically smart, slow it down, slow it up, lower exposure, lower visibility, plan your effort a little better, recruit a little more,

lay the predicate a little stronger and rest up a little bit and burst out of gates sometime in spring or early summer. cheryl: well, do you have any idea what they're thinking in the jeb bush family right now? >> i don't. i do know this, i've had -- i went to work for the senior bush for 41 when i was 22 years old, and obviously know 43 well. there is something about the bush men, when they say they're going to make a decision, i saw this with 41 in 1978, i saw it with george w. bush in 1998. when they say they're going to make a decision at a certain time. they make a decision at a certain time. take jeb bush at his word, he's going to make a decision after the first of the year. that means he's not going to make a decision in november, not going to make a decision in december. may not make a decision in january. he can wait a little bit of time. my sense is we're likely to see a decision by him exactly when he says he's going to make it,

sometime early next year. cheryl: i have to say the "wall street journal" ceo council survey shows 73% of ceo's back jeb bush as the 2016 gop nominee, karl. >> yeah, look, my column tomorrow in the "wall street journal," i talk about the invisible primaries that are going on right now, and one of them has to do with raising money, and i think this is indicative of the strength of bush. there are four candidates who would have the ability to raise money. chris christie and jeb bush would be the two strongest of those because they have networks, and a lot of the ceo's who work the rolodexes and call friends and family and ask them to write checks would likely be in his corner. cheryl: karl rove, so great to have you this evening. we have breaking news out of washington of all places. karl, thank you very much. >> you bet. cheryl: we promised you we would monitor what's happening in d.c. we're getting word that in just a few moments we're going to see department of justice, this

when we get more information. the reverend al sharpton is expected to come out and he'll be joined by, we're told, eric garner's mother and eric garner's widow. he has been in close contact with that family today. not only was the reverend sharpton in contact with family, also was speaking with mayor de blasio in new york city. we're monitoring a lot of different break developments tonight. so don't go anywhere. let's bring in christian adams former u.s. department of justice attorney who served under presidents bush and obama and the author of the book injustice, exposing the racial agenda of the obama justice department. i tell you, you tell me where you want to start christian. a lot has been happening in the last few moments. your thoughts in the eric garner case? >> folks need to understand something, this is not news. the justice department opened up a review in every single case like this.

they don't always have a press conference. they don't always console with al sharpton but in every single case like this, there is a federal review of what happens. so what you're seeing is holder harvesting as much attention as possible for doing what the justice department always does. cheryl: so there's always a press conference. there's always an investigation launch like this. frankly it surprises me, and i care to disagree for just a moment, the president came out and spoke about eric garner. we've had all the protests in ferguson and violence in ferguson and now this. what does he have to gain by bringing attention to the eric garner case. loretta lynch is anything to be replacing him at some point. >> what he has to gain is making his political base happy by make the groups that are very involved in these issues happy. what he has to gain is deflecting attention away from the very bad civil rights case in ferguson. i reported i think on the show

last week the justice department sources tell me there is not going to be a federal civil rights case because the evidence doesn't exist. but now -- cheryl: watching the civil rights investigation. why waste taxpayer money on an investigation if it ends up the same way that the staten island grand jury ended up today, no indictment of the officer who is on video administering a chokehold to eric garner? >> i'm not sure the staten island case is going to end up the same way as ferguson. this is standard operating procedure to open up a review. what holder announced with fanfare is like announcing they turned the lights on at justice department. they do this in every case involving a police death like this. cheryl: well, let's get your reaction to -- i'm note going to talk about al sharpton, all on the heels of what we saw in ferring pentagon and a lot of major issues happening right now with regards to ferguson and still a lot of unrest down there. do you think that between the ferguson protests and the

garner protests tonight, do you think that the president is going to come up with a new strategy to deal with racism in this country, and the fact that many african-americans believe they are not respected or treated equally when it comes to civil rights? >> well, holder has given us a hint as far as what's coming. he's promised best practices guidelines from the civil rights division to give to local police departments. ironically, the sheriff in milwaukee said no, thank you, we're not going to follow them every way. we don't live in a country that the federal government dictates to the local police. what we can expect the justice department to do is to come up with best practice guidelines, which i can tell you if it's written by the people i used to work with at the civil rights division, the best practice guidelines will be very much anti-police. that's the perspective of the lawyers who will be writing the guidelines. >> if you look at nypd manual, chokeholds are not part of the

to be running with the iraqis, it would be virtually impossible to know that iranian aircraft are flying across the border bombing isil. you would know that. perhaps with the delicate relationship with iran, vis-a-vis the nuclear talks and the like. no doubt, iran is happy and, yes, the enemy of our enemy is our friend. cheryl: so, there's a report on the hill and the white house coming out just today and saying that they will not cooperate with the iranians, but can you foresee a time depending how strong isis gets and how much of iraq they take over, you can see a time we would have no choice but to start to converge with the iranians who let's be honest, the proximity is there to iraq and bring in the turks and bring in even parts of the syrian government. i know that sounds horrible, but that might be where we're headed with all of this. >> the quagmire is certainly a mess, but, yes, if you're a

and they are saying that we messed this up. are you surprised at all by that statement? >> not at all. here is an example of the unintended consequences. when you have a massive effort that did not involve the right types of compromise with republicans, though it is a difficult and arduous process, it tends to lead to better policy and you have a program that everyone can conclude, raise the premiums and other things, making it different for businesses to grow. everyone realizes that this particular system that he wanted to be the hallmark of the legacy is the most difficult to unravel and to fix. and so that is going to be what people remember about the president's effort. cheryl: you also have kathleen sebelius coming out and saying that she didn't know him. he has been the center of the

firestorm saying that they understand health care and now they are denying that they knew them. >> welcome i think that if she didn't know him we have a problem because we just paid $400,000 to be an architect of this program so that it would be replicated with the romney care plan that was a state program on a national level. which very few people and maybe only the president makes that much money. but in government, people should know that no one makes that on capitol hill and people don't make it in the treasury, even if you are a close adviser, you're not making that kind of money. so there's a big amount. so if he and kathleen sebelius working together, maybe that was a problem. but looking at the democrats coming out and being critical now, it's been four years and

excuse me, the officer came out and said he regrets a situation and he apologizes. and that is what is cast over the city right now, there is a lot of regret. but there was not a racial undertone to this in the case that there were no epitaxy used, there were a lot of things that they could see on camera, discrepancies on what should happen. but i think that is a part. the newark police department officers have done a lot to protect a lot of people who have come to the city and that is a point that shouldn't be neglected. >> i have about 15 seconds. is there concern that new york becomes the next? >> in this case i think people will think that this is a lot more unfair because this is a video and he has not just ripped off a convenience store, he was selling untaxed cigarettes in the street and said he couldn't breathe. the ramifications in the case will be more unrest.
