welcome back and thank you. go to a webpage for our live show after hours at fox business.com. mod we will be there and just moments.how have a good night next. lou: good evenings everybody, renewed fears tonight about muslim extremist violence and attacks after a lone a radical islamist took 17 people hostage at a cafe in sydney, australia. the crisis ended this morning after more than six teen hours. the police raided the cafe after they heard gunshots. after it was all over the iranian gunman and two of the hostages were he had d authorities have not given the media any details who shot the gunman or how the hostages died. australia's prime minister just moments ago went on television to tell his citizens that the gunman was well-known to the country's law enforcement. >> he had a long history of

violent crime. infatuation with extremism, and mental instability. we know that he sent offensive letters to the families of australian soldiers killed in afghanistan. and was found guilty of offenses related to this. >> here at home it was police officers under attack as demonstrators took to the street in new york city, washington, d.c., and boston to protests the deaths of michael brown in missouri and eric garner in new york. the march billed, as a million march but just over 20,000 people showed up in all three cities. and in new york, protesters actually called for the deaths of police officers. >> dead cops. when do we want them. >> now. >> dead cops. lou: we'll taking all of that up on wall street. stocks falling after market's worst week in more than three

years. today's 100 point plunge on the dow, as crude oil prices continued their six-month selloff. a global crash that has seen the price of crude cut by almost half. we'll analyze what's behind that tonight. but we begin with the hostage crisis in sydney and concerns that there was a long list of missed warning signs leading up to the attack. position news chief intelligence correspondent catherine herridge with our report. >> within hours of the siege the suspect's online presence was reportedly include ad pledge of support for isis was suspended. well-known to australian authority, man haron monis or as he calls himself, sheikh monis. accused of killing his ex-wife. the iranian board suspect was charged with the 2000 two sexual assault after woman, stemming from allegations of multiple

lou: thank you, catherine herridge. police in pennsylvania are searching for a former marine reservist suspected in the shooting deaths of at least six people at three houses in the philadelphia suburbs. they were shot and killed before dawn today. investors don't know how bradley william stone is moving around but he is suspected of killing his recently-engaged ex-wife and several members of her family. on capitol hill the threat of a government shutdown is off the table. after the senate cleared a trillion dollar spending bill late saturday night. president obama who joined house republican leaders in pushing for the measure now expected to sign it by wednesday. but the legislation's passage was not an easy feat. conservative republican senators ted cruz and mike lee tried to delay the proceedings by calling for an up-or-down vote on president obama's executive actions on amnesty for illegal immigrants. their effort was rejected.

74-22. and democrats took advantage of the extra time they had to spend in washington to advance dozens of the president's nominees. still, senator lee today defended their manuever. >> when we have a president who engages in acts of lawlessness and behaves as if he were a government of one it is always worth it to stand up for the american people and get a vote whether or not the president should have taken that action. >> by the way just moments ago, the senate voted to confirm dr. vivik murthy as the country's new surgeon general, more than year after president obama nominated him. his nomination was held up over his outspoken opposition to gun rights. >> no new signals tonight as the republican put it that jeb bush is seriously considering running for president in 2016. he announced over the weekend he plans to release more than 250,000 of his emails from his two terms as florida's governor.

lou: homeland security secretary jeh johnson in south texas today. there he inaugurate ad 50-acre detention center that will hold as many as 2400 illegal immigrants caught crossing our southwest border.

johnson used the occasion to tout the president's amnesty plan. he claims it gives his department a chance to get serious about border security, freeing it up to put more resources on the border as they put it. and, our next guest says is very serious about border security and entire issue of illegal immigration. holeds that the president's fiats and executive orders are flat-out unconstitutional. joining us tonight is senator david vittert a member several key committees including armed services and in the next congress it has just been announced that senator vittert will also be joining the judiciary committee. he is chair of the senate border security caucus. always good to have you with us. >> great to be with you, lou. thanks for the invite. lou: let's talk about what happened over the weekend in the sense that cruz and lee were slapped down pretty mightily by the senate on their efforts to hold the president accountable

for that fiat. your thoughts on the fact that the president has not been actually in any significant way challenged by the house or the senate, this senate at least in his executive fiats? >> well, i think it is really a shame republicans split on that vote. a lot of folks split on sort of a technicality saying, well it was a constitutional point of order and the spending bill was not unconstitutional per se. the spending bills are unconstitutional in his actions. i think that is splitting hairs too finely. reality we are far more united against executive amnesty as that vote shows. we'll have a chance to show that next year. i'm for fighting back any way possible against this unconstitutional action. lou: with your appointment to the judiciary committee in addition to all your other prestigious and very important committee assignments, the house

judiciary committee reported out four bills to the house. >> yeah. lou: i support those four bills. i have said point-blank, that legislation represents leadership on the part of the republican party. >> yeah. lou: on the issue of illegal immigration and border security. why could that not be the initiative that republicans in the house and senate combine to drive forward as true, viable, reeffective reform? >> i think it can be and i'm hopeful it will be early next congress. one avenue i'm pushing, we need to do a bunch of things at once, but one avenue i'm push something strong pro-enforcement legislation like that. i think we move forward with that in the house and in the senate. we should put those things on the president's deck. that is one goal of mine. i think we need to do other things at the same time. one thing i've announced i'm going to oppose this new attorney general nomination that. will be on the judiciary committee for hearings to oppose it because that person would be a key person in the obama

administration helping president obama implement his illegal, unconstitutional executive action. lou: and, on loretta lynch, in opposing her, what is the practical effect? will it, is there sufficient objection to her to, to avoid -- void her as the president's nominee? >> lou, we don't know yet. i hope there is. there certainly could be if voters help us focus on this travesty of executive amnesty, that is flat-out unconstitutional. it would also help if we went back to the 60-vote rule for executive nominations in the new senate. both of those things are a bit up in the air. lou: no question you're one of the most talented and experienced and brightest people in the senate and -- >> i can point to a lot of folks who would argue with you but i appreciate your opinion. lou: imagine that, a politician

with detractors. but your alliance with elizabeth warren, joining forces for her to remove the financial regulation roll back under dodd-frank, that was an alignment people really got their hair on fire about. >> well, i know it surprise ad lot of people. it really shouldn't if folks followed my work in terms of too big to fail. for instance i've been working with sherrod brown for a couple of years now to try to truly end too big to fail including by having much higher capital standards for megabanks. this was a similar related issue and i don't think that taxpayer should be basically subsidizing risky behaviors through fdic insurance and that's what this issue was about. lou: to put it in vastly oversimplified language, what the senator is referring to is rollback of legislation that now permits fdic-insured institutions to maintain

derivative trading within their corporate structure which means that the fdic is the senator just said, will be insuring what would be a rick that dodd-frank did not, did not anticipate or, point of fact, tried to remove from the legislation. >> lou, if we had blocked the rollback, as you know, those derivatives could still happen. they just wouldn't be under fdic insurance umbrella. would not be essentially subsidized by the taxpayer in that way. so they would have been more properly priced in the market somewhere else. lou: and, senator, as you look toward the year ahead of us, do you think that this is going to be a constructive, effective senate and house that will be able to do, to do business with this president who refused to compromise through the first six years? >> well, first of all moving beyond the harry reid senate has to be constructive around

our new multi-health wellness line. ♪ lou: coming up tonight, violent end to terrorist hostage crisis in australia. general jack keane will be here to talk about global radical islamic terrorism, lone wolves and impact of the islamic state. that is coming right up. first a few thoughts on one of this country's key allies and our closest ally certainly in the middle east. secretary of state kerry today met with israeli prime minister netanyahu. their meeting comes as the obama administration is apparently divided how to respond to a large number of countries led by france and jordan that are pushing hard for a u.n. resolution. the french draft would, we're

told, remove israelis from ground one in the 1967 war and set a time frame for the creation of a palestinian state. and given certain conditions, mr. obama is in concurrence. at the same time, in a rare contemporaneous set of bilateral talks, senior u.s. officials are meeting with iranian officials. under discussion, cure tating iran's nuclear program. that bilateral discussion comes just two days ahead of full nuclear negotiations with world powers and after having already extended a deadline for a deal to be reached, to july. unnamed obama administration officials say we should expect a deal with iran sooner, rather than later. this while u.s.-israeli relations are icing over. it was less than two weeks ago that the white house refused to confirm or deny reports that it is weighing sanctions against our ally in the middle east over building settlements.

>> very clearly not denying we have strong concerns about settlement activity underway in israel but it has not and will not affect the united states strong commitment to the national security of the nation of israel. >> it took two days for the white house to, clarify its position, to right itself, calling reports of sanctions, quote, completely unfounded and without merit, end quote. and it required nearly 50 house republicans demanding that the white house give israel strong public support instead of making public threats. the obama white house still resists new, stronger sanctions against iran and seeks half-measures that may give the administration a basis for at least a public relations claim to historic deal with iran. but which would surely dishonor america's special relationship with israel, jeopardize israel's ability to determine its own future, and, bolster iran's capacity to destablize the entire middle east.

reality. i am not suggesting that you have to do nation building, but the fact is that the enemy chooses the form of war and not us. lou: we have even allow the creation of doctrine. but we have some generals talking about this and creating doctrine that insist upon patience and carrying out war which seems to be the inverse of what we learned and the anon, which is not to move the forces unless we can extricate them after achieving victory. and this is a difficult time for the military and it has much to work out. >> yes, it does. the military, particularly ground forces have been captivated by the president and congress and this incredibly

significant drawdown. it is beyond making a mistake and is quite reckless. to get to your point, wars in and among the people are complicated and they do take some time, it doesn't mean that you don't go after it with urgency and commitment and resolve and trying to bring it to completion as soon as possible. and we haven't begun to train and arm the sunni tribes. we just announced that we are not even going to be in iraq and syria, we are not even going to begin to deal with the syrian army until sometime around march. so this patience is a lack of commitment and resolve, that's what it translates to. there is no sense of urgency. lou: there seems a great urgency

and creating a deal almost any deal on any basis. especially when we project this with iran. this looks like an extraordinarily dangerous time for the region and for israel and for ourselves and the rest of the world. >> they are permitting the iranians from any analyst perspective from having far too many centrifuges and it's quite successfully, because we are sitting at 19,000 centrifuges and i understand that they had a

lou: stocks closing lower common the dow jones down 100 points. close to 100 as you can get. the s&p 500 down 13 points come in the nasdaq dropping 48. volume on the big board 3.4 billion shares. crude oil plummeting 44th straight session, settling below $56 per barrel. when did you think that you would see that number six months ago? the falling crude oil prices sending gasoline prices up 81

straight days. the national average for gasoline is $2.55. that's wonderful. the lowest level in more than five years. and that includes taxpayers and consumers and sabers, we have john lonski with us. fox business contributor. good to have you here. we are looking at a billion dollars worth of savings here. almost every minute. >> for the consumer it's great news. and most people are spending most of their money on holiday shopping after cybermonday. the consumer is procrastinating.

the gasoline is dropping and there's more money in their pocket and they're going to go out and spend even more. we saw that. >> it raises the possibility of that we could look an unexpected growth for consumer spending as well as gdp in 2015. and this happened when we had weakness overseas that helped to drive oil prices lower and the real gdp grows by more than 4%. real consumer spending by more than 5%. in part because the said was forced to cut rates in the second half in response to global problems. >> we're talking about 2% monier and this is the absolute inverse

of what all the experts were telling us just a couple months ago. >> 1.8%, don't be shocked if we end up there under 2%. >> what are we seeing in terms of this? we are talking about the savings from gasoline. we are not seeing great excitement about what the retailers are bringing to the

table when this holiday shopping season ends. >> i think that the purpose in the earnings reports as we will see the next couple of months. what i wanted to point out is that when we see a drop in oil prices, we would start to see that. at the same time even businesses are going to start benefiting from this. when you see a drop in oil prices, it becomes cheap to manufacture things. this only bodes well for the small business. you will start to see hiring go up as well. lou: i hope you are right. that's a lagging indicator in this economy that as you suggest is showing signs of vitality. but here's the question. why do we have all this talk about raising interest rates into this? it looks to me when we look at europe or china, we are talking about inflation. when we look at this country, we are looking at the prospect of exactly the same thing, disinflation in this country.

>> when you broaden your horizon it makes no sense to be worried about a rate hike anytime soon. i want to see the world economy so that we can find that the financial markets apart of this. lou: you have to jump on the yield spread. >> that sets 550 basis points rights. and that was june 2004, february february 1994 -- the yield prices were high. >> maybe not anytime soon, but the duty of gdp is getting better. >> in 1998 the fed cut rates. lou: the idea that there is some sort of foregone conclusion, but they will raise the rates, which is part of a lot of strategies on wall street. it's absolutely idiotic because it would be a disastrous impact.

that republicans get the fact that they better focus on the middle class this time? the 1600 page bills are going to fly all the time. if they play that game, they are going to be dead in the water. >> the longer the bill, the less likely they are to help in the middle class. but the working class voters hep republicans and they didn't do as well with mitt romney at the top of the ticket. and so that is what happens when he wants more accessible. so instead of saying i'm one of you, they put on their mom jeans. lou: let's take a nonracist and ask jeb bush. he has had a start at telling folks that he's running for president and this is his fourth
