a deal by late march, and there is apparently so much obvious pressure that iranian media portrays the united states as desperate for a deal. also here tonight, critics blasting president obama all last week as an apologist in chief, saying his refusal to acknowledge radical islamist terrorists would only embolden them. now with only two days into this week the administration yesterday warning of al-shabaab terrorist threats against the mall of america, and today the islamic state has kidnapped at least 150 christian men and women and children from a number of villages in northeastern syria. we'll be taking all of this up tonight with former pentagon official k.t. mcfarland here in moments. senate majority leader mitch mcconnell came up with a plan to save republicans from themselves allowing the gop a graceful exit from the department of homeland security

funding fight. >> i've indicated to the democratic leader that i'd be happy to have his cooperation to advance the consideration of a clean dhs bill, which would carry us out through september 30th. lou: mcconnell saying the senate will hold two votes, one to fund dhs, and one to defund the president's amnesty fiat for illegal immigrants. but is mcconnell giving democrats just what they asked for, and will the house agree to what some see as a surrender? we'll be taking it up tonight with house republican party policy chairman congressman luke messer. he's joining us tonight. we begin with the administration's flailing foreign policy. president obama today meeting with the amir of qatar offering an update on the iranian nuclear talks that may not assure arab allies or israel.

>> i gave the amir an update and assured him that our goal here is to be able to verify that iran does not have a nuclear weapon. lou: the president's comments come just one week before benjamin netanyahu's address to congress, an address being snubbed by the administration. joining us tonight, former pentagon official fox news national security analyst k.t. mcfarland. good to have you with us. let's deal first with these revelations, if they can be confirmed, from the iranian opposition group, what do you make of them? >> iran needs three things to have a nuclear weapon. it needs the fuel enriched uranium or plutonium. a missile to deliver a nuclear weapon and a blueprint to pull it altogether. what the supposed deal does is maybe it restricts some of the

enriched uranium, it doesn't do anything about the plutonium fuel or the missiles or stopping the blueprint. iran is on the verge of being a threshold nuclear state. the president from day one of presidency, from inaugural address, lou talked about wanted to have a relationship with iran. i think he's convinced by the end of his presidency he's going to have a summit meeting in tehran and do whatever it takes to get it. as far as nuclear weapons? iran is good at pretending they're not building them, and we're going to pretend to believe them. lou: there is difficulty with that. the iranian opposition group saying they have evidence they know for a fact that iran has another facility, buried deep underground that has not been detected to this point. how much credence do you give their report? >> lou in the past we have found that iran has done this several times where, they've had underground fassacilities.

some of the facilities have been denied by the iranians and the u.n. inspectors iran has a track record of doing this deceptions. it's probably a highly credible thing. even if it's not credible iran is not going to stop even by the obama agreement, the plutonium reactors. all those things added together, the president is going to leave the middle east and say iran, you're in charge we're going to lift the sanctions, you're going to have a powerful economy and a threshold nuclear state. you're going to run the table. lou: you truly believe that is his intent? >> he said it on day one, lou. of the inaugural address he wanted a relationship with iran, and at every step of the way, he has been willing to throw israel under the mats our americans traditional allies under the bus he wants the deal with iran and going to get it at any price. lou: let's turn to another

thing he obviously is not being so transparent about, and that is his refusal as expressed in three days of the so-called summit on on violent extremism. he refused to acknowledge and said outright this war with the islamic state and radical islamists has nothing to do with religion. today is word that 150 christians were captured and taken hostage by the islamic state in northeastern syria. that looks like a strong indication of an ideological conflict of a religious war in fact. >> don't take it from president obama, take it from the muslim leaders in the region. the president of egypt went to the university, the vatican of the islamic religion and said it's your problem, you have not called out, you have not said what a radical islamist is.

you have not condemned it. the grand mal of the university went to saudi arabia where they're having a conference on extremism and violence and said we need to reform the religion, we have to condemn this twisting of our own religion. even though president obama is blind not going to admit it and see it for what it is the rest of the world does and particularly the islamic world. lou: k.t. mcfarland good to see you. thanks. president obama vetoed a bill approving construction of the keystone pipeline. the president had vowed to veto the bipartisan legislation and he did. the president's audacity undiminished, claiming he vetoed the bill because it quote cut short thorough consideration of issues that could bear on our national interests, including security safety and environment. mr. obama is indeed a very careful man because his administration has been considering those implications

and some kind of a vote on columns. the problem is i'm waiting to hear from the speaker, we have to make sure that people understand the bicameral nature of this congress that we serve in, so to have senator mcconnell pass the ball over to the house isn't going to do the trick. lou: our next guest says the latest senate strategy gives the president the opportunity to fund dhs and veto legislation that would stop executive amnesty. joining us is congressman luke messer, the chairman of the house republican policy committee, also serves on the financial services and education workforce committees. good to have you with us congressman. it sounds to me like senator reid and his colleagues there schumer and durbin, mean to sort of slap boehner around a little. what do you think? >> it's kind of ironic to hear harry reid showing so much

respect for the institution after the way he blew up the filibuster over the course of the last couple years. you know, lou, the american people spoke in the election of 2014. no issues big or the debate than the question whether we should allow the president's immigration reforms to move forward. after the election the president decided to double down and issue executive orders that i believe are unconstitutional. the house has acted. we voted to both fund the department of homeland security and to not allow the president's unconstitutional actions and frankly, we need to stand our ground. lou: stand your ground, it's too late to that as far as senator mcconnell is concerned, and it makes it pretty clear. somebody is doing somebody else's bidding, because as you say, the midterm election are significant. the republicans won by historic historic levels, and somebody seems to be either

listening and take their their orders from the chamber of commerce or the business roundtable or some other entity because it sure isn't the american people as you just said? >> yeah, and add into that the district court ruling from last week where the district court judge says the president's actions may well be unconstitutional. seems there is nothing unreasonable about not funding actions that may be unconstitutional. the compromise is shouldn't fund these things until the court determines they ought to be allowed. the house i believe is on strong footing. i think they will have a difficult time passing any kind of clean funding bill through the house. lou: you're going to have a -- your caucus will meet tomorrow you're going to get some indication. have we got speaker boehner's words so everybody can hear how we responded to senator mcconnell and his decision to bifurcate the bill into funding

dhs and defunding, in a separate bill the executive fiat amnesty fiat. boehner saying this, quote -- . lou: now, do you find that an acquiescence to the mcconnell approach, congressman? >> well the speaker has a hard job, i would say this, the american people didn't send us here to highlight hypocrisy, they send us to stop the president's overreach, his unconstitutional actions, and that's what i think my colleagues in the house want to stop this week. that's certainly what i will be working to do. lou: this is a direction, i think, a lot of a lot of americans are going to be very disappointed in the direction,

having won control of both houses the direction of which the republican party is going, don't you think? >> well, lou, you know when this strategy was set out a few months ago our promise was we would fight tooth and nail to stop the president's unconstitutional overreach. we've got a district court opinion saying the actions may be unconstitutional. i think we need to continue to stand our ground. this is serious business, no one wants to see the department of homeland security shut down. that's why the house has acted. acted to make sure we fund the department of homeland security and stop the president's executive action frankly given the district court's ruling it seems there is nothing unreasonable about not funding those activities. lou: do you see anything perhaps strategic and of a different purpose, on the part of the republican party, as expressed in the senate the house, the republican national committee, perhaps as well. in that there has been no

attempt to create a message on the filibuster of the democrats against the dhs funding bill in the senate. there's been nothing but crickets on this but at the same time, the president and reid and every democrat is beating you guys over the head trying to blame you. there's no republican response there's no republican message. and the message would be very simple. the democrats and filibustering the funding bill are putting the executive fiat ahead of national security. but there wasn't even that -- that wasn't even whispered? >> listen i think we can always question whether we can do more. in my home state of indiana, though, my seven republican colleagues in the congress sent a letter to joe donnelly who believes the president's overreach of executive order. senator donnelly please allow debate. we got virtually no coverage back home in local media. i had a video, you can find it on our facebook page they spoke

directly to him. lou: with all due respect, senator, i'm talking about a national campaign, it is a national issue, one of which you have the funding, the money, and you said and i compliment you, i congratulate you, you're talking about this isn't a vote on a matter of achieving a record, it is not to expose hypocrisy, frankly that is so obvious, in that town, it is however, a constitutional crisis in the offing and it's going to be exacerbated perhaps as a result of the actions that are taken today and tomorrow leading into friday. >> we didn't create this constitutional crisis the president did. we have a responsibility to step into it. you know lou, my only point would be could more have been done from a paid campaign? but at times it seems like the mainstream media is on their side, too. we got to work and fight through that. lou: and unfortunately congressman, as you and i both

only injury a cut above his eye. a very lucky fellow. what is it they say about drunks and fools? few thoughts on the unseemly surrender on senate republicans on the issue of amnesty by presidential fiat. a curious day. senate majority leader mitch mcconnell would be seen as a master of strategy or exit strategy. mcconnell offering up the bill funding dhs and defunding fiat four separate times the democrats filibuster. mcconnell split the bills, one funding dhs, the other defunding the fiat. >> i don't know what's not to like about this this is an approach that respects both points of view and gives senators an opportunity to go on record on both. both the funding of the department of homeland security and expressing their opposition

to what the president did last november. lou: the three senators behind mcconnell don't look like they're having any better time than mcconnell was. mcconnell was right, his approach allows senators to go on record on both measures. save face and accept defeat while constructing a political fire wall that would allow them to rely on the courts for their salvation. on the issue of amnesty and the constitutional affront of presidential rule by fiat it's hardly clear what the house will do now? but speaker boehner seeming to defer to the mcconnell rescue. he issued the statement that we reported to you earlier saying this vote will highlight the irresponsible hypocrisy of any senate democrat who claims to oppose president obama's executive overreach on immigration, but refuses to vote to stop it. i think it would be all but automatic to get a stipulation

on the hypocrisy of just about everybody on capitol hill at one time or another. some republicans remain hopeful, at least nine senate democrats voiced their concerns about the president's executive amnesty fiat. not one of the senators voted for the bill linking dhs funding to the president's fiat. at least some of them may support the mcconnell plan but they're under familiar pressure to fall in line. here's their minority leader looking his part. he's senator harry reid. >> we need to do is make sure the thing that is important to america today, to protect our homeland is to make sure that homeland security is funded. isis is funded we see that every day on tv. lou: the senator is surely aware 85% of dhs employees are considered essential, and would remain on the job defending and protecting the nation. it's fully funded at least in

that sense fully manned. and now the republicans will at least have part of what they wanted. a vote on the president's amnesty fiat showing clearly who supports imperial presidency and who supports a constitutional republic. it's that simple. sadly, it's likely to be a close vote. now the quotation of the evening by the great general and military strategist who said -- i commend a further reading to messrs. mcconnell and boehner. we're coming right back. closing arguments in the trial of the man accused of murdering the american sniper chris kyle, and that vegas road rage shooting it turns out there's a lot more to it.

investigation found insufficient evidence to charge george zimmerman is federal civil rights violations in the shooting death of florida teenager trayvon martin. it has been almost three years to the day since zimmerman shot martin during a confrontation in which zimmerman said he feared for his safety. zimmerman was acquitted of second-degree murder and manslaughter two years ago. and closing arguments taking place today in the capital murder trial of eddie ray routh accused of gunning down american sniper chris kyle and his friend chad littlefield at a texas shooting range. routh's defense team trying to convince the jury routh was in the grips of psychosis at the time. earlier today jurors had excerpts from a jailhouse interview which it said, quote -- . joining us now two of the best attorneys in the business

lis wiehl, mercedes colwin. both fox news legal analysts. lis, start with you this is a trial, does this man get off? >> no, i think he will be convicted. what the defense has to prove. and i'm saying the defense has to prove which is unusual, usually the prosecution, the defense has to prove at the time of the killing he did not know right from wrong, but his own words convict him. he said to a texas ranger after his arrest, texas ranger asked him do you know what you did was wrong? he said yes, sir. would it have been okay if i stayed instead of leaving the scene fleeing which is consciousness of guilt? yes jurors have experts on both sides but they'll say throw them both out and go with his own words. lou: do you agree? >> the apology is key. apology you know what you did. lou: shows you are wrong. >> obviously he did by saying he was sorry and didn't know why he did it.

lou: george zimmerman, no civil rights charges. three years after the fact. i mean is there any excuse? why are americans now seemingly inure to put up with this process. this is like a soviet-era kind of procedure in a far distant country, not in america. >> you are not surprised by this, are you? eric hold ear oo. lou: am i surprised? frankly, i am surprised, abhorred and disgusted at the american judicial system. i'm not blaming holder even though he may be at fault. it is the entire judicial system that is a wreck. >> holder got this case after zimmerman was acquitted. he wasn't going to look at it until the acquittal came down. lou: the last-ditch effort. >> exactly. the standard of poof on the civil rights case is so high they have to show that

zimmerman, the only reason he went after martin was because of race. that was the main reason, and zimmerman saying i was scared this guy was intruding in my neighborhood. lou: and the idea that -- as lis says, that this justice department is so politicized that this is what's taking place. it's driving the civil rights charges that he couldn't muster. it is driving the investigation in ferguson he had to conclude led nowhere. it goes on and on. why do we tolerate this? why isn't there a response? >> the fish rocks from the head. if you want changes in the branch of government, you have to look who's heading it up. change the presidency. part of the reason why holder did what he has done is he's been emboldened. you haven't seen this level of activism by a u.s. attorney other than this administration where have you this type of activism and you have these statements, these pronouncements that someone is

guilty before the investigation is completed. we've seen this time and time again. with respect to zimmerman, kudos to the zimmerman defense team, they complied with whatever the investigation was and ultimately d.o.j. concluded. >> d.o.j. came to the right decision, they would not have prevailed at trial. lou: i want to go very quickly to the vegas road rage case 44-year-old woman, tammy meyers was shot and killed. we call it road rage there are very big questions that it may have been in fact a drug deal gone bad. what are the implications? >> huge implications. we heard last week that the victim was attacked by this defendant. went to her home and got her son out to help her, and the son brought a gun, okay? then went after that guy, a shoot-out ensued and she dies. now we're hearing there was much more to it. she knew him very well.

>> i think that we need to see what with them survived. we don't want to address real issues, we are actually not seeing them do what the american people have a good service. they are doing things that really don't matter and i think that they are going to continue to do that and it's up to the candidates and the teams to come up with responses to the questions. and in proper response is to say that americans care about more important issues and you are asking me right now. lou": turning to scott walker, he had been down 25 points, most recent poll showing him a one point differential between senator ted cruz of all people in texas and governor walker. >> yes, it is big because we know that ted cruz has aspirations for the white house as well.

so certainly this journalism is flourishing in america and it's that way and a lot of what you are seeing is the self-inflicted by republicans. we should be smarter than they are and we shouldn't be giving them the red meat that they craven desire. we should be talking about issues and not personalities, so many things that are broken in this country and scott walker walked into a lot of the controversy this last week and that is what the process is for. make mistakes and make them utterly. lou: if you have aspirations of being president in the united states, one with a that you have a pretty clear understanding of the hot button issue end the gotcha politics. it is amazing that republicans do not have responses to this.

so you wrote a piece on this and i was fascinated with the so-called summit on violent extremism at the white house. the fbi director not there you wrote about that. it was an accident, was a? >> no, it wasn't that the fbi director wasn't there, he wasn't invited. i took a look at my column in the hill this week as to why he wasn't invited. many of the groups that were invited, some have been under investigation by the fbi. so the scary reality is that the group, the groups that have been under investigation for terrorist related activities members have been arrested and indicted were invited to the white house to discuss extremism, generic extremism, and the fbi director was not

invited. so that shows you where we will go moving forward. lou: he also sold out and went out and gave a political speech and it was appalling. and he has no recourse because he is a useful tool for the obama administration and he squandered an incredible reputation. don't you agree? >> i think that there are separate issues when it comes to this. >> they are related, but it's important to look at the issue as to why the fbi was not invited to discuss extremism and terrorism considering that they are the first line of defense when it comes to compassion and putting terrorists into prison here in the united states. lou: the last issue for you and that is mcconnell did it. and also president obama as well. what are your thoughts on the strategy, will it work?

and willow speaker boehner acquiesce to management by the chamber of commerce and the business roundtable of the republican party? >> we should not have been on the hook in the first place. don't rule the way that you wish that it was, rule the way that it is. regardless of what the house wanted to do, it was not possible to do what they wanted. mitch mcconnell got it and he understands that. lou: do we know exactly what they want him to do? because the american people voted in november and said that very clearly where they stand on this issue, now we are watching the president rule by executive fiat. >> i understand that. but if anybody let the republicans off the hook, it was the district court judge that granted the injunction. and we have to fight the way that this process gives us the ability to fight. assuming that we got a bill through, they don't have the
