and isil will remain a substantial foam. but any aura of the invincibility of isil is shattered. it is not invincible, it is defeatable and defeated by iraqi forces defending and take back their towns and cities and ultimately their country with the support of the united states and the coalition. and importantly very importantly, the aura of the so-called caliphate is destroyed. lou: tonight we'll take up the truth behind the enemy the obama administration still refuses to name. house armed services committee member brad win strop is with us tonight. also obama administration relations with israel. sunk to new lows as the president's national security adviser is given new orders and more talking points. this time targeting israel and the prime minister's speech next week to congress. here is rice disparaging netanyahu and demeaning the

state of israel. >> what has happened over the last several weeks by virtue of the invitation that was issued. >> by the speaker of the house. >> by the speaker and the acceptance of it by prime minister netanyahu two weeks in advance of his election, is that on both sides there has now been injected a degree of partisanship, which is not only unfortunate. i think it's destructive of the fabric of the relationship. lou: the white house supporting rice. press secretary josh earnest saying her comments are entirely consistent with the president's previous statements. we take up the frayed relations with israel tonight, we'll be talking with billionaire publisher, real estate magnate mort zuckerman. the senate ostensibly reaching a deal on defunding the department of homeland security. not so fast. senior republican aides tell us a clean dhs bill that doesn't

defund the president's amnesty fiat will be very difficult to pass. house speaker boehner doesn't seem to be budgeing. >> waiting for the senate to act. the house has done its job to stop the president's overreach on immigration. and we're waiting for the senate to do their job. senate democrats have stood in the way now for three weeks over a bill that should have been debated and passed so until the senate does something, we're in a wait-and-see mode. lou: boehner saying hold up mcconnell. when it appears the majority leader was folding all the republican cards, not just his own. we'll take up the stalemate as the clock ticks down to midnight friday. we begin with the ukrainian foreign policy challenge that faces the president. air force general philip breedlove assessed the grim situation before ukraine before the house armed services

committee. >> none of us knows what mr. putin will decide. if we take action and he believes he'll accelerate. if he takes action, it might raise the cost to him and he might take another decision. it's important we judge what we might think happens and move forward. what is clear it is not getting better, it is getting worse every day. lou: our next guest was present for breedlove's testimony. joining us congressman brad wenstrup, a member of the armed services and veterans affairs committee and serves on the president's select committee on intelligence and combat surgeon in iraq. breedlove was early in sounding the alarm on putin's ambitions and capabilities. he sounds more concerned today than when it all began. >> well he does sound more concerned than when it all

began and should be. the president spoke out very vociferously when this all began and said we would be supportive of ukraine. i don't think that's what the ukrainians are feeling, nor is the president. when he spoke to congress he said we need more than mre's and blankets we need help here. i don't think mr. putin feels threatened that the point. lou: if he doesn't feel threatened and nato seems in utter disarray the member nations are not demonstrating any appetite whatsoever to stand up against his aggression and certainly president obama is not. is it a fait accompli just fill in your target mr. putin you win? >> i certainly hope not. you know, i think we talked about this type of thing for a while. people are seeing opportunities around the world in trying to take advantage of what they perceive as american weakness and weakness in some cases of our allies. i see the ukrainians wanting to

put up the fight and we should help them with that and let them do that. at the same time there are things that we can be doing diplomatically with that region of the world to help their economies, help them grow, to make them stronger and make them less dependent on russia. lou: congressman there are times i have the strangest feeling when i talk to members of your committee and other leaders on the house and senate side, that they think that somehow the legislature is going to influence diplomacy, the commander in chief, when it becomes patently obvious over six years have you no influence whatsoever on him or the direction of the country. >> i would say that on many aspect not only on foreign affairs, not only on military decisions but on so many things. very little engagement. you know, i never planned to be in congress, but as i look at what i observed out of washington over a number of year, many times presidents i

didn't necessarily agree with they came to the table and discussed things and did so from what they felt was in the best interest of the country. i don't see us having the discussion, and to go back further, a very tell tale sign that is sad. if you go back to the state of the union last year, two years ago, when the president said if congress doesn't act, i'll act without you, and the democrat side of the body stood up and applauded. they told the president we don't mind being irrelevant. you go ahead and do what you want. we're just here for the ride. i don't know what the constituents think about that. lou: their constituents must be somewhat pleased because those are people who sent them there. just as your constituents and those of the republican party must be utterly confounded. it's as if the november midterm elections had no effect at all. meant nothing because senator mcconnell says we surrender on illegal immigration, we'll give you two votes and do what you

want. this isn't a constitutional crisis and never mind, just go back to your constituencies, be quiet and we'll take it from here with the chamber of commerce and the business roundtable. are you guys kidding? what's the deal? >> you hit it on the head there. and really this is not about immigration. this is about the function of this body and the function of our government that has been in place so many years. if the president can do this, what is next? i'm in favor of discussing immigration and coming up with a long-term immigration plan, secure our borders decide how we want our legal immigration system to look. we have the conversations. lou: congressman, may i point out, four bills out of judiciary that are the bulwark of any intelligent plan in the national interest to reform immigration and secure the borders and your leadership ignores it. everyone is ignoring that

reality. the goodlatte plan is a great plan would and solve the problem? >> you are right, and listen, we can't implement anything without border security. we have taken that action in the house. if you remember last july week did that. we did not go home in august until we got that done. i think that it's a step-by-step process, but more concerned is this executive action and just being able to run right over congress and therefore the voice of the american people. lou: you're caucus met, your conference, and you tell us is your leadership standing? is he going to hold senator mcconnell's hand and jump off the same bridge of surrender? >> i did not get that impression today. i can tell you that. i don't know what's going through the speaker's mind, but i did not get the impression he's ready to go along with that today nor are most of the members ready to do that. like i said, this is bigger

than immigration, this is about the function of our government for a long, long time. lou: absolutely and whether or not the imperial presidency will be held to this, at least this state rather than something far more expansive. congressman, good to talk with you, we appreciate you being here. >> thank you very much, i appreciate it. lou: congressman brad wenstrup. breaking news we learned the obama administration will not go before the fifth circuit court to appeal and try to overturn a texas judge's ruling blocking implementation of the president's amnesty fiat for illegal immigrants. it means that we'll be waiting until march 3rd because that's what the judge said would be the time frame for his decision on what will happen to his order. critics claim, of course that the president's fiat is unconstitutional and the white house makes it clear that they think it is just the right thing to do for the country.

nuclear power in the area. and it's astounding to me that in a sense he seems to be getting away with it. lou: he, to this point, is and i think most people are utterly dumbfounded, those paying attention to what this administration is constructing in these talk the architecture of this deal makes literally no sense whatsoever. it is laying out a pathway to creating an existential proximate threat to the state of israel to all the allies in the region and to the west. >> right. when you see a country like the united states literally ignoring an unbelievable threat saudi arabia egypt and jordan then have you somebody who lost touch for whatever region. lou: and kerry holding fort

talking about netanyahu's record on the war in iraq as if netanyahu was prime minister when george w. bush decided to attack. i mean these are bizarre, bizarre thoughts especially for a senator who was for the war before he was against the war as he famously put it. >> right, i must say i'm taken aback by that. i've known him a very, very long time and completely astonished. i suppose once you're in the administration, you get caught up in that rhetoric. this is something that diminishes john kerry on many levels. lou: it is a sad thing to witness. i have to tell you frankly, i look forward to the prime minister's speech at the joint session. i think to hear a counterveiling voice to what we have heard from this administration, frankly from both parties will be i think, edifying. >> it really in some

fundamental way is astonishing they didn't have more empsxaeth -- empathy and understanding of a prime minister who has the capacity to deliver them if this administration's policy is allowed just to run amok. no country in the world would want to stand by and not do anything about that, and to treat it the way they are as if this is somehow an unnatural and inappropriate reaction on the part of a man who's trying to save his own country. that is ridiculous. lou: and, of course, this administration appears to be reserving its empathy for our enemies. >> yes, the thing that is really amazing, they are -- you look at countries that we can rely on egypt and saudi arabia and some of the other countries affiliated with saudi arabia and jordan, and we are walking away and giving iran a free ticket to develop nuclear

weapons which would change the entire balance of politics and power in that region. it's crazy. lou: and does on so many issues, as we have to wrap up here. this administration has not gone before the american people to sell the idea, to sell the plan nor has it brought congress along. this is a president behaving, if he were in any other country but this, his approach and his demeanor would be considered by just about any careful observer as authoritarian not democratic. >> agree with that. my hope is that the congress is going to react across political lines, both republicans and democrats stand up to this because i think it's outrageous. incidentally, you know they attacked netanyahu for going to the congress without informing them that this was a violation of protocol. i don't know if you saw the "new york times," they turned out, they did know about this before, and they put a

because he famously as then a senator, kerry did vote for the war with iraq, later lamenting famously that he was for the war before he was against the war, you may remember that. unnamed white house officials over the past six months alone calling the prime minister a, quote, chicken expletive, a coward, obtuse blustering even he spat in our face end quote when he accepted that invitation to accept congress. at least the obama administration is beginning to attach names and faces to their nastiness. the prime minister meanwhile flipping rice's comments about partisanship back on her as he rejected an invitation to meet with senate democrats next week. he said, quote -- with quick quips like that i'm thinking the squabble insists on having with netanyahu isn't

and from writing on this issue, there is a peculiar tone to it. the very idea he would say this about immigrants legal illegal, he doesn't differentiate. instead of talking about what he's going to do for upward of 30 million americans who are out of work millions dropping out of school. it's a peculiar tone? >> to me the central issue facing republican primary voters is who is going to strengthen and rebuild our domestic economy and who's going to provide leadership overseas to fight this scourge of isis the nuclear iran. lou: let's be serious, okay. it's going to be none of the above. >> that's very scary, lou. >> i meant it to be because it's reality and about time people started talking honestly about this. jeb bush talks about foreign policy, doesn't mention radical islamist, doesn't mention vladimir putin or what he would

so did jeb bush in his first sortie into foreign policy. >> the central question facing us which is why i was interrupting and i apologize is because radical islam is the central challenge of our time. it's that clear. and after that is vladimir putin, his territorial ambitions in ukraine and through the baltics to jeopardize and try to upset nato. those are existential threats to our freedom and our liberty and our well-being. lou: and there's not a thing that nato is doing nor the united states, jackie. at what point, when will the national media start talking honestly, seriously about the deficiencies of this president and the threats instead of halting or diminishing is, in fact enabling in many parts of the world? >> i'm not sure i understand the question. you know we were talking about jeb bush's speech, it was a

very broad speech. lou: we changed the subject. >> in terms of the president's strategy -- lou: let me make a note. >> i'm sorry, i didn't understand what you were asking me. in terms of the president's strategy, there is speculation that maybe it's not working. >> there is no strategy lou, let's be clear. there has been no speech where the president says we will go after isis anywhere and everywhere with every bit of resources we have in our command. no if's and's or but's. >> do you put boots on the ground? >> absolutely. of course you do. that's the question. >> i've answered it. clear and unambiguously. they are threatening to kill us, kill europeans, go anywhere and everywhere. we have to kill them first. there are only 20,000 of them. what is our hesitancy, lou? i can't figure it out. lou: 20,000 foreign fighters.

national immigration forum. ali, good to have you with us. spill it. what were all the secrets at the closed-door meeting we should be aware of. >> what we've been reading about where the administration is going to file an appeal in the south district court, start to begin the judicial process of contesting the lawsuit from the 26 states and really move forward with the executive action that the president took, but i think the broader message here is the country's immigration system we all agree is broken, and whether the administration taking a temporary action or congress actually moving forward with something constructive that's a permanent solution that's what we all need. lou: yeah, it's interesting that the president has chosen to act, and he says it this way himself, because congress would not, he will. that has to be words he regrets when he goes into court, and when he prepares as he surely must in this case not personally, of course. he will be before the supreme

court saying to them he took it upon himself to actunilaterally with executive action, just because congress wouldn't do what he told them. that's got to concern you. >> well when you look at judge hanen's opinion, he doesn't dispute whether or not deferred action is legal or not. lou: no, no, i understand, i understand. either side will move here to appeal if the fifth circuit court or whoever loses goes to the fifth circuit and goes to the supreme court, and that will be on the merits. >> correct. and the merits of this will be that the administration does have prosecutorial discretion in terms of how to utilize the resources, that's the issue at hand here. lou: and the issue too has to be what is in the national interest and the supreme court will be making all of these judgments, and then there's going to be the matter of trying to resolve and fix the broken immigration system. you know it's interesting that

the president still has done nothing with citizenship and immigration services brought in an extra thousand people to try to service it. we're looking at a disastrous procedural process here for those people he's giving work permits to. and the numbers are changing. we're hearing the numbers are significantly higher than has been reported to the american people, those being given work permits. is that true, ali? >> when you look at original deferredac he took in 2012 we estimated at that point 1.2 million people eligible. at this point, 700,000 have applied and gone through that process. the number of them not being eligible and being disqualified. i don't think the numbers are greater than what we expected. the numbers are lower than what we expected. lou: and, you expect a happy conclusion, and how soon? >> we expect a happy conclusion from congress. i think that's what we all have to expect. we have to expect that speaker boehner and leader mcconnell
