"varney & company" begins right now. stuart: mar cra, thank you, indeed. you can't run forever, robert durst, you can't disappear forever vladimir putin, and you better get that gas price down some more and fast. that's a good way to start, isn't snit three deaths a mumbled confession on hbo, and after 30 years dodging prosecutors and and arrest robert durst behind bars. this is a big money celebrity story. in russia putin appears. out of sight for ten days, he pops up on state-run television. but that hasn't ended the speculation. does he still have a firm grip on power in now he's calling up 40,000 troops. and get the price of gas down and do it now. oil at a new low. the refinery strike is over so come on, let's see another gas

"varney & company" is about to given. ♪ ♪ stuart: two big market stories to kick off the monday morning. a big triple-digit rally for the dow jones industrial average this is all speculation about the federal reserve and interest rates. on it goes forever. but we look like we're up to close to 18,000 again. now perhaps even an even more important story the price of oil keeps on dropping. 42.97 that is a new six-year low. that means, in my opinion sharply lower gas prices coming very soon. as of right now, the national average for a gallon of gas is $2.42, down a couple of pennies

over the weekend, and it's down nine days straight. remember, please the refinery strike in the west is over, we're still swimming in oil. i'm going to ask patrick dehaan of gas buddy next hour if gas prices are indeed, set to plunge the way we want them to. that will be about 11:30 eastern time, this program today. the arrest of robert durst in last night's finale of hbo's documentary the jinx which is about the unsolved murders he's linked to, he can be heard confessing, quote to killing them all. durst was still wearing a microphone as he went to the bathroom x he started talking to himself. listen to. stuart: that is the key phrase, "killed them all." he was arrested saturday in new orleans reportedly preparing to take a flight to cuba. he is the 71-year-old heir to a

new york fortune, he's been arrested in the murder of his friend, susan berman, a murder that took place 15 years ago in beverly hills. it took hbo's producers two years to find and recognize that audio of the confession from durst. judge napolitano on the durst big money saga and that mumbled confession, 11:15 eastern this morning. to russia, vladimir putin has surfaced in public, first time if ten days. there was speculation that he was sick, dead or a coup had taken place. russian state tv released new video today, shows putin appearing with the leader of kirk stand. putinen says rumors are nothing -- putin says rumors of his death are nothing more than gossip. why should any of us in america care if this guy disappears for ten days? >> well, you care because what was he doing? did he have a palace coup threat? putin has become very reckless. stuart: what do you think he was doing? >> i think he was shoring up

support. kremlinologists have always been watching russian leaders for. well, his girlfriend was having a baby, so he took time off to be with her, or maybe he was having a facelift and cosmetic surgery. i think much more likely was he was shoring up support with the constituent groups. the economy -- stuart: has he faced an internal revolt because of what's happening to the economy? >> the big thing is the economy. you know a year and a half ago when he ran for re-election, he was not doing well in the polls and then the crimea crisis happened, and he was able to stir up and whip up anti-american, pro-russian nationalist sentiment, and his popularity's now 8, 0 09%. so he's really riding high on the anti-american, we're the beleaguered russians we've been surrounded, we've been cheated, we've been lied to, and he's diverting attention from the absolutely dismal economy. the economy's going to catch up with him because there's no chance that gets better while oil prices are low. stuart: what's this about

calling up 40,000 troops? i believe he did that today. he made the announcement today. what's that all about? >> well, and he also revealed, this is the first year anniversary of the crimea annexation. he also revealed that russia was ready to go on nuclear alert. so he's beating the war drums. he's gotten himself into the position where they're on a sugar high. you know the russian people ignore the fact that things are bad in the economy, ignore the fact that their standard of living is rapidly declining, and if you're a great russian national, you have got to support me and support what i'm doing in ukraine. the question will be what do the russian oligarchs do? they've gotten really rich and they've just seen their billions probably decrease by 20, 30% in the last several months. are they going to say forget about russian nationalism, i care about my own personal money. stuart: will putin let them get their money out -- >> no. stuart: -- or drastic capital controls to say it stays here, boys? >> he'll do the latter.

and i think they'll start looking around who else could lead this great country. i don't think putin finishes his term -- stuart: really? >> no, i don't think he does. stuart: you believe he's going to do something dramatic. >> i'm worried that as he gets more and more desperate, you know, the wounded bear is a dangerous bear that he will be more aggressive. he'll have to continue that sugar high to the russian people. so ukraine

department. yep. stuart: what do you make of this k.t.? >> well, the obama administration's wanted a regime change in the middle east from the very beginning of the obama administration. regime change in iran or -- stuart: you sound terrible. >> they want regime change -- stuart: in our foremost ally? do we want to change it? >> you bet they do. they think that israel and bibi netanyahu is personally standing in the way of some mythical peace deal, and they know they're about to have a deal with iran which is not favorable deal for the united states which is going to spur a nuclear arms race and they want to make sure bibi's out of the way. so they think a new israeli leadership will be compliant. i think they're wrong. >> and really quick, this group wants to go back to 1967 borders, and that is something that the president has actually voiced support for, our president. stuart: okay. so the left in america is providing money to the left in israel. i think that's a roughly accurate statement to make? >> and the swing vote is going to be palestinian -- israeli

not sure i'm going to buy that but we are talk to the creator. here's the story that's really creating the buzz, the big money celebrity real estate family member, robert durst, arrested, charged in connection to one of the three killings in his background. he's caught on tape saying "he killed them all." hbo picked up this so-called confession because durst's microphone was still live when he went to the bathroom. listen again. stuart: you could hear it. it was kind of mumbled, but you could hear it, so here is judge andrew napolitano. can you convict based on that? >> i'm chuckling because i've tried many cases with so-called confessions, never one quite like this. [laughter] stuart: i'll bet. >> first of all under the law this is not a confession. a confession can only be given to the government only after

warnings and after an assertion in writing or on tape. i know and i realize that i'm giving up my right to a trial and i'm saying this. so the government's not even going to argue it's a confession. the government will argue it's a spontaneous admissionment and that's -- admission. and that's where the issue of did he have an expectation of privacy comes in. did he think in his own obviously demented mind he was just in the bathroom? did he forget like he was, like you and i are now wired with live microphones? each we who wear these things -- even we who wear these things all the time forget that they're live. stuart: we do. >> we all do that. so these are questions the court would have to have asked and answered. then there's an issue of his mental stability. he's obviously a madman of some sort. the question is does he know

right from wrong. did he know right from wrong at time he made this statement, not "i killed them," but "killed them all." stuart: it seems to to me prosecutors seized on this spontaneous admission because he was about to get on a flight that took him to cuba, and if he did, odds are he's not coming back. this was only just discovered the relevance of the tape was only just discovered. >> isn't it interesting that the fbi was there at his hotel room at the time this show aired, therefore, they knew about it before the show aired. when did they know about snit and if they really think this guy is a dangerous murderer on the loose, why did they wait until the program calm on -- stuart: come on, judge, let's not throw the blame onto the prosecutors or the -- >> well, i'm suggesting that law enforcement's glee over this will be short lived. i understand their frustration. he is probably a serial killer: he probably committed these other murders.

but one of them he hasn't been charged with. the one that he was charged with, he was on the witness stand for four days gave an absolutely absurd absurd meaningless defense. i killed this guy in self-defense, and then i panicked and so i cut him up into little pieces, and i wrapped each piece in three pieces of plastic and threw it into gavel stop b bay -- galveston bay, and he's found not guilty. stuart: that raises another question, if you're really really rich and you can hire an army of lawyers, i believe he did, you can get off. >> he can't be tried again for the one for which he was acquittedded. he could be tried for perjury however they usually don't do that if they've got you convicted for murder. this is not going to move the ball in a positive direction towards the prosecution of robert durst. stuart: but he's in prison. and he's not coming back. >> yes, he is in prison. i'm not so sure she's not coming out. the delay argument that i gave

you is a substantial argument for giving him bail because the government knew for a long time about this garbled statement and chose not to arrest him. therefore they cannot argue he's a danger. if he's a danger today, he was a danger the day before they arrested him. stuart: real fast, in your experience as a judge do people who have done something wrong, maybe many, many years ago, just want to get it off their chests? >> yes, yes. stuart: either in peace or forgiveness, whatever it is finish. >> yes. i know that is sometimes the stuff on which novels are made, but it's based on reality. stuart: all right, judge. >> it's fun once in a while. it reminds me of my prior life. when creeps like this were two feet away from me in the courtroom, as close to meas you and i are now. stuart: don't back off from -- >> not from you! optimistic, and i think you certainly could see it come may when refineries finish up with their maintenance. of course, you still have that big hole in the i side of a refinery at exxonmobil's facility in los angeles. that's probably not going to be fixed as fast as you'd like. are we going to see your $1.75 plunge i think you said earlier? maybe not see that much, but it's looking very good, stuart, for the summer. stuart: come on, patrick. okay, i picked a number out of the air, $1.75, but it should be below $2. after all, last time that oil, crude, went to 42, $43 a barrel we were down at $2.03 national average for gas. now we're at $2.40. i mean surely we -- the driving public -- aren't we entitled to $2 or less in. >> well, see, you bring up a great question that a lot of motorists have been asking. crude prices are at 42, what in the world is going on? well unfortunately we can have all the crude oil this the world, but if there's a problem refining that crude into

gasoline, this is where the disconnect is taking place, and as refineries switch to more expensive gas as they do maintenance, you know, i feel like i'm sitting here explaining it, and i shouldn't be giving them any credit. once that maintenance is done you're going to see gasoline prices start dropping, and that's why we're fairly on the mustic that this summer's easily going to be the cheapest since 2010. in fact you'll see those sub-$2 a gallon prices start coming back if crude oil prices hold trajectory. stuart: oh, patrick dehaan, that's good. that's good stuff. you don't make as much money when gas prices are plunging. i know you don't quite make as much money. you like them to go straight up so everybody comes to you to find cheap gas but you're still making money -- >> nobody can take the suit off my back anymore. stuart: and that rolls royce is in the garage around the corner. you're a good man, thank you very much for agreeing with me. see you again soon.

something just in from new orleans robert durst just agreed to extradition. he's going back to los angeles. he's agreed to do that. our cameras are outside the courthouse in new orleans where a hearing is taking place right now. at some point we will have him emerge. not necessarily from that door but he will emerge and he's going to be extradited back to los angeles, we hear. now, to the man who is in high demand in washington. look at this. we've known for years that steve moore has valuable insights, that's why we put him on the show. he rates. now politico is writing an article called "the wooing of a washington wonk." behind the scenes every presidential candidate is fighting over a small pool of top candidates. steve moore is one of those top people. he joins us now. >> hi, stuart. thank you. i'm glad you're finally treating me with the proper amount of respect. [laughter] stuart: absolutely. >> just teasing. stuart: what are you telling these republican candidates? in a nutshell, i know you've got a message, what is it?

>> you know what it is, growth, growth growth. we've got to grow this economy we've got to get it back to the 4-5% growth that we haven't seen in this country for a decade. we're seeing declining middle income families in terms of their take-home pay, and it's this kind of recovery has not reached a vast majority of american families. stuart: yes, but are you telling them, are you telling these candidates you've got to reduce corporate and personal individual tax rates? >> of course. [laughter] of course they do. stuart: that's how we get growth? >> look, i'm a radical on this. what i've been telling them is blow up the tax system entirely, start start all over again, come up with something mush simpler fairer and brings jobs back to america. we've got a tax code right now that works against this company. it's like our competitors wrote it for us. look, the good news is i'm just doing this with these candidates because i think this is going to be one of the most important elections in our country in 50 years, maybe at least since reagan was elected. we can't afford to have someone

who isn't a pro-business growth advocate, and i'm very worried about it quite frankly. i have to tell you, stuart having talked to five or six of these candidates already if you're a republican, it's a rich talent pool out there. stuart: okay, one last one. i think to get the economy really going over the long term, we've got to reform medicare and social security. >> of course. stuart: are you telling them that? >> of course. stuart: that's the third rail of american politics at the moment, isn't it, steve? >> it is. but, you know, look, with social security reform, why not move towards a system of personal retirement accounts for younger workers so they don't lose 15% of their paycheck for the rest of their life? with respect to medicare and obamacare, i think there's a broad populist appeal to repealing obamacare and coming up with a plan that covers everybody in america but allows them much more choice. you get to keep the doctor and the physician and the hospital of your choice, and we could do that, by the way, stuart. one of the things i've been telling them, we can cover everyone in america with health
