"imus in the morning" when you think that is valid is framing the? republicans opposed to big government democrats in favor of big governments of the role of government is the key central issue in this election. is it? >> role of government in a weak economy. another thing the republicans have going for them is the government is very vulnerable right now. they just aren't delivering. the veterans administration continuing scandal. people nervous about the governor, obamacare the biggest example still law popular. i think hillary's agenda is very vulnerable and the republicans
12:06 pm
are assembling a team that can take that to the american people. stuart: hillary has to be dragged to the left for the primaries. then she has to be back to the center. wishy do that? >> no. i don't think the left is going to let her do that. she has former obama people working for her in her campaign like john podesta. the moment she starts for the center and talking about corporate tax cuts, the left is going to go public and they are going to go ballistic attacking her so we are teed up for a really interesting campaign. stuart: we are right into it. dan henninger eric, thanks very much. more of today's top stories. loren is back with a headline in case you missed it. >> we have a victory to tell you about for general motors. a judge ruling gm is protected by its bankruptcy, meeting claims over its faulty ignition

switches from before it emerged from bankruptcy are not valid. here is what the judge has to say about that. judge napolitano: innocent people will not have redressed the unfortunate consequences of a government regulated managed and forced bankruptcy. >> potentially billions of dollars is saved because many lawsuits will not be allowed to proceed. that is why flying skinnier, smaller planes means fewer seats and fewer cheap airfares. no new orders have recently coming by any domestic carrier for an airbus or boeing jumbo jet. senator harry reid, the minority leader is not holding back punches taking a jab at the 2016 gop presidential field. take a listen. >> how do you see the republicans? to become public and nominee? >> there are all losers.
12:08 pm
>> losers. you can say is that when you are retiring and not seeking reelection. stuart: i guess so. before we let dan henninger go you have got to comment on harry reid. >> the old songs i and a loser. he is quitting because he could have lost the senate reelection race out in nevada. harry reid can sit on the sidelines, eat popcorn and watch hillary tried to transform herself into a winner. stuart: you just love it. >> i love it. stuart: the gyrocopter, that thing that landed near the capitol building, the military didn't see it until it landed. roll tape. >> this is not good people. it is not. stuart: you heard what the lady said. this is not good, talk about the

understatement of the year. every time we have a pilot tom sullivan comes on the show. welcome back. >> you guys are involved somehow. there's some sort of aviation story the day i am scheduled to be with you. always honored to be here but the problem with this story is he tried to get the attention of members of congress about money and politics and instead he got there at tension about they are worried about their security. stuart: he told the tampa bay times that is the name of it, he told from what he is going to do, he went on line and set i am going to do this and then he did it but what astonishes me is that is right in the center of washington d.c. and the military didn't see him. you can explain this away by saying he was under 200 feet but isn't that an obvious threat that has been around for years? >> you know where they're

sitting down going how do you -- we need to build 50 of them and we will fly them in. the thing about it is this is the most secure air space in the world and a 15 mile radius for the supersecured part, 30 mile radius beyond that, he flew 80 miles from gettysburg, pa. down to washington d.c. and nobody anyplace picked him up. stuart: i am told they had long guns on him 50 caliber things which could have blown him away but somebody had to give the order issued for don't shoot. that is interesting. >> the big question out of this is he told the tampa bay times there were stories about it. did they know he was coming and they didn't shoot him because they knew he was a mailman from tampa or did they just not do what they should have done which a lot of people think is shoot
12:11 pm

stuart: i have a winner for u.n. did is not an ideal. this company has a deal with cisco to provide security products for the internet of everything. that is where you apply computing power to everyday items. that stock is a big 38% to be precise. president obama has declared war on coal.
12:15 pm
the ceo robert mary, a coal company has to lay off hundreds of workers and he is blaming the president for it. he is suing the epa. a federal appeals court hearing arguments on the case today. tom sullivan what is this about? >> coal is the most efficient energy sources and we have an abundance of it and other countries want it but we are doing everything we can to put them out of business and there is a clean coal technology but the president said before, when he was a senator that he would be effectively like to run poll out of business. stuart: look at that chart they weren't run out of business not quite but almost. >> coal is mined in almost half of the nation but the big states pennsylvania, west virginia, they are hurting. the unemployment numbers are atrocious. that is why you see senator manson and others that are not happy about this. stuart: when this gentleman had gone to court and said the epa
12:16 pm
is killing me 8 is wrong, it is illegal, get the law my back. >> i hope he is successful. is going to take the court because remember they also said the epa has all kinds of superpowers. we will see whether or not mr. murray is successful. stuart: don't you care about the planet? >> they are killing the people that are in the coal business and it is the cheapest most efficient form we have crinkle technology. stuart: that gentleman in the news it will be tonight on neil cavuto at 8:00 p.m. on the fox business network. let's get to hillary clinton, a campaign staff staging events for her, planted voters, planted questions, not really everyday america, is it? fox news contributor and town hall's katie brad lidge is with us on the campaign. i say it is not going well.
12:17 pm
she is extremely wealthy and extremely powerful. >> that is what happens when you are a washington insider for almost 40 years. hillary clinton trying to read brand herself now is going to be a serious problem for her because it is so transparent, easy to see the she is trying hard time fulfil that role. i thought was interesting looking at a campaign language used in the campaign announcement videos saying i want to be at champion for those americans who are not at the top and getting the short end of the stick. what that implies by one to be that is she hasn't been that. they use that language to -- and her campaign live string. she isn't that. stuart: it begs the question if you want to be the champion of the middle class, fair enough but how are you going to do it?
12:18 pm
what are your policies? a broad outline what are your policies? >> at this point she hasn't done a single interview with reporters since he announced on sunday she visited school in iowa, had students locked down in their classrooms because she didn't want to get too close to the real people. wanted to look like she was walking among them. this chipotle thing was the big thing for the media that this was the new fun thing she was showing us how to do, that was staged the problem when candidates, republican or democrat trying to reinvent themselves on the campaign trail is they are not genuine and it is very obvious they are trying too hard to fit into the mold of what is popular. stuart: i got to say i am surprised because she has a gigantic campaign team. he hand-picked the best of the best from the left that is for sure. an enormous campaign. why are they coming got with what looks like amateurish
12:19 pm
stuff? the scooby bus what is that about? planted questions. everybody can see through this. >> apparently hillary clinton even stole the name scooby do bus from her secret service agents. that is not even an original point but in terms of her campaign team, what i actually don't know that i would give them credit when it comes to saying they are the best of the best, one of her senior communication advisers and spokesperson is karen finley who used at a weekend show on an sand bc, we know how well that channel is doing and the rest of the campaign team is doing poorly and is the same people who were on her book tour. stuart: when hillary went into that jacobi the bill came to $20 and change, she plunked down $21
12:20 pm
and walked out no tip the. some people are making a big thing out of that if you want to the person of the people, spread it around a little bit, some people are making a big deal out of this and i do too. am i going overboard? >> those fast-food workers would be able to make a living wage -- it is not a big deal because i don't -- i think tips are earned, not given but because hillary clinton is such a hypocrite on the minimum wage issue saying people need to pay more, people deserve to have more money for the job they're doing based on the government forcing them, not market value. that is where the problem is. in general i think that is a little bit silly to be worried about a tip that chipotle which is not somewhere you typically kept. she can afford it. stuart: in the corner. i am law former waiter. i know about tipping. >> i was a waitress as well.
12:21 pm
stuart: a waiter or waitress. katie come back soon. tom sullivan is here and he is desperate to get involved. >> i was up wait person. i want to make that clear. wait staff. here is the deal litter they know she's not warmed. what they're doing is what they tried to do with al gore, reinvent this person. the problem is they kept reinventing al gore to know where nobody knew what he was a gift they're doing that she has a problem. stuart: a group of co-workers and in an anonymous letter to someone they work with accused her of putting up too many facebook posts about her new baby. this is all over social media. does it cross the line? you will see more of this in a moment.

now this. a new mom still home on maternity leave received a very nasty letter in her mailbox from her co-worker so-called friends. here is just a piece from the litter. sheet crawls off the match. we don't care. he is 6 months old. big deal. we can't wait for you to get back to work. maybe won't have time to be on facebook quite so much. dierdre bolton is here, a mother herself. >> these are not friends the these are grouchy people who need a drink for of vacation or both. did you see this little girl? she is the cutest little thing. if you don't want to look at the pictures just on follow. stuart: this was in australia. >> which is surprisingly if this were done in new york i would say we are all overcaffeinated and compete for everything and in the copy line or a seat on the subway but in australia i thought people were friendly and
12:27 pm
laid-back. stuart: i you kidding me? we just posed the question of the screen. these think this litter was outrageous? my answer is yes. it is our rages. this is your co-workers litter the went to the expense of the trouble of finding this thing. and it was that nasty freeing. what do you say? >> my problem is as much with the person who wrote this letter, if you don't whiteface book and it bothers you that someone is putting their child up there -- >> what do you think you are going to see on facebook? bernard: when you can hide it. >> friends and family are annoying. that is part of the deal we make. here is my friend, gets on my nerves. >> they have been exaggerated. stuart: any day now, literally any hour now i am going to be the grandfather of twins. >> congratulations. stuart: it will be all over this entire network the face book

page, pictures. >> listen up and if you don't want to see baby pictures stay off of stuart varney. >> what do you say when someone shows you the photo of their baby? the one that is wonderful. that is love at first sight. >> you are a class act. >> babies like munchkins. why do we see looks just like the you? >> i am citing with stuart varney. stuart: what time are you one? >> 1:00 p.m.. stuart: the name of the show? >> "risk and reward". stuart: your name is? dierdre: on the basics. breaking news. the house voted to repeal the so-called death tax, the estate tax. the vote was 240-179. the plan makes it possible for the wealthiest americans to do what the other 99% already can do pass assets to offspring without federal estate tax.
12:29 pm
the regular costs so they say $269 billion over a decade. a senate vote last month came up short of overcoming a democrat filibuster. >> this actually has bipartisan support. at least it has in the past because of the fact the classic is the farmer but even small business people who started their business and built up and actually sold it and did well over 50 years, the family has to sell the business in order to pay the estate tax. stuart: the very rich to not pay the estate tax because you have an army of lawyers. >> bill gates is all for this and what he has done is put his money into a foundation which he gets a deduction for and get control over the money. he is a hypocrite on this issue. stuart: this would be really something if it passes the senate and goes to the president's desk it is the repeal full repeal of the federal estate tax. that is huge. >> won't do it. >> this helps the rich get
12:30 pm
richer? that is pretty much the basis of the argument. stuart: i don't think i should be taxed again on what the accumulated already paid tax on. the reason for the estate tax is to stop america having an aristocracy. it doesn't work. >> it happens anyway. stuart: any wealthy person will be protected by estate lawyers who will protect your estate and make sure the government doesn't get it and hypocrites' like warren buffett who are so big on the estate tax but don't pay it, they give it away. >> you had that ceo yesterday, warren buffett said i shouldn't make this much more than my assistant and head that fantastic founder yesterday is that i will take a pay cut and pay my employees more. stuart: warren buffett should simply pay himself more salary and then he would pay the same. >> he hasn't given it away he gave it to his own foundation. stuart: he has avoided the
12:31 pm
estate tax. fee avoided the estate tax by doing that. that is what he has done. are we done? >> when does the stuart varney foundation begin? stuart: no comment. >> with two new ones on the way. stuart: i have a lot of grandchildren. they need it more than i do. check the big board please. i will say this is dead flat. i think i am accurate down 3 points, 18,100 but look at this, netflix. if this isn't the stock of the day i don't know what is. it at a record number of subscribers. i believe it is $4.8 million, up she goes $73, 15%, up on netflix. quick question, tom sullivan would you buy it? tom: no but i love the product. i would not buy the stock. not at this price. stuart: dierdre was acting behind use the we have to keep the camera on me. and our floor manager was going
12:32 pm
crazy. tom: don't ask him anything. they really are, they are going to split probably long term. charles payne was saying that. he likes long term. is pretty expensive right now. stuart: it has revolutionized entertainment. gerry fernandez. first-degree murder. his troubles with the law started long before the nfl. joining us now to weigh in is nfl insider, mike gaer fallow. it's very good to see you. now, hernandez's trouble was well known way before he went to the patriots, it was known way back when he was in florida, and the coach knew about those troubles when he was in florida. the coach went ahead and put him on the team anyway. seems to me that the coach had a choice. i can get this guy on the team, he's a great player i might win, or keep him off the team and then he won't ruin the
12:33 pm
reputation of my team. he took the choice to go and win. what do you make of that choice? >> well, stuart, you know, urban meyer, if you ask him about this, would tell you that to pin aaron hernandez's actions on the staff or the university of florida would not be fair. urban meyer now with ohio state. and he actually said that in the past, saying that we tried our best to guide this young man and to steer him in the right direction. there were a number of players on the university of florida team who have had issues and have had issues since. so you can go back and say that the players they recruit t, the players they put on the field have all had their issues. once you take it to the step of murder, i don't know that anybody saw this happening. you go back to his former teammates both in the nfl and florida it's amazing how shocked they were. you don't get anybody saying, yeah we kind of saw this coming. i don't know that anybody would have thought aaron hernandez would have been capable of this even though he did have issues
12:34 pm
such as bar fights was questioned in a shooting when he was at florida and even had issues testing positive for marijuana. stuart: i'll give you my opinion for what it is worth. i would say that if i'm the coach or owner of a team, i want the best players on it because i want my team to win. and i will overlook a lot of the troubled background of i my best players -- of my best players. i'll hire 'em i'm put 'em on my team because i want to win. that's my first priority. where am i going wrong with this. >> well the only place you're going wrong, stuart is if you're looking at guys saying is this guy trying to be a better person or not? can he be guided in the right direction? can we do more for the this person? you know, the old giants' gm george young, the late george young one of the things he said was we're not in the business of well adjusted people. you're going to have a lot of players to who have a lot of issues but is this guy capable of murder or something to that
12:35 pm
degree? that's obviously a gunpoint that you have to -- a gut you have to make a -- stuart: it's an impossible judgment to make mike isn't it? you can't do that. >> well i guess you just have to be a little bit better at it i suppose, stuart, because some guys -- look, i'm a football guy. a football guy going back a long way. and structure that the team provides, i've seen it happen can take a guy who's got some issues who is heading in the wrong direction and he can learn a lot of things from the sport as far as leadership, camaraderie loyalty and can be steered in the right direction. that's not the case with aaron hernandez but i can give you dozens or hundreds of examples of guys who did eventually walk in the right direction. stuart: well said, mike. that's a very important point to be made. thanks so much for joining us, fox sports. appreciate it. >> you got it. stuart: and now time for charlie gasparino. he's going to take a victory lap. [laughter] his former -- here's former ge chief jack welch on "fox &
12:36 pm
friends" this morning on ted cruz. >> he says what he's going to do, he does it, he's highly principled. he's a guy you can truls. stuart: now that's important because jack welsh is the premier executive of the last generation, and he came pretty close to -- well he said it, i like ted cruz. that's exactly what charlie gasparino reported on this program yesterday, and he's back. [laughter] >> don't you love it when little old stuart varney and little old fox business beats the big guys over there at -- stuart: we like you on the show okay charlie? >> david and goliath. we beat fox news, we beat cnbc, we beat everybody -- stuart: yes, you did. anything to add? >> jack welch is an interesting guy. he's generally considered an establishment republican. if you look at his campaign contribution record, it's a lot of mitt romney, scott brown, much more of the moderate type
12:37 pm
contributionings. stuart: yep. >> so this is kind of big. what jack welch is saying, and, by the way, most of these corporate chieftains, they generally vote at the moderate level. they would be most likely to vote for a jeb bush or a chris christie. stuart: but there is exasperation -- >> that's what he's -- stuart: just goes on and on and on and on and on. >> and that's what jack is telling people. we tried the moderate vote we lost in 2008, we lost in 2012, we need to go to a true believer now. i will say this, inside as we were talking about yesterday, this is kind of like the ncaa brackets to the republican primaries right now, jeb christie, scott walker to some extent on the moderate conservative, you have the tea party which is rubio, cruz and rand paul, you have evangelicals my good friend mike huckabee and santorum possibly. so when you get a guy like welch, you know putting his finger on one guy in that one category it screws up the other
12:38 pm
two guys. i will say this, the rubio people are freaking out. stuart: because they fear, rubio's people fear that ted cruz sucks up the money -- >> sucks up the money which would have been for rubio. and not only that, rubio's people made a play for jack well. he has given money to rubio in the past. stuart: but what he really gives is intellectual clout. >> he's more of a guy that goes on tv. stuart: come on in tom. i think he shifts the debate to the right among the republican party. >> it surprised me, but you never understunt jack welch. -- underestimate jack welch. he is the strategic thinker on so many issues and so when he says something about this, you're right about rubio and cruz, there's only room for one of them. one of them's going to push the other one out. >> you know what else is interesting? in the past he was talking up rand paul. so rand paul he considers, i mean based on what he's saying now is an also ran.
12:39 pm
the last time jack talked about this was in late last year, november, where he started bringing up the fact that republicans may have gone moderate, we haven't won. i like rand paul. he mentioned rand paul specifically. he he talked about -- >> yeah but look what he did. >> but my point is he's narrowed it down to one right now. and if you're a betting man, you know, if you're looking at the sweepstakes for that conservative tea party vote, cruz has got to be way at the so much that right now because you can't beat jack welch's pr. >> welch just said you can trust him. those are powerful words. stuart: indeed. charlie well done. thank you very much, indeed, sur. former lieutenant general thomas mcinerney said that israel should consider using nukes to bomb iran. what does ambassador john bolton think about that? and tonight, "strange inheritance" with jamie colby, 9 p.m. eastern, all about baseball cards and they are worth a lot of money. >> how many are we talking
12:40 pm
about? >> hundreds. [laughter] >> i was just floored. because i had no idea what a 100-year-old baseball card looked like brand new. that's when you realize this was the find of a lifetime. sicals down. martha and mildred are good to go. here's your invoice, ladies. a few stops later, and it looks like big ollie is on the mend. it might not seem that glamorous having an old pickup truck for an office... or filling your days looking down the south end of a heifer but...i wouldn't have it any other way. lo ok at that, i had my best month ever. and earned a shiny new office upgrade. i run on quickbooks. that's how i own it.
12:41 pm
hey, girl. is it crazy that your soccer trophy is talking to you right now? it kinda is. it's as crazy as you not rolling over your old 401k. cue the horns... just harness the confidence it took you to win me and call td ameritrade's rollover consultants. they'll help with the hassle by guiding you through the whole process step by step. and they'll even call your old provider. it's easy. even she could do it. whatever, janet. for all the confidence you need td ameritrade. you got this. >> the s&p 500 down almost 2
12:42 pm
points and the nasdaq down about 5 sitting right at 5006. we've seen consumer staplings and discretionary doing well, but on the downside we're seeing utilities. utilities is the worst sector of the day and let's take a look at some of those names under pressure including duke energy dominion resources and first energy. many of those names down more than 1%. netflix, on the other hand though crossed to 500, 550, making all-time record highs as they say subscribe iser growth continues. it's up 15.5%. everybody's waiting on the stock. reporting after the bell american express, mattel schlumberger just to name a few.
12:43 pm
12:44 pm
stuart: look at gm's stock price, please. dead flat. however a judge has ruled that gm is not liable for the deaths and injuries that were caused by those ignition key problems if the problems occurred before 2009 the year of the bankruptcy. this could protect gm from literally billions of dollars in claims. we've got one lawyer estimating they are protected from $7 billion worth of claims. gm's stock is flat. now to iran, lieutenant general tom mcinerney had strong comments the other day. listen to this. >> if putin, in fact, because he's got a problem with the u.s. and nato on the ukraine and crimea, if he releases those
12:45 pm
missiles, then i see no other option but the israelis must attack. and by the way they may have to use their tactical nuclear weapons. stuart: ah, that created a few waves, did it not? ambassador john bolton is here. general mcinerney raised two issues. first of all, he said that the israelis may have to consider using their tactical nuclear weapons. what do you say about that ambassador? >> well, i don't think they do. i think they have the capability of using conventional weapon withs to do -- weapons to do what's necessary to break iran's control over the nuclear fuel cycle assuming they can get to their targets and i think that's what general mcinerney's really concerned about. that's what the potential release of these s-300 missiles really means. stuart point number two, that the israelis not exactly will be forced to attack when these missiles arrive in iran but it gives a very good reason why the israelis should attack.
12:46 pm
your comment on that. >> right. look, these f-300s it's actually a more advanced system, have been on hold for five years because netanyahu went to moscow and who knows what he offered the russians phi years ago not to sell them. they're very sophisticated anti-aircraft systems. they can defeat anything other than stealth our craft which israel doesn't have. if the s-300 were deployed and made fully operational in iran, it would prevent israel from destroying the key elements of iran's nuclear weapons program. and so i think the point tom is making is perfectly legitimate that the tomb frame for israel's decision -- the time frame for israel's decision to do something militarily about the program just got very short. i personally think barack obama's fine with that. i think that he's happy. he's at least, he's in equi-poise that putin is going to allow these missiles to be sent to iran because he doesn't
12:47 pm
want israel to attack. stuart: okay. a develop doing news story broke about an hour and a half ago on this program that al-qaeda has taken control of a small town on the southern coast of yemen which we understand is a port and an oil terminal. al-qaeda took control of it, not the houthis who are aligned with iran, but al-qaeda. what's your reading on this one, ambassador? >> well, it shows that despite the administration's claims about how well we were doing against al-qaeda in the arabian peninsula based in yemen before the entire country of yemen disintegrated it's not true. they're still capable of taking strategically important locations. i think the country is fragmented, but i think now it has dubious distinction of being home to both aqap and the houthis -- a group that's functionally a surrogate of iran. and it says it's another piece
12:48 pm
of evidence of the growing spread and sweep of terrorism around the region and around the world. the world is getting less safe. stuart: but it puts the oil patch in play to some degree. when this news broke, ambassador, we had the price of oil way down. it was down about $1.20. as of now, 90 minutes after the news broke, it's only down 15 cents. the implication is that this upsets the oil patch maybe supplies are threatened, so the price of oil stop ises falling and may actually go up. i think this is strategically a very important development, certainly for the oil market, would you agree with that? >> well, from that price movement maybe they're finally catching on. you know, explain to me why price of oil didn't go through the ceiling when the administration announced the nuclear weapons deal with iran which puts iran on a free path to get nuclear weapons at a time of its choosing imagine what will happen to the price of oil once iran has nukes. stuart: well, when the deal is done -- and i'm sure it will be
12:49 pm
done -- iran loses the sanctions, and they start exporting as much oil as they can, that's why the price of oil didn't go through the the roof. last word to you. >> well, think about this: when they've got a nuclear sword to hangover the heads of the oil-producing monarchies of the arabian peninsula or those monarchies get their own nuclear weapons that's what the oil industry and our president better walk up to. stuart: gee maybe then we'll build a pipeline and start fracking. who knows? mr. ambassador, always a pleasure. thank you, we appreciate it. >> thank you stuart. stuart: a minor league baseball team in pennsylvania, they're called the iron pigs. they pied themselves on bacon. -- pride themselves on bacon. they've been called out by a group of doctors, so what does the team do? they offer broccoli! deep fried, and it's bacon-soaked. [laughter]
