record close. its seventh this year alone. the dow 30 points away from the fifth record close of 2015. it is up more than a percent right now. a freight train derailing outside of pittsburgh earlier today. 13 empty cars jumped track. emergency officials say there are no immediate reports of injuries. that no hazard does substances have been spilled either. now to the latest on the deadly amtrak crash. the ntsb reveals the train was going more than 100 miles per hour. that is more than twice the speed limit on the curve where it jumped tracks. >> it has been a massive effort. it has been painful. >> we must now report that we have confirmed eight deceased from this horrible tragedy. melissa: fox news's joel walled enin philadelphia with the latest. what is the latest there? >> melissa obviously a sad day

at the crash scene. confirmation from philadelphia mayor nutter's news conference in fact the 8th person was pulled from the wreckage. he went on to explain at about 8:00 this morning there was reason to send cadaver dogs to the crash site. this cadaver dog came on three different hits. they sadly found the remains of the 8th victim. we started at five official victims. we jumped up to six seven, and eight. it has every day been a fluid scene out here. a good news silver lining in all of this, only 43 people remain in the hospital now. eight of them are still believed to be in critical condition. but everyone, according to this news conference now everyone has been accounted for. that was a question everyone was asking about. will we have anymore victims? meanwhile there is a heavy focus today on the 32-year-old engineer brandon bostian. he is accused of speeding through the curve here at is 06 miles per hour. that would be moret$ñ than -- 106

duh. also really ominous for this guy steven king to be coming out with these statements. we track five indicators that essentially pinpoint where we are in the economic cycle and roughly they're all telling us roughly is it to 13 months left of economic expansion. throw this out for now. melissa: you think there are 12 to 13 months? have you looked at recent economic data? for the last quarter we were at a standstill? that is growth and expansion? >> our models have u.s. growth rate slowing. we're past we'll slow into the next recession. that is not for a few quarters. >> that is not a lot is it, 12 months? just another year. when people haven't felt this recession and this guy's pointed out deficit is still relatively high. welfare payments are still high. would be disaster. melissa: more importantly, if we do slow down more from here, we don't have a remedy because we're still sitting at zero percent. todd? >> you're right. i'm not a money guy. i live in a neighborhood with a lot of mom-and-pop businesses going out of business. folks just don't have money.

trustworthy is not obstacle to get elected. it helps if you're the most talented politician of your generation the way bill clinton was and she is not. melissa: possible takeover. let's go to nicole petallides on the floor of new york stock exchange with more on this one. nicole. >> melissa we saw avon shares today surge 20%. in fact the stock was halted for volatility three times between 11:30 and noon. only to find out now, that the potential takeover offer from ptg capital was in fact a hoax. the sec is looking into this one. and meantime the investors and shareholders of avon have been long awaiting some sort of takeover of this company that has been under pressure. so it is a name we'll continue to watch. right now it is up about 5 1/2%. still holding on to some gains. earlier in the day prior to the big surge in the stock, the stock in fact had been hitting lows, lows that we haven't seen, i charted back to 1995.

lockdown after the secret service detain ad man for attempting to fly a drone near the grounds. this is according to a federal law enforcement source. we'll bring you more details on this story as soon as we have them. the boston marathon bombing trial resumes today as the jury deliberates. the penalty charge for dzhokhar tsarnaev. tsarnaev was convicted last month of all 30 charges against him. 17 which carry the possibility of a death sentence. fox news's molly line reports live from the u.s. district court in boston. molly? >> melissa, jurors have been deliberating today for about five hours. they deliberated for about 45 minutes yesterday afternoon. they're just beginning this process. they hold the life of dzhokhar tsarnaev in their hands. the convicted marathon bomber. the 12 jurors that initially coin havinged him of 30 federal counts are same ones behind closed doors right now, looking at 17 capital counts he was convicted of those that carry possibility of the death

. melissa: market rally holding strong as we head into the last hour of trading. the dow and the s&p both set to make new record closes for the year. let's bring back nicole petallides at the new york stock exchange with more on this one. we're looking at the dollar weakening, crude oil closing below 60. what's inspiring the rally? >> reporter: absolutely right. you started to see things stabilize. crude oil the dollar pulling back. i'll add government bonds in the u.s. and abroad in europe, and those two have stabilized with. that, that put a floor and a nice hold for equities overall. the dow jones industrial average up 181 points. in fact, just over 40 points away from record all-time high of 18,288, and with this we're seeing a broad-based rally. technology is leading the way, microsoft apple facebook are
