can. charles: even if you're a punk rocker you can sell out. i mean make money. if you can't see the show dvr it. we are making you money. tomorrow, i'm going to be shotgun with maria, starts at 7:00. lou: good evening, everybody, i'm lou dobbs. washington rattled tonight. two phony bomb threats today. the first prompted capitol hill police to shut down two senate office buildings, or at least parts of them, and within hours the secret service had evacuated the white house briefing room, and moved the reporters in it to the old executive office building. these incidents raising concerns tonight about the reflexive and unthinking response of security agencies to uncorroborated or unvalidated threats and questions about the secret service's ability to keep our president safe.

this all began at noon when staff were evacuated from two senate buildings. the dirkson senate building and the russell senate office building because of unsubstantiated reports of suspicious packages, claims that turned out to be phony as they nearly always do. nothing was found but an hour later the white house press briefing room was evacuated in mid briefing after a bomb threat was phoned into the metropolitan police department. curiously the secret service decided it was necessary to evacuate the press from the briefing room but not the press secretary, nor the president whose office is within a short throw of the briefing room. we take up these almost automatic and almost always highly costly reflexes to threats and examine whether there's a better way for security agencies to respond. security terror and policy. we take them up with lieutenant colonel ralph peters tonight.

also president obama waging a full throated campaign, trying to drum up public support for obamacare opposed by more than half the country right now. the president not embarrassed in the least as he tries to intimidate the supreme court to rule in his favor on the legality of obamacare subsidies. this time, of course, mr. obama trying to get people to forget his famous empty promise that you can keep your doctor or his further promise that premiums would go down while he argues that health care is, quote, not a privilege, a right. we'll have a full report and take up the case with two of our leading attorneys rebecca rose woodland and wendy patrick j. . the senator is a top tier 2016 candidate or perhaps the man himself. otherwise why would they publish a hit piece on his

personal finances which makes rubio a lot more relatable to voters than the nine-figure net worth hillary clinton for example. among our guests tonight fox news the five co-host juan williams, republican strategist matt schlapp and the national review's jillian k. melchior. we begin with the bomb threats at the white house and the senate. press secretary josh earnest was grilled by reporters why the briefing room was evacuated but not the rest of the west wing steps away in which the president and his family remained? >> josh, you said you were evacuated, but you just went to your office? >> that's right, i was evacuated from this room like all of you. >> you can remind us how close your office is? >> right down the hallway. >> reporter: hard to imagine why a bomb threat would necessitate evacuating this entire room wouldn't affect the rest of the west wing complex

it's not a very large complex? >> i can't account for that. lou: joining us now to talk about the administration's inability to combat threats both at home and abroad and curiously staged, if you will evacuations from the white house. fox news strategic analyst lieutenant colonel ralph peters and the author of the thriller valley of the shadow. ralph great to have you here. let's start with your reaction to a white house that evacuates the press briefing room under threat of a bomb and a suspicious package presumably, and leaving the president in his office and the president's family in the white house as the reporters are going off to the executive office building. what do you make of it? >> practical reason. i would bet the secret service didn't want the journalists to see the way, the tools they use to clear an area from bombs.

because if they see what the secret service is up to and how they do, it inevitably some journalist would print it. it might have been a very, very practical security measure. lou: i get the feeling ralph, you might not have put the press high on priority list for evacuation under such a threat? >> i would say that this administration might have left -- if it was a real threat left the press in place and be glad to do it. seriously, the problem's bigger than whether or not the press is flushed out of the briefing room. the problem is with swatting as they call tucker -- it the phone call claiming there is a bomb threat or hostage situation week don't take them seriously enough. whether calls are made by a bona fide terrorist or a drunk from a bar or high school punk. it needs to a terrorism charge. until you get serious about the penalties for calling in the

threats. our police fire departments, fbi secret service are going to be run ragged and continue to cost a lot of money. lou: is it your view, and i agree with you, the reflective response of security agencies, s.w.a.t. teams in full regalia showing up because of some ridiculous phone call that is not substantiated the threats within the call, it's just mind-boggling the way our police agencies law enforcement security agencies react here. what is the alternative? >> well the alternative is to have real penalties and go after the people make the calls. >> can we find those people? do you believe we're good enough to track those people down? >> you will probably miss some. we could do a much better job of tracking them down, you have to have telecom companies on board. you have to have the internet companies on board, and you got to get the clowns on the far left and far right who don't want the rand paul types who

don't want us to monitor anything ever. you got to get them on board or neutralize them. if we don't take them seriously, the terrorists win. if it's a high school prankster the terrorists win. one thing that nobody or we rarely talk about is the enormous financial impact of 9/11 and all that came after. and every time you get the copycat terrorist calls, terrorist sympathizer calls, you get the copycats it costs money to small town budgets the city budget the state budgets the federal budgets. think of what al qaeda and all that has come after. how many hundreds of billions of dollars they have cost us around the world and here at home. that's a terrorist triumph and we're not serious enough about it. lou: lieutenant colonel ralph petering are good to have you here. >> thank you, lou. lou: president obama defending obamacare before hundreds of hospital administrators at the

catholic health association. but the target audience of his speech certainly the justices of the u.s. supreme court. in the next 21 days those justices will decide whether to invalidate the health care law subsidies fox news supreme court correspondent shannon breen with our report. >> i think this is almost like a bullying technique. >> reporter: the fallout continues today from the president's remarks that not only should the supreme court not have taken the case it's currently considering which will impact obamacare subsidies paid out to millions of americans but expects the supreme court to play it straight and side with the administration. >> what is the implication there if you all don't win that case? that the justices are playing politics with the issue or that they don't know how to do their job? >> i think the president's view is that this is a straightforward case, and in the mind of the president as you mentioned yesterday, this is a case the supreme court shouldn't have taken up.

as long as they have issuing the supreme court believes the reading of the law is quite clear. >> reporter: subsidies will extend in the states that set up their own exchanges, more than 35 decided not to but the irs extended them into all states. so far obamacare architect jonathan gruber explained the law this way. >> if you set up an exchange that means citizens don't get tax credits. >> i can't account for his comments. >> reporter: the president continued to sell his health care law at catholic health care association gathering in washington. >> despite the constant doom and gloom predictions, the unsending chicken little warnings that somehow making health insurance fair and easier to buy would lead to the end of freedom. the end of the american way of life lo and behold it did not happen. >> reporter: the president went onto say in many respects the affordable care act performed better than expected. >> costs have exploded. not just the cost of premiums but the cost of co pays the

cost of deductibles in spite of the president's promise that people would see premiums drops by $2500 per family. the newest reports are premiums are going to skyrocket again this year so there is no end in sight. reporter: some saw irony in the fact the president spoke to a catholic organization about the overwhelming success of the health care law. dozens of other health care groups are suing over religion objections to the law. back to you. lou: shannon thank you very much shannon breen. political commentator pam geller launched a new free speech campaign. geller is running billboards with the winning cartoon from her recent mohamed art competition in the state of texas. criticized by the left from provoking jihadis and became the target of an assassination plot. the would-be jihadist was killed by boston police last week. we'll keep you apprised on this

. lou: the mckinney, texas police officer placed on administrative leave for his actions at a pool party has resigned. corporal eric casebolt was the target of demonstrations after a video showed him forcing a black teenage girl to the ground. he didn't get support from the police chief who said casebolt's sanctions were indefensible and out of control. hundreds marching compared to what happened into ferguson baltimore and elsewhere, but a local internet talk show host who is himself black defended police. he posted a message on facebook saying, quote you've been hoodwinked, bamboozled show 7 minutes of a 30 minute ordeal.

i live in this community and this entire incident is not racial at all. a few thugs spoil a community event by fighting. joining us now, the five co-host columnist for the hill juan williams. good to see you. >> always a pleasure lou. lou: the idea that these professional activists are getting in on a suburban pool party and trying to create equivalencies to ferguson to baltimore. your thoughts. >> you know what outraged me lou, i saw people walking in the protest with their hands up. remember that? from ferguson, which turned out to be a bogus claim? remember that. that was exactly what they were doing are in incident in texas. as if you are dealing again with a very difficult criminal situation you know some poor black kids who are out of control. no this is a suburban pool party. we don't know as you just

heard from the man who lives in the community a black man we don't know what happened before or afterwards. i don't see there was any need for the policeman to be sitting on a bikini clad girl, i don't know what she was hiding. idea he pulled a gun was over the top. nonetheless, the fact that people are taking this in a way that would allow them to exploit it as evidence of somehow police culpability in ferguson new york and elsewhere again, it's just undermines their own credibility on this very important issue. lou: you know policing in this country has gotten to the point that it's a very difficult job, always a difficult job and more challenging no support in most instances. what are we going to do about instilling among those people whether they live in the suburbs of mckinney, texas or downtown baltimore instilling respect for law enforcement officers so that the first reflex is not aggression, is

not confrontation, and is not disobedience to a law enforcement officer? >> this is a tough one, you know, because look, the reality is that lots of times when the police officer shows up and a lot of the communities now not this one, not this suburban pool party. i'm talking about in urban, tough neighborhoods poor neighborhoods when the policeman shows up it's often times the first time that any authority figure has intervened and tried to set some limits on bad basic and the response from a lot of the young people is you know you can't tell me what to do or i'm going to show you who i am. that is so disruptive and threatens the police. it just -- it sets off the whole trauma on a regular basis. lou: how do you instill in the young people, get through the sociology why kids have tough lives. lots of people have tough

lives they don't confront or go after a policeman or his weapon, as we have seen this. is ignorance and it's on display as some sort of great social demonstration. it is stupid whether it's an individual it is stupid whether it's a mob, and police should not have to put up with this nonsense because they are after all, how well trained and meaning, they're human. >> good point. say it again. they are only human. in that situation at the pool party with the suburban kids there's no sense that anybody was hiding it. still i think the police officer's behavior indicated he felt threatened. he felt the situation was out of control, trying to impose control and failing and overreacted. but he is a human being who felt threatened and i think if you don't stop and say listen you know what? you need police and somebody needs to impose order here. we're going to be at a loss if our community, and especially poor, minority communities that

are afflicted with high levels of violence there's going to be a tremendous loss unless can you have the police trusted and act in a way that says we are trying to help you. lou: you know here's the deal. the cops are the cops. we got that part, it's a given. now time for folks to start respecting law and order in this country. what about black churches? what about public schools in this country? boys clubs? girls clubs? teaching young people all across the country first thing you do is you respect authority. you don't adjudicate on the streets. you don't decide on the streets. leave that for later. first don't get yourself killed. don't get yourself or someone else injured why. go through this? why perpetuate this ignorance and why aren't community leaders doing more to ensure it's tamped down and stops here. >> i couldn't agree with you more. if you recently paid attention

to what's going on in baltimore with a very sharp escalation in terms of murders and chaos because i think the police have pulled back. police said any time they stop anybody, any time there is any question. lou: the idiotic situation has given them no choice. >> the people who need it most are the people who live in the dysfunctional highly violent communities. there has got to be a lesson here, i wish, i wish that those activists and leaders that we saw today in texas for this pool party run amok were more likely to say look, why are black people killing black people? what's going on? why the dysfunction? let's protest and do something that can help ourselves. take responsibility here. lou: signing up with the dobbs program to start instilling respect for law enforcement officers? >> look you know what?

equivalency and implied moral superiority over the nine men and women who make up our supreme court. just one day after he slammed the high court for even daring to listen to a case that challenges obamacare. here is the president not only defending his signature law but demagoguing the issue, and insulting everyone who opposes obamacare, he calls them cynical ideologues in front of the catholic hospital association. >> health care is not a privilege, it is a right. there's something -- i have to say just deeply cynical about the ceaseless, endless partisan attempts to roll back progress. we have an obligation to put ourselves in each other's shoes and see each other's humanity. lou: mr. obama who can't win on the facts, instead trying to convince people his moral sense is much higher than might reasonably be expected of one

middle class, and by the way, those deficits utterly unsustainable yet here we are 40 years in. and we've built up an external trade debt of $17 trillion to boot. to sacrifice, the jobs and the quality of life of millions of americans who are the victims of such glib leaders who deny millions of americans the opportunity for prosperity. where is the morality when a president lies refuses to enforce our laws and who denigrates congress and our judiciary, who sneers and dismisses coequal branches of government established by the constitution he's sworn to uphold and to defend? our quotation of the evening now which offers perspective on the petty politics that seem to have swamped washington in recent times. our quotation tonight, the words of one of my favorite journalists, a great

. lou: the president today resorting to what his well-developed sense of superiority to make his case of obamacare one day after he blasted the supreme court the decision to consider this case. joining us to better understand it two of the best attorneys in the business, defense attorney rebecca rose woodland and wendy patrick. good to have you with us. let's start with the president trying to bully the supreme court wendy. is this -- will they be tempted to show him who's co equal. >> the good thing about the supreme court, they are not tempted by either side. their goal is to follow the law, that's why they are where they are. what's egregious about this particular case, it's a pending case, not something that's been resolved, one way or the other. president obama wouldn't be the first lawyer to disagree with something the judge does. while the case is pending this

made the remarks more inappropriate than they already were. lou: what do you think? >> i agree. supreme court is a separate body. lou: coequal branches. >> coequal. he is out of line by discussing a pending case saying they shouldn't have accepted the challenge, who is he to say that? they determine how they should. lou: he's saying everybody is a partisan nine judges that are just democrats. why hasn't anyone in the national media pointed out to the president or why hasn't the president been man enough to say these guys upheld obamacare three years ago. >> yes. lou: and had to torture, reason and the language of the law to do it. >> more the facts of what have you done for me lately. three years ago was a long time, he appointed two of the jurists so this isn't an arena. lou: i didn't know how this was going to end, jurist. >> right!

[ laughter ]. >> the issue is the supreme court they have live appointments, they are not looking for political gain here, they're looking to preserve the constitutionality of the legislation or not. and that's very important, and i think obama should step back and let them do their job. lou: a cop. turning to another subject, the texas pool party that some fools are trying to raise to the level of ferguson or baltimore. the cop stepped down, corporal eric casebolt. his police chief saying he was just wrong, period. that's it. what are police going to do now? they're confronting these -- well whatever they are. >> you made a good point on the last segment. where we're seeing climate change is in the way that society looks at police officers. that's too bad. because when police step down crime goes up. they should be able to enforce the law, should respond to situations, what i think distinguishes what we saw on the portion of the videotape

that went viral is was there an overreaction, that's what the chief of police just said. we want our kids to respect the police. >> exactly. the police are there to maintain order. yes, there are times that one individual may overreact, but in this situation we are not seeing -- lou: thank god no one got hurt. >> thank goodness. let's not make it racist. to the kids they were as provocative vulgar and insulting. no police officer should have to put up with that. >> no what's difficult when you look at police conduct. we've got to look at it in foresight. what facts and circumstances were present to the officer at the time that made him believe he had to use that level of force? lou: i got to turn to the james holmes, aurora colorado the shooter out there in the movie theater. three jurors were dismissed because they talked about the news rebecca. >> i know. lou: as if this were a medieval

court. what's going on? >> okay, to put it in perspective. he didn't declare a mistrial the judge, which is very important. he dismissed only three and retained the rest of the jurors and had backup jurors. what the concern is when people watch the news they are influenced by things that may not be legal or factual or evidence in the case. lou: so they're smart enough to decide a person's fate but too stupid to read a newspaper, to listen to a radio or watch television. >> no throughout the course of a trial usually and we see this a lot with the judges. they want to maintain that the information and the facts are as presented in the courtroom. so whatever is determined to be legal within the rules of evidence. but in this matter, i was very concerned that the judge was going to call a mistrial on a case where we cannot have this repeat. it's costly, and there's no need for that. >> i know this is not going to be a popular idea with either of you, but shouldn't the legal system be less dependent upon a

bunch of alternate jurors and really be respectful of the jurors they're bringing of their time be more efficient and the way which they administer trials and the nonsense that a juror is not going to know what's going on from media sources? i guarantee you there's not a juror on any -- on any jury who has absolutely virginal when it comes to information about his or her world including the part of that world affected by that trial? >> that's right the distinction lou, and you make a good point is up until the trial starts everybody is on social media. you can't deny it. even those on the pool claim they don't use it. the prosecutor got in trouble for tweeting during the trial. >> he said it was an accident. >> everyone is on their devices we can agree on that. once the trial has begun we're in a different perspective. now people are -- lou: i'm suggesting you all get out of it.
