mexico admits he went specifically to san francisco because the city offers sanctuary for illegal immigrants, including criminal illegal immigrants. yet san francisco's sheriff defends his office's decision to release sanchez and place the blame on the federal government. sheriff ross saying, quote -- they have the sheriff's department to notify i.c.e. before releasing him. and i.c.e. says sanchezs case is one among more than 10,000 in california alone, 17,000 nationwide since january of last year. in which an ice hold on an illegal immigrant was declined or ignored. we take up why our federal government no longer works for

the american people with guy benson and jillian kay melchior, is the city of san francisco legally liable for the murder of kate steinle? lis wiehl and mercedes colwin on that issue, and two authors from the right and the left, from the right, brad thor, from the left naomi woolf on where this country is headed. lots of questions about what direction our country is headed in and who's at the wheel, and her murder ignited a national debate on border security and illegal immigration. francisco sanchez was by any definition a public enemy, well known to federal and local authorities. nonetheless, the sheriff's office simply released him to roam the streets of san francisco and then to kill. among his criminal convictions are at least four felonies for possession of heroin and manufacturing narcotics.

a misdemeanor conviction for inhaling toxic vapors. he's been charged several times with felonies for illegally entering the united states after being deported. he was immediately charged with steinle's murder, and this morning arraigned for the crime. fox news correspondent claudia cowan in san francisco with our report. >> reporter: local law enforcement and federal authorities are playing a very public blame game as each accuses the other allowing a seven-time felon with a long rap sheet to be set free. francisco sanchez was in federal custody for four years when he was handed over to san francisco authorities to answer on an old bench warrant. a transfer supposed to be temporary because he was going to be deported back to mexico for the sixth time. but after the charges were dismissed, the sheriff's department released sanchez without notifying immigration and customs enforcement. less than three months later by

his own admission, sanchez shot and killed 32-year-old kate steinle on a popular san francisco pier. if the feds wanted sanchez back they should have issued an arrest warrant. >> they knew his history with deportations, we did not. they could have taken measures when they brought him here to make sure that there was a warrant or a judicial order which we would honor. >> reporter: at a senate hearing in washington, i.c.e. officials were on the defensive. >> tell me specifically what is preventing us when we have people in this country illegally, and they have had seven prior felony convictions why aren't we able to deport those individuals? >> in that particular case, our detainment was not honored. >> who didn't honor it? >> san francisco sheriff's department did not honor the detainer we lodged. >> reporter: in the hot seat, san francisco's mayor issued a statement saying --

former san francisco mayor senator dianne feinstein issued a statement this afternoon saying sanchez should not have been released and looking into additional federal legislation to prevent this thing from happening again. francisco sanchez and all the lawyers are due back in court at the hall of justice in san francisco on july 22nd. lou? lou: claudia, thank you very much, claudia cowan from san francisco. we'll have much more on this story and this issue later in the broadcast. turning now to the white house. president obama's men trying to put a positive spin on the second missed deadline in a week to reach a deal on iran's nuclear program. >> as secretary kerry himself said back on sunday, we have never been closer to reaching a final agreement than we are now. but there continued to be some significant differences that

remain, and this is a view, this is a view not just of the united states, but the view of all of our p5+1 partners as well. so that's an indication that these talk at least for now, are worth continuing. lou: talk between iran and major world powers will continue until friday. a key problem reportedly iran's insistence that all united nations sanctions against iran be lifted immediately. that includes a ban on the import and export of conventional weapons or all sanctions be lifted immediately possibly. we'll be taking all of this up with former pentagon official k.t. mcfarland and claudia rosette, journalist for the defensive democracies. greece disappointing eurozone leaders at an emergency meeting in brussels. creditors were expecting greece's prime minister to bring with him a new written proposal how to safety country from financial disaster.

dwindling resources in his decision to cut troop levels to 450,000, 17,000 civilian employees are expected to be laid off. that the same hearing, defense secretary ash carter made a stunning admission about the president's program to train and to arm moderate syrian rebels to defeat the islamic state. >> as of july 3rd, we are currently training about 60 fighters. the reason for that has to do with the criteria we apply and some of this is the law, to these recruits. but we'd like to see more and we're trying to get better at training them because the number 60, is, as you all recognize, is not an impressive number. lou: no, it's a silly number. and for a defense secretary of the united states to stand before congress and actually say that with a straight face, my god!

theater of the absurd, i don't know where to begin, lou. look, 60, what that really means is we're turning this over to the iranians whom we have already been helping on this front, which leads tout iran nuclear talk. there is a massive american capitulation going on here to the world's leading terrorist sponsoring state, which, by the way is not going to be stopped by the current endlessly protracted talk from getting nuclear weapons. so, yeah, 60 is an emblem of very bad things. lou: perhaps the avatar for the absurdity that seems to be this administration's foreign policy, k.t.? >> it's all about iran, about president obama's obsession with iran that he's had since five minutes after being sworn into office, we're going to extend the friendship with iran, clench your fists. president obama is chasing after a deal with iran, and all of the things, if you pull the

string, it's all about iran. why is nobody signing up to be trained to fight isis? because guess whose fight they'd have to fight alongside the iranians. if we wanted to deal with isis we'd arm the kurds and the anbar cities why. ? iran doesn't want strong kurds iran doesn't want strong sunni arabs. all of the things go back to president obama's obsession with having a deal with iran, a deal at any price, at any cost. lou: and you claudia sound as though you have reached basically the same conclusion here, that this is capitulation to use claudia's word. >> yeah. lou: is there not a role for our senate, for you our congress, for the loyal opposition? is there not some voice that can be heard above all the others to say to this president, are you out of your mind? i know netanyahu's tried. he's been dismissed. >> here's the problem that

president obama is going to be gone, he's not going to be president five years from now. five years from now there will be a nuclear arms race in the middle east as a result of his policies. the people in congress now, if they still want to be in congress five years from now, they better understand they will be held accountable. obama will be long gone, they'll be there, held accountable, because right now the deal is unverifiable, unenforceable and unbelievable. the other countries in the region are looking at that and laughing saying we can't trust america, iran is getting nukes we have to get our own and nuclear arms race in the middle east. lou: josh earnest said we're not just talking about it, this is worth pursuing the next few days, it is the 5+ 1 countries and, of course, germany, as if the united states needed some company in this thing, some corroboration to continue another 72 hours of negotiations. the white house they just look

they'll get that fixed quickly. the obama administration extend the deadline for the iran nuclear talk as they have again and again, so tonight, a few thoughts on deadlines and red lines, at least as recognized and interpreted by this administration. incredibly it was three years ago that president obama sternly almost theatrically warned iran, quote, the clock is ticking. perhaps the ticking to which mr. obama referred is that of the doomsday clock ticking closer to armageddon since he took office. ticking or not, it's been more than 500 days since the negotiations began, 500 days. over that period, u.s. officials made incredibly nearly 70 transatlantic flights to be at the table for the talk, only to miss yet another deadline. the fifth missed deadline, a deadline is not the only self-imposed line ignored by

the administration. president famously proclaimed that syria's use of chemical weapons would be a, quote, red line for us and vowed consequences. of course, there were none. when faced with tough action against syrian president assad mr. obama simply instead cowered and turned to putin for help. but mr. obama's self-imposed lines didn't stop there, vowing to, quote, degrade and destroy the islamic state in syria and iraq. a claim he repeated incredibly yesterday, followed by these comments. >> for hearts and minds is going to be a generational struggle. ultimately not going to be won or lost by the united states alone. it will be decided by the country's and the communities that terrorists like isil target. lou: and that made sense apparently to the president himself. a generational struggle so much for degrade and destroy.

to see hillary clinton denouncing hillary clinton donor donald trump. i wonder if she'll return the money he's given her over the years. lou: i can see that happening almost immediately. >> and went onto tie donald trump to the serious republicans in the race. donald trump is not really a conservative. if you look at his record over many decades and said that the entire party falls along a, quote, spectrum of hostility on the issue of immigration. lou: i love that spectrum of hostility. >> i wonder where she falls on the spectrum of hostility. as u.s. senator she gave an interview where she said she was adamantly opposed to illegal immigrants, not illegal immigration, illegal immigrants. so she falls i assume on the spectrum, maybe between jeb bush and donald trump. we'll have to ask her. if someone would ask her a follow-up question sometime in the next few months. lou: your thoughts, positive or negative? >> i think he's an absolutely negative influence in politics.

we appreciate it. >> thank you, lou. lou: thank you, both. a canadian trying to soar high above the clouds landing himself behind bars. 26-year-old daniel boria tied 110 helium balloons to his lawn chair and took flight. he claims he rose about 10,000 feet in the air before deciding to parachute off the chair. that makes it sound like somebody questioned his judgment. he injured his foot upon landing, the stunt an attempt to proclaim his solution company, but law enforcement not amused. officials charged him with one count of mischief, causing danger to life and not necessarily the publicity he was looking for, but good going nonetheless. up next, a tragic murder in san francisco a national debate on illegal immigration, sanctuary cities and a border wide open. and a florida state quarterback doing the unthinkable. we take up both cases with our attorneys here next.
