virginia, colorado and iowa into the democratic column in 2008 and kept them blue in 2012. if hillary clinton is the democratic nominee in 2016, those states and their combined 28 electoral votes could go red. according to new quinnepiac university poll which pitted clinton against three republican presidential candidates, jeb bush, marco rubio and scott walker. in those three swing states, clinton loses to each of them in head-to-head matchups. in certain matchups the poll even showed democratic long shot, turned contender, bernie sanders faring better than clinton but still losing. a deeper dive into the poll might explain clinton's potential troubles. in all three states her approval rating is underwater. clinton has unfavorable rating of 56% in both iowa and colorado. 50% in virginia. the poll did not match up clinton with the current republican frontrunner donald trump but the swing state

nickname mr. softy, it is 3 billion-dollar quarterly loss is the largest ever. apple and microsoft stock declines are responsible for shaving 66 points off the dow. dan ives covers both stocks. he is a senior research analyst for fbr capital markets. thanks for joining us. do you think this is warranted today? >> they're held to a higher standard. they're the gold standard in technology in terms of apple even though they slightly beat street. it was not enough for the whisper numbers of 47 1/2 million iphones. number was over 49. i view it as small step back. there are worries now going forward on the growth story. melissa: let's go to ashley webster real quick as we speak of tech. qualcomm's earnings are in. what do you have? >> melissa, here we go. on earnings 99 cents, the estimate was for 95 cents. that is 99 cents on eps. revenue at $5.8 million. the estimate was for 5.85.

that is a slight miss on the revenue. of course we'll be keeping a close eye on them. they have had trouble with the chip business. they have been underpressure to spin off the chip business from the patent licensing business. so we'll dig through it a bit. headline numbers beat on earnings. a slight miss on revenue, melissa. melissa: thank you so much for that, ashley. let me get your reaction. this is sort of the same story we're seeing through tech. what is your impression overall? >> it has been a pretty choppy earnings season. google, ibm which continues to be a massive challenge for growth. you're seeing it. it is a bipolar spending environment but on apple it is a little knee-jerk reaction. i do believe we've seen this the last few years. we go into the next product cycle, 6s, nine thames x cash, we -- times ex-cash we view it as a buy in terms how we view the name. it is improving. the watch is a big x variable. they're not giving numbers around that.

the china growth story is the epicenter of apple. that is really the high octane fuel for apple. melissa: let me pull some of the things out you said. you would tell "people" to add their position. >> i view it nine times ex cash, given iphone ship. s. given china, 100% growth, there are a lot of skeptics think that will not continue. we view that as is 50 billion-dollar market cop student. -- $150 billion. 140, $160 stock and i think this is one look back six months. melissa: tell me about the rest of the market in tech. there is a, are we in the midst of a tech bubble. look at stocks inflated carried higher. if you break down the nasdaq, turns out net-net more losers than winners. what do you think of tech? >> bipolar spending environment.

traditional hardware and semis. that is under massive headwinds just given the market. then areas like big data, social, cloud, cybersecurity. that's where you have seen strength. so it is really a finite group of growth companies that is why the valuation spectrum continues to move out on a lot of these names as investors need to own the high growth names. but the losers and winners are becoming clearer in the techlandscape. melissa: losers and winners, have the winners gotten out ahead of themselves? are we seeing there the bubble? talk about social specifically. every company when you hear earnings oh, but they're betting big on the cloud going forward. everyone is trying to do that same thing you're talking about. are those companies in jeopardy where you see the bubble. >> it is true. around the periphery, bear cued today, the stock missed down 30%. as an investor do your homework, sharpen the pencil. know where winners are, secular themes are in the market.

melissa: we've got breaking news. thank you so. david, over to you. david: [inaudible]. ashley, how do they look? >> american express, david, earns coming in at $1.42. the estimate was 1.32. beating eps 10 cents but on the revenue side the estimate was for 8.46 million. the number coming in at 8.28 million. so same as qualcomm. we have a beat on earnings but miss on revenue. american express saying that strong dollar really hurting its international business. we heard that time and again, david. david: after-hours not doing too bad. we should add it is close to its 52-week low. if you're looking for a bargain maybe it is american express. talk about gold, looking for bargains. some people think it is, some people think it has a lot more to go, tumbling for the 10th day in a row. prices at five-year low. closing just under $1100 as an ounce. goldman sachs analyst jeff curry

says the worst is yet to come. he sees gold dropping below 1000 bucks, the lowest self since 1999. i talked to ed butowsky, said it could gown to 650 bucks. >> that mines oil could go down too. i'm not that bearish on it. there are bunch of things headwinds to gold. strong dollar and headwind in the states, took top off it. go back to look, when the shanghai exchange started to tank, we saw liquid earnings or put up margin money in china. so that was definitely the beginning of it. and now the only two real reasons i want to get involved with gold, are number one to hide my money from inflation. we don't have inflation. arguably we've got deflation. number two is armageddon. we made it through the greece thing.

i hardly think that is armageddon. i don't think there are real worries there. nothing tells me you want to get in front of this falling knife. david: another commodity affected by value of the dollar, that is oil growing down below 50 bucks. how far does that go? >> i think we go to make new lows. it is hard to get bearish at the bottom here. i think we get down to the 40 level, 43, 40. then we'll start to see refine is come off-line. you know what? it is not flowing through to the economy. that is the big worry. david: it is not flowing through because there is not enough gasoline out there, right? we have big excess reserves of oil, the refined stuff is in short supply. >> well, but that gas price savings that we have had from the $100 a barrel oil to $50 a barrel which is 80 to 90 billion on annual basis in the consumer products has done nothing to retail sales or cpi or ppi. it is not flowing through. that i think has what got the

came in 59 cents just under the estimate. revenue 2.92 million. revenue is just under 3 million. they operate in malaysia and the united states. the cost cutting has been effective though numbers are down but as you mentioned, david, those shares moving higher in after trade. obviously something in the guidance investors like but a miss on the top and bottom. david: china is down 26% for las vegas sands. thank you, ashley. >> sure. melissa: we have breaking news a new york state wage board moving to increase the state's minimum wage for fast-food workers to 15 an hour. the board appointed by governor andrew cuomo to hike the minimum wage incrementally by 2018 and by 2021 across the state. now the acting labor commissioner to accept, reject or modify the board's recommendation. this should be interesting.

uber pulling a trump in its never-ending battle with new york city mayor bill de blasio uber isn't pulling any punches this time. in a email to users the ride sharing app gave out city councilmember margaret chen's, phone number. the she is the original sponsor of the proposal to cap uber use in new york that received bill de blasio support. only 16 new drivers a month according to the company. uber spent $10 million on a campaign to gave stay in business. councilmember chin will not be bullied despite the campaign and incoming phone calls on her way. new york city's council is considering a bill that would put a cap on uber. another bill would allow the city to study ways to regulate the app based car industry. both are scheduled for a vote on thursday. i mean, this, let's not forget that uber also points out in the

email, i got one as well, they want you to tweet at them, mayor de blasio got, i think $500,000 from the taxi and limousine commission in his campaign. david: that is the incredible thing. he says, i do not debate with heads of private corporations over their own self-interests. that is what he says about uber. as though he has no self-interests. the taxi commission bankrolls his run for the mayor. of course he has, everybody has self-interest in this battle. melissa: just own it. be up front about it. his support is sort of bought and paid for on this. he is living up to his commitment there by fighting uber. david: we are living up to our name as new york city place where people fight out in the open. it is coming out now. there is no way the gloves are going to stay on. melissa: no, definitely not. david: a few other stories on our radar, the man who flew a gyrocopter through some of america's most restricted airspace before landing at the u.s. capitol has rejected a plea deal from the government. douglas hughes's attorney says he believes federal guidelines would call for zero to six

months in jail, rather than 10 months prosecutors were offering. prince george is touring, turning two years old today. at the changing of the guard at buckingham palace the guards even played happy birthday to him. prince william and duchess kate's birthday boy celebrating with a small family party at his parents country retreat according to reports. an increase in shark attacks in north carolina has one couple taking matters in their own hands if you can believe it. i don't know if this thing works. the couple craft ad bizarre-looking contraption taking to the beach to outer banks before a lifeguard said you can't do that. it isn't going to work but secondly it is a danger to swimmers. you do what you can to fight sharks. melissa: we talking about this. crossing "new york times" reporting that mayor bill de blasio and administration is dropping their plan for an uber cap. new york city will conduct a four-month study on the effect

david: breaking news. uber winning a very big one. new york city mayor bill de blasio is for now, anyway, dropping his proposed bill to limit the growth of for-hire vehicle companies like uber in the city. according to "the new york times." had propose ad freeze on growth for higher vehicle companies including uber around its competitor lyft. "the times" reporting that the city will conduct a four-month study on congestion and pollution which it said uber may be contributing to. stay tuned for that one, melissa. melissa: hmmm. let's go back to ashley webster at new york stock exchange. >> digging more of earnings report, qualcomm beat on earnings and missed on revenue. the company talking about major

retruck turing of the company. reviewing corporate structure as it puts it. planning changes to the company structure. it will be cutting offices and cutting its headcount cutting spending by $1.4 billion. reducing number of employees. a shake-up on the board. qualcomm has been under tremendous investor activist pressure with likes of janus partners pushing qualcomm to split the chip on business with the decline of pc market to the patent licensing business where they do much better. a lot going on with qualcomm in the latest earnings report. seems like they're reviewing their entire operation, guys. back to you. melissa: thank you so much. david, over to you. david: we have some breaking news. judicial watch is getting some preliminary details on a foia request about the irs. of course the president tried to dot impossible defending the irs last night. our own gerri willis has been working this story. gerri what have you learned?

>> i have to tell you they have not released these emails yet but what we understand they might contain, listen it, this is breaking news, we believe that emails are going to show that the irs used donor lists from tax-exempt organizations to track down donors. david: wow. >> and we are getting details that among the organizations that were targeted too that you may have not expected, the u.s. chamber of commerce. david: holy cow. >> and karl rove's crossroads gps the issue -- david: this could be interpreted as kind of and intimidation of people that disagree with the president's views on things? >> it could be indeed interpreted that way, david. you got that exactly right. what we're talking about here, they would look at the organizations to see if they reported their donations to conservative groups as being subject to gift tax. that is not the way it has been interpreted by the supreme court. so, we'll have more details as the evening wears on. i'm just getting these details now. but surprising new news. of course it comes on the heels

of the president's own defense of what his administration has done when it comes to the irs. just last night, and i think we've got this set, he criticized some of the comments, criticisms of the irs. here is what he had to say in defense. >> we've got this back office and they're going after the tea party. well it turned out, no, congress had passed a, crummy law that didn't give people guidance in terms of what they were trying to do. they did it poorly and stupidly. >> got to tell you, the president has big problems with his own treasury departments. tigta, which is the treasury inspector general, released a report two years ago, way in the background here, that said the irs used inappropriate criteria that identified for tea party and other organizations applying for tax-exempt status based on what? their names or policy positions. so this is two years old. the president disagreeing with this.

this is his own administration. david: illegal to intimidate people using the irs to intimidate political enemies. that is against the american culture around it is, was made illegal after nixon tried to do it back in the '60s. should still be illegal and somebody, looks like somebody violated the law. >> president also complaining here that the irs doesn't have big enough budget to fulfill its mission. as you know we're collecting more taxes than ever. david: absolutely. gerri willis, thank you so much. melissa. melissa: concern after hackers task control after jeep while it was moving. two men working for wired.com, hijacked vehicle, toying with the air, the radio and more terrifyingly the brakes. jeff flock joins us live from chicago with the latest. jeff, this is a really disturbing story. >> can you imagine, if all of sudden going down the expressway, here i'm going about 50 miles an hour. what if i just didn't have control of this car anymore? that is what these hackers did. wired.com, "wired" magazine

hired these guys, white hat hackers, allegedly, who just exposed this flaw, this ability for someone who knows how to, to get into the system of the car and this is how they did it. take a look at this. this is the uconnect system that fiat chrysler vehicles use. right now we're using it to listen to sirius radio "after the bell" show on that fox business network but people use them for all sorts of things, for music, for navigation. essentially this connects your car to the internet. we have pictures what this system looks like on the various chrysler vehicles. this is what they used because the car is connected to internet. they were able to get into the system and screw around with it, blasts the radio. blasts the ac. gain control of the braking system. turning the brakes off. turning engine off at one point. in fact they did it to the wired correspondent with a big 18 wheeler behind him just like the one behind me right now.

can you imagine if all of sudden your car stops and you have a big 18 wheeler behind you? should you be freaked out about this? well differing opinions about it. fiat chrysler put out a statement today say it has no evidence saying anything like this has been done in the real world. i would say this is the real world. hackers say possible not just fiat chrysler vehicles but any car connected to the internet is potentially hackable. melissa. melissa: amazing. jeff flock, thank you so much. david. david: coming up later in the show, donald trump heading south as he doubles down on criticism of his gop rivals. from snapchat to selfies how presidential karn dates stepping up their game to appeal to millenials. that is coming up. ♪

1.02 million. anyway you look at it, beat on top and bottom for sandisk. that stock up 5% as it trades after-hours. melissa: ashley, thank you so much for that. david, over to you. david: can't stop, won't stop. donald trump doubling down on his offense, slamming his gop rivals and a trip to the u.s.-mexican border. that is tomorrow. let's bring in today's panel. matt welch from "reason" magazine and judy miller from the manhattan institute. she is also a fox news contributor. john tamny, i have to say i'm mixed minds on donald trump. clearly he goes overboard what he says in some different things. on the other hand if the whole establishment is against him there must be something good about him, right? >> yeah. certainly has its appeal and i think that is why the voters to some degree are rallying around him. i'm a little bit disappointed. republicans are historically skeptical about expensive government, armed government. here they're supporting a guy who promises to build a wall

policed by armed federal officials this is disappointing this is anti-economic growth. immigrants are wonderful. why would they support that? david: if you dig down on a lot of his ideas they end up costing a lot of money. they do seem to be against conservative principles. matt, carly fiorina was on fbn earlier today. here is what she said about trump. i think shy is right. >> donald trump taps into the frustration i feel, ben carson feels. those of us who are outside is know voters are sick of sanitized sound bites, formulaic speeches and in the end a talk but no action. politics is not a game or entertainment. it is deadly serious. david: she have the right mix there, matt? >> she is right. her and ben carson and to lesser extent ted cruz are trying to tap into this outsider, we hate everything establish men tearian ethos. david: which ain't bad. >> this is huge portion of gop.

trying to get at donald trump after trump gave out his cell phone number on national television. here is how lindsey tried to deal with this. ♪ >> if all else fails, you can always give your number to "the donald." david: john, i like that, but is it even wise to try to match up donald's antics? >> no, no. he is always going to beat you on the big stage, but hopefully it's a reminder to voters how very unserious these people are. that assuming any of them gets elected, we very much limit their power. what an embarassment all this is. david: but, matt, is it wise to try -- at least by the way we're getting some of this stuff out before the campaign gets serious, right? >> yeah. let's remember that lindsey graham and rick perry, who has been giving some blisser iting speeches about donald trump, they're on the bubble right now of that first debate. they're right there 10th. lindsey graham is doing worse than rick perry. they have to distinguish

melissa: earnings season in full swing. we're expecting report from e giant amazon. jo ling kent with the preview what to expect. >> melissa, amazon expected to post a loss of 14 cents a share and revenue of $3.29 billion. the report after the bell

tomorrow. analysts will watch mortgage american sales growth and amazon web services which drove the first quarter. and of course amazon prime. you remember prime day which will not be included in this earnings report saw mixed success with sales outpacing black friday but some upset customers who were disappointed by the deals. overall amazon prime is a crucial revenue generator for ceo jeff bezos. the company says there are tens of millions of members in the u.s. consumer intelligence research partners estimates 44 million americans use it. investors will also be watching amazon web services which bezos valued $5 billion last quarter with net sales up nearly 50%. amazon shares are on a tear. they're up about 57% year-to-date. melissa. melissa: all right. i look forward to that. jo, thank you so much. david, over to you. david: joining me for reaction what to expect tomorrow with amazon earnings, kevin kelly, john lonski, moody's chief

economist and rob morgan, sefi financial group chief investment officer. john, amazon's stock is up 25% over the past three months alone. it is on a tear but there is something called momentum buying describe what that is and why average investor are so susceptible to it. >> momentum buying is when investors give short-shrift to underlying fundamentals and buying a stock on the premise that everybody else is going to continue to buy that particular share. david: that is what happened to amazon over past three months an example of this? >> you could make the argument whenever a share is fully valued, vis-a-vis fundamentals the stock price goes higher you have to give credit to momentum buying. at this point the investors have to proceed with caution. this market is made for professionals. it is not made for amateurs. david: rob, we saw that in the past 24 hours with apple. i'm wondering if amazon could be

in for an apple-like surprise tomorrow? >> well certainly it's possible. i agree with john this stock is priced for perfection. it is selling 175 times next year's earnings. no matter how fast you grow you better not have an earnings miss and to amazon's credit they haven't but eventually in the long run they probably will have some kind of a stumble whether it is tomorrow or a future quarter. david: kevin, i don't know how many times i have had to say this about amazon. they have only had one quarter in years that's been profitable and you just have to question whether a stock rise like we've seen over the past three months is worth it for a company that doesn't make any money? >> if you're an investor you need to ask yourself why it is up 25% the last three months and 11% over the last month alone. the reason why is the revenue growth. they're actually dominating in amazon web services space. they're the gold standard. david: by the way, it was just

announced they could become the biggest retailer of clothing items in the world as a result of sales online. nobody doubts market share but profit. >> e-commerce platform where margins are growing. reinvest in business rye investing in itself getting growth. who cares about eps. you want to focus on revenue. they're not paying back shareholders with a dividend or doing buybacks. what they're doing is investing in their future. they are a small microcosm of a trillion dollar i.t. market. they're growing revenue in the web services space. it is to the detriment of ibm and other players. so you have microsoft and you've got amazon who are growing cloud space. david: rob, do you trust that jeff bezos at some point is going to flip a switch and say okay, i have all the market share i want, now it is time to get profits in? >> yeah. i mean that's, that is certainly a possibility. that that could happen. and i you know, in deference to the other guests, i have a hard

time just completely throwing out the eps. it is a good strategy they're following now but whenever we start saying, oh, don't look at this fundamental, i have a problem with that. david: i agree with you. warren buffett does too by the way. john, rob, kevin. we have breaking news. got to leave it at that. melissa. melissa: maybe turns out all you need to beat new york city mayor bill de blasio is help with high powered friends. kate upton and neil patrick harris and ashton such are coming out in favor of the ride-sharing app. we learned de blasio for now dropping his proposed bill to limit the growth of for-hire vehicle companies. earlier the mayor had wanted to freeze the number of new vehicles allowed on city streets. a cap could still be imposed if uber fails to turn over data on location and duration of its rides in the city. uber has 35,000 cars in new york city, compared with 13,000 yellow taxis but this
