. david: hillary clinton hitting back at reports that she's been target forward a criminal investigation over her state department e-mails. >> i have released 55,000 pages of e-mails. i have said repeatedly that i will answer questions before the house committee. we are all accountable to the american people to get the facts right. david: let's go straight to the panel. we have jerry side from the "wall street journal," hans from the heritage foundation and the accountability project. jerry, first to you, does the

journal stand by its story? >> well, our story is narrowly defined. it says that the inspector general of the intelligence community found there were at least four e-mails that contained classified information or information that was classified at the time that it was sent, and as a result of that, they made a referral to the justice department, which is actually a reasonably routine procedure that says there seems to have been movement of classified information here, that wasn't proper. you should have a look at it. that's where the inquiry is, what the inspector general -- david: all right, it stands by the story. the "new york times" did not. the "new york times" changed a story particularly in regard to whether it was a criminal investigation. let me show you a quote of what hillary said earlier about this e-ma

e-mail kerfuffle -- she said it three times, but the inspector general says as jerry just said, four e-mails she sent were classified. >> we'll have to see. one of the things that the inspector general did say is that the e-mail was not labeled classified but it was classified. getting into the nuance of this. david: well, hold on a second, she said it wasn't classified, she implied that some of it wasn't classified at the time but later classified secret, but not so, the "wall street journal" says four e-mails were classified as secret. >> as told by the inspector general. david: correct. so who do you believe? the inspector general or hillary clinton? >> i'm not defending either of them. this is a problem for hillary if it does prove to be not true, and obviously, that's going to be a big problem for her but it is happening early in the campaign. poll numbers are dropping, but

we're a whole year out. if she ends up being correct, she can get over this quickly. she understands the law, she's a lawyer, she's been through this many times before, knows the nuances of the argument you. >> bring up an interesting point. she's been through this before, that's the point! she's been through this before, that leads one to wonder whether there is a apparently here. there was a question about billing records she was working for a failed s&l and claimed she couldn't find the billing records and found them in the white house about 18 months later. that led the prosecutor to say this about their kerfuffle. i interviewed him a couple years ago, here's what he had to say about that. >> if hillary clinton had intentionally been withholding those billing records would that have been obstruction of justice? >> if she was subpoenaed to produce the records and knew she had them and didn't produce them, yes. if i subpoenaed records from

you, and you didn't produce them and 18 months later you say i found them in my house, what do you think would happen to you? david: there was a prosecutor who was involved in a criminal investigation of hillary at the time. so she's been through it before. is there a pattern here? yeah, of course, there's a pattern. this personal server was set up the day of her confirmation hearing. the only reason to set it is up to avoid having to respond to congressional oversight and avoid having to turn over documents to freedom of information act requests. look, she has been given a courtesy no one else would be given. all of the ig reports have been looking at copies that she has turned over. with anyone else. the fbi, the justice department would have been over with a search warned to immediately seize the personal server to examine it themselves and see what's on it. not just what she has decided to turn over.

david: all right, well gerry seib, it has hurt her in the trust issue in the polls. this is not going to help her, the fact there's this investigation going on, right, with the trust factor? >> look, obviously, if you're a candidate for the highest office in the land, this isn't the sort of thing you want. on the other hand, you know, there is a bit of a backlash issue here among her supporters which is they tend to see these sorts of things as a reason to rally around the flag, and there will be that reaction as well. particularly upset with the initial reports about this which were wrong which said if this was a criminal referral, it's not. and that has allowed them to sort of say look this is overblown. so i think it probably necessary to let the dust settle, let it all calm down and figure out where this is going as a legal matter before drawing too many conclusion about the political implications. david: there is one thing that can make hillary in all this,

she beats bill. in the fantasy matchup, hillary comes out on top, gaining 51% of the vote compared to the former president's 26%, according to a new poll from reuters. this is good news for her? >> if they get together, they can win the entire presidency! >> you get the entire package, isn't that what they say. >> with all this happening, the fact that hillary has been able to push through. this they are such a disciplined campaign. she will not answer questions unless she absolutely needs to and she's going to continue to do so until past the primary and the debates into the general election. this is a woman who knows how to run a campaign. david: well, she does, she knows how to run somebody else's campaign, hans, i don't know if she knows how to run her campaign? >> i don't think she's been doing a very good job with this. she keeps giving answers, when she does give answers that are simply wrong. like her saying she had never

gotten a subpoena. we know that is incorrect and there's been all kinds of answers that go contrary to the truth and the facts as they've come out. david: but again, jerry, bill used to say it's a package deal, you vote for me and you get hillary. now if you vote for hillary, will bill help her into the white house? >> well, look, if you want to step back and look at the question in those terms, bill clinton is probably the most popular political figure in the country. some love him, some hate him. the people who love him are outnumbering the people who hate him. whether that translates into an assist to get her elected to the white house herself, i think that's an open question. we've never been here before, how that plays out depends on a lot of factors that have never been road tested before. we're going to have an -- probably have an interesting test of the proposition. i'm not sure what the answer, is none of us, frankly.

was interesting to see the festive atmosphere here, though night fall had happened here in nairobi. as you pointed out security will be a major emphasis in the conversations that the president will have especially in bilateral breakout with the kenyan president here as well as in nairobi ahead of the entrepreneurship summit he'll be speaking at tomorrow. he talked about sometimes you have to make deals with countries that don't see things the way you do. maybe not eye-to-eye, that certainly is the case in some cases with kenya. listen to how he described that relationship to the bbc. >> the same way i visited russia and the same way i visit china even when we know that there are significant human rights violations taken place, we want to make sure we're there so we can have this conversation and point it in a better direction. >> reporter: he was talking about essentially the idea that both kenya and ethiopia to a lesser degree or some would argue to a greater degree are

jolie will direct and produce the film first they killed my father, set to premiere in late 2016. melissa? melissa: some of the biggest names in social media are reporting back to back earnings, twitter set to release second-quarter earnings on tuesday, and facebook wednesday, linkedin thursday. back with me now jack hough and jp, what is the name of the game when it comes to the social media right now? is it mobile? is it new users? is it engagement? what's the key thing everybody cares about. >> so for facebook we're talking primarily mobile ad revenue growth. growing 18% year-over-year, it's pushing revenues along, a significant driver of the revenues, investors are taking

a close look what the numbers will look like in the quarter, and also whether or not they're accumrating new advertisers as well. for twitter, it's largely about user growth in general, over last three quarters they've seen very sluggish user growth, barely growth at all, and i think investors want to take a look whether or not that sluggish growth will continue. david: jack, these are very different companies, right? we put them together because they're under the umbrella of social media. in terms of making money, it's different. >> facebook makes money for investors and going to make more money, it's growing revenues at a pace which suggests going to leverage expenses better, rapid earnings growth going forward, and this is a business where you need scale, the people want to spend money in online advertising, you need a big platform. twitter is not profitable, especially when you back out employee stock awards, it has sales growth but from a very

low base, and the user growth is very questionable right now. melissa: j.p., twitter is in a tough spot, what do you see going forward? >> jack dorsey took over on july 1. he said there wouldn't be a change in strategy, we're seeing a huge change in strategy where personnel is concerned. you've seen a lot of people move. they're going to double down improving and boost and expand advertising products and build upon partnerships they have, like, for instance, earlier this year they had a partnership for google where you see tweets show up on the google search results. for twitter it's about expanding reach beyond twitter.com and areas of the internet so once internet users see the tweets, they're compelled to get twitter accounts of their own. melissa: jack, do any of those things mentioned seem like revenue drivers to you? a way to make money?

>> maybe. i think when i look at social media right now, everybody talks about facebook and twitter. don't count out google, let's not forget youtube is a social platform, you put up videos, people comment on them and so forth. that is profitable. that's going to have 40% of the revenue of facebook next year and that's a side business for google. talking about revenue growth, that's a tremendous revenue growth right now. melissa: j.p., what's the next social media company? you talk to younger people, nobody is on facebook or twitter anymore, you're on there so no younger person is on it at all. what's the new thing we haven't heard of but is going to be very hot? >> well, depends on what you consider hot and what you haven't heard of. but i say mere cat and periscope, the live streaming apps on the phone. i can broadcast this interview, a concert, any sort of live

event and broadcast it to many, many hundreds if not thousand of followers, that's starting to pick up steam with periscope which twitter owns. >> whatever it is, it will have a name like a muppet like smurfler or big chief or fling flong. melissa: i can't wait to see what the handle is on there. guys, thanks to both of you. david: i like smifler. new york city is filled with cold-blooded reptiles but usually speaking figuratively, not literally until now. wait until you see this.
