you have a "strange inheritance" story you would like to share with us? we would love to hear it. send me an e-mail or go our web site hey, guys, me and lou dusted it up pretty good earlier. he's back in his seat and he's coming up next. lou: good evening, everybody. i'm lou dobbs. we're exactly one week from the first republican presidential debate and predictions of donald trump's demise have not only been greatly exaggerated, but have been proved to be wildly wrong. wishful thinking, two new national polls show trump trouncing his republican rivals and opening up a double-digit lead over his closest competitor, former governor jeb bush. without a doubt, this is trump time, and he relishes it. the republican establishment, for its part, is gut sick with the daily testaments to the growing strength and appeal of

the billionaire populist front-runner. we'll have the full story tonight. also tonight, hillary clinton embroiled in another pay to play scandal. that's right. another day, another clinton scandal. this time, the former secretary of state is accused of working out a favorable irs settlement for a swiss bank that rewarded clinton by pumping millions of dollars into her family's foundation. we take up the strength of the clinton camp to see here tonight with leading conservative and citizens united president david bossie. and a minnesota judge today ordering tom brady's deflategate court to new york jurisdiction where the new judge told both sides to tone down their rhetoric. the commissioner says all along he wanted a level playing field and ordered an entrapment, a kangaroo nfl investigation, and his direct report suspend the nfl's champion quarterback and judged the merits of the appeal. will a federal court call that a level playing field?

we take it all up here tonight. our top story -- donald trump pulling away from the rest of the contenders for the republican presidential nomination. trump's ascendents making him the man to watch in next thursday's presidential debate. and trump seems more than comfortable in his role as front-runner and not the least bit concerned by his lack of experience in such debates. >> as far as preparing for the debates, i am who i am. i don't know. i've never debated before. i'm not a debater. i get things done whether it's this or whatever. i build, i create jobs, politicians talk about it. these guys debate every night of their life. that's all they do is debate, debate all over the place and nothing happens. lou: fox news chief political correspondent carl cameron with our report. >> reporter: claiming the world asked him to be there despite his controversial remarks about illegal immigrants, donald

trump arrived at his turnberry resort near glasgow, scotland to host the women's british open and plans to be the next president of the united states. >> legal immigration is a huge subject and i brought it to the fore and everybody is thanking me for it. that's one of the reasons i became number one in the polls. >> reporter: the latest quinnipiac poll has trump ahead of jeb bush and scott walker. a six way virtual tie 59 and 6% and the next are 3% or under. he'll need to address his past support for democrats, universal health care, abortion, and his attacks on john mccain and most of the gop field. >> when anybody, i don't care who it is, takes a shot at veterans of this country that make statements like donald trump made about our p.o.w.'s, i'm not going to be quiet. >> the other day when he went

the last to enter the case was john kasich, polls suggest he got an immediate bounce into the middle of the pack. kasich is now looking for a second boost from the debate to launch him into the top tier. lou? lou: carl, thank you, carl cameron. another scandal threatening to derail hillary clinton's presidential campaign. we've heard that before, haven't we? the "wall street journal" reporting then secretary of state clinton intervened in a massive justice department investigation of switzerland's largest bank. clinton reportedly helped ubs obtain a sweetheart deal which they had to turn over nearly 4500 names of american account holders, roughly 8.5% of what the government originally looked for. once the case was settled, the bank's donation to the clinton foundation rose a mere ten fold and paid former president bill clinton $1.5 million in speaking fees. hillary clinton today denied there was any conflict of

interest. >> this is just the kind of unfortunate claim or charge that you see in campaigns, and all i can do is there's no basis to it. i'm proud of the work i did as secretary of state. lou: i'll have a few words to say about it in tonight's commentary. and turning to the controversy surrounding planned parenthood. antiabortion activists released a fourth undercover video they claim shows a doctor negotiating the sale of fetal body parts. agreeing to illicit pricing per body part harvested and suggesting ways to avoid legal consequences. those videos have sparked a nationwide backlash and brought renewed attention to the fact that there have been more than 57 million abortions in this country since roe v. wade. 57 million. fox news correspondent kristin

fisher with the report. >> reporter: this is undercover video of a meeting between a planned parenthood vice president and two people posing as fetal tissue buyers. listen as the vice president explains why any potential contract between the two parties should be done in the name of research and not a, quote, business venture. >> putting it under the research gives us a little bit of a -- a little overhang over the hole thing. >> so you have someone giving it for you. they're going to probably get caught. >> reporter: the planned parenthood executive also discusses payment, rather than one flat fee for each aborted feet us, agrees to price it body part by body part. >> stomach? heart. >> reporter: the director of priests for life said, quote, in order to sell baby body parts, there first has to be a

baby. it's time for those denying that fact to admit it and those admitting it only in private to admit it in public as well. this is the fourth undercover video released by the antiabortion group, the center for medical progress. a group in california banned them from releasing footage of three high-ranking members to researchers. but the temporary restraining order did not apply to planned parenthood officials. planned parenthood maintained it's done nothing wrong or illegal and called it a misleading and deceptively edited video publicized by extremists who entered our facility on misrepresentations and elaborate year's long fraudulent scream, and it was, quote, extremists who shut down the website for hours today. rick scott is ordered an investigation into every planned parenthood office in the state that performs abortions. and on capitol hill senate republicans are pushing a bill to defund planned parenthood, a

. lou: greenpeace has shut down a main highway bridge in portland, oregon. 13 greenpeace demonstrators and protesters rappelled down the st. john's bridge, that bridge crosses the willamette river. they're demonstrating against drilling in the arctic.

they successfully turned back an ice breaker that belongs to royal dutch shell. it's necessary to begin drilling in the arctic. a federal judge ordered those activists to pay daily fines that amount to $2500 an hour. so far the activists and demonstrators have outright ignored the judge's order as you see there. police are also moving into remove the protesters from the bridge. the new york federal judge who is now overseeing the appeal of tom brady's deflategate suspension issued an order of his own today. district court judge richard berman directed both the nfl and the nfl players' association to begin settlement talk, quote, forth with actively. the judge also making this request for everyone to zip it up, saying, quote --

joining us now, criminal defense attorney tom kinef, good to have you with us, and fox news analyst mercedes colwin, good to have you with us tonight. mercedes, start with you, this is a judge that opened things up saying let's move toward a settlement that means that the status quo is not acceptable to him, right? >> absolutely. and kudos to the judge to say enough is enough. you guys are playing like you're back in a sandbox in kindergarten. this is enough. a federal proceeding. stop the rhetoric, stop running to the media, stop the facebook entries, the facebook, the twitter, all this is happening in the public domain. get serious, get down to brass tacks and talk about whether you can settle the case or not. we're talking about a four-game suspension, we're not talking about multibillion dollars at stake. four-game suspension, that's why the judge reacted the way he did.

lou: to mirror mercedes's point here, tom. there is a ten year collective bargaining agreement at stake here, and the way this commissioner has mucked up three suspensions, greg hardy, ray rice and adrian peterson, and been reversed, i mean the power of the commissioner himself is in question and therefore perhaps the cba itself over ten years because of frankly his incompetence. >> i agree, and i agree with the sentiments of the judge with respect to tone down the rhetoric. that's not helping anything. situation, you used the term scorched earth incendiary situation. it's not going to help anything. i wouldn't look too much into the judge's order to conduct the settlement negotiations forthwith, courts are always looking to get things off the docket. >> the nfl has told us is locked down absolute certain.

the first thing the judge is, is order settlement talk. that's a man saying with immense power, he wants things fixed and that's not the status quo. >> he's saying he doesn't necessarily want the status quo. what is implicit in his words is look, i don't want as a federal judge to get in the middle of a four-game suspension. lou: too late, he's in it. >> he's in it but he wants out. lou: i understand. and to that point, let's go to some of the rhetoric but also the rhetoric as the judge put it, thank goodness he doesn't have dominion over poor television hosts, the nfl players' association, listen to what they said. the nfl violated the plain meeting, if we can put that up --

. lou: mercedes? >> he's being so disingenuous. lou: what seems disingenuous. the nfl? the nfl players? >> the nfl players as -- goodell did what he had before him. wells, if you look at the investigation it's clear brady destroyed evidence. we talked about this before, it's absolute evidence. he knew they were going -- lou: i've got ask an attorney to admit one thing. there is no evidence. >> hard for me to admit anything. lou: i understand, in your role as our guy the through the arcain world of law and the extraordinarily incendiary case before this judge, the fact is the phone was not evidence. the interest was in the messages, and the nfl players' association is making it absolutely clear that the nfl has all of the messages that it sought. not the phone, not the messages.

>> not all the messages, though. lou: let me repeat this, let me repeat this. instead of admitting they have all of the phone records they asked for, end of discussion. >> they don't have all the phone records. >> that's either a lie or the nfl has done what they are suggesting and that is stooped to a new low in public relations. >> you have to keep in mind -- >> there is a new low, there was evidence. if you talk about the investigation, you need to do a full-blown investigation. lou: $45 million worth and two investigations by ted wells. >> lou, when they turned to brady and said we want your phone. by the way there were two phones, the only phone he gave was the one phone that had nothing to do that, didn't exist at time of deflategate. the second phone suddenly disappeared the day before he's meeting with wells. doesn't that sound suspicious for you? lou: it sounds like you're vaguely, vaguely close minded what is proceeding here.

i'm only saying vaguely. >> just to jump in here and back up mercedes a little bit. there is a difference between what may be on phone records. phone records are cryptic, they don't necessarily capture everything on the phone itself. if you're dealing with a criminal investigation. lou: but i don't want to get lost in the weeds, the fact of the matter is, quoting what the nfl players, that's their contention, the nfl has come out with a massive pr campaign as you would expect that they would. the nfl players' association is responding. now, where we are with this is a judge, want to get back to this. what is the settlement that makes sense here? brady apparently, reportedly been offered one game, and he said no. >> the reason i'm a lawyer is because i can never do math. i think the math is pretty simple. half of four? two. i think ultimately -- lou: you have done very well

with that. >> een i can handle that. the settlement that everyone is seeing and not saying is split it, the arbiter initially put four-game suspension, the appeal, the arbitration wasn't successful, now give it to the federal judge, he'll brow beat the parties into splitting it. lou: so i have a view on this, and just like mercedes and i'm somewhat prejudice in this. i do not see how anyone with a straight face, including an nfl commissioner say he's only interested in a level playing field and go about the following: instead of guiding, counseling and directing employees in the case of the indianapolis colts and the patriots, not to have any -- don't mess with the footballs, and we're going to have referees here to make certain of it. then ensnare them instead, if you will. thirdly, then carry out an investigation that has been flawed and demonstrated

empirically by of all people, the american enterprise institute's fine scholars. then at the same time, upon direct investigation to have the report decide what the punishment will be, and then he decide about the merits of the appeal. if that's the nfl's idea of a level playing field, they certainly -- >> you sound like a member of the brady defense team. >> exactly. >> the points you're making aren't relevant and logical and cohesive. lou: no. >> they want to make it not about tom brady but want to make it about goodell. >> it's going to be very -- >> just as a mere hard working journalist. let me say this is already about goodell. he and his leadership of the nfl this year. ray rice, greg hardy, adrian peterson, he's been reversed three times. it's about time -- and i'm looking at it as a business and fan of the sport. >> lou, he got it right with brady. he got it right with brady. lou: mercedes, the reason

. lou: a few quick thoughts on the latest scandal to plague the democratic front-runner hillary clinton facing new pay to play allegations after intervening in the report is investigation of ubs while she was secretary of state. donations to the clinton foundation rose ten fold as a result. clinton today dismissed the report. campaign fodder. >> any implication that is attempting to be made along those lines is categorically false, and i worked hard as our

nation's first diplomat to solve problems. this is just the kind of unfortunate claim or charge that you see in campaigns. lou: certainly in clinton campaigns. and expect more controversy as her state department e-mails are expected tomorrow in a friday document dump. of course, questions remain still about her use of a private e-mail server after two inspectors general from intelligence and state found e-mails with classified information on her server. e-mails that contain information from five intelligence agencies. and earlier this year, the clinton foundation was exposed for failing to disclose foreign donations while she was secretary of state. donations linked to political favors. the growing number of scandals taking a toll on clinton in the polls, approval rating plummeting, voters saying she is outright dishonest and untrustworthy. despite all that, clinton is

still firmly in the lead for the democratic presidential nomination. bernie sanders and joe biden, well, they trail far behind. what exactly would it take to y out of this race? certainly more than questions about her integrity to shake her democratic supporters. while she appears vulnerable to just about everyone else, her opponents and critics, she can make the case she's clinton strong, overcoming every hurtle imaginable. we'll see. now the quotation of the evening, this one from our 34th president, dwight david eisenhowerer who said -- any office. we're coming right back. she must be bored with all the attention.

trump has a double-digit lead over his closest rival, former governor jeb bush. democrats reportedly increasingly nervous about hillary clinton's campaign. clinton now worried that vice president joe biden may jump into the race sometime later this summer. and a federal judge has threatened to hold irs commissioner john koskinen and justice department attorneys in contempt of court. koskinen and his attorneys have repeatedly stalled the investigation into the irs targeting of conservative groups. our next guest says trump is tapping into the frustration that americans feel toward the current leadership in the republican party. joining us now david bossie, the president of citizens united, one of the country's leading conservatives. good to have you with us. >> thanks for having me back. lou: trump. you know, everybody -- not everybody but so many of the wags and pundits and savants say he will flame out soon and all that he does is each week add to his lead.

what are your thoughts about trump and his prospects? >> look, i think that donald trump is very serious. look they started by calling him a clown, saying he wouldn't disclose his income or his worth. they started by saying he's never going to enter the race. he's dispelled all of those things, and then speaks truth to power. he takes on the republican establishment and they're confounded by it, they attack him. and he attacks them right back and his numbers go up. they don't know what to do with him and quite honestly i'm glad. look, you have mitch mcconnell and john boehner running this cabal, the washington cabal, and kicking the can down the road, and donald trump is taking it to them and the american people are tired of what they see in washington. lou: that's exactly right. the american people are tired of democrats who don't do their jobs, and they're tired of both

parties run by basically the same elites, and pro-big business to the point that small business and its interests and working men and women and our middle class, their interests are suffocated, and while in washington, because of the money flowing through k street. >> that's right, and i say he speaks truth to power, the doctrine there, political correctness that has just overtaken america and overtaken the mainstream media and what goes on in politics today. that's brought frustration to the american people, i think he's tapped into the frustration that they like to see him just -- lou: are you a trump supporter now? have you made a choice? >> no, i have not. but i can tell you i know mr. trump very well. known him for many, many years and he's a good friend of mine. i like a lot of the candidates. i can tell you why donald trump is successful and why he's tapping in, because he sees the

failure of washington, both democrats and republicans and speaks directly to it. lou: well, we see the koch brothers talking about the establishment. those fellas have billions of dollars and they're turning their backs on donald trump. they won't give him access to state of the art analytics or data or any help at this point. what does that augher? >> well, look, i don't know what they're doing or what calculations they're make. i can tell you the last time i checked donald trump was a billionaire himself and can afford the data on his own without needing to get it from anyone. i think his campaign is running a little differently. let me make this point. jeb bush has raised 110+ million dollars and donald trump spend about 2 million, a little less than 2 million. one guy is leading in the polls doubling the other's numbers, one has all the money, the other has none. he has passion and conviction

and speaking to the american people about issues that are important and jeb bush has nothing. lou: tremendous free media. >> he is good at that. he is good at that. lou: he's always been good at that. and i have to say this is going to be, a week from tonight, on the fox news channel, the first debate. this is going to be spectacular. i cannot wait. i'm looking forward to it. i am going to be there and can't wait to see what happens with the ten of them. look, i just remember back four years ago, newt gingrich came out of nowhere and took on the establishment and he shined in these debates. >> not this time, david. i don't think the past has any remote influence on what's going to happen next week. i think it's politics as usual has taken a beating so far in the republican party. much to the surprise if not the delight of the leaders of the republican party. david, thanks for being here.

now 8300 acres. that over the span of 24 hours. 150 to 8300 acres. it's destroyed a number of buildings, triggered road closures and forced evacuations. as of right now, there is no containment of any kind on this obviously rapid-moving fire. california firefighters right now are also battling 13 other fires that are now large fires across the drought-stricken state. 95% of that state by the way is in drought. russia's vladimir putin today praised the iranian nuclear deal talking with israeli prime minister netanyahu. putin claims the deal provides reliable guaranties that iran's nuclear program is peaceful. he didn't make the guarantees itself, he said it had reliable guarantees and will have a positive effect on stability. russia officials are also announcing curiously that they are upgrading the s-300 air

because clearly mr. netanyahu and his country are coming out on the short end of the stick. lou: well, turning to the iranian nuclear deal itself. you know, there's a large question about whether republicans and other critics and opponents of the deal will be able to stop it on any term whether they muster the votes. and at the same time, we find out is it's a farce is all i can say. we find out the site agreements don't mean anything, don't include inspections, valid inspections not only by americans but anyone else in the iaea? >> right, they're literally in bed with each other. what's so interesting is the clip you just showed a minute ago, that shows russian s-300 missiles. real quick for the audience, inside baseball. these are the russian versions of the patriot missiles. they are actually excluded --
