very deeply moved. an emotional argument makes sense. i've always said that. but hillary clinton is very likable. when we going to see her surge? >> they have nothing to do with hillary clinton, running against one other person and she's the least charismatic person in the history of politics. so that's something to do with that. but she is not going to have a big surge, if you are liberal and you buy into that mindset, why would you not supported. what is hillary going to say? we should raise at $15 an hour and then bernie would say 25? why not do that. kennedy: it's like the price is right. joe biden says that, you know, apparently the latest rumor is part of the whisper mill saying that he's not going to get in until the poll numbers nationally go below 40. and so is the buying oil or running for president.

>> if you think about this, this is like the outliers campaign so far. and in some way, he is an outlier but he does have respect from both sides. hillary, unlikable, uncharismatic, but she has a lot of money. >> and also a lot of unpledged obama donors. they have not pledged her yet. maybe these are the only people on the democratic side who see that her candidacy is not a foregone conclusion and they look at something like joe biden and say what you will about his past which is checkered with bad decisions, he is vice president of the united states. >> is vice president of the united states in looking further back there is the gaffe and then he came from delaware. a lot of people are going to hang him for that. kennedy: including elizabeth warren and i could impart about. >> she has that little best

kennedy: hello, and i'm sorry, i have bad news for you liberty lovers out there. the supreme court overturned a decision, there's metadata lightly violating the constitution.

>> there's been a little bit too much give-and-take for my life and where are we at? >> well, what the court of appeals did today is reversed the trial judge's decision which allow them to run the program. the judges were unanimous, the only thing they disagree about is whether to reverse the trial judge in the one thing or whether they should throw the case out entirely. the reason why is because there's not sufficient evidence to show that the plaintiffs in this case have their data collected, which means that they have the right to sue under the standard doctrine. kennedy: the standard doctrine, the splintered judges here in the circuit court. and this is headed for the supreme court, they keep contradicting each other in striking things down. one judge said that what they are doing is illegal and another

says it's illegal under the patriot act and congress amends the patriot act. where do we stand now? >> i think that ultimately the issue is going to be the supreme court. but i would eat surprise that this is the case that goes to the supreme court. because they really don't like cases where they are not sure that the plaintiffs are allowed to sue in the first place. so the problem with the decision from the dc circuit saying that they can't sue is that in order to get the evidence required to show that their data is being collected, that isn't secret information. so the government isn't going to hand over that information and the logical conclusion is that no one is allowed to sue. one of the opinions that the circuit issued today was written by janice brown, probably the most libertarian judge on the branch. and in order to prove that they are allowed to sue, they would have to get the kind of evidence that is already being kept secret because of the program

and that's just the way that the secrecy rules are working and there's nothing that the court can do about that. kennedy: by the nature of the way that the courts are set up for fisa, even if they change the nature and structure of that, it, at least until november thanks to executive decree. how are you ever going to be able to prove something that is completely at opaque and hidden from view. i don't understand it. but what i want to know is who does this gray area benefit? >> ultimately benefits the government and that the reason why many legal scholars have criticized this standing doctrine the matter what the law is. because the federal courts are supposed to be open for people to bring their complaints when rights have been violated. it's not just an ounce of national security but the people have their cases thrown out because of the standing doctrine even in cases that involve ordinary disputes of property rights and things like that. it's often a problem for lawyers that we have to first prove to
