and she is testifying, and here is a an aide of hillary's and he'll plead the fifth. he told three congressional committees he'll invoke his right to the fifth amendment. let's get to the markets, look at dow futures, where are we going to open today? up about 90 points, maybe. it depends how the futures look. i'm going to call this steady as she goes. maybe that's a good sign. have we hit bottom and returned to this at the moment. we've seen some big swings in the big names. apple, for instance, it's going to be flat ahead of the open, 112. that's a good thing. netflix, huge drops up and down. flat right now. move outside technology. how about wall street, that will also open flat today.

i don't think the stability is over. i love your number, though. 1,600 is a great 16,000 in the dow is a great line in the sand is. before that, we get worey, below that, looking for l versus v, though, stuart. stuart: tawed, you've been consistent on stocks and commodities. 16,000 on the dow. i take it you don't think that's the baseline. >> good morning, stuart, no, i don't think 16,000 will hold. i think we'll probably turn around here. china is closed, we'll do whatever it takes and the jobs number amount. but china comes back to work, i think 16,000 will be a memory in the next couple of weeks and will be significant lower than that going forward, and i still think that you're right. that after this last weekend of gas prices, gas will be on its way down much quick theory notes now. stuart: jeff, you come into this, please. we talked to you a half hour ago.

refresh your on comments now. 16,000 on the dow you say is not a baseline. >> no. i think the baseline is the reaction that we made last monday, a week ago monday 16,781, somewhere around there. i think that's the line in the sand. i think we are in a boeing process, unless that reaction low gets taken out as the other gentleman suggestions it will. stuart: now, look at this. 20% of the s&p 500 stocks, that would be 100 of them, are officially in bear market territory. that adds to your argument, jeff, does it? >> well, we put out a note a couple weeks ago of the 4,000 largest capitalization stocks traded that 41% of them were down 20% or more from them three-year high and 21% of them were down over 40% from their three-year all-time highs. and so what you've had is an internal correction and typically towards the end of a correction, the generals or

the few stocks in the indexes that have been holding the indexes up, they finally surrender and that's what you've seen over the past couple of weeks and hopefully it's capitulation low. stuart: okay. so the consensus from our three market guys, you ain't seen the worst yet. more down to go. i want to move to vic companies and products. the iphone comes out next week, september the 9th. i'm hearing the battery life is not going to be good. >> i think they'll fix it and it won't be an issue. most people there have been issues with they fix it, they move on. stuart: they tell me it's a big deal. you have to keep recharging the iphone all the time. >> well, that was the complaint -- so when the 5 came out, i still have my iphone 5. eating up the battery life. and apple, they're a software company as well. when they say they've made their software more efficient so that they doesn't need battery life, i believe them. stuart: i have to have

chargers everywhere. i always plug in everywhere i go. that's how i work this thing. some of the big names, we check them every single day. been open now for about four minutes. let's check them out. netflix is down today 3.7%. netflix at 101. amazon despite all that news about the dash and all the rest of it. up today 5.12. and walmart, where is walmart this morning snap i'm going to call that flat. i'm going to say that's pretty stable. caterpillar has been down big, down a buck today, 75 on cat. and mcdonald's despite all the news about breakfast all day long, $96 a share. it's been there a long time. and dr, what do you like? netflix, amazon, apple? have they bod? >> i think apple was a good-bye when we got below that 104 number we talked about in july steward and i think that's going to be a continued stability stock, that he is a good place to put money if you were worried

going up and down. i like amazon in this. in the big moves that we've had over the past week, last monday not withstanding, it's been the strongest of that lot. i think the continued good news has been coming out the dash, the video, downloading came out the day before yesterday, they continued to trickle out good news and keep people excited about that stuff. stuart: do you own amazon. >> i do not. stuart: you do not? >> not currently people an in and outer. stuart: take a look at gopro and that stock had a big hit yesterday. down 10% and look at that. down a bit more today. gopro down 41. they've got supply issues as they move toward the christmas and holiday selling seen. you wouldn't touch that with a ten-foot pole? >> have made going to sell cameras but nothing to follow on. they've got the raiser but not the blade. and the big issue it looks like they're not going to have any new product announcement. that's what the semi conductor

said we're not getting any new orders for the end of the year. so i think that's what really spooked people on gopro. i do not like that bun. >> . stuart: a rot ron looking cart. and nicole is there. how about plant fitness? i know that profit's up. >> that's right. and the ceo is pleased with the latest quarter. seen sales growth, stronger margins, opening of the 1,000th plant fitness gym. stock up 1.5% and they beat analyst assessment. price at $16 back in ipo near n august, not near its highs but doing well. stuart: show me ebay and paypal. >> well, ebay has its 20th birthday basically. a buck back in 1998 and then we did see it in 2010, $10, now $27. take a look also paypal see how that's doing right now. at $35.

that's a little bit to the downside. stuart: okay., paypal has been liberated and they're at 35. all right. got that. adam is here keeping an eye on conocophillips. >> you asked about the dividend yield yesterday. stuart: yeah. >> and it's roughly 6.1% and that got me looking at have they've been consistent with their dividend and for the most part this dividend every quarter they haven't cut it since about 2006 it's gone up and up and up. so if you're looking for a long term hold, talking about bp also has a very high dividend yield of 7, 7.5% but bp has some other structural issues and trading only $32. conocophillips is down 30% year to date. so this may be if you're looking for very conservative, kick off some money for my investment, conocophillips is something to look at. stuart: i do want to bring in todd from chicago.

this is a guy who trades backwards, forwards, all the time, commodities, you name it. would you ever buy a stock at a 6% dividend and sleep easy at night. would you ever do that? >> no. i would not. i would buy a stock on a textual basis and i think conocophillips happens to be a great buy. if you believe in the strength of the country, if you believe we're eventually going to come out of the disaster we created, then i think it's a great play and it is a stock that i do own and continue to own because i do like the dividend if the stock looks forward going forward. but i would never step in and buy a stock because it pays 6% because it b you just said it's down 30%. stuart: i hope you've made a lot of money in your trading activityivity and i suspect you have. i'm going to get onto tesla. i think there's news on tesla. they've got new models coming out. that's for sure. do you like tesla? exactly 250. do you like it? >> well, i've been a bear on tesla. stuart: yes, you have.

>> but interestingly what's going on now, the people are voting with their wallets and saying, look, we're going to overcome the production problems they've had. what they did was announce the model 3, preorder it next march, going to start being delivered about nine months after that, and they have to get the gigafactory up and running to do that. but people are voting with their dollars, stuart, and saying we're holding tesla up right here. stuart: as i recall. the question was would you buy it now at 250? >> i could buy it. stuart: could is not an answer. would you buy it, yes or no. >> i would buy it. stuart: you do not like shake shack, do you? >> no, i don't like that whole casual space. i think the whole space got chipotle over thrown. all of these came through with these great numbers. they're doing really well but they're priced like their world beaters, and i don't think any of them are world beaters. stuart: i don't care what they charge, i just want it ready now when i walk in the door.

adam, i've got something here about google self-driving cars talk a hit. >> another -- real accident. keep in mind that of the 16 accidents that google self-driving cars have had, 1s have been rear-end collisions in which the human driving vehicle hit the google car. so this is not a statement about the car. stuart: jeff, come on in, please. i know there's a list of stocks you like. start with wells fargo. go. >> yeah. i think if you're looking for value in a market that doesn't have a lot of value in it, i think the trading complex, they trade book value, have lower -- than the market multiple is and they have 3% plus yield. so i think if you're looking for value, the banking complex in this country is a good place to look. stuart: all right. we heard you. thank you very much. i'm going to move to disney specifically because they're gearing up for their star wars reboot. one investment firm says all the merchandise sales of the

star wars stuff will bring in maybe $5.8 billion in the first year. i find that an extraordinary amount of money. dr. do you believe it? >> i do believe it. i remember seeing an interview with jeffrey where they asked if it was the movies or the merchandise that drove the business and he said you don't get it. it's the synergy between the two. people taking these and things unboxing them and getting 50,000 hits of unboxing a toy. that's a driver to people to go buy tickets. stuart: do you realize we have someone on this program someone 40 years old who is going to be buying that kind of stuff. can you believe that? >> and people use it as collector items. keep in t in prest even condition and doing a lot of things with that stuff, so they're homing it's going to appreciate over time while they get to look at it off the top of my head shelf. stuart: you buy star wars stuff, adam? >> no. i'm not going to buy

that, nor beanie babies. but disney stock, they've got the star wars coming out, the shanghai theme park opening in 2016, that movie is going to be bang busters and the word of yoda, try not or dodo not, there is no try. and they're going to succeed. stuart: todd, are you still there? >> i'm waiting for you. stuart: you standing in line trying to buy star wars merchandise, i don't believe you are but tell me. >> you are correct. i'm not a buyer, but i think that's priced into the stock. i think it will sell. you've got a big fan base who los it. you have a lot of novelty players here. the products you're talking about will sell probably even more than they think because you've got a lot of the ones the collectors, people want to play with. the whole story. but for me -- i've never seen a star wars movie, so i don't think i'll start today. stuart: oh, dear lord. take a look at the stock market. big picture, please. now we have the dow starting to rally. i called it stability when we started. i guess you could say 100

points up is kind of stability. at least not shedding 2- 300 points but up 116. that is where we are right now. can i call that stability? it's not -- oh, wait a minute he's shaking his head. >> got the jobs report coming out, going into a holiday, watch this thing sell. stuart: really? come back in again, you don't like merchandise from star wars, you don't like dividend stocks, do you like this rally? >> i love this rally because it gives me a chance to sell at higher prices. i'm happy to sell, i'm happy to give it to them. i believe that we're going to see maybe not tomorrow but over the next short period of time we'll see significant low prices, we'll definitely test the low that we put it in last monday. sooner than later. it gives me an opportunity to sell some more. stuart: okay., jeff, come back in again. now's your chance to redeem yourself. now we're up 110.

are we going to hit new lows? >> i don't think so. i think we're going to make a successful test of the last monday's low slightly underneath 16,000. i think the market rallies from there. stuart: rallies from 15.6, 15 upon i 7. that's interesting. right now we're at 16,456, a gain of 106 points. and a massive military parade. beijing showing its muscle and, by the way, they've shut down stock trading. that may have helped us today because we're not getting a pointer from china of where to go. on our screens now we've got all kinds of military muscle on dismay in beijing in their big parade. what do you make of this? >> i think that china's showing that they're -- they're trying to take over the world the way they've been acting, and i think that you're seeing a display of strength. they're closing their markets and going to show you who they are, which is, you know, the

nice communistic manipulative place to try to take over the world. stuart: dr is laughing or crying, i'm not really sure which. >> i love the description of what's going on there and they keep calling it a commemoration but really this is a victory of japan over world war ii and it's a blowout. they're holding back nothing. stuart: yeah, but it's disquieting. they're persecuting journalists and anybody else connected to the market. they've got an economy that's sliding, clamorin clamping down. >> pay no attention to the man behind the screen and what's really going on. stuart: . stuart: okay. we're up 113 points for the dow industrials. 15 minutes into the trading session. as we do every day, check out some of the big names. i'll start with starbucks. excuse me. i need that cough there.

the expected $15 an hour minimum wage hike for fast food workers that's coming in some places. the employment policies institute has placed this billboard in time square. michael research director of the institute is with us today. okay. now that. i can't read that. and our viewers can't read it. michael, can you tell me what that billboard says? >> the billboard says -- you know, it's a guy with a pair of headphones, a bro with sunglasses and says what? i get $30,000 a year with no skills or experience. and our point here is in a place like new york where the assistant managers may be earning 15 or $16 at a fast food, what does it do to morale and hard worksomeone new on the job gets to earn the same wage. stuart: so you're clearly opposed to mandatory legislating of waging at $15 an hour. is the big board part of your campaign against this. >> yeah. we're running a campaign called fast food no problem.

this isn't your dad's minimum wage flight. these $15 levels not only on the west coast seen some really dramatic consequences but there's a potential here to say to employees, hey, you don't really need to work hard anymore to get into the workforce and work your way up. you can just come in and make 15 right off the bat. maybe it creates an incentive for some people to not finish school. stuart: okay. you mention serious consequences. i believe that the $15 an hour minimum wage has been imposed in seattle. what were the consequences there? >> so what we've seen, we've seen pizza places like z pizza, for instance, announce that it's closing because the minimum wage was going so high so fast, they couldn't afford it. and other places like oakland, had child care providers, restaurants that had to get rid of tips, cut staffing some businesses in china town closed all together. these are real headline grabbing consequences that proponents don't want to acknowledge.

>> why do we think -- why do some people say, look, all jobs must pay a living wage? why can't we have some jobs that are entry-level positions encouraging you to climb the food chain? why can't we have that? >> that's the thing. you can either have jobs that pay $15 an hour or have the same number of opportunities we have right now. but you can't have both. in a situation where all of jobs require to pay a living wage, you might have a few jobs that you can earn a middle class income flipping burgers but for everyone else working there, their jobs have been replaced by ipads. stuart: i agree with you in principle but in practice did you can't roll this back. there's very little you can do about this. you can't roll it back, can you? >> well, i think the hope is that in some of these markets the left coast and places like new york that we're going to see enough evidence in these commodity places that the policy makers elsewhere are going to take a look at whether they want to follow labor unions down the path of

flee. now we're talking tens of thousands, going to the public, into trains and boats and cars and buses and walking, some of them, some dying, including children, it's too big for the europeans to say who is terrorists and not terrorists. they don't have at that capacity. stuart: so you're looking at a future terrorism problem that continues to grow. >> not just future, it's happening right now. i mean, from previous waves that hit europe coming from libya. european law enforcement tell us that they know there are hundreds that got into europe and they've seen how they connected. now from the east, coming from syria and iraq, it's a much bigger problem because the numbers are bigger and isis penetrated them in northern syria and other parts of the country. stuart: what are we going to do? are we going to put the blame where it belong which is radical islam and what are we going to do about that?

>> this is a big issue, and we're vague on it's like a cancer that's growing big, i'm clarifying here. the refugees are at the borders, this is a refugee humanitarian issue, nothing much one can do except solving it. it's making sure that these areas where terrorists are in control in libya are reversed, that should be some activity there and report finding a free area interior. it's the fourth year and we haven't done much. stuart: they're not going to do anything, i don't think it's military, i don't think they're in a position to do anything in north africa. >> anywhere around the world, i don't think that european would do anything. stuart: make the value justice, walid, should the u.s. step in and do something about libya and syria. >> united states should do something strategic, there could be military,

could go a lot worse. i believe that the fed has propped up stock prices to such a level with all the printing of money and et cetera and low interest rates that with the global industry being in the shape it is, we're headed for a disastrous situation. carnage is a correct way of putting it and the reason is, if you're a retiree, if you're someone, a family that's saving for your future and see your stock portfolio go down, 10, 15, 20, 25%, are you going to hang on? what we saw was the last cycle, people didn't hang on, they got rid of it. that's carnage. stuart: what's the sign? is there a sign you would look at, some kind of indication, some kind of development that you expect that will really set us way, way down, the plunge? what's that sign? what's the signal? >> i think the signals will be further indication in china and emerging markets that things are going to get bad, even

worse than where they are. the ability that these signals are more credible. i think you'll see them get more credible in time. and that will affect the markets. you're going to see volatility like you've not seen, in my opinion, and it will get ugly and frankly, in my opinion, carnage will happen. and what do you do in this situation? in my opinion, i think you should go to cash right now. it's not a good time to be in the market, especially if you're-- if you need access to the cash. if you're a long-term investor, it's irrelevant long-term because if you're going to hold this, 10, 15 years and you have great companies and you're well diversified, you'll be fine. but if you need the cash, get out, get on the sidelines and don't be part of the carnage. stuart: and you're addressing those people, for example, who may be facing imminent retirement, going to step aside from their job in the next six months or one year, you're telling those people, sell it,
