others, that it may very well be that process by the time we get through it, closes the window on mounting a realistic campaign for president. that it might close. i have concluded, it has closed. david: the vice president formally ending months of speculation about his presidential plans today after he is reported to have decided to stay out of the race last night. peter barnes has the inside story from inside the beltway. peter? reporter: that's right, david. as you saw there in the sound bite the vice president was in the rose garden with president obama standing beside him. there he said, biden said he always knew he would have limited time to mount a viable run before he could determine, especially if his family was emotionally prepared for another one so soon after the death of his son from brain canser in may.

biden said his family was prepared to back him but said nonetheless he would not be a candidate. >> i hoped there would come to time, i said this to other families, sooner rather than later, when you think of your loved one, it bring as smile to your lips before it brings a tear to your eyes. well, that's where the bidens are today, thank god. beau, is our inspiration. unfortunately i believe we're out of time. the time necessary to mount a winning campaign. reporter: as you said biden's decision bolsters's hillary clinton's standing at frontrunner for the democrats. in a statement she praised him saying quote, joe biden is a good man, and great vice president. serving alongside him in the president and in the administration. i saw his first-hand passion for our country and our people. but in what sounded like a warning to clinton and all other candidates for president democrat and republican, he said

he will not be silent in the race and will forcefully defend the obama legacy. david? david: interesting, very interesting. what caused him to make that decision? we'll be getting into that in detail in this hour. peter, thank you very much. melissa. melissa: congressman brendan boyle, pennsylvania, didn't see vp biden's decision coming. he joins me. you had it on good authority he was getting into the race. you're not only one. what do you think happened? >> i've seen this before. clearly where vice president was over the weekend was he was running, and i'm not the only one who had gotten that indication. then something happened in the last 24, 48 hours to cause him to pull back. in one sense i'm surprised, but another sense i have seen before candidates, even candidates i recruited in the state legislature, make the plans, help people to run, ready to go, right at the last second come to the realization they don't want to do it. i think you saw that conflict in

president biden speech today, 99% of it sounded like announcement speech. melissa: right. >> everything he wanted to do as president and everything he cared about except, with the i'm not running instead of, i am running. >> there is a lot of conspiracy theories out there. they don't believe it was necessarily his decision. they think there were clinton forces at work. what do you think of that talk? >> no, i don't think -- like most conspiracy theories they sound interesting but a lot of times the more simple explanation is the correct one. in this case i take vice president biden at his word when doing the cold calculation even though very much wants to run for president and believes he would be a good president, he just simply looked at the facts that hillary clinton is a very strong favorite. even if he were to run she would remain a strong favorite. melissa: with the announcement everything changed. how do you size things up? what is different now? >> clearly hillary clinton was the strong nominee entering this cycle. she has been able to keep that

even with momentum for bernie sanders. she still maintains a pretty solid lead. she had great performance in the debate last week. i think that helped her tremendously. now i would say, i would have said this even if joe is running, she is the favorite to win the nomination and i think that today's news only bolsters that. melissa: there are a lot of people that think democrats are very vulnerable whatever may happen now, whether it is investigation into her emails or tomorrow on benghazi, we shall see. congressman, thanks so much for coming on. i wish we could talk more. we have american express earnings. the world's biggest credit card issuer out with third quarter results. ashley webster is standing by. what are the numbers, ashley? >> melissa, they're not that pretty to be honest with you. 1 to in$24 and estimate was 1.31. -- miss an earnings and revenue.

shares down in after-hours trading already. one of the things that stuck out to me, income from international card services was down 37%. american express of course has been struggling. it lost its contract with costco, that runs out next march. also with jetblue airlines. says it will try and now appeal to perhaps a less affluent consumer. so that's interesting. they also say marketing costs have gone up as well. as you can see that stock moving lower in after-hours trading. melissa: absolutely. joining me, jonathan hoenig of capitalist pig as well as a fox news contributor. we also have kimberly foss of imperion wealth management. thanks to you both. john, give me reaction to these numbers. i thought i was keeping american express afloat all by myself but apparently i was not doing a good job. >> obviously not, melissa. i don't know if you shop at costco but investors are taking a hard look at american express moving forward. two misses in terms of eps and

in terms of revenue. a lot of headwinds here. costco, the travel business weakening. also just a general downtrend not just in the market but a lot of these credit card companies. visa weak as of late. discover and american express looks poised to make a new 52-week low. that's a bearish sign. melissa: yeah. kimberly, when you look at the stats they have the u.s. dollar as a big headwind for them. year-over-year they're down 10%. year-to-date, 17%. is there opportunity in this stock? american express has been a leader for a very long time. >> yeah i think there's an opportunity long term but really is going to be dependent on this relationship split with costco. i think, and american express to see how they are going to replace those revenues and how to replace those cardholders if they don't deviate over to visa and mastercard with this new relationship with costco. so i think long term maybe there is some growth there. i'm just kind of wondering,

melissa, where is my black card fee is going? how come that is not going down since everything else is going down. melissa: yeah. >> we have it in our large cap portfolio but again i think the, the large cap u.s. stocks are really getting beaten down also by the strong u.s. dollar and that's a hard headwind to fight right now. melissa: kimberly, we did our best but didn't make the quarter for them. i guess we'll have to try harder next quarter. maybe not. my husband is cringing as i say that. >> i'm spending like a banshee. christmas is coming up here. melissa: don't remind me. guys, thank you so much. david: i'm cringing for your husband right now. melissa: i know. david: breaking news on capitol hill right now. congressman paul ryan is expected to meet with the crucial house freedom caucus to discuss his possible run for house speaker. joining me is the cofounder of that caucus, congressman david schweikert. >> hello, david. david: let's talk about first the charges against paul ryan among some republicans say he is not conservative.

i have known the guy 25 years. he was acolyte with jammingjack kemp and. why do some republicans think he is not conservative enough? >> they're making a complete information tactical error. this actually is a little less about paul or the person who may be the next speaker. it is actually about the rules, the policies and procedures. we the house operate under, let's face it, paul can be a transformative figure because of his understanding what is happening in entitlements and growth of debt. we should embrace those things. now our conversation we're about to have with paul over at the freedom caucus is, will he also now help us move forward on rules and the process improvements for all of us. david: right. let's talk about one of his conditions. he mentioned hear has some conditions. one of them supposedly enduressed by at least 4/5 of your caucus. is that acceptable to you? do you think he will pass that

particular obstacle? >> well the big moment is coming, the second i'm off the air with you. we'll go over and have that conversation. if paul steps up and says he is willing to help us move forward policy and procedure improvement so every legislator has a chance to legislate, i think el see a favorable light. but we need that conversation. i know it is geeky but the rules mean a lot here in congress because it is how we do our job. david: let's talk about one issue that's pressing on wall street right now which is the debt ceiling. >> yes. david: some people want to tie the lifting of the debt sealing to cuts in cuts in social security and medicare. if paul says that is unacceptable he is unacceptable to your caucus? >> i have not actually heard that discussion in the all the meetings today. the reality the debt ceiling will happen. is there a chance to deal with a systemic mechanical problem we have as the baby boomers are

aging? we're about to hit reflection where the debt begins to skyrocket. we need to step up and deal with that reality. david: finally, just a quick question, he is a huge family man. frankly that is why he never ran for speaker before and why he is so resistant to do so now. he is sacrificing a lot of his family time for this job if he takes it? >> people do not understand, speaker boehner spent 200 days on the road out raising money telling our story. paul has young kids. so if paul does become the speaker, all of us as members will have to be out there in the country telling the story and actually raising funds that are necessary. david: david schweikert, it will be -- be pleased to report back to us as soon as we can. it is happening just about four minutes from now, the meeting. at the end of the meeting will we know if we have speaker, very quickly? >> i don't know if it happens that fast because there is a lot of discussion still to come. david: thank you, congressman. appreciate it.

the forecast was 2.09 billion. so just a slight beat on revenue. gross merchandise volume up 6%. also maintaining its revenue guide for rest of the year. showing growth of three to 5% for the entire year. as you can see that stock moving nicely higher. up 9% at one point in after-hours trading. >> ashley, thank you very much. david: bark with us jonathan hoenig and kimberly foss. kimberly i've been looking at 10% gain after-hours. it was slim beat on revenue side. do you think these gains after hours will hold tomorrow? >> well, tomorrow will show but i think it is positive because last year they were down, they were at about 46 cents a share. now they're at 43, which is booed, better than 40 cents that was expected. big thing here, david, this is a stand-alone company now without paypal. david: right. >> investors are looking to see if they can continue with that growth even without that big

engine because they were a great, dynamic duo together. let's see if they can continue with that. looks to me that investors are positive for -- david: jonathan, explain to me, revenues have been cut in half, literally more than half as much money in revenues when they had paypal. how can a company whose revenues fallen more than half continue to get good numbers on the stock price? >> well, david, i think the a lot of that expectation was built in prior to the paypal spin-off. this is company that transformed commerce and was transformed again by its acquisition of paypal. now that they have spun the company, pun paypal off what will ebay do to transform itself once again? this time, david, it has tremendous amount of competition, certainly more than in the late '90s. alibaba, amazon. the pop we're seeing. obviously a good things for longs. a relief pop appeared of very

weak performance problem. a technical perspective it has to hold 20 one. if the stock doesn't hold 21 look out below! david: that is from the technical side. get more fundamental, kimberly, a repeat for the question of jonathan. how do you manage when you suddenly have half as much revenue as you used to? >> they have to go internally to cut costs. as an ebay user, you big complaint is the cost of what they have to say for sellers to list an item. they have to do restructuring internally from operational standpoint. then they also have to make a bang out this last quarter is christmas. so they have to go up against like jonathan said, amazon, those types of other seller pressures they didn't have before. if they cut costs and maintain it and their operating costs are profitable which they are, you know might have a chance. david: gotcha. jonathan, very quick please. >> david, to your point, how do you raise revenue? innovate. how any company raises revenue.

own elizabeth macdonald. great exclusive, elizabeth. >> well, thank you so much, david. good to be with you and melissa. department of justice officials close to the matter tell fox business they are concerned that foreign telecoms breached hillary clinton's emails and her home server while she was overseas on business as secretary of state. now high on the list of fears, china. this is a first indication that federal officials are concerned about hacking by workers at foreign telecoms. one justice department official tells fox business, quote, her emails could have easily been hacked into by telecoms in those countries. they got the emails first and routed them back to her home server. another doj official close to the matter, quote, that telecom in that foreign country could follow the trail of emails back to her home server in the united states. used words quote, reckless, stunning, unbelievable in discussing the controversy swirl around clinton's use of home server and personal devices as secretary of state.

speaker of the house. freedom caucus cofounder congressman david schweikert tells us ryan's criteria may not be a deal-breaker. >> if paul steps up and said he is willing to help us move forward policy and procedure improvements so every legislator has the chance to legislate, i think el see a favorable light. melissa: joining me now, fox news's mike emanuel live from capitol hill. boy, a lot going on there, mike. what is your assessment? >> melissa, no question about that. speaker john boehner who is retiring says one week from today house republicans elect a speaker nominee. if all goes as planned they will elect a new speaker next thursday. paul ryan says he is willing to do the job if his colleagues see him as a unity candidate but as you mentioned he says the party must unnye now. he is open to making changes but the whole team must vote on them. he wants to make a change in the ability to fire the speaker. today the outgoing speaker offered this endorsement.

>> we all know paul ryan, all right? he's a very good member. he works hard. he is very bright. and he has a good relationships i think with all the wings of the party. so that is why i think he will be doing fine. reporter: ryan spent much of this day behind closed doors answering questions from his colleagues about those changes that he would like to make if elected speaker. this hour ryan is meeting with the conservative house freedom caucus, addressing some of their concerns. >> the only concern that i have right now it appears he is asking for more power to be in the speaker's office instead of less power. >> i don't think the speakership is 9:00 to 5:00 job. i have family and i'm not running for speaker or any position like that. you have to work on weekends. reporter: those close to ryan say he is will to fight for the democrats and taking arrows to the chest but he doesn't want to get shot in the back by fellow republicans, melissa. melissa: that is always a danker

in politics, mike. thank you so much. david? david: vice president biden's announcement to stay out of the vice-presidential race sounded like a campaign speech. he touted his middle class background and talked about making america great again and sounded like a lot of people to donald trump. talking about the mix i had signals. former senator scott brown, chris hahn, and jason roe, former mitt romney campaign manager. i hate people who ask two questions for one but i will do so quickly. why did he pull out and did leave a little wiggle room open for him to get back in if necessary. >> pulled out for the same reasons i've been telling you this august, there is no staff for him to hire, it is too late for him to get in. is not a protest candidate. if he ran he is running to get win. there is no wiggle room. david: didn't it sound like he

was making a campaign speech at the announcement? >> absolutely. a lot of wishful thinkers writing that speech as announcement speech. but joe biden is smart, seasoned politician who was not going to run to see his name out there. david: scott, one thing he did do, was take a shot at hillary clinton, not by mentioning her by name but during the debate she was asked which enemy she was most proud of having. she mentioned a lot. ticked off iranians, drug companies, isis. said probably the republicans here is what isis said about calling the republicans your enemy. he said this today. >> i don't believe like some do that it is naive to talk to republicans. i don't think we should look at republicans as our enemy. they are the opposition. they're not our enemies. and for the sake of the country, we have to work together. david: that was a direct hit at hillary, was it not?

>> oh, of course it was. let me remind hillary and others who are listening that we're americans first. democrat, republican, independent. we come from all stripes, and even socialists it looks like. with we come from all stripes. number one thing we are is americans first and we all care very deeply about this country. just a question how we get there and i know the vice president. i have a lot of respect for him. i thought he was spot on in that. when the president has checked out time after time after time, it was the vice president who reached out to the republicans. that is part of the problem up in washington. they don't talk, they don't like each other. if that is how hillary is going to be, she will be continuation of president obama's policies. >> hope she is continue ages. david: hillary is, she will not change her stripes after all these years. clintons, had enemies list, et cetera. do you think she is going to have, his comments will have any effect on the way she campaigns? >> you know i think that was a warning shot to her that is not how we'll win an election if

we're democrats in november. i think it was pretty pointed in otherwise kind of pro-biden speech. i think that has got to be, i heard her say it, this is gift to republicans to show how divisive a clinton presidency will be. i think republicans will show how we're different than that, reaching across to democrats. i think it was critical to her. david: could the vice president have any influence on her in her campaign? >> oh, look, i think he is very influential person. i agree with what he said that they are not enemies that was unfortunate line in the debate. otherwise perfect debate. that was unfortunate line. that said i think the vice president will be eventually be supporting whoever the democratic nominee is -- david: but on this issue, chris, the issue you said was a mistake, a lot of democrats say was a mistake, could the vice president have any influence on way she governs her campaign? will she change that rhetoric? >> i think she will change the

rhetoric she will take that back. it was joke that didn't land and leave the comedy to professionals. david: not a very funny joke. melissa? melissa: sony has agreed to pay up to $8 million in a settlement with employees who claim their personnal data was stolen in the hacking you heard about last year. joining us for more details in the case is deirdre bolton. >> well, melissa, you said it. $8 million, just broken down into bits as you like it, did pen thousand dollars per head if you like -- $10,000 per head ors loss of theft of identity and $1,000 per head, what people had to do after the hack happened. is to say, hire these monitoring services to make sure their data did not show up in other places. so, sony, remember that picture "the interview." the fictional assassination of the north korean leader. not everybody thought it was funny. in fact it may have made sony a

he has been entertaining and looks like he is taking this thing seriously. i have a feel a lot of people out there thought this was just for him to promote himself may see he may be a real candidate. david: scott, this thing, let's face it, the presidency, donald trump is many things, but one thing i have no doubt he is patriotic. this is very patriotic man. i know his family. they're very patriotic. he has got to be taken seriously. even establishment republicans who didn't take him serious now have to, don't they? >> well, it is interesting, i'm glad we're talking about this i just spoke to him about four hours ago. i gave him a call. i check in periodically with him and others seeing what is up, giving him read on the ground here in new hampshire. you're right, he is patriotic. he is very confident and he thinks he will win this thing. i pointed out, listen, it's a long haul. starts obviously in new hampshire. there will be coming after him full bore. he says, well, i'm ready. that being said if he is the

eventual nominee i think he will do a fine job because he is smart enough to surround himself like reagan did with good people who have experience in areas that he may not be as solid in. so i look forward to seeing what happens. and, you know it is kind of exciting. david: chris, today we found out biden's not in the race. i happen to think that trump would do better against hillary than he would against biden because biden was such a nice guy. hillary has background being very tough, having enemies list. don't you think trump would have done better against hillary than biden? >> no. hillary will take him apart. we'll enter into scrutiny phase where voters decide who they are. david: the question who will take who apart. i know that is what you think, but i'm saying against biden he would be more vulnerable, because biden is recognized as nice guy.

he wouldn't be aggressive as biden would be against hillary. >> aggressive against hillary with his sexist background will backfire against him in big way. i don't think he has chance anybody. i don't think he has chance against republican field. david: various matchups by the way, he does appear to be ahead in, i know you can look at all different kinds of polls. >> right. david: but some of the polls are against you on that one. >> but, david, what you're failing to miss in my statement here, we have not entered into the scrutiny phase where candidates backgrounds, records and plans are really scrutinized by voters. right now he is entertaining us all. he entertains me. i love seeing him on television. people want to keep seeing him on television. that is why he has risen in the polls everyone else -- david: chris, think you're right but one thing we haven't seen, jason all the background stuff on hillary. you know there is a lot of stuff, a lot of people have been doing background stuff on hillary, whether she had
