the dow down over 250 point here as we head into the close. the closing bell sounding on wall street. [closing bell rings] david: down 250 point on the dow. looked like recovering at midday about noon. kept going down and down closing lower in the close. the s&p is down, almost all of them are down well over 1%. melissa: right. david: down 3% right now. even gold taking it on the chin. usually when you have market like this, people flock into some kind of substitute. not today. everything is down. melissa: price of oil below 42 buck as big driver. lori rothman on floor of new york stock exchange. tell me about the selloff. reporter: we're flush with supply we learned. oil down seven of last eight sessions. call it fed dread. we had a handful of fed officials marching out, saying this and that. generally leaning towards what

4:02 pm
melissa: one of the big things people talking about is selloff in crude oil and what is driving it. that is the concern. it is being driven lower by weak demand and global slowdown that is what makes it a harbinger of things to come, right? >> absolutely. again no surprise there. we've been following a china slowdown. european equity market selloff. moves in the dollar and gold. the dollar could hit key psychological level. how it reacts to that. all those things, we're trying to gleam messages from the asset classes and what their value is. what it says about the overall global economy. melissa: absolutely. lori, thank you so much. i want to bring in "barron's" senior editor jack who is with me now. what do you make about the selloff? is about the fed or crude oil? is it consolidation? >> i think it is about the fed but i think it is wrong-headed. investors looking at possibility that as we raise rates bonn

yields move higher and provide better competition for stocks. not necessarily, right? if you look last time we had big run-up in fed fund rate, three years before may 2007, when the fed was trying to cool the housing market, you had a rise in fed fund rates. look what happened to the 10-year treasury, it barely budged. bond yields barely moved. because you have action on shortened of the church, we're going from sear are to anything but zero. just because you have movement on shortened doesn't mean you get any action in bond. that depends on economy. growth is lackluster. i don't see a run upin bond yields anytime soon. stocks will look like the most attractive asset class even if they're not that attractive relative to their own history. melissa: maybe a response to oil. downdraft of oil down below 42 bucks a barrel. down better than 3% on the day. folks looking at that, maybe about oversupply in the u.s.
4:04 pm
maybe all the supply we got from fracking. >> yeah. melissa: at the same time, china is slowing down, probably by more than numbers are telling us. is there a global slowdown? that is why we have the glut? go ahead. >> with oil we see profound effect on corporate sector. energy sector has fallen off a cliff that brought down earnings for s&p 500. that makes s&p 500 a little more expensive. we haven't seen other side, consumers having more money in their pockets from lower gas prices. spending more at register. we seen the bad stuff. we haven't yet seen the good stuff. that is hurting stocks prices. melissa: thank you very much. david. david: don't forget the value of the dollar. that is going way up. that might be affecting the price of oil. republican candidates take a key step step descending on on new hampshire. we have kind after ritual every

four years but kind after fun one. reporter: david, no question about it. focus on first-in-the-nation pry parry state and new hampshire and verbal jabs between candidates over issue of immigration. texas senator ted cruz filed to appear on the new hampshire ballot earlier today. cruz ripped on much of the field as supporters of amnesty for illegal immigrants. >> a majority of the candidates standing on the republican debate stage had previously publicly supported amnesty. i am the only candidate standing on that debate stage who has never supported amnesty. reporter: one candidate who was not on the prime time debate stage the other night also filed his paperwork in the granite state. former senator rick santorum took this swipe at cruz. >> guy who was just in here, makes big passionate speeches about, how tough he will be on illegal immigration. yet in the gang of seven, the "gang of eight" bill he offered his ammendment allowed people to

stay here in this country indefinitely. reporter: today florida senator marco rubio said some illegals will need to be deported and government will have to deal realistically with 12 or 13 million illegal folks in this country. the american people are watching to make sure the law is being enforced. >> you have to prove to people illegal immigration sunday control. you have to show them you're actually enforcing the law. you have to prove to them it is working. you have to modernize the legal immigration to make it merit based and not family based anymore. reporter: next stop for the republican candidates is florida, for a two-day event called sunshine summit. david: we could use some of that in northeast. mike, thank you. melissa: rand paul duked it out over marco rubio over the florida senator's child tax credit. now donald trump is entering into the fray. blake burman with more details. blake? reporter: debate over taxes continues well after our presidential debate on tuesday night. donald trump appeared earlier

melissa: exactly. all ties together. lori rothman, thank you so much. >> you got it. melissa: fbi is widing a probe into hillary clinton emails. agents are exploring whether statements made by clinton in her email actually violate a federal statute. fox news's catherine herridge has details on the developing story. reporter: thanks, melissa. intelligence sources tell fox news that fbi agents are exploring whether there are violations of federal false statements statute, 18 usc 1001. staple statute convicted martha stewart of her insider trading case. it pertains to materially false statements given either in writing orally or through a third party. it is not required the statements are given under oath. >> martha stewart was having a conversation with a fbi agent and her lawyer in the fbi agent's office. she was not sworn to tell the truth. she was asked about certain
4:10 pm
activities and she lied about them. as a result of those lies, she was prosecuted and convicted under this very statute. reporter: legal experts say section 1001 could apply if clinton aides or tern were not forthcoming with fbi agents about her use of personal email for government business or destruction of documents. it is not publicly known who the fbi may have interviewed. separately two u.s. government officials say the fbi is doing its own independent classification review of the clinton emails, effectively cutting out what is becoming a grinding political process at state department. the bureau is boeing directly to the agents who got the intelligence in the first place and under regulations have final say on classification. >> during the investigation you want to make sure that all the boxes are checked and all the sources that you used in carrying out that investigation. reporter: fbi district tore james comey avoids commenting on any ongoing investigation but

including the late editor of "the wall street journal," bob barley, saying that the great depression was caused by trade barriers because of the smoot-hawley provision, a protectionist law put in place by republicans. only person that was real free trader every night who had to remind everybody the new asian treaty did not include china after they suggested it did. if it is likely a republican that is elected not rand paul we will get higher tariffs and maybe some trade wars? >> i tend to doubt it. i think it depends who it is. certainly if you get establishment candidates, whether it's somebody like marco rubio or jeb bush, they will go with what is a widespread consensus and certainly very widely supported in the business, the establishment community, in the republican party, and, they would support free trade and reduction in tariffs. guess what, there are 18,000

price of college went up to match the level of support in freeness that students were getting from the government. steve, what do you think of that? >> well, just watching those protests. it is sort of a sad wages. we raised a -- sad situation. we raise ad generation of kids who believe in grievances entitled for everything to given to them for free. what a terrible attitude. you're right, melissa. i've done the same analysis. every time we raise federal subsidies to universities, universities turn around to raise the tuition. becomes like a dog chasing its tail. why not get to programs requiring kids to work for education? these are 20, 21, 22-year-olds, rather than protesting they should get a job. >> melissa, you want to raise the price of something, you do two things. you artificially puff up buying power so everyone is richer. >> yep. >> then you constrain supply. you don't allow new entrants into the market. with college, especially elite
4:46 pm
colleges we have cartel system, right? only, job of college itself to certify how well its own students have learned and confer degrees. when you have that system, no one else can enter the field of course you will get sky-high prices. these student are saying education should be free. guess what? education is just about free. we're talking about a college degree which is very different thing from an education. i want a little more say in how those degrees are conferred and how we judge how good of a job colleges have done teaching. melissa: i have to object to the word free. it is not free. not like the university will do it for free. they're saying i want it, you i don't want to pay for it. i want you taxpayer at home to pay for this and take over the debt. the word free is total misnomer in this situation. and steve, i mean, looking at this scene right here, hunter college, this is an amazing, beautiful school that's really cheap. that's the irony of it. this school is 6,000 bucks a
4:47 pm
year. it's not like so many other schools and tuition everybody else is paying elsewhere around the country. these students are totally dissatisfied. steve moore, can't take it. put me out of my misery. >> i wish i could. i will say this, if you're financially hard-pressed and need a very high quality education you don't need to spend, 20, 30, sometimes $40,000 a year. go online to get the courses 1/100 what they cost to go to them. online education should drive down costs universities. i think, melissa, there is good news here. there is big bubble in college tuition costs. those will fall dramatically because of the competition of online. just ike -- like uber. >> i could not agree more. this bubble will burst. rules of calculus have not changed. it should not cost you $3,000 to teach you calculus. someone will innovate and
4:48 pm
college costs will go dramatically lower. melissa: we have to go. >> best line in the debate when marco rubio said, we have way too many philosophers and not enough welders in this country and welders make more money than philosophers. i don't think they teach welding on college campuses. melissa: twice, thank you very much. david: elizabeth warren was teaching at harvard, 300,000 for one week. your smart tv could be spying on you. a new report saying that electronics maker vizio could be spying on 10 million smart tv owners, tracking what they watch and selling to advertisers. deirdre bolton joining us. this is scary stuff, deirdre. >> in fact, david, as usual, let the buyer beware. with these customers, these 10 million you highlighted from vizio, you have to opt out. so you have to know where to find that fine print. tough turn it off. if not, david, here is the information they're looking for. i will read you the list. gender, age, income and interests.
4:49 pm
so they are tracking what you want and then based off of what you watch, they're making a guess as to all those categories. then selling it to data brokers, who then basically can reach out to you through other ways like tablet, your mobile phone. this is a little bit stronger, a little bit more aggressive than what some other smart tv companies are doing, for example. samsung, lg electronics. they have smart tvs as well. they collect some data. but they're not selling it. they're clearer up front. do you want to participate? so it is pretty clear if you don't, you say no right off the bat and you're in the clear. vizio is -- david: if you want to know how not to participate. keep your private data private, listen to deirdre bolton. she will being on the top of the hour. "risk & reward." deirdre, thank you. daily fantasy sports sites are striking back against the new york attorney general, but the ag, he ain't messing around. here is another look at protests in new york city.

saying people should still use the sights even though the state ordered them to stop. who wins. we have our own liz macdonald. business and sports attorney seth and first name only. liz, what is the latest? reporter: eric schneiderman says this is massive million at this billion dollar scheme to fleece sports fans nationwide. what happens to payment processers, citigroup, discovery, visa, mastercard and paypal? what happens if eric schneiderman wins this fight, what are they going to do? david: right. reporter: they certainly don't want their brand names roped up into quote a criminal enterprise. this is tough one earnings absolutely. mike, pretty gutsy of the sites, keep the money coming. we're going ahead. we don't care what the ag is doing.
4:55 pm
that is a gutsy move, is it not. >> it is, david, you're absolutely right. i see this as a shakedown by the attorney general. david: yee. >> why are daily fantasy games more a fame of chance and gambling than season long? very, very large percentage of winnings only go to 1% of those that play. this is if anything more of a game of skill than are season-long sites. this ag gets a lot of campaign contributions from casinos. david: right. >> so he is started looking at this. david: may be some of that in there. seth, there is no question that attorney generals, they call them, they call them governors, assuming the governorcy. they want to be gives. that is what attorney generals do. is this all political on his part. >> i don't think so. david: hold on. go ahead, seth. >> sure. i don't think this is purely political. obviously every attorney general has some possible political aspirations but look, this is a real case.
4:56 pm
this is a threat of a cease and desist with a short fuse. and schneiderman has an argument here. it will be a close call but new york law says that if chance is a material factor in how this happens, that these guys lose. so therefore, next week will be a huge turning point for this entire industry. tuesday is the deadline. if they can not negotiate this or come some kind of turning point will be locked into litigation with injudges. david: mike, verily, do these sites survive? >> yes. i think yes, if it is not in new york state they will survive outside of new york state. very popular. david: that has to be last word. thanks, everybody. we'll be right back. (vo) me? i don't just wait for a moment. i watch for the perfect moment. the one nobody else sees. and when i find it- i go for it.
