discuss the possibility of coalescea around a trump alternative and forcing a brokered convention, and in new york state some establishment republicans, so-called, want to have trump banished from the party altogether. this as republican consultant e. o'brien murray, you can tell he's establishment, considering filing a complaint with the party. >> the message about keeping americans out of our country if they're muslim and out of the country when he did that on monday shows, i believe, his lack of being genuine in running for president. lou: whatever. the establishment resistance to trump will be met by a candidate that loves a good fight, who has as well overwhelming voter support as we are now less than two months from the iowa caucuses. trump is still dominating in the polling, all polling.

a new cbs "new york times" survey shows trump dominating the republican field with 35% of the vote. trump's showing is improved by 16 points since october. i'll be talking about the republican race with one of trump's challengers, senator rand paul joins us tonight. also tonight, growing outrage on capitol hill over how the federal government's visa screening process failed to stop one of the san bernardino shooters from entering our country. authorities are now certain that tashfeen malik was radicalized years ago. so how was she able to obtain a k-1 fiancee visa? and why should any citizen believe that our immigration system is effective? that this administration can assure public safety and our national security? we'll have a full report for you tonight, and i'll take all of that up with conservative commentator michelle malkin tonight. she says the government needs

the presidency. paul used twitter to list several reasons why it's president obama who is unqualified for the oval office, and among those reasons, according to senator paul, obama thinks an executive order is legislation and how you make law. his copy of the bill of rights obviously only goes from one to three, skipping the second amendment and more and obama appointed an attorney general who says speech against muslims is a bigger threat than terrorism. joining us tonight, republican presidential candidate, senator rand paul, a member of several key committees, including foreign relations and homeland security. senator, great to have you with us. >> thanks, lou. lou: i want to turn first to the vote last thursday on the secure act. your act which you proposed a temporary ban, i guess, is the way to put it on 30 some odd countries that you've identified or would be identified as bases for

extremism, is that correct? >> yeah, i think we're crazy not to look at immigration. even starting with 9/11, all 19 highjackers came here using the legal immigration system. they all had visas but weren't obeying our laws. a couple came as students but weren't attending school. a couple came as visitors and weren't visiting us, and a couple were on the cia watch list and we let them in anyway. two lived with fbi informant for a year. we have to look at our legal immigration system and say do we want to have more scrutiny on the people who come and visit us? this most recent example in san bernardino. i think there should have been more scrutiny of the woman's visa who came in. apparently she wasn't honest on the visa application and no one scrutinized it. lou: and the fact of the matter is the interviews that are supposed to be so rigorous were not conducted as far as we know right now.

there is clearly a statement from the state department this is a rigorous process for the so-called fiancee k-1 visas. this is a small number of folks who travel in the country. the reality is not even the least, the minimum was done to protect american citizens and to follow the law. >> and this isn't just the first time. two iraqi refugees came to my hometown, bowling green, kentucky and came under the refugee program and turns out they tried to buy stinger missiles and we caught them. one of them's fingerprints were in a database on a bomb fragment from iraq. they said we have great scrutiny for the refugees. two who came to my hometown weren't sufficiently scrutinized. we have to have rules who comes into the country and we are fools if we don't invoke stricter rules. you get a background check, once you've had it, if you're a

businessman or woman who comes here frequently. by all means keep coming. go through the frequent flier program, the global entry to background check people so we don't have random people. all of the attackers in paris were french citizens. people from getting on a plane right now. we have to do something about this if we care anything at all about terrorism. the first thing we've got to do is defend our border. lou: for whatever reason, senator, as you well know, the integral agency in all of this is the citizenship and immigration service, one of the most screwed up agencies among many screwed up agencies but critical to administering immigration law and the process by which people enter this country lawfully. it is an outright mess. >> see, we've been talking about for decades fixing the immigration system. what i said is why don't we stop immigrating people from the countries that are high

risk for terrorism and force people to fix it now rather than promising to us we're getting around to fixing it, it's a few more years and we'll fix it. stop immigration until it's fixed now. how big is the problem? there are 11 million people in the country illegally. 40% of them are said to have overstayed their visas. but we don't seem to care, we don't know who they are, we don't know where they're, and don't enforce our rules at all. there's 150,000 students here from the middle east. many are probably good people who like america. if 40% of them are overstaying visas and we don't know where they are, that's a huge mistake and a huge risk to us. lou: it is just -- it is breathtaking to think that ten years ago in the united states senate we were talking about comprehensive immigration reform and taking votes. ten years ago talking about border security and incremental dollars were added to the budget and border patrol doubled and tripled from levels

of two decades ago, and at this moment, as we speak, a surge of illegal immigrants on our border particularly in the state of texas. it is, and this administration has told the american people go to hechlt we're going to do this my way, doesn't matter what your silly congress and senate have done in terms of enacting law, this is going to be done my way. >> the problem with border security is not money, a lack of agents it's a lack of willpower. we have not had a republican or democrat president who had the willpower or inclination to defend the border. all you have to do is enforce the laws. it is illegal to come across illegally, and yet don't do anything about it other than to say we're not going to do anything it. you get more of something that you don't enforce the laws against. i think we need to enforce our laws. that takes a president with the will power to enforce the law. lou: senator, great to have you with us. congratulations for being in

republican party and the american dream. there's a collision. a new survey from harvard's institute of politics contains terrible news for the american dream and those trying to live it. and good news for the anti-establishmentarian theme of this republican campaign so far. the poll shows half of millennials say the american dream is dead for them, but millennials are evenly split on the dream. 48 split of 18-29-year-olds say it's dead. 49% say it's alive. the new pew analysis finds about 121 million adults living in middle income households early this year compared to half a million more in lower and upper income households combined. this is historic because the pew survey results mark the

suicidal. lou: it is suicidal. and you point out often what this government is doing that is suicidal but it is also homicidal because it is taking down republicans who in good faith really want to win the 2016 election. when you have a speaker like paul ryan, who is attacking one of the candidates and stepping out of what should be a neutral role. he tried to walk it back but it was too late. have you mitch mcconnell playing political games. the rnc. the meeting that the "washington post" reported that we have reported on now of the elites trying to kill the trump candidacy. they're talking about subverting the will of millions of republicans who in good faith select aid candidate. these people are about to destroy the republican party's chances of winning the election in 2016, and i think if they're successful in that, they very well -- they could cripple this country for years, decades to

idea, it fascinates me. trump said clearly, i'll put it in parlance, in the vernacular. if you screw with me he will go independent, and he will tear the republican party to pieces because the people who like him mean for him to be the nominee. they are passionate. the intensity of their selection him is much more intense than anyone else. betsy, there is any way this can be avoid? the republic scan party is saying we have 15 candidate, but only one of them can get the 35% and it's the wrong one. >> trying avoid this is the million dollar question. a poll came out yesterday that showed 68% of trump's voters would vote for him if he ran as a third party candidate. that's giving the election to hillary clinton.

>> there is one big problem that trump is racing toward. the sore loser laws we have that would prohibit him from getting on the ballot. he won't be able to run. lou: the deal for the two parties, republican and democrat laws. who knows what's going to happen three weeks from now much less by the time we get to the convention. it's impossible to predict what donald trump is going to do. if he squeezed out, if the new york republican party tosses him out of the party, he certainly has the ability to blow everything up. i don't know. >> why wouldn't he? he's knee deep in hand grenades right now. that's trump.
