my friends, the dow up 120 points as the bell sounds; is that right? that's not right. >> about 123 at the moment. >> 123, the nasdaq up 44, that's not bad. maybe santa claus rally here, oil down 35-78 so a little trouble there in oil land. >> yeah. oil is really remarkable to see where it is. as we close it up on the monday morning on the markets here in just a bit but first to that political story of the day and senator lindsey graham he's out of the race. south carolina senator spending his campaign for president. blake berman starts us off today with the details. blake. >> the republican field has shrunk by one. senator lindsey graham has ended his presidential bid. long considered a long shot only have registered higher than 1% in a national poll just once in the last six months. graham is the senior senator from south carolina. highs departure came on deadline day for candidates to have their names removed from

that ballot. graham announced the end of his presidential run in a youtube video. >> i'm far more confident today that our party will reject the obama doctrine of leaving from behind and will provide the strong leadership america needs. >> with it the state of the republican race remains largely unchanged. donald trump continues to dominate according to the latest fox news poll. trump has support now from nearly four in ten republican voters. he's 21 points clear of ted cruz at 18. marco rubio is at 11, dr. ben carson at 9. no one else is higher than 3%. that poll is notable because it was taken entirely after last week's republican debate, which focused on national security. back to you in new york. >> all right, blame. blame berman there in dc. >> the commander-in-chief president obama downplaying isis in his year-end interview with npr. joins us from honolulu where

the president and his family are vacationing. >> good day to you. you're right. the president somewhat defiant i guess you could say in that interview saying it's the lack of messaging that's getting through to the american people about successes as it relates to the on going war on terror. that's really behind the anxiety that americans are feeling. he says it's that and not the policies that are currently under used by the administration. of course the president has long been saying that this is going to be a long fight. one that will last well beyond his presidency. but we heard in that interview with npr that's a lack of messaging that's the problem. listen to what the president had to say about it. barack obama: i think there's a legitimate criticism what i've been doing and our administration has been doing in the sense that we on a regular basis described all the work we've been doing for

more than a year now to defeat isil. >> we're talking about 89,000 air strikes, for example. and the fact that the coalition is actual, gerri, in many cases been able to gain ground against isis, that's the messaging that the president said it's simply not getting through but lawmakers on the other side of the aisle are simply saying it's not just the lack of the messaging by the white house that's behind the anxiety that's building among americans. >> without american leadership, nothing's going to happen. the president of the united states needs to step up and say okay. here's the plan. >> now, the white house has an evolving plan. they keep saying the strategy moves and evolves as does the threat. and we've heard them say on a number of occasions they're going to have more air strikes, more corporation with international partners, even going so far as to say that they will target isis financing and even their online recruiting and messaging. but of course as i pointed out, this is a battle that will go well beyond january of

>> well, there are measures that have happened. >> no. melissa: few weeks, they had the press conference talking about the terrorist financing resolution that passed at the un. there have been specific measures in the house and the senate related to visa waiver reviews? so there have been concrete things happening behind the scenes? maybe the american people into the policy details but these things ahappening, and i do agree. the tone has been problematic, and i think the communication strategy can be improved. connell: especially after an attack because as we saw in san bernardino i think in the public's minds, and we went through it here in new york after 9/11. people do get emotional and there's a couple of ways you could go and p. and the president has clearly chosen to tone it down almost on purpose, maybe that's calming but in this case it seems people wanted something effort. you know? >> i agree with you. there's a difference from fearmongering and playing into peoples fear and i don't think the president has doing. but to be honest i felt they've been lacking in that front. there's not that intensity to some of his remarks on these issues. connell: not the anger or

passion he has in some other areas. i think that's fair. >> right. i think that's fair. i think the president has been good in pointing out our fear shouldn't make us overreact. we shouldn't be sending hundreds of thousands of troops in an overreacting way but they're not in alignment on his strategy. connell: on something that they feels they do. all right. we're going to talk more to you later on. but thanks. gerri. gerri: breaking news. 24-year-old enrique marques in court charged with aiding the two terrorists who went on that mass killing spree in san bernardino we were talking about. fox news will is live in the courthouse in riverside, california with the very latest. will. >> hey, gerri, within the last hour a judge came out and denied bond to enrique marques saying he's a danger to the community, keep in mind he planned two terror attacks in 2011 and 2012 that never happened but the judge taking that seriously nonetheless. now, marques appeared calm in court. he was wearing a white

jumpsuit, he was shackled at his wrist and ankles. it looked like he hasn't shaved in a couple of days but wearing glasses, had his hair neatly combed. seemed compared together from the day after the shooting saying he called 9-1-1 wanting to commit suicide, he is the man who bought the ar15 that syed farook and tashfeen malik used in this massacre. and if he is convicted of the three federal charges that he's facing, he could face up to 35 years behind bars. at the same time this community continues to honor the lives lost. sierra claiborne, nicholas all laid to rest this weekend. three of the 14 shot and killed inside the inland regional center in san bernardino. gerri. gerri: amazing story. will car, thank you for that. connell: let's shift it over and we talked right when we came on the air about the price of crude oil. let me show you brent crude in a moment which they trade over in london.

this price is an 11-year low, 336-15, so really is as i said at the top to see these go down, and cheaper oil helping to drive down prices at the pump, there's your latest numbers there, below $2 a gallon. how about that? we were waiting for that milestone. we love round numbers, below $2 a gallon, jeff flock in chicago with more on what we can expect on gas prices and jeff has put his jacket on. take it away. >> raining. yes. a little rain has come to chicago at the food 4 less, which i think is more named today gas for less. less than $2, which is the national average you see back there. 1.99. that was 2.41 in case you remember one year ago, and actually six years ago was the last time the national average got this low if you take a look at the six-month chart, you see what it has been doing. stealed declining, not rapidly but steadily declining.

right now we have 14 states selling gas below $2 a gallon. the price according to aaa is 1. $90 and according to aaa they tell us drivers this year alone saved 115 billion with a b dollars in savings on gasoline compared to last year. leave you with the refiners some of them are refiners too but these are the largest of the retailers, the gasoline retailers. their stocks bp, chevron, exxon mobile, marathon, not great news for them. obviously the margins are tighter. going to get gas down this low and aaa said today it could go even lower than it is right now. connell: that's right. i mean there are definitely two sides we talked about onto these oil companies but consumers will take it. thank you, jeff. jeff flock. gerri. gerri: i love when it's below $2 a gallon. we have more breaking news. another black eye for chipotle.

investigation was -- was it triggered by the hike? was it triggered by social media persona or a deeper case that law enforcement has been looking into? that's what we're going to be looking at going forward. back to you guys. gerri: great stuff. connell: we have a few other stories on our radar today, six soldiers killed in a suicide bomb attack in afghanistan, this is an area close to the u.s. base, the attack currently under investigation. it now raises the death toll of nato service members who have died in afghanistan this year to 25. huge landslide of construction waste and trash in buildings in southern china. at least 85 people left missing as a result. 900 have been moved to safety. and then space x's shot at redemption. that begins tonight after an unsuccessful attempt in june, elon musk's company is said to launch a rocket tonight just after 8:30 eastern time if you want to watch that. cape canaveral in florida. gerri: and the daggers are out after the debate. donald trump calls hillary

in u.s. taxes in 2012 alone by using a strategy involving three offshore divisions. cook told charlie rose on 60 minutes last night that the company is doing nothing illegal. >> we pay more taxes in this country than anyone. >> well, they know that and you should because of how much money you make. >> well, i don't deny that. we happily pay it. >> you have more money overseas than any other american company. >> i do because as i said two-thirds of our business is over there. i'd love to bring it home. >> why don't you? >> because it would cost me 40% to bring it home, and i don't think that's a reasonable thing to do. >> according to one study apple has parked $181 billion of profits offshore and would owe an estimated 159 billion in taxes if they tried to bring the money back to the u.s. gerri. gerri: thank you for that, peter. connell: all right. more to talk about on this whether

semi-tax evader or avoider from barons senior analyst with us in the studio also get to the stock price in a moment but any that you say on the tax money parked overseas? and issue that has been fourth years brought up in the 60 minutes interview. >> well, is apple trying to dodge taxes? of course it is like everyone is trying to keep their tax bill as low as possible while following the law. its argument is that the law is ridiculous. and, you know, it's not really any big secret out there that in america we have a corporate tax code that accomplishes neither of the things that it should accomplish. it does raise a heck of a lot of revenue because inculpates so good and have so many ways -- connell: not reasonably calculated to lead to the @ paying the true right? >> but it ultrasound has a statutory rate that's frighteningly high compared to other developed nations. the thought of paying 40% on that money to bring it home, i mean he's got a responsibility to shareholders to try everything he can do to avoid that.

connell: as you say rival not the only company maybe the biggest one but not the only company involved with this other comments on china where, you know, they were talking about jobs and -- products being made over there. he said it's not necessarily because we're doing things cheaper, it's the skill set. the education system in china and that's -- >> yeah, not a lot of people are buying that one i don't think. i bet doesn't mind it's also cheaper. >> right. i mean come on. >> i've got to believe when it first came time to build these things. yeah, the skill of putting these together, you know -- they have engineers in germany. i mean you can find labor -- skilled labor in other places. connell: sure. >> but at this point they have so much manufacturing over there, you've had some wage inflation in china and they've been a big driver of that, other companies as well. at this point, though, it's probably easier just to stay put certainly than to move somewhere else. connell: let's talk about the stock price because that's another. in your wheelhouse as gerri said it comes out of bear market territory today barrel.

107.33. >> yeah. connell: thoughts on apple stock price. >> you should buy. i'm going to go. you should buy it tomorrow. look, apple the stock price is pessimistic if you subtract the cash from the stock market value of the company. you've got a price to earnings ratio in single digits. that's a bet that apple is done growing, that it can't grow anymore. i think that's totally wrong. it's done growing by 40% a year. this is a company that turns into a hardware annuity business where you keep getting people upgrading, they gradually gain slivers of market share, they come out with new products, and i think this company continues to grow its earnings by 8% a year. connell: that growth is enough to drive the stock. >> absolutely and return a ton of cash to shareholders. i think this is a stock over the next year they need to play some valuation catch up. once you see the growth, i think the stock returns 30% next year. connell: interesting. jack, gerri, back over to you. gerri: well, someone has the right to be a sore loser after all.

he says the gop party has made progress in recognizing the threat isis, clearing the way. joining us is judith miller and betsy woodruff political reporter at "daily beast." we have a fourth gop contender dropping out. is this a surprise? >> not particularly. lindsey graham polling particularly low, the real clear politics showed him with 1.7% of the vote. it would have been embarrassing for him if he had gotten such a poor showing in his state. him exiting the race is another example of experienced, seasoned politicians who can't get traction in the primary. gerri: you make a good point, and judy to you, as betsy was saying, this is today's the deadline to pull out of the south carolina primary. are you surprised he pulled out? and now we have now 13 left. how far does it go? isn't this the season of dropouts? >> i think it is.

i think we're seeing this and it's unclear to me that lindsey graham was really running for president. i think he may have been running for the post of secretary of defense in the republican administration if there is to be one, but he did set a very firm line in terms of the hawkish wing of the party. he was one of the first to say we need at least 20,000 boots on ground, never waivers from that. he has been a benchmark of what republican party used to be. gerri: i'm so curious to see if trump were to get the nomination, can lindsey graham support him. he's called him a race-baiting xenophob, a bigot and how do we make america best. betsy to you, could he support trump? >> it remains to be seen. he held up lindsey graham's cell phone number in front of a massive audience and said call

this guy and complain if you don't like what he's saying about me. hard to believe lindsey would make nice and forgive him. if trump is the nominee, it's possible he'll bite the bullet and go after hillary. gerri: this race is amazing. move to another beltway bout. the 2016 front-runners over isis, donald trump calling hillary clinton a liar after she says isis uses videos of him as a recruiting tool. >> he is becoming isis' best recruiter. they are going to people showing videos of donald trump insulting islam and muslims in order to recruit more radical jihadists. >> it's nonsense, just another hillary lie, she lies about everything, whether it's trips, where she was being gunned down in a helicopter, or an airplane, she's a liar and everybody knows that. gerri: judy, to you first. is there any evidence that, you

know, they're using video of donald trump to recruit isis members? >> no, there is no evidence, there's no single video as we saw poor jennifer palmieri struggle with when she had to answer that on national television this weekend, but the fact of the matter is the seam that donald trump has been striking, the words he's been saying alienate muslims and to that extent people have been warning they alienate the people you need to warn bus attacks being planned in this country. that being said, you know, donald trump calling her last week, she was low energy. this week she's a liar. it's just -- this is outrageous. gerri: that's his style. betsy to you, the trump says he will never tone it down. even if his videos are used to recruit terrorists. what do you make of that? >> well, one thing that's interesting it's a challenge

for isis analysts to talk about isis, they don't want to show up with propaganda. one woman i spoke with said he's taken flack for calling isis the islamic state. that is the most important thing is to tell the truth. one other thing is funny if being isis propaganda means you are messing up, hillary has her own issue, her husband bill clinton appeared in isis propaganda. they called him a fornicator. >> judy, quick question to you, one of the interesting things of the debate is hillary saying the strategy in dealing with isis is in the right place. do you agree? >> she said finally in the right place, and i agree with the finally part, i don't believe we're in the right place. most people think we're not doing enough either in the information war far front, countering the ideology that is

at the core of this movement, not on the ground because that's what all of our military people say. we are not yet where we need to be, and i'm just surprised that hillary clinton let herself get put in that position of endorsing a policy which she has opposed as secretary of state for obama. that was what was surprising to me. gerri: betsy, what do you say? >> i think it's totally reasonable. senior defense department officials told my colleague that they have low confidence in how the president's prosecuting the war on isis. it isn't just congress, it isn't just republicans. isn't just democrats. highup people in the pentagon who know what's going on saying things aren't going the way they're supposed to be going, and explains why the demdebate was at 8:30 p.m. on a saturday. likely hillary clinton and allies are concerned she might say this in front of audience twice the size and could have negative repercussions.

>> and was wearing a brown suit, another no-no on tv, ever since al gore. i don't know what was going on saturday night. gerri: betsy, judy, thanks for that. connell: almost 36 past the hour, the natural time to transition to talk about flying cars. for a few minutes. this is actually a true story. cars could be soaring to new heights, this is video of the prototype a company is working on. the faa is giving an aircraft company called terrafugia the prototype to test out the flying car prototypes. joining us is the foxnews.com auto editor. is it practical? anything that makes you believe we'll be flying around like george jetson in our cars? >> i don't know about you and i, people will buy one of these, quarter-million dollars, half million dollars, the one we saw, that's the first model, the transition. kind of airplane, foldable wings. the idea is it's street legal

so can you drive it to the airport. take off, fly where you are going, land at the airport. the other has vertical takeoff and landing capabilities, they'll test a model pretty soon. that opens it up more. you can take off from the backyard, land in the parking lot at work. there's a lot of market for that. high net worth individuals take helicopters or driver a quarter million dollar car to work and sit in traffic for two hours. if you can make it convenient, there is market some years, we're not talking about next year. connell: people say traffic is building up, if i get to east hampton on a friday in the summer, i'll fly, in my own car. the other one i watched was pulling out of a driveway and almost like a helicopter. that's the other model. the second one? >> that's the next generation version, the tfx, that's when it's going to get interesting.

>> they have to regulate it. today is the day, public service announcement, for those of you who haven't registered your drone, today is the day do you it with the faa. i would think this would be craziness of having more, if people are flying around in their cars, the faa is going to have work to do there too, right? >> when there's a lot of them. it's not that many. the thing is there's this growing industry of sport light aircraft that's pretty big right now. and you don't need a regular license for it, you can take a 20 hour test. you can fly in uncontrolled airspace. that's where this falls into. you will be able to get another license where can you control the airspace as well. the idea is to have this flying around the margins and above the traffic and making things better for everybody. connell: take a lot of things, when we years and years ago said it was just nasa and people said private space exploration, there will be another launch. people said come on. the government has to do that,

and even years before, that the fact there is space exploration at all is considered crazy. what about the practicality of this? you said maybe not you and i, so it's years and years away in terms of a timeline for something like this? >> hope to have the first one certified within two years, they said it was going to be 2012, seems to be a few years away. the other one they're talking about 8-12 years away, but more about getting the vehicle certified than the rules governing how it flies. one thing if they can get them there, they have to start working them. . connell: you don't want this thing malfunctioning flying around with the family. gary, good to see you. appreciate it. gerri? gerri: i like that better than self-driving cars. much better. connell: really? i could have myself a self-driving car. >> i want to be in charge and large. connell: that's also your prerogative. in charge and large.

. connell: here's a stock alert for you. we're not having a traditional santa claus rally where the market does well in december. today we rallied nicely into the close. telecom did well, technology did well and the s&p 500 rising on the day almost 16 points. all ten sectors ended up green on the day. last week we gave up 600+ points in two days. oil continues really to be the big story in the markets with nymex crude sliding a total of 33% since the end of 2014. a nice close for stocks today. gerri? gerri: i like that trend much better.

but you know, if you shut down the energy grid, isn't that far worse? >> absolutely is. yet we've supposedly been prepare energy very threat for years and years, nothing seems to be better. the infrastructure is not modernized and this is not isis, this is the work of state organized hackers. gerri: china? >> china, iran, russia, people who want to use this as a weapon in the event of war and embed in our infrastructure and it's are about dangerous, they're probing and mapping our networks. gerri: tara, what i hear from the left is the problem is really this is held by private companies and not in a position like the government would be to fix this problem, you go with that? >> it's a little bit of both. similar to the issues with the tech companies about the encryption social media debate. you need the government and the private sector working on this together. the government can pass legislation for companies to meet, but at the end of the day, the power grid, the water
