12:00 am
of the ham monds family. we hope you will be with us tomorrow. good night from new york. kennedy: yes, the year is so new and baby fresh. i'm watching frustration boil over. people have had it up to their beaver caps. the oregon standsoff has caused outraged cries of domestic terrorism. just because murderous jihadists live and kill among us doesn't mean there needs to be an equal and opposite number of home-grown loans on the other side of the equation. if you didn't grow up hunting and fishing in oregon or utah i pity you. the federal government has over
12:01 am
the years and decades knead grievedy stlanlds grabs to control their share of the western pie:mining and logging and fishing and who gets what. hands tory minimums and judicious overreach in the caves the hammonds, an inagainst scab has been ripped off. you should be sceptical of anything forced upon you via social media which is supposed to stomach your feeling without giving you brains in return. donald trump's popularity can be partially explained as a backlash against regulation and force that is meant to make our lives better. our president will never disbelieve his own tainted logic and he's forcing his heavy-handed philosophy on us like a straightjacket.
12:02 am
his latest gun regulation will expands background checks and bolster the number of checkers and regulators to make your dream of self-protection a total nightmare. regulation cures frustration like suicide cures death. on the show tonight. bill clinton went into dairy headlights mode when asked about allegations about his past. see what spooked him. peter berg is here to share a sneak peek of his powerful series "live to tell." i'll tell you why missouri needs more constitution classes.
12:03 am
president obama announcing his executive action on gun central today at the white house. >> this hasn't bent first step in some slippery slope to mask confiscation. this is not a plot to take away everybody's guns. kennedy: tonight's a man panel. we have tom shill through. matt welch is the reason magazine editor-in-chief. matt, i will start with you. did the president make his case today on gun control? >> not at all. the clip you just showed is totally contradicted the last time he opened his yap about gun control. we know what works in australia and england where they
12:04 am
confiscated guns. democrats didn't spay squat about gun control for 10 years. after al gore lost tennessee widely seen as a revolt against his gun control. they didn't talk about it for 10 years because they have thought it was an electoral death nell. every time they talk about it it gets less popular. all these measures after every single shooting, they get less popular. so obama is giving us a great gift to the democratic party to say i'm going to advertise things that won't make any difference in the under lying cases. kennedy: they probably won't in the future. when you make an emotional argument like that, you run into all sort of other problems. >> not me. i'm an unemotional person. kennedy: he tried tugging at
12:05 am
those heart strings. i don't know if i'm qualified to talk about this because gliement pocket of the gun lobby. who this their pocket. most of these -- kennedy: mat overamericans -- >> i give donations to the nra base don't like it. it has nothing to do with the nra. politicians get donations for everything. is obama in the pocket of anytown u.s.a.? kennedy: yes. believe they donated heavily if not personally to him, to causes in his favor. i don't mean he's doing something children tonian. so what does this stop the background checks redefining mental illness. >> nothing he said is going to
12:06 am
prevents the mass shootings. the majority of gun violence the united states, if not assault rifles or whatever they are trying to scare people with. it's handguns violence perpetrated by people who are already criminals. why don't they talk about the connection between the violent cities like baltimore and dam den and oakland. there is a correlation between gun violence and democratic mayors. they will have to look at their own policies. kennedy: it's a complex issue and it's impossible to derive correlations on either side. that's why both sides have made it a political issue. but the constitution says leave it the hell alone, thank you very much. apparently the clintons are back off their war of words with donald trump. the donald went after president clinton's indiscretions and when asked about it on the campaign
12:07 am
trail, clinton seemed stunned. i guess they have decided. at least one republican is certainly going to do that. are you surprised bill turned into a mealy mouth stumble bum and he didn't have an answer. >> i have had several arguments on fox news with leftists or democrats who think bill clinton is teflon. what happened to him. remember when they pulled the monica lewinsky thing. but this isn't about bill clinton and him getting re-elected and us having sympathy for him. they are going to try to play the sexist card on trump and trump will come back at them hard and it will neutralize that. and he knows it, so he wants to stay away from it. kennedy: here is the definition
12:08 am
for sexism. do you think the clintons, particularly hillary bit off more than she or they could chew when she claimed he was sexist? >> i can see you are worried about it looking at the grim faces of people standing behind clinton. they look like a bunch of pows. it's like he's standing in front of us rather than behind us getting ready to grope us. you can't mess with trump with something like this because he comes at you. even when he overstates things, he has an amazing way of saying an opinion that's so crazy, but when you back off you think maybe there is something to that. clinton has been getting a free pass on being a sexual predator. >> how should they deal with trump? what should the clintons do? >> they will ask for more of
12:09 am
this. every time trump opens his mouth [bleep] or the trump things that come around, it's good for hillary. kennedy: and good for donald trump. >> hillary wants desperately to run against donald trump. kennedy: she thinks she does. >> i hate him, but the whole value proposition of trump is he will say the things you are not supposed to say in politics. for 15-20 years after impeachment fizzled we had a gentleman's agreement not to talk about the clintons. kennedy: reince priebus never offered him a gentleman's agreement. he didn't sign it an doesn't want any part of it. he's not mitt romney and the clintons are not prepared for that. you can watch a whole lot of
12:10 am
screaming and hollering or some gentlemanly ribbing. the republic kan presidential debate. it's january 14 and it's going to be awesome. what does donald trump have in common with kim kardashian. later we'll dig deeper. president obama's gun control orders with katie pavlich.
12:11 am
12:12 am
12:13 am
kennedy: hello to you, high plains drifter. let's run and frolic together. carly fiorina firing another shot in her duel with donald trump. >> he remind me of the kim kardashian of politics. they are both famous for being famous and the media plays along. kennedy: i don't know. tom, i think this analogy falls apart. >> it's a good analogy. donald trump is the kim kardashian of politics. but unfortunately she is the
12:14 am
khloe and the other one is the kendall. kennedy: the 18-year-old is dating a rapper. >> they are all "k," right? the kardashians are famous for being famous, but so are all these politicians. it's just that trump is the best at it. kennedy: joe? >> i think there is some confusion there. you will hear the phrase giant ass mentioned when discussing both of them. kennedy: one of her advisers says she has a big butt and he has a big mouth. >> kim kardashian, there is nothing more to her than his celebrity. donald trump if you put him on a desert island, there is
tv-commercial
12:15 am
something that kim kardashian -- >> there is more if you cut her buttocks. number two, rick santorum lashing out against ted cruz in iowa. >> ted cruz is wonderful at reading children's fairytales on the senate floor. rick santorum spent his time in the senate a little differently. >> he was plugging holes in boats. this is 9 months too late. ted cruz came out of the gate. his opening speech was at liberty university. he said there will be no rick santorum and mike huckabee in this race. i can be the christian conservative first.
12:16 am
it's 9 months too late. when was he voted out of the senate? 9 years ago. he should be running as an outsider. people say he sat on panels. who cares? kennedy: he should be running like johnny and pony boy. ted cruz's super pac spending $10 million to tank marco rubio. >> i know i have a debate, but i have got to get the fantasy football thing right. >> they missed the joke. we'll show the republicans are playing up the stereotype of being out of touch. you watch the original rubio fantasy football thing it's a
12:17 am
funny bit that they did. every time cruz tries to do one of his sort of clint eastwood things, it's embarrassing. your eyes roll. kennedy: that's his chair on the stage. >> history is going to judge that chair well. mark my word. you won't sit there and say mitt romney is what it was about in 2012. no, clin clint eastwood on the r talk about god knows what. kennedy: i don't think this will be ted cruz's chair moment. the man panel returns because the new head of zoo says the first amendment is not a free pass for saying hateful things. we'll have katie pavlich on the we'll have katie pavlich on the broke downof the gun power grab.

when you're on hold, your business is on hold. that's why comcast business doesn't leave you there. when you call, a small business expert will answer you in about 30 seconds. no annoying hold music. just a real person, real fast. whenever you need them. so your business can get back to business.
12:21 am
sounds like my ride's ready. don't get stuck on hold. reach an expert fast. comcast business. built for business. kennedy: earlier today the president announced his new executive actions to push gun reform. it would put restrictions on people with mental health problems. here he is at the press conference earlier. >> the problem is some gun sellers have been operating under a different set of rules. a violent felon can buy the same gun over the internet. kennedy: when you sign up for aol you got a handgun free. kennedy: so katie, let's talk
12:22 am
about the idea dangerous felons can go online and get handguns without any criminal background checks. >> it the absolutely false. the president implied violent felons can goin a gun shop and see an ak-47 and say i can't bite in a gun store because i need a background check so i'll go on amazon. if you purifier arms through an online dealership, you pick it up in a federally licenses dealer who runs a background check. the idea they can go online and bite same guns they can purchase in a gun shop is false. the f.b.i. sometimes misses
12:23 am
felons put into the background checks and they end up getting their hands on guns anyway. >> maybe they should be scream lining and refining the systems they have already got. i want to move on to mental health. conservatives have long said that maybe the questions we should be asking ourselves instead of passing new laws, maybe we should be addressing new health. the president called them on it. but my worry is what falls under his umbrella of mental health? if you go to your doctor and you have postpartum depression and you want a firearm for depression, is your doctor going to contact the f.b.i. and say this new mom might be depressed. she should probably be on a list that forbids her from owning a firearm. >> one of obama's executive actions allows doctors to go
12:24 am
around hippa privacy laws to tell the f.b.i. someone is unfit to own a firearm. that sounds great on its face, but if you ask questions about what qualifies to be unfit to own a firearm, no one can answer that question. the last thing we want is people with an idea long cal agenda or the white house deciding who is fit to own a firearm. there has been and lot of work on this by the nra and the national shooting sports foundation. they have done work for years encouraging states to put people who have been involuntarily committed to mental institutions to be put on the background check registry. kennedy: when people talk about
12:25 am
gun violence they wrap the suicide numbers in with the homicide numbers and that's very, very misleading in the. >> the president today, the white press secretary josh earnest. bloomberg's every tawn, they repeatedly state 30,000 people in america are victims of gun violence. while any tragedy involving a firearm is a tragedy. the fact is 20,000 of those so-called gun violence occurrences are actually suicides. it's disingenuous for the president to say background checks will solve the problem of suicide. it's an extremely misleading in the thing to say 30,000 people a year are taken by gun violence. the vast majority come from a suicide problem. kennedy: are you going to
12:26 am
involuntarily commit anyone who has suffered from depression or anxiety and has talked about giving up? it seems that's a huge infringement on civil liberties and has gone into a dangerous part of the conversation. coming up, somebody has figured out who adele is talking to on
12:27 am
12:28 am
12:29 am
kennedy: when old man winter is playing your frigid ribs like a xelophone.
12:30 am
if you are like me you can't stop listening to adele's latest album. you are probably wonder who the hell is this ex she has been calling a thousand times. he's a normal guy who works in a cubical and he's getting sick of her calls. watch. >> hello? >> hello, it's me. >> i know, you must have called 1,000 times. hello, can you hear me. >> barely. it sounds like you are calling from the middle of a wind storm or something. go inside. hello. i'm afraid she is going to write a song about me. kennedy: she is snow needy. how did she find an old-time
12:31 am
phone booth in the middle of a shire. we know sparklers are like a web bush of fireworks. what happened if you light 10,000 of them at once? one ukrainian filled a giants bucket and found out. i haven't seen anything that impressive since me tall today in 1993. 10,000 sparklers. but did you know what happens when you light one million sparklers? topic number 3. in australia they light two things. sharks and a good knife.
12:32 am
that's not a knife. >> that's not a knife. that's a knife. kennedy: that's definitely a shark. some randy guy and his chicken skin caught a 6-foot target shark and strapped the thing to the fronts his car. a curious onlooker snapped this picture and sent it some of with a few emogees to the proper authorities. the shark wasn't dead. those things can breathe for hours on lands. the guy was relocating it. then this happened. topic number 4. christmas has come and gone but we are only now seeing the yuletide damage left in its wake
12:33 am
like one family gathered when they gave an iphone to their eldest but not their youngest two kiddos. kennedy: it was my idea. next year if the kids are still in grades, santa should stuff their stockings with cell phones from the as it. it weighs only 14 pounds. but imagine the size of your by accept. even with a brick cell phone you can still get a call from adele. i have been listening to adele's music in my head and fell in love with her voice.
12:34 am
those devil dogs are whip smart and they love taking hostages. witness one unassuming one strolling into the laundry room as his pal lies in wait. that's a bad name for a dog. i don't know if that human was doing some coaching and teaching the instigator to imprison his friends. i just know how these things end. speak of which, i need to get some lotion for my basket. starts in the laundry room, always ends in a well as you are being made into a fleshy disco suit. if you have weird stories you

[bassist] two late nights in blew an amp.but good nights. sure, music's why we do this, but it's still our business. we spend days booking gigs, then we've gotta put in the miles to get there. but it's not without its perks. like seeing our album sales go through the roof enough to finally start paying meg's little brother- i mean, our new tour manager-with real, actual money. we run on quickbooks.that's how we own it. kennedy: last week the university of missouri's interim vice chancellor -- is it equity or quality. chuck henson said the first amendment does not give people the right to say hateful things. maybe chuck should shut the cheung and take a course in
12:39 am
constitutional law. our panel is back. i thought that was the point of the first amendment. >> there is no constitutional or legal doctrine called hate speech. it doesn't exist it's a fake category invented by would-be censors on college campuses who say if you say something super mean about joaps beard, it's hateful. but you can't go to court and get anywhere with a hate speech exception to the first amendment. an alarming number of government officials believe there is an exemption. kennedy: what are they trying to protect. >> some people say my beard is a form of hate speech. the first amendment is a pass to say unpleasant things.
12:40 am
the idea that your feeling are hurt is nonsense. if you talk to someone you peach to cause a problem. it was all nonsense. none of it was -- he made it all up. so you have a swastika made out of poop which is an am b -- is n ambiguous statement. kennedy: if colleges wants to be all inclusive they should move to jamaica and open up a resort. >> the constitution is not written in stone, is it, kennedy? it's on paper. it's more of a suggestion. the second amendment isn't really about the right to bear arms. the 6th amendment is not guaranteeing the right to a speedy trial. it's more of a suggestion.
12:41 am
kennedy: what about the 8th amendment. again. it's a suggestion. kennedy: these are more than mere suggestions because colleges are making a contract saying if you come here you will be protected. therefore, that seems like a legally binding agreement and if you are not protected i think colleges are opening themselves up for big fan lawsuits from weeny pants undergrads. >> if colleges are these den of like nonstop raping as you hear on one hand. why do we have to make it mandatory for everyone to go to college. the mixed messages about what is actually happening. kennedy: if college doesn't make your life better does that mean getting sexually assaulted makes your life better. >> the political makeup of
12:42 am
faculty or students. kennedy: the oakland raiders within the sa the san diego chas and the rams want to relocate to los angeles. all these teams want to leave where they are at. l.a. wants a team really bad. >> the weird thing is the three teams who supposedly played the last games at their stadium. do they have to go back to the fans and say they are crawling back. we are actually not going to l.a. people in l.a. have great college teams and warm with the. they don't need the rams to come to town. kennedy: can't l.a. pick the teams? >> why does anyone want to go to los angeles? it's terrible there. >> no, it's not. take that back.
12:43 am
you are high on crack and weed. >> there are a lot of places in california that are fantastic. i think san diego is fantastic. kennedy: the chargers don't think so. the raiders want to leave oakland. you just listed two non-los angeles places teams are dying get out of because los angeles has a lot of money and a lot of fans and they will do whatever it takes to build a stadium. my only question is will the stadium be publicly subsidized. >> of course they will. carson is back in the game. everyone is going to get into it. >> they relocated to suffolk county. >> don't take our brooklyn dongers, please.
12:44 am
>> just have all your teams in jersey like we do. kennedy: scientists at the university of north carolina found a correlation between heart disease, stroke and cancer. and one potential ailment. >> i would like to talk to you about diabetes. kennedy: diabetes, it's here, it's here and if you are lonely it will eat you alive. tom, you are really busy and you have got busy kids. do you ever pray for loneliness? >> i agree with this. it makes absolute sense. if you know anyone who lives alone after a certain age. the cultural joke is the woman who lives alone. women can live alone. it's men. men absolutely fall apart if they are single after age 45. kennedy: catmen?
12:45 am
>> he's got to get married. kennedy: is the problem we have too many facebook friend? >> a facebook friend can't tell when you have been dead for a week and the smell of your body is contaminating the rest of the apartment building. that's not a real friend. kennedy: for this one he kept his pants on. but being so connected has created new forms of loneliness and diabetes. >> i trust everything i get from the daily mail in terms of personal health stories. kennedy: i totally he grow with that. i think loneliness is a killer. people don't talk about it. i think people are embarrassed by it and they don't know how to reach out and end it. the's heartbreaking literally. reach out to people. not end their lives.
12:46 am
end the loneliness by reaching out. >> take a few with you. don't go out. there is no style. kennedy: i endorse love and companionship and dogs. dawks suck away loneliness. gentlemen, thank you so much for being here. a beautiful night, especially for me in my dress. producer peter berg joins me in just a little bit. facebook o i don't want to live with the uncertainties of hep c. or wonder...

kennedy: a documentary series "live to tell" follows the special operations forces in afghanistan and iraq. it follows green beret and army rangers leading in the covert operations against al qaeda. >> you actually know somebody is going to get killed pore wound. it's -- i knew it. there is no way you can stop it. you know that it's going to happen. we can only be lucky so many times in a row. kennedy: the author of "extreme ownership" is one of the producer. former army ranger mike baumgarten. people may now as a director and actor, "chicago hope" guy. when did you develop an interest
12:51 am
in telling stories from a perspective of military special operator? >> my dad was a marine and he served in korea. he was a huge war historian. growing up any time we pulled into a new city we found any memorial museum or monument. ken were did you like that as a kid? >> i had it as a kid. my father would spend a lot of time correcting tour guides pat war museums. so it was embarrassing. sometime around college i realized something had stuck and i didn't hate it and i actually started developing my own passion and interest in what these guys do. and it's been a privilege for me to be able to take what my father started and, you know, make movies about it.
12:52 am
kennedy: sometimes it takes a civilian to tell that story. we don't know what it's like fighting as an army ranger. tell me about the story they highlight from your group of comrades. >> the show turned out where a large portion of the episodes are from the ranger regiment from the ranger community. kennedy: you were an army ranger? >> i have been out of the army a couple years now. kennedy: there was an incredible life-changing experience for you. coming on to the show i did want to tell the story because it is personal. a good friends of mine, my former roommate robert sanchez was killed on a mission. i feel like if i can tell the story and let the country know who this guy was, a very exceptional individual, then i have done right. the cool thing about this
12:53 am
episode, it's not just us in the platoon telling the story. his mom is there sharing her reflection. kennedy: did it unfold differently than you thought hearing these stories? >> i don't think it unfolded differently. what impressed me with what mike and raymond, the producer of the show, retired navy seal. what these guys were able to do in terms of pulling out these intimate honest vulnerable side to tough guys that, you or i would have a completely different experience if we sat down and asked these guys to talk about these personal stories, we wouldn't get very far. what mike was able to do with the honesty and intimacy that these tough guys were able to speak with was very surprising and impressive. reporter: and important to you not politically but personally
12:54 am
to tell the stories. are you surprised we are still in afghanistan? >> no, not surprised. overall strategy is something that was always above me. to me we carried out our mission and that was part of our job. we didn't shape strategy nor have i reflected on it too much. ken require's america's longest war, and now you are trying to take care of veterans and tell that story as well. >> it's important for all of to us pay attention to this. kennedy: very good. coming up, mark zuckerberg telling women, don't bait the nerd, be the nerd. i said you better sign it... hi, i'm andrew luck. could anyone use some of my lucky beard for retirement? i could use some luck. make a wish. nice. thanks.
