and remember, you can't take it with you. ♪ execution attempt on a philadelphia police officer. here's lou. lou: good evening, everybody, i'm lou dobbs. terror on the streets of philadelphia. philadelphia police officer tonight is in stable condition after he was shot three times by a man who said he had pledged allegiance by the islamic state. officials say 30-year-old archer confessed to committing the crime. he says he believes police defend laws that are contrary to the teaching. police describe his act as an outright cowardly ambush. >> you can see the male in question. going towards police officer hartnett already firing, second shot he is literally inside that car.

he's got his arm extending -- extended firing at officer hartnett. i'm absolutely amazed that officer hartnett is here with us today. this male fired at least 11 shots from a 9-millimeter at close range. you can see he begins to run away, continues to fire, even as he flees away. . lou: we'll take up the growing concerns about radical islamist terrorism. we'll be talking with former secretary service agent dan and former nypd homicide detective bowe. also tonight donald trump is back in south carolina for a rally within the hour at the university and rock hill, south carolina where the fox business network, by the way, will be holding the next republican debate. that's coming up next thursday. tonight, we have for you brand-new polls on the state of the race for the white house, the national race in iowa and new hampshire. we'll have a full report on

the islam state last night shot and seriously wounded a philadelphia police officer. the police commissioner says trying to assassinate the officer who is in every sense of the word a true hero. here's fox news senior correspondent rick. >> the photos are chilling. a robed gunman who pledged allegiance to isis opened fire on a philadelphia employer at close range advancing on the cop while emptying the stolen police issued 9-millimeter handgun firing as many as 13 rounds. some with the weapon inside the patrol car. >> he certainly was targeting police. it wasn't just targeting a motorist driving down the street. he knew who he was shooting at, and my god. the way he's got his arm inside that vehicle, i mean he knew what he was doing. he was trying to assassinate this police officer. >> somehow four-year veteran jessie hartnett was able to avoid most of the bullets.

hit three times in the left arm. he exited the vehicle and returned fire before collapsing in pain, losing blood, and calling for help. >> i'm shot. >> all cars stand by. we have an officer shot. repeating in the 18th district assist the officer 60. we have an officer down. >> the suspect, 30-year-old edward archer was caught by responding officers. he's an excon. her son had a couple of head injuries and was hearing voices and the family asked him to get help. two law enforcement sources describe him as more as a disenfranchised looser. but authorities say he confessed his motivate and they're searching his home and social media for more clues. >> he stated that he pledged his allegiance to islamic states. he follows à la and that's the reason he was called upon to do this. >> the fbi and department of

threats from the mexican drug lord last summer. it is a good day for trump, who is continuing to dominate the republican field and the latest polls. the latest fox news polls, fox news chief political correspondent carl cameron with this and more from conquered new hampshire tonight. >> these polls will help determine the roster for next week's debate and the final sprint to the first votes. here they are hot off the process prezes. naturally donald trump leads at 35%, ted cruz at 20, marco rubio are tied for third and all the rest in single digits. cruz is ahead there with 27%. trump's at 23 and rubio at 15, again, the rest in single digits. in new hampshire, the fox poll shows trump still way ahead at 33%, more than doubling marco rubio in second with 15 and ted cruz is close behind with 12%. polls tend to titan as voting nears. trump last night went after ted cruz again questioning cruz's eligibility to be president because he was born in canada.

>> because it's awful hard to run when you have that hanging over your head. he was born in canada, he was a -- you know, i think partially canadian citizen. i guess he was joint. and frankly i think it's something he has to get solved. >> cruz was asked about it by a voter for the first time today. >> as a legal matter, the question is straight forward. my mother was born in wilmington, delaware. she's a citizen by birth. so i became an american citizen by virtue of being born to her. i have never breathed a breath of air on this planet when i was not a u.s. citizen. >> jeb bush suggested they really week that the new hampshire race is now for second. bush used to say trump will not win the nomination. that changed last night. >> if donald trump wins the nomination, and he might, hillary clinton will beat him like a drum. >> trump in burlington, vermont thanked bush with a slap. >> my opponent has nothing going. my opponent is horrible,

lou: learning a lot more about the attempted assassination of a heroic philadelphia police officer, his name is jessie hartnett, he's in the hospital right now in stable condition. the gunman is 30-year-old edward archer. he told investigators that he pledged allegiance to the arch islamic state. his mother called him a devout muslim. despite that newly appointed philadelphia mayor jim kenny contradicted his own police department. listen to this. >> in no way, shape, or form does anyone in this room believe that islam was the teaching of islam has anything with what you do on the screen. that is -- it's just terrible, and it does not represent the religion in any way, shape, or

form or any of its teachings. and this is a criminal with a stolen gun who tried to kill one of our officers. it has nothing to do with being a muslim or following the islamic faith. lou: the mayor has some kind of cognitive disdense there, his own police officer articulated precisely what had transpired in what the charged suspect said of his own motivation. and guess what? backing up the mayor, the muslim, and the organization care. decimating a -- designated a terrorist group the unit arab emirates with the philadelphia mayor for crying out loud. they say archer does not appear to be an observant muslim. despite what his own mother said, as we just reported. well, joining us now, former nypd officer former secret service agent dan, also the author of a soon to be released book, the fight. a secret service agent inside

count of security failings and the political machine. good to have you with us, dan. and bowe, former nypd police detective. fox news contributor. bowe, great to have you here. let's start with this -- it's clear. as a police commissioner laid out what had happened. this was an attempted assassination. >> you know, lou, first of all, my heart goes out to the officer. that is a real hero who was able to get three shots off and shoot this creep -- lou: amazing. >> thank god. thank god he's going to be okay. but let's not get this wrong. let's get the facts right. i mean this guy -- islamic terrorism. that's exactly what you saw. and i'm sorry to use the word. that's it. he doesn't have to be a part of isis. he doesn't have to talk to uncle isis on the phone before he did it. he doesn't have to be al-qaeda. he's doing this under the name of à la. he's an extremist muslim terrorist. and let's not get this wrong. this man might be smoking a crack over there because he doesn't know what he's talking

about. he was talking about à la as he's shooting this cop, he represents the western world and trying to do that in the name of islam. lou: dan, what do you think of this -- let's start with this mayor. interjecting as he did in the middle of this. and i understand frankly he's what some people might call something of a tired left wind hack in the city politics of philadelphia. nonetheless he's running his mouth& embarrassing the department. >> yeah, and it's -- not so much the embarrassment that worries me, lou, it's the fact that you have politicians like this gentleman here who make no mistake are putting you, your listening audience, are putting you in danger. these are people who clearly understand the threat, lou. keep in mind there's understandable two explanations here; right? either this is one of the dumbest human beings on the planet who is ignoring the very, and i say that -- i mean it because the man -- these police chief just said after that said, hey, this wasn't a stupid guy.

that was was this a guy who said he was doing this -- or you have a man who is not unintelligent, who is intelligent, which i think is more likely, and manipulating the listeners of that press conference and willingly put them in danger for some kind of political cause. either one of those is grossly disturbing. lou: yeah, and the bridge between both is he's obviously a left wing hack coming out of city politics in philadelphia and running his mouth off. >> look at the two brothers in boston. lou: right? >> they didn't get off the phone with isis or al-qaeda. they did it under the name of à la. we've got eight million muslims in america. the moderate muslims must step up and divide and distance themselves from these radical psycho paths. lou: well, i've got to tell you. i think right now this country has got to take a pause and think about what we're doing. >> trump is not wrong when he said we've got to know what's coming.

but what's in america, 8 million muslims by 2040 they estimate half the world will be muslim. lou: think about this. and we're talking right now -- we had to have donald trump step out into a presidential race for there to be a serious discussion about whether or not we knew who the hell was coming to this country as refugees and immigrants from the middle east. and countries in which jihad is being practiced and sought. i mean i think it's stunning. >> you know, make no mistake. this process is broken. the vetting process for bringing people into the country, i cannot express to you in grave enough terms here, lou. there is no process. okay? it is broken. when i was a federal agent, we -- the federal systems were so broken. everything from the fbi's counter terror database. they were so not functional and what we needed. when we were working joint terror cases, we would go to private sector databases just to make sure the data was

somewhat accurate. this is a broken system. you have no idea who is here. lou: james comey to his credit, the director of the fbi acknowledged they do not have a way in which to vet. >> i talk to border patrol guys all the time. they e-mail me, bowe, speak up on this thing. they're coming from our southern border through the middle east through central america up through the border. all they have to do is say i had to leave my country because i was afraid. we put them into the system and that's what we have now. and the bad problem is we don't know what the hell we have in this country, lou, and it's only getting worse. and america is a country of everybody. lou: i want to conclude by just saying, all of your prayers, please, for officer jessie hartnett. he's in stable condition in philadelphia. >> real hero. lou: but this prayers will be appreciated, and we hope helpful. dan, bowe, good to have you with us. >> thank you. >> thanks, lou. lou: be sure to vote in our poll tonight. the question is do you believe the obama administration has

chairman rice whether he will be able to pull the together together if trump or cruz wins the nomination. >> everyone is going to get behind whoever the winner is. whoever the delegates of our party choose, that's going to be the nominee, and our party is going to be behind that person 110% to save this country. lou: well, he's a good guy, and i want to believe him. but we need to see the grand ol' party kick into gear, and quickly. one idea perhaps he could move quickly to shove the loyalty pledge in order to vote in the primary. donald trump has already told the geniuses in virginia that he would like to get those votes instead of see them blocked. trump stays far ahead of the establishment republicans and other candidates, it's down right breath taking at times, don't you think? and my favorite columnist, peggy at the wall street journal today crowned trump the republican party's thought

leader writing quote i do not understand the inability or refusal of republican leaders to take mr. trump seriously. that's just his support is all about anger, angst, and theatrics. that is part of the story but the more consequential part has more to do with policy issues. mr. trump is function this year not as a great communicator or compromiser, but the disrupt. the grand ol' party may be coming around to trump and his contributions, crushing political correctness speaking plainly and clearly to the voters about the issues that matter most to them. from illegal immigration to refugees and radical islamist terrorists and trade with china. the establishment has tried to dismiss trump to marginalize and mock him. but now, they seem to be accepting what they should have been celebrating for some time. turns out trump is a hell of a lot smarter than they are, than their candidates, and it

gop strategist cathy lynn taylor, founder of the policy people, and it's great of you both to be here. and let me start if i may with you, kathy. this guy is born to this. i don't know yes wasted all of his time making billions of dollars when he could have been a politician. what do you think now of his chances? >> they seem to increase every day. a few things that he's done exceptionally well that we haven't talked about much are the data machines he's building. many who are undecided are just curious about the trump phenomenon and translating them into voters. and that coupled with the unlimited money and the presence is very powerful. . lou: do you see it that way, fred? do you see a real database being built? a real get out to vote for trump? a machine being built here? >> well, he can certainly afford one, so why wouldn't he build it? but i think something more important happened this week, and you touched overs commentary and that is, look, when the chairman of the

national committee says, hey, if it's trump, we're going to back him 100% as our party nominee. that shows that trump has become acceptable. and that's a big step. and then when peggy newton calls him a thought leader as you pointed out. once again, which he has been, the affect he's had and the vindication he's gotten particularly on the immigration issue of letting muslims come in and not come in having a pause on that. and we know what went on in cologne, germany in new year's eve and we know about these two iraqis who came in and have now been arrested as terrorists. and the other thing is, you know, what i think helped legitimatize him with republicans more than anything else? it was that fantastic counterpunch at hillary clinton. republicans loved it. lou: yeah, he is no one to mess with. as every one of the establishment candidates has now learned. the rhetoric persists, but you can tell they have so many

body blows, their legs are about to followed under them, don't you think? >> well, anything donald trump says, he says himself. i wasn't supposed to be here. he went into this race because like 70% or so of americans, he was frustrated with the government. he never could have foreseen how he could coless this group of people in the republican party that the gop was not even paying attention to. so it's time now for the gop to realize that party means the more the marrier. lou: i understand you're giving him props, but i don't think you're giving him an sufficient amount. >> i'm an analyst. lou: this man knew what he was doing from the moment he stepped forward. >> you think so? . lou: i know so. >> you know so. lou: and the reality is that what he's worked through in seven months, he is dominating every poll, he's ahead in every race. >> right. lou: and we are about to see history unfold. and i cannot believe the number of people who want to -- >> who want to argue, and we've heard it here. lou: fred, you and i have talked about this. >> yeah. we have. lou: there is no candidate

as -- as smart at the techniques, at the strategies, at the execution of candidacy that can keep up with him. >> well, and the -- you know, he commands the press. so many people in the press don't like him, they're criticizing him. lou: you're talking about a president who hates every conservative can't stand you and me. what are you talking about, partner? that's ahead of the -- >> he is an amazing character, and it's clear now that he can -- he can not necessarily will, but can win the republican presidential nomination, beating hillary clinton is harder. i wouldn't say that's a certainty -- >> i don't know. i disagree with all the rhetoric on that actually. i think that -- lou: yeah, a woman is about to get endited it appears. >> that's right. and i think donald trump has the intelligence and the ability to be a whole lot more presidential. let's remember he's not consistently conservative. he's very centerrist on a lot of things. lou: he is. >> i think he has it in him for that part.

lou: i think he is what he is. i mean he is centerrist, he is radical, he's a disrupt, he is also the frontrunner. fred, i've got to ask you this. in virginia, the party down there wanting to close the primary. >> yeah. lou: at a time when this is a man who can draw those democrats and those independents necessary to win the presidency. that's madness. >> yeah. i think they'll have to back off on that. the primary in virginia -- i live in virginia, isn't until march 1. so they lots of time to change their mind. and, look, and particularly after the national chairman says, look, we're going to back this guy if he wins the nomination, i think they'll have to say, look, we're going to do what virginia has always done and that's had open primaries. >> yeah. because that's the best movement ryan smith has made all year. lou: i agree with you and it's the next step for him to kick the leadership of the state party in the tails and get that done. i don't think they should wait on this one, fred. i doubt you do either.

lou: joining us now former u.s. ambassador to the united nations american enterprise institute senior john bolton also fox news contractor, ambassador, i've been looking forward to talking to you all day. how in the hell did we lose a hellfire missile? >> you know, if people aren't fired for this, you can just about give up on effective control of the government. somehow or another, this missile -- which is extraordinarily sensitive and in the wrong hands, and it's in the wrong hands, can cause us an awful lot of harm. went to europe and then somehow made its way back to -- unfortunately, not to the united states but to cuba. this is the kind of mistake for which there is simply no excuse. but what i fear is that in the culture of lack of responsibility, we're not going to find out the answer. but i think members of congress, john mccain, the chairman of the armed service committees and others need to get on this. this is extraordinarily serious. lou: you know, it's extraordinarily serious. you're asking for mccain to get on this. i mean i can't think of a

thing the republicans have done right or able to bring to effect in conclusion when they do one of these investigations. it's been one of the most feudal process i've ever seen in my time in covering applicant politics and government. i mean this is -- with a president who really -- >> doesn't care. lou: possible understanding i can bring to this is he doesn't give a damn. >> yeah. well, i think that's right. honestly i don't think the president really gives national security anything like the priority it deserves. but we're down to two choices. either we have congress investigate, or we count on barack obama to tell us what went wrong. so discarding the second possibility is not happening. i mean this really -- lou: we've got two bad choices here, john, i think you would admit that. >> right. i'll go with mccain. i think he'll find the answer. i think it should be a campaign issue. this is a matter of really a grave breach -- oh, absolutely. >> we've had one after the other -- lou: by the time congress could get to a solution, we'll

have had an election in january of 2017 will be upon us, hallelujah, if i may say. >> well, i bet you a dollar, we'll see it in six months. lou: well, that's going to be a near bet. we're going to be talking about august versus january. let's turn very quickly if we can to the iranian agreement. we've seen seven democrats, including the chair of the democratic national committee turn on her president. turn on the democrats. seven of them turned against the president on this issue and called for sanctions against iran. is it possible for the republicans to build a -- an actually effective resistance to happen and insist upon sanctions and have them placed against iran instead of turning over like a bunch of chumps and, by the way, suicidal chumps $150 billion to the iranians? >> look, i think it should be a major priority for the house and the senate coming back into session.

lou: the mother of the affluenza teen complain being her first night in jail. tonya said her cell was uncomfortable and she didn't sleep much. she was told by sheriffs it's a jail, not a resort. great stories and interesting folks. she helped her son flee to mexico while on probation. he killed four people in a dui crash and managed to get people to give him a pass because he's so rich. joining us is john gibson and john giordano.

this woman, and this kid, john gibson, they get off because he doesn't know right from wrong because he's too wealthy. in this country once if you had privilege you were expected to be held to a higher standard, not a lower one. what's going on? >> the system is getting ripped off. if he goes back into the juvenile system he can only be incarcerated for 120 days. they will have to be creative to come up with a punishment that fits what he did when he killed people and fits what he did when he ran away. as for his mother she'll say i went down there on vacation and look who showed up, my son. >> i see a netflix series coming out of this. people who seem to do bad things end up with one.

lou: i don't know what kind of series it will be for this apparently islamic state inspired assassin in philadelphia. i have got to start by asking you, don, your mayor, is he nuts or what snow's a radical. he said this has nothing to do with islam despite what his police commissioner said and the evidence says. >> you are in new york city usually. he's our declassio. he's a combination of training of radical progressive causes he put together and a big union background thrown together and he will be the mayor sadly for 8 years in philadelphia. we are a sanctuary city. he took what the old mayor did, tore it up and made us san francisco in his very first hour just this week.

lou: in texas you all seem to be continuing the good fight. but one of the terrorists arrested was from houston ander from california. we are looking at a country that is in real trouble. houston is a major destination for u.n. refugees and they are not being vetted. how nervous are you? >> out here in fort gibson i'm not too nervous. i worked in sacramento for a long time. the country is under siege. you have got guy in philadelphia, you have these two guys, the president is saying you can't have a gun when it is apparent everybody needs one. apparently the cops in philadelphia need two or three because they are just sitting on the bull's-eye. i think people are freaking out

when they hear this news and see this news. and they are rushing for the gun stores and donald trump. lou: those are not i are rational decisions. the fact of the matter is people are starting to respond to leaders who are talking about their interests, their emotions, their sense of future and fear of present. i was so impressed by tia kyle who told the president murders are at an all-time low and gun ownership at an all-time high. he had no response to that at all. i thought she because splendid and the president looked utterly lost. >> i had her on my show today and i say god bless america. she and her husband have done as much for the country as i know.
