i'm jamie colby. thanks for watching "strange inheritance." every night, catch the show at 6:00 p.m. now the man himself, lou dobbs. keep it on fox business. lou: good evening, everybody. i'm lou dobbs. six days till iowa, and even donald trump's fiercest opponent says he could be unstoppable. listen to senator ted cruz talking with iowa pastors. >> if donald wins iowa, he has a substantial lead in new hampshire. if he went onto win new hampshire as well, there's a very good chance he could be unstoppable be and our nominee. lou: donald trump is clearly the front runner all of the latest polls out of iowa, new hampshire and nationally.

in fact, a cnn survey has trump hitting a new high in the race for the republican nomination. 41%. on the democratic side, hillary clinton back to denying misconduct over her e-mail scandal. the former secretary of state told a democrat town hall meeting last night that here use of a private server was not an error in judgment, but that's not what she said only four months ago. we'll take all of that up with my political panel, fox news jedidiah bila, washington free beacon's lachlan markay and republican strategist matt schlapp. and california manhunt intensifying for three escaped inmates with incredibly violent histories. quote, they let hannibal lecter out. we'll talk about that with legal panel later in the broadcast. our top story tonight is donald trump. trump solidifying his lead for

the republican nomination with just six days to go before the iowa caucuses. but a big question still remains. can trump translate all of that enthusiasm for his candidacy into turnout at the caucuses? a short time ago trump tried to answer that question when he talked with my fox news colleague bret baier. >> i am doing very, very well with evangelicals as you know and can see, nationwide we're leading with the evangelicals and tea party. poll came out. we're at 42-11 nationwide overall. we're doing very well. we've had great managerial skill but have a great message which is more important. lou: fox news chief political correspondent reports now from marshalltown, iowa, where trump is dominating the gop field. >> reporter: with the first caucuses in less than a week

it's go time in iowa. the airwaves are cluttered with attack ads, the candidates are pounding one another every day, and on the ground game it's frenzied. >> please fill out one of the commit to caucus forms on the way out. >> reporter: volunteers are signing up, candidates are criticizing one another and voters taking sides. >> please, nobody here vote for trump. [laughter] >> he's just -- as we say in the medical field, he's jpn, and that means just plain nuts. >> reporter: marco rubio is zeroing in on ted cruz. >> ted is feeling pressure, falling in the polls and losing to donald. >> reporter: rubio's the only other candidate in double digits. trump is new to running for office but ran for the reform party's nomination in 2000. this morning he called cruz dishonest and ineligible.

>> lie after lie, it's not becoming, and he's got a problem, got a very much bigger problem. a lot of people think he can't run for president. he was born in canada. >> reporter: trump got a boost with the endorsement of jerry falwell junior. cruz want to iowa polls. now downplaying expectations and warned iowa pastors trump could win it all. >> if donald wins iowa, he has a substantial lead in new hampshire, if he went onto win new hampshire as well, there's a very good chance he could be unstoppable and be our nominee. >> reporter: cruz is openly trying to downplay expectations of winning any of the first four states to vote. >> we are running a national campaign. from the beginning we've said no state is a must-win for us. >> reporter: george pataki who dropped out endorsed rubio who is selling himself as the candidate who reunite the right. >> i will win the election, unite the republican party. >> reporter: donald trump drew

a big crowd and took a shot from several women's pro-life groups. concerned women of america, right to life find trump unacceptable because of his past pro-choice positions and his treatment of women. in marshalltown, carl cameron, fox news. lou: the race heating up, turning now to the democrats where there is plenty of heat as well. hillary clinton is struggling to defend her use of her private e-mail server for official business. last night she was confronted about another issue that plagues her campaign, here popularity among younger voters. fox news chief white house correspondent ed henry with our report from des moines. >> most people come out and vote, we will win, and we'll win big. >> reporter: bernie sanders fans are so devoted, the iowa field worker shaved the bern right into the back of his head.

with a razor thin margin separating him from hillary clinton would not answer if he believes the front-runner is honest or not. >> not making characterizations about my opponent. >> reporter: sanders supporters are making a characterization and it's not good. one young sanders backer at a democratic forum blistering clinton who with her back against the wall decided to fire back at her critics. >> heard from quite a few people my age they think you're dishonest. >> they make the charges, i keep going forward because there's nothing do it. >> reporter: though in 2008, experience did not carry the day for her here in iowa. clinton keeps falling back on her resume. >> i've been particularly interested in the area of children. >> all of us have a responsibility to ourselves, to our children. >> reporter: and after president obama offered warm words about clinton to politico, iowa tv station asked if that was endorsement. the candidate did not say no.

>> i am proud to continue the progress, but i have my own plans and proposals. >> reporter: that close embrace raises the specter of a third obama term which may save her now but complicate the general election. and the president's kind words come as fbi is investigating clinton's e-mail practices. >> willing to say it was error in judgment, you should have apologized? >> not willing to say it was error in judgment. nothing diwas wrong, it was not in any way prohibited. >> reporter: seems like clinton is backpeddling. since she already did apologize. >> should i have used two accounts. one for personal. one for work related e-mails. that was a mistake. i'm sorry about that. >> reporter: nbc and the union leader in manchester are trying to add a new debate in new hampshire february 4th but running into all kinds of problems. this would not be a dnc sanctioned debate. other networks are balking, not

all the candidates are getting on board. the bottom line is the dnc originally limited the number of debates to insulate the front-runner clinton but some people close to her are thinking given where she is now, she might have benefitted from more debates. lou? lou: ed, thank you very much, ed henry reporting. there are troubling new reports that thousands of cuban refugees are moving in and crossing our southern border with mexico. congressman henry cuellar's office says the refugees are coming from central america through mexico and the numbers crossing into the united states are rising. one report says the border patrol expects some 7,000 cuban refugees over the coming days. and another troubling story tonight out of milwaukee. fbi officials there arresting 23-year-old samy mohamed hamzeh who allegedly planned a mass

shooting at masonic temple in milwaukee. charged with possession of machine gun and silencer. pope francis meeting with iranian president hassan rouhani, the first meeting between a pope and the leader in 17 years. they met for 40 minutes at the vatican. they talked about human rights and iran's role in middle east conflicts. at the end rouhani asked the pope to pray for him and the pope says he hopes for peace. accommodations for rouhani on his high-profile visit to europe. the capitol museum contained classic white sculptures with white boards to avoid possible offense to the muslim president. that offended proud italians. we're coming right back, stay with us. lou: with six days to the iowa caucuses, donald trump is leading in the polls,

. lou: breaking news tonight, donald trump just a short time ago, in iowa, said he will probably not attend the next republican debate. that debate hosted by fox news. here he is. >> i'm going to be making a decision with fox, but i probably won't bother doing the debate. i see they picked me as number one. not only number one, number one by far, probably won't be doing the debate. lou: probably, he won't be doing the debate. this week's fox news republican debate lineups were revealed tonight. the main event thursday 9:00 eastern, scheduled of course to include the front-runner donald trump, also senator ted cruz, senator marco rubio, dr. ben carson, former governor jeb

bush, governor chris christie, governor john kasich and senator rand paul. the earlier debate begins at 7:00 eastern, it will feature carly fiorina, former governor mike huckabee, former senator rick santorum and former governor jim gilmore. joining us now to help sort all of this out, washington free beacon reporter lachlan markay and author, columnist, fox news contributor jedidiah bila. good to have you here. first, your reaction to trump's, i guess it's a veiled threat or ambiguous statement on his part? >> it's surprising, i have a problem with anyone who doesn't take the opportunity to make his or her case to the american people. it's great he's in first place, he's done a lot of things right. now is the time anyone could rise up. you see ted cruz tighten the race. establishment look at marco rubio. i think to say i'm not going to do the debate is saying i don't have sdposhgs comes off cocky,

a little elitist and he doesn't need the opportunity to make his case to people. lou: you said donald trump comes across cocky? lachlan, you don't see that, do you? >> i thought it was interesting, the excuse, he went back to the feud he had towards the beginning with megyn kelly. if he doesn't feel he needs to do the debate, he should say that. maybe he thinks he's going to coast it out through new hampshire. all the numbers are looking good for him, he doesn't need the debate. to revive the feud with fox is pointless and not going to help him. i don't think it will hurt him too much, but unbecoming of a presidential candidate. >> agreed. lou: it's interesting because he's defied it every step, conventional wisdom, if you will, analytics that would suggest he's making a mistake. it is difficult to some point to say here's another rash judgment by a man who's overstepping. he's done it for seven months

and remains a front-runner. jedidiah, your thoughts? >> why would you use an opportunity to make yourself look small. this is a guy wildly successful. you can see someone who conquered big issues and like him because you think he can take people on. he's fearless and he keeps bringing up megyn kelly, she's strong, and asks good questions, if you are afraid of megyn kelly, that's a problem for voters, if you don't think it's a way to make your case to people. i think donald and the other candidates should get out there and tell us what you want to do with the country. lou: there is some possibility here, just as senator ted cruz is acknowledging the possibility of the unstopability of the trump campaign, and i'm not -- i can't see into the future better than anyone else, but there is the possibility within

all of this that he would accomplish against his own interest what the national review, the business roundtable and the chamber of commerce could not do, and that is create a problem for his campaign. >> i mean, what it comes down to is the first two primaries. and you know, obviously, he's looking good in both of them, so he doesn't see reason to upset the applecart. but you know, when you start getting into the nitty-gritty of retail-style politics, you look at structure of the iowa caucuses, and requires a tremendous ground game that no one is sure if donald trump has at this point. and the delegate recruiting process is rigorous, a convoluted process and saw ron paul get three times as many delegates as mitt romney. he'll get the vote of confidence. lou: what annoys me lachlan is nobody has assessment as to whether or not he has a ground game or he doesn't. i would prefer something far more than conjecture on the

part of the liberal media. left, right, whatever you want to call it, why isn't there emperical ground game. there is a little helicopter journalism going on in the sense that we don't have that number in front of us. >> well, i think a lot of campaigns like to play up the strength of their ground game. lou: i'm not worried about campaigns, i'm worried about the job that you and and i jedidiah and everybody else. >> maybe there's not that much reporting because there's not much to report on. lou: in that case, everybody is in trouble. lachlan markay, jedidiah bila, i'm just being told that donald trump's campaign manager has said donald trump, quote, will not be at this thursday's fox news-hosted gop presidential debate. that's the latest word we have, and we, of course, will keep you up to date as soon as we learn anything more. vote in tonight's poll.

. lou: a few thoughts now as we are all hurt ling toward the first event of this presidential primary season, the iowa caucuses. the savage, venomous attacks on the gop front-runner, well, they're of greater intensity each day. the republican establishment. the national liberal media seemingly cannot comprehend why for the first time in decades they wield no -- the

"washington post" tearing itself apart frustrated in the ability to tear down the front-runner, jennifer reuben penned a column entitled how to eviscerate trump. can you imagine the outraged howl of the left had that title contained clinton or obama? eviscerated? all of this because trump claimed to be at the outset seven months ago. he's not for sale, and no one owns him. elites fear his populism because trump means to return america to the people, and the polls show his message is resonating. 67% of republicans expect trump to be the party's nominee. that's a 25 point increase from november, and according to the latest abc news-"washington post" poll and 56% say he's the most electable nominee in the general election. now, that is far seeing stuff.

the real clear politics average, however, shows trump with a nearly 17-point lead over closest rival, senator ted cruz. in fact, they seem to have the field to themselves at times. but even cruz is seemingly, well, in awe, making this admission last night during a meeting with pastors in iowa. >> if donald wins iowa, he right now has a substantial lead in new hampshire, if he went onto win new hampshire as well, there's a very good chance he could be unstoppable and be our nominee. lou: some who call themselves conservative seemingly want to stop trump no matter what. 22 conservatives tried to take down the front-runner in the national review's against trump issue. so rabidly intent on stopping trump that the national review failed to endorse a candidate of their own. whose sense of the country and immense potential have

invigorated the imaginations and the hopes of a lot of republican voters. we'll soon find out whether this country is ready to throw off the shackles of political correctness. orthodoxies of partisan political parties, the chamber of commerce, the business roundtable, that kind of group think, and the pure nonsense of those whom we've allowed to lead us to this sorry state. we're about to find out whether it is time for a loud majority of us to say enough is enough. this is truly an exciting time for all of us. just ask donald trump. the quotation of the evening, this one from khalil gabran who said -- we're coming right back.

ask your hep c specialist if harvoni is right for you. . lou: we don't want to neglect new hampshire now. talking about iowa and the national polling. donald trump opened up a larger lead in new hampshire. a boston herald poll shows trump with 33% support. that's a 19-point lead over ted cruz in second place. governor john kasich, the only other candidate in double digits, he has 12%. joining us now, chairman for the american conservative union, matt schlapp, and investigative reporter for the washington examiner, sarah westwood. good to have you both with us. let me start with you, sarah. the news from the trump campaign that he doesn't wish to participate in the debate thursday. what do you make of it? >> donald trump is pulling out all the stops ahead of the iowa caucus to make sure the conversation is about him, no

matter what we're talking about. leading up to the debate, the question is not what ted cruz is going to say about immigration or what marco rubio is going to bring to the table, we're only going to be talking about whether or not donald trump will be there. and that plays to his advantage. it's been his strategy the entire time to dominate the conversation. this is just another move. lou: let me be clear, carl cameron reporting definitively that the trump campaign says he will not be in attendance. it's not a matter of -- there isn't much ambiguity in all of that. matt, your thoughts? >> obviously, i wish he would go. i think he's been a positive impact on these debates. i think he says it like it is, and i think the debate format is good for him, and quite honestly, i think whatever differences he has with megyn kelly, bury them in the ground and keep talking about the issues that matter to the american people. lou: well, he has been doing that, in the view of those

being polled better than anyone else. it's going to be interesting to see what the next 24 hours, 48 hours bring, so you know, at this point, this is all we know. so we will see what happens. let me turn to senator cruz saying he's unstoppable in his judgment, if he wins iowa. do you agree with that, sarah? >> a pretty candid remark from ted cruz and pretty accurate. if donald trump wins iowa, the kind of a toss-up, ted cruz has a lot of ground support there, it's pretty much a foregone conclusion that donald trump is going to win new hampshire at this point. then he's heading into south carolina and the southern primary states that go on super tuesday with the cloud of inevitability. it no longer is will he or won't he win, he needs a few early state losses to shatter the illusion he's unstoppable or will be the nominee. lou: that's the question here, sarah, it doesn't appear to be an illusion? >> here's the thing, if donald

trump wins in iowa, which has demographics that should favor ted cruz. if he wins in iowa, i see him running the table on this race. i think ted cruz. sarah's right. this is a moment, it's political calculation because ted cruz wants to get every conceivable supporter of his out to caucus. caucus is a difficult and time consuming thing to do, but it's honest. he must win iowa. lou: let me get to, this we keep talking in all of the rather vague things about the ground games. i want to hear some assessment of the reality what the ground operation is for each of the candidates, certainly for cruz and for trump and for rubio in iowa. because as we all know, the games that are played in the caucuses are pretty interesting. sarah? >> it's just the million-dollar question is whether donald trump has the ground game. he certainly has the popular support, he has the enthusiasm

behind him. the question is because he's not a professional politician and new to the game. does he have the organization that could carry him through a caucus night. it's a unique process. lou: do you have the answer, matt? >> let me try here. i think ted cruz is running a textbook campaign. he has campaign manager an expert in how to use mail and phones. doing every step they can to contact voters who agree with them. here's what's also true. donald trump has enthusiasm and crowds at his events like we've never seen, and some people don't believe that will translate into votes in the caucus. i can't imagine you spend that much time trying to get into a trump event and not vote for the guy. lou: doesn't make a lot of sense. i agree. >> doesn't make a lot of sense. lou: quickly, hillary clinton, another town hall meeting in place of a debate. sarah, is she basically done? at what point does the weight of all that's hang over her

simply reduce that campaign to something that is so ineffectual that it has to succumb? >> the problem is that democratic primary voters, they don't care about the e-mail issue as much as general election voters. this is going to come back and haunt her, she becomes the nominee, and if she starts to lose to bernie sanders, if bernie sanders ekes out a win in iowa, probably going to win in new hampshire. this is a greater liability because she's no longer the candidate of inevitability. lou: if he doesn't win in new hampshire, no one can win against her in new hampshire. matt, last word here. >> let me tell you, the base of the democratic party does not love hillary clinton. they rejected her in 2008, wanting to find any excuse to reject her this time. the reason the e-mails matter, it reminds democrats she's a weak candidate and reminds candidates of three letters that are very important, the fbi.

. lou: joining us now, former u.s. ambassador to the united nations, american enterprise institute senior fellow. ambassador john bolton. also fox news contributor, and a terrific political mind as well as geopolitical. good to have you here. >> glad to be here. lou: i want to turn to the announcement by the trump campaign that apparently donald trump was infuriated by a release by fox news about the debate, and has said, in what is assumed by some to be a fit of pique that he's not going to attend. your thoughts? >> as the former senator phil gramm used to say, never take a hostage you are not prepared to shoot. he is prepared to boycott the debate. lou: that was a more serviceable saw in earlier

times when there weren't so many of them. >> in this case, from trump's point of view, he has the pretext of this press release, playing a larger game. he has shown throughout this campaign, he's not intimidated by anybody. not intimidated by the other candidates. now he's not intimidated by the media. and the takes would be much higher in a general election debate. he's now shown he's prepared to walk away. i think that gives him -- for the guy that wrote the art of the deal bargaining support. lou: this is related to what he wants in you're saying he's going to miss this debate -- >> to prove a larger point, yeah. i think it would be stunning now -- lou: what would be the larger point? >> that he can get pretty much what he wants from the media. i think he has seen in his efforts against other republican candidates when they criticize him, he strikes back

and they walk away. look at the jeb bush super pac spending millions against marco rubio because he's afraid to talk on donald trump! [laughter]. lou: you've got that causality, and i know and i deally respect your analysis, but that causality is rational, you know, it may be worse than that. you've come up with a motive that may not be in attendance. lou: look, trump has dismissed all of the conventional wisdom about the campaign so far. just dismissed another one. i listened in the hour, everybody said he'll end up at the debate. he has to go. lou: let me argue forcefully, if i may, that he's just being a follower, just following rand paul's example with his pique at the early debate, what say you to that? >> chronologically, that's correct. trump is playing a larger stakes game and maybe a different game.

lou: does he win or lose as a result of not being there? >> i think he -- lou: most folks would say he loses? >> i'm not sure that's right. most people couldn't care less, they're prepared to say right oglad he did it. the larger stakes down the road are what he has his eye on. lou: do you want to perhaps speculate about what the specificity of what he's seeking? >> i think in a general election again, there's a lot more in terms of how the debates go, who the questioners are and so on and so forth. if he has threatened to boycott a debate, i think is bargaining leverage in the general election is much lower. if he's walked away from the debate, whatever media may do the general election debates has to take serious good to prospect he would just not show up for one of those. lou: as we are discussing all of this, and these developments as they're breaking, and aids, we'll bring you the latest, whatever it is here and through the remainder of this hour.

lou: a prosecutor likening one of the three men who broke out of a southern california prison to the notorious hannibal lecter. he's an iranian native. but the orange county sheriff's office doesn't want to offend anyone. they said the prosecutors comment about hannibal lecter was uninformed, and rash. lis weihl is with us with her new novel called county newsmakers." and former criminal prosecutor. good to have you here. i'll start if i may. these three dangerous prisoners

running out of the orange county jail. how could such dangerous people first of all just be in a general population? >> we should be embarrassed considering we tried to criticize the mexican officials for letting el chapo escape more than once. we are allowing three inmates to escape a maximum security jail. last june two convicts escaped from new york. there are several questions that come to mind. one being why was in a 16-hour gap before there was a second observation check made. we have given these three inmates a 16-hour head start essentially. lou: there was a disturbance in the jail, they think that was part of the plan to distract everyone to break away from the hourly bed checks. this looks like a carefully

calculated plan and subsidized effort. >> exactly. but they only had to break through a quarter inch grill. that's not have much. so orchestrated effort with them and the people helping with the creating whatever that was, the ruckus. the other thing that's important is there was an hourly check twice a day checks which is under california what they do in other checks. twice a day with 60 men in one common dorm? lou: and they were all apparently very dangerous. one of the folks, iranian, served in the u.s. marines. has a horrible criminal record. and immigration authorities, one inmate had been ordered to be deported back in 1998 back to vietnam.

what in the world is going on in our law enforcement that this would happen? particularly in a jail like the orange county jail that has these dangerous criminals behind bars? >> there was a 2001 supreme court ruling that stated the u.s. could not hold an inmate indefinitely under deportation orders without the support of that country. so we don't know that vietnam was actually wanted to actually help with this. lou: china refuses. the reason we have tens much thousands of chinese that should be deported in this country is because china won't accept them. so away we go. the united states government right now is behaving irrationally. >> we have to look at how much of an effort i.c.e. is making to deport these individuals. lis: what you are painting here is a picture of negligence on the part of the prison.

negligence which means when they are out, all this time they are out, before they are apprehended. if they hurt anyone, hurt property or a person or people, they could be obviously sued, the prison can be sued for negligence, for not doing enough. lou: getting ahold of someone -- it's just -- >> that was so inappropriate. >> to whom. he wasn't convicted yet. he was under charges. lou: i'm quoting the prosecutor. so how inappropriate can it be. i think people need to calm down about inappropriate when you are talking about the kind of folks like this who have broken out of jail. lis weihl, and it was great to
