oh. i'm jamie colby for "strange inheritance." and remember -- you can't take it with you. have. they've always been there. we've always had wars. charles: a man who knows the answer. lou dobbs. he's next. lou: good evening, everybody, i'm lou dobbs. we're now five days from the iowa caucuses and a new poll out of iowa shows donald trump with a seven point lead over senator ted cruz, the monmouth university poll shows trump at 30% while cruz is at 23%. political analysts are telling us what seems to be the obvious, that trump faces hurtles as they see it. trump's victory depends whether his campaign can move enthusiastic audiences to enthusiastic and large numbers of caucusgoers monday night. and i want to point out, the

monmouth poll was conducted before trump announced he's a no-go for tomorrow night's fox news debate. trump tonight, he's campaigning in gilbert, south carolina, the republican front-runner set to take the stage there within the hour, and we'll be bringing that to you when he steps up to the podium. we also are focusing on what in the world is trump up to? what motivated his abrupt withdrawal from the republican debate? what are the likely consequences in iowa and new hampshire and south carolina? we'll be taking all of that up and discussing the republican race with former reagan white house political director, republican strategist, ed rollins. also tonight, sources tell fox news, the fbi is going straight to the source, as they put it, and the investigation of hillary clinton's e-mail scandal. by that, they mean the fbi is now interviewing intelligence agencies and some cases individuals who generated the classified information

discovered on clinton's personal e-mail server. but why hasn't the fbi already interviewed mrs. clinton herself? we take up that very question here tonight. and the three week long oregon standoff has turned deadly. the fbi is not giving out details what led to the death of a rancher in oregon, who was occupying the malheur national wildlife refuge. 55-year-old la voy finickum was killed after the fbi and state police stopped vehicles 20 miles north of burns, oregon. eight others including the protest leader, ammon bundy were arrested. we do not know who pulled the trigger on the shot that killed finicum. dave ward was emotional as he called for an end to the standoff. >> there doesn't have to be

bloodshed in our community. we have issues with the way things are going in our government. we have a responsibility as citizens to act on those in an appropriate manner. we don't arm up. we don't arm up and rebel. lou: sheriff ward in stark contrast to just weeks ago when he was taking a very hard-line with the ranchers who were demonstrating on protesting the bureau of land management and their role in the hammond family persecution by the u.s. attorney and the federal government. we'll be talking about all of that with former assistant director of the fbi, bill gavin will join us later in the broadcast. our top story tonight -- donald trump and his boycott of the fox news republican presidential debate tomorrow night. the immediate and obvious

beneficiaries are opponents for the republican nomination, and those in the national media who have been salivating at the very thought that trump would stumble. trump's rivals are doing their very best to take advantage of his absence now. fox news chief political correspondent carl cameron with our report. >> reporter: trump's withdrawal from tomorrow night's debate has touched off a torrent of criticism from his rivals. >> people have a right to be angry about the direction of our country, but also have a right to know from the people that aspire to the presidency what you're going to do if you're elected president. that's why the debates are important. that's why i'm not going to get into the side shows and theatrics that ted cruz and donald are involved in. >> reporter: rubio is running third, ted cruz battles with trump at the top of the polls was first to strike last night. >> i think anyone running for president of the united states owes it to the people of iowa. to have the humility to come in front of you. to make the case, to answer the

hard questions, to look you in the eyes. this is a job interview. >> reporter: rand paul, who returns to the primetime debate stage hailed trump's absence. >> the iq of the debate went up a couple dozen points i would say, and it's probably a good thing for the party. it shows sort of his dilutions of grandeur he thinks he can dictate everything. >> i've been asked hard questions, i like hard questions, it doesn't bother me at all. >> reporter: trump said he was offended by a sarcastic news statement that he was threatening to boycott the debate because he says he was treated unfairly five months ago at the last debate. >> i didn't like the fact they were sending out press releases toying, talking about putin. >> reporter: they said -- trump's rivals suggest he's hiding from something bigger than fox and looks week. >> anyone scared of megyn kelly

is not going to stand up to hillary clinton or vladimir putin and we need a strong principled conservative president. >> reporter: instead of debating, trump plans a rally for veterans. trump was name calling again tweeting, quote -- in the latest monmouth poll trump leads in the 30s. cruz in the 20s and rubio and carson in the teens based on estimated record shattering turnout of 170 caucusgoers. the record set in 2012 was 122,000 republican voters. if this year's turnout is 130,000, trump and cruz would be literally tied for first while rubio and carson would be virtually tied for third. cruz challenged trump to a head-to-head debate with or without a moderator and trump kissed it off, where's it going to be? canada? another reference about cruz's eligibility. lou?

lou: carl cameron, from iowa. on the democratic side, senator bernie sanders spending the morning at the white house with president obama. that's right. at the white house. the meeting coming days after the president's politico interview which he undercut sanders campaign calling the vermont socialist a bright, shiny object, while praising his former secretary of state hillary clinton. after his almost 45 meeting with president obama, sanders said he did not use that time with mr. obama as an opportunity to ask for his endorsement. sanders says the two did discuss politics. and sanders made it clear he remains hopeful even optimistic about his chances in iowa. >> i think what the iowa campaign ends up being about is one word, and that is turnout. we're feeling really good about where we are, and if there is a large voter turnout, i'm not saying we could do what barack obama did in 2008, i wish we

could, but i don't think we can. if there is a large turnout, i think we win. lou: and the newest polls may be the reason for the senator's buoyant mood, polls show sanders leading clinton. senator sanders with 49% support compared to clinton's 45. in a new abc news "washington post" poll shows clinton's national lead is shrinking. clinton with 55% support to sanders 36, a substantial 19-point lead. but nonetheless down from a 31-point lead just a month ago. the standoff between an oregon militia and law enforcement took a deadly turn last night. fbi agents opened fire killing 55-year-old la voy finicum and arresting eight other demonstrators. local authorities made an emotional plea for an end to the standoff, and moments ago, ammon bundy's attorney asked

for the militia to stand down and please go home. fox news correspondent dan springer with our report. >> reporter: federal agents are ratcheting up the pressure on those still occupying a federal wildlife refuge in rural harney county, oregon. the move follows a fatal shooting last night and the arrest of seven of the protest leaders. >> it is the actions and choices of the armed occupiers of the refuge that has led us to where we are today. they had ample opportunity to leave the refuge peacefully. >> reporter: killed in the gunfire was 55-year-old la voy finicum an arizona rancher who was the activist spokesman. the group was stopped on the highway as they were trying overtake public land to nearby grant county. leader ammon bundy was among those arrested. bundy's father who had his own showdown with the federal government over grazing rights

was told finicum was not posing a threat. >> my boy was cold-blooded murdered. they shot him with his hands up and murdered him. >> reporter: the armed protest began as an effort to keep two local ranchers out of prison for setting fires on public land it. shifted to indictment of all federal ownership of lands in the west. the local sheriff is begging the remaining occupyers to leave to avoid more bloodshed. >> tearing our community apart. we don't arm up and rebel. we work through the appropriate channels. this can't happen anymore. this can't happen in america and can't happen in harney county. >> reporter: over the last three weeks, the fbi used extreme caution with the protesters, not wanting to spark local militia uprising, they criticized the feds saying the occupation had tend to now. the fbi all the way up its ranks finally listened and acted, lou? lou: and one man is dead tonight as a result.

never seen so many of those republican candidates so gleeful. they've got grins on their face. dr. ben carson looked like the happiest man on the planet. >> one less face on the stage as jim gilmore made the junior varsity for the first time. that's less debate time. they're going to go forward. donald trump is running his own campaign. i would not have advised him to do this. he had a good debate last time. momentum going for him, and 30, 40% of that vote is not decided. i don't want to convert them and answer the charges. he's going to be part of the debate no matter if he's there or not, and there's no one defending him. lou: interesting the tone the candidates are taking in his absence, not what i call a killer tone on the part of any of them. it's going to be instructive to see the stage with the other candidates and to see how much energy. how much appeal they really have, that will be judged of

course in the audience and judged in the ratings the following morning. >> judged more by the second hour of the ratings. i think a lot of people will tune into see what occurs in the start-up, but can they hold the attention? there are very good debaters on the stage. the last thing anybody wants to see is a 90-minute debate between the former college champion debater and donald trump. i think from the perspective of the news organization we all work for here, they made the right decision, they didn't kick him off and defended their anchor as they should, as they would you, that's a very important decision that mr. ails made. lou: it's important to understand that working for the fox news organization here at fox business network, one of the things you always know when it comes to roger ailes, he has your back, he's a stand-up guy, and frankly, it would be --

it's just exactly what we would expect of mr. ailes. as you say. i think there's also probably no surprise for the audience that you and i think pretty highly of him. the issue here, it seems now for the republican party and for donald trump, what are the consequences? what will be the result? he has a 7-point lead as we reported in the monmouth poll. he in the real clear average as well, he has the lead in iowa. does he forfeit it in your judgment or it will actually improve because he's standing up against the national media? >> i can't answer that. lou: what are we doing here then? what are we doing here then if you can't answer that. give us your best guess. >> trump supporters think this is all part of the game and the establishment is against him and they're going to be supportive. the critical thing in all of the polls they are projecting a gigantic turnout to make the numbers they have. 120,000 is pretty much the

historic and the most votes ever gotten in a contestant was mike huckabee got a little less than 40,000 votes. the same numbers going in there. lou: turnout is a big issue. >> a big issue. lou: i heard carl cameron say if it's 130,000, you're looking at a tie between cruz and trump. not sure how that's divined but the reality is -- >> if there's 130, 140, 150,000, you got a new record and lot of people that haven't participated before. joni ernst campaign was a primary when she got the nomination as senator. i think 140,000. lou: joni ernst, senator of iowa. >> thee she had 140,000 people turn out. it's a snowy, rainy night. it's not easy, who has the organization to get them out. lou: this is my continuing frustration on this broadcast is night after night we're talking about this, talking

. lou: a few thoughts now on about what has been a slow but now expanding investigation of hillary clinton and her private e-mail server. the fbi is now going directly to the source in its investigation as some have put it. intelligence sources telling fox news that the bureau is going to the affected intelligence agencies to depose specific individuals. those who generated the highly classified materials that ended up on her server. that's great. but it does raise a few questions. first, why has it taken almost ten months to get to the sources in this case? ten months. and isn't clinton really the right source herself? incredibly, the fbi still

hasn't talked with him. clinton last week in a cnn interview was asked if she had been interviewed by the fbi, the former secretary of state flatly said no. the fbi opened its investigation into clinton's private e-mail server back in august, but it's been a full ten months of countless public contradictions of clinton and calls for that investigation, at least six months of active investigation. at least 1300 classified e-mails at last count have been found on that unsecured private server of hers. and some of the e-mails are so highly classified that even top lawmakers can't read them without acquiring special clearances. those e-mails contain intelligence known as special access programs. that level of classification goes beyond top secret. and clinton's problems are only growing it seems by the minute from her falling poll numbers to trailing senator bernie

sanders by four points. in the latest poll out of iowa, to the possibility of an indictment. without question, hillary clinton's problems are compounding. but the highly politicized obama justice department may soon create new problems for themselves and the president as well as hillary clinton. being extraordinarily careful in that investigation of a former first lady, former senator and secretary of state, it's all understandable, with about 100 special agents now assigned full-time to the investigation, according to our sources and about 50 others temporarily. it seems that a resolution would reasonably be expected soon. further significant delay in my opinion is all but unimaginable now if it were not the obama justice department in charge of all of this. our quotation of the evening now. this one from lord halifax who said --

here. please stand down. please stand down go home and hug your families. lou: bundy was arrested last night along with seven others after a violent shoot-out on a highway which left their spokesperson lavoy finicum, 55 years of age from arizona, dead. joining us tonight to discuss this and also the prison break from southern california in which three very dangerous criminals are at large, former assistant director of the fbi in new york, bill gavin. bill, great to have you with us this evening. let's turn first to this demonstration. you heard the attorney talking about leaving the vicinity. 3 1/2 weeks. we almost knew this would end tragically for some of those occupiers, demonstrators, ranchers. what do you think of the fact that one of them was shot last

night, as best we can tell from the details, either by fbi agents or state police officers? >> lou, good evening. it's a tragedy, any time anybody ends up being shot and killed, it's a tragedy. but these individuals knew, no matter what the complaint was, if there's legitimacy to the complaint, that's not the question here. armed to federal property armed with long barrel weapons and decided they were going to make a stand that way. that's not the best way to resolve it. best thing is the individual said that please, go home, and stop this thing right now. i don't know what happened during the car stop last night. car stop with two cars with armed individuals in the cars is the most dangerous thing in the world for the police and for those guys. lou: i can't imagine asking agents of the fbi or state patrol to do that.

i mean, first of all, it is crazy! you know these people are armed. accidents can happen. i don't think any of these people, i may be proved wrong in this, i don't believe any of the demonstrators had malignant intent, but at the same time, all of the patience exhibited to suddenly at 4:30 on the afternoon pacific time yesterday, everybody decides to be all law enforcement and go after these two car loads. it's a bizarre judgment, and by the way, this is going to be a rallying cry for folks, again, against the government because it's resulted in a fatality. >> lou, you're right. but in a situation like this, you have two car loads of armed individuals going to another town, and i understand how difficult that is for everybody, but sometime in some place, this has to end, and to

take the leaders of this whole revolt, one fell swoop is what they did. one person died. one person was injured and the rest of them gave up. bottom line is it's a difficult set of circumstances. these people need to go home and have the attorneys try to resolve it with the federal government. lou: to be clear, i've urged them to go home from the outset, they are standing on property where one believes it is rightfully that of the state rather than the federal government. the reality is it's in the hands of the federal government. i've said that from the outset, and by the way, we should note that most of these people were intervening from out of state, in fact. in support of the hammond family, who are the real victims in all of this and who get pushed to the second paragraph of the story. dwight and steve hammond in federal prison in san pedro, california, in an outright abuse of federal power. let me turn, bill, if i may to

the manhunt now for the three violent criminals wanted for murder, brutality of all sorts. these people, it was a coreio graphed escape. i mean a riot that prevented an hourly bed check throughout the prison and these people managed to escape through a diversion. 16 hours of lead time and no one seems to have a clue where they might be. >> lou, it's a deplorable set of circumstances. somebody at that prison has to look through all of the protocols that they did. you can cut a hole in a wall with 65 other people that are violent offenders in the same? you don't think they wanted to get out as well? somebody shielded this whole thing. and i'm sure once they start to look at it, there's been maybe some people that work at the facility who turned a blind eye and went the other way down the

hallway when they should have been looking inside. how do you keep track of all these people. they do facial recognition once a day. not enough cameras and personnel and not enough paying attention to prevent something like this from happening. lou: and the facility in orange county, millions of people live around that facility, and as it's been described to us, there isn't a clue that they have discovered as to their whereabouts right now. >> no, they have not. lou: bill, always good to talk with you, thanks for being with us, we appreciate it. >> lou, my pleasure. lou: a prison break caught on video. a different prison unfortunately. surveillance video showing at least 40 inmates escaping from a penitentiary in brazil. a bomb was used to blow a hole in the exterior wall. that allowed convicts to climb over the fence. shots fired by guards sent some of the inmates retreating back toward the prison.

comparison made throughout this campaign, that's vladimir putin, and, of course, these republican candidates in particular. we find out that the russian special forces moved into a town on the border with turkey and syria, hunting for the very person who took credit for killing the pilot of that downed russian jet fighter just when we thought apparently russia had forgotten all about it. >> well, this is potentially a real crisis for the united states. why? technically what the russians have done is invaded turkey. it won't be treated that way, turkey is a nato ally. they're in. lou: on the syrian side of the border. >> they are on the syrian side of the border. if they go into hot pursuit, are they going in. lou: surely they would not cross the international border. >> they've done it a lot. we've done it in eastern europe. lou: well, i'm sure, i am sure

is from senator ted cruz. $25 hats that say "make trump debate again." >> he wants a debate between the two of them. but i don't think trump is afraid. he's afraid to debate. that's not the case. this is a power play and we'll see how it plays out. lou: cruz thinks somebody can make him debate again. >> it was a good idea. it's a good gag. but the gold on white lettering doesn't stand out too much. from more than five feet, it looks like another trump hat. lou: it's the cruz marketing folks, not the trump marketing folks. one of the things i want it this video of a doctor.
