[closing bell rings] melissa: stocks finishing higher, dow jones is up 43 points. nasdaq basically flat on the day. crude higher as well. david: while markets wait for tomorrow, here is what you need to know right now. mitt romney blasting donald trump today, urging republicans to dumb the party's front-runner for the good of country. take a listen. >> donald trump is phony and a fraud. his promises are worthless as degree trump university. he is playing members of the american public for suckers. he get as free ride to the white house. all we get is a lousy hat.

david: fox business's peter barnes at cpac annual conference for conservatives with the very latest. peter, hows with that received there? >> we're getting mixed reaction from it, david. some say that, if romney had felt this strongly about it and wanted to lead the establishment charge against donald trump how come he didn't start earlier? others say he is not elder statesman of party so it probably won't have much impact. however, romney did speak here in 2012 and in 2013. has been a participant of the cpac conference. he also sought donald trump's endorsement in 2012. back then was singing a different tune about donald trump. listen. >> donald trump has shown an extraordinary ability to understand how our economy works, to create jobs for the american people. he understands that our economy is facing a threats from abroad. he is one of the few people who stood up side, you know what?

china has been cheating. reporter: and of course donald trump attacking romney for seeking his endorsement four years ago but romney tweeting out this afternoon, quote, if trump had said four years ago the things he says today about the kkk, muslims, mexicans, the disabled, i would have not accepted his endorsement. david, all of the republican candidates for president will be speaking here at cpac conference tomorrow and saturday, including donald trump on saturday morning. back to you. david: that will be interesting. peter barnes doing golf course correspondent talk. slow and quiet. respecting people behind him. melissa. melissa: not taking anything lying down, donald trump is firing back at the attacks from mitt romney. >> so disappointed in him because he let us down, he let us down. i backed mitt romney, i backed him. you can see how loyal he is. he was begging for my endorsement. i could have said, mitt, drop to your knees, he would have

dropped to his knees. he was begging. [shouting] mitt was going to run. it was going to be a third attempt. the second one being one of the great catastrophes. first one just didn't happen so that is okay. jeb bush actually convinced mitt not to run, can you imagine? jeb, jeb sold him. mitt was a disaster as a candidate. melissa: there you go. so trump went on to claim that a 2012 fund-raiser for mitt romney ruined one of his carpets. speed ahead. voters vote in kentucky, louisiana, maine. and tuesday, idaho missouri, michigan. a state with 59 delegates up for grab. the most since any state since super tuesday. latest poll out of michigan has trump leading by 10 points at 29%. followed by near tie for second between cruz and rubio. david: no coincidence, michigan is where fox news is hosting tonight's big gop debate. blake burman is standing by in detroit with preview of main event. go ahead, blake. >> david, good afternoon to you from snowy downtown detroit. we're five hours away from the latest republican presidential debate, appropriately behind me at the fox theater here in downtown. only four candidates will be on that stage tonight. we are down to donald trump, marco rubio, ted cruz and john kasich. they will battle it out. trump held a rally, nowhere near here earlier today. he was in the state of maine. he kind of gave a hint as to how

hopes to approach tonight saying that his wife told him to act presidential. he plans on doing just that. however, he also said those plans are likely to get interrupted. >> my wife called just before she said, darling, would you please react presidentially? be presidential. i like presidential but if somebody hits me i will hit them back harder. reporter: one of the candidates not likely to engage in any of this is john kasich. he told reporters earlier today, that he doesn't think calling donald trump names really solves anything or or will an election. you will remember it was just one week ago, one week ago that marco rubio did basically a 180 with his campaign and went after donald trump on the debate stage. we anticipate that tonight from him along with ted cruz. notably dr. ben carson will not be here. this is his hometown of detroit. however he pulled out of the debate yesterday saying at this point he doesn't see a path

towards the nomination. david: i love that fox theater backs ground. >> pretty good, huh? david: terrific. made for us. melissa: more controversy surrounding democratic front-runner. the justice department granting immunity to former clinton staffers, brian packly -- pagliano, responsible for creating clinton email server in the recent fbi probe. ashley webster in the newsroom with latest on this. this is a lot, ashley. >> the plot thickens, as they say. seems this investigation is moving right along, especially when you start talking about immunity as you say for brian pagliano. he installed hillary clinton's private email server in her new york home back in 2009. he was paid a grand sum of $5000 to do that. now we understand that the fbi could be getting ready in the next several weeks to actually start questioning people including hillary clinton and some of the former top aides about how this system worked.

were passwords shared among the inner circle if you like which would be direct breach of rules surrounding classified and secret emails and communications and so, that is what the fbi is trying to get to. based on what we know about mr. pagliano it is presumed that the grand jury has been convened in this case because immunity would have to be granted by a federal judge and we also understand that the fbi, department of justice, working in tandem, hope to have this wrapped up sometime in early may, at which time, we'll find out if the justice department decides to go ahead and file criminal charges. now, what's interesting is, what they're trying to figure out is, how was the gap bridged between the secure servers and server in hillary clinton's home? how did that happen? who had the passwords? who was getting access to all of this material? interesting stuff and as we say, seems to be moving right along, and we do expect some interviews to be conducted over the next

coming weeks, guys. melissa: ashley webster, thank you so much for that sure. david: here to weigh in on hillary clinton's widening legal troubles is a former federal prosecutor. joe, you have said that you do believe a grand jury has been convened. what makes you believe so? >> well, it is pretty clear if one hasn't been convened, then awful lot of time has been wasted. in order to get documents, emails, and other things of that nature you have to issue subpoenas. in order to issue subpoenas there has to be a grand jury to authorize those subpoenas. so in all likelihood there is a grand jury. in ad -- david: joe, let me stop you there. wouldn't the justice department have to sign off on a grand jury? doesn't that discredit those who were saying the justice department is in the bag for hillary? >> well, you can be conducting a grand jury investigation and use it to walk away from something but i think, from all indications there is honest investigation boeing going on

right now. as long as fbi is in charge doing it i have faith in it. the other thing, once you start granting immunity that means you're in the process of starting to present testimony, not just in meetings but also to the grand jury. tough take testimony before the grand jury in order to lock it in, to lock people into truthful testimony. so i think all the indications are, there is a grand jury. david: now there are two -- we've been focusing on e-mails and propriety of dealing with those emails but there is also an investigation you believe going on concerning the clinton foundation, correct? >> well i think certainly there is a separate investigation with the ig. also it is clear that the fbi is looking at that as well. you wouldn't need 150 fbi agents just to look at private server. so i don't think there is any doubt that, by the way, if they're not looking at clinton foundation, it would be a miracle because it is such a cesspool of official acts being conducted in exchange for money. i've never seen anything like it. david: joe, hillary clinton had

a history in law enforcement in the past, dealing with billing records. most people remember those things, for a sale she claims she hadn't been doing any work for a failed s&l, but billing records show they had. they went missing for quite a while, turned up in the white house. hick ewing, very well-respected prosecutor looking into that, said there was a draft indictment begins her for that. we interviewed him back in bate. here is what he had to say about that. >> if hillary clinton had intentionally been withholding those billing records, would that have been obstruction of justice? >> if she was subpoenaed to produce these records and knew she had them and didn't produce them, yes. look, if i subpoenaed records from you, and you didn't produce them in 18 months later, oh, i found them in my house what do you think would happen to you? david: so, joe, would the fbi consider her background and past

david: this is a party divided over donald trump. the billionaire inching closer to the gop nomination but further from establishment republicans, many of whom refuse to support him including of course mitt romney who came out swinging urging americans to turn away from the front runner. >> let me put it very plainly. if we republicans choose donald trump as our nominee, the prospects for a safe and prosperous future are greatly diminished. there is plenty of evidence that mr. trump is a con man, a fake. mr. trump has changed his positions not just over the years but over the course of the campaign. david: with that kind of rhetoric, can the rnc ever bridge the divide? joining me sean spicer, communications director for the rnc.

i don't envy you. you have quite a job. between trump and romney, i sure you saw both of them, who made the better case today? >> that is good try, david. i'm not boeing there. i think above romney has firstment right to express himself in this primary process, talk about who he would like to support, who he is not. donald trump can go out and talk to the voters as he wants and at end of the day what it will about voters across the country will decide what delegates get given to the folks going to the convention in july. david: that is what bother as lot of people what romney said. he seems to be defying will of voters who come out to the primaries? >> well it doesn't, with all due respect at end of the day, whoever gets 1236 delegates is the nominee. plain and simple. david: look how many he has got to far, sean. that is the point. turnout is extraordinary. you haven't had turnout like this for republicans in years. >> that's right. once he secures the delegates the nomination is his.

whoever gets that thing, that amount. it is pretty plain and simple. whoever gets delegates, that are required to clinch the nomination gets it. david: but again, sean, you're dealing with a republican and he is registered republican, you're dealing with a republican, donald trump, who not only has great turnout, he had 20,000 democrats in massachusetts switching over so they could vote in the republican primary. we used to talk about reagan democrats, remember that term back in the '80s? could it be we're in era, trump democrats, something certainly romney can ever get? >> sure. if he gets votes of delegates. that becomes the nominee. that is plain and simple. in between then i expect more people lend their vices both pro and con all of these candidates. we're at very crucial point in the process. i think you will see people come out to support donald trump. they will criticize donald trump. they will support marco rubio, they will criticize marco rubio and same with governor kasich and senator cruz. this is the point of a primary

election though. you get your supporters out there and whoever wins gets to be nominee. david: this is point of primary season, we never had one in my lifetime, i got a couple years over you, than you? >> not at least last couple years. david: try a century, sean. >> no, again but i look at this, as you pointed out our turnout numbers in 18 of 19 states have been record high. on democratic side they're below everyone of the 2008 level. david: going in opposite direction, right. >> we're actually experiencing tremendous excitement and intensity on our side. it is not just debates. it is number of people -- david: sean i have to read a comment from harold ham, i'm sure you know him. forgive me for turning so i can read it. trim tapped into the anger and frustration with the establishment in this nation at this particular time. he is unstoppable and republican party must unify to help him. what would you say to harold ham, quickly.

>> i would say as soon as they receive number of delegates we'll unify the party and come out of cleveland victorious. david: sean spicer, using is earning his pay. thank you, sean. melissa: ted cruz thinks the pick pub divide is fueling the front-runner. >> as long as the field is fractured, that benefits donald. it allows him to state after state after state because there are multiple opponents dividing the vote. melissa: plus the one person who doesn't spar with donald trump. how his wife melania deals with the don. that's next. e*trade is all about seizing opportunity.

melissa: the republican candidates gearing up for fight night in detroit. a few hours before the big debate. facebook is us about about what

voters want to hear. fox news's shannon bream is live from detroit with the trending data. shannon? reporter: melissa, this is so much fun because unlike a formal poll or survey you're asked specific questions and people are thinking how their answers may be what facebook does look at conversations people have on line with a more candid response. look at michigan, where we are scene of tonight's debate. we look at the state and top issues and top candidates. this is not positive or negative. this is volume of conversation. economy top issue here, pretty evenly split among gender. you see it spikes more with the age group that would be in the prime earning years. not youngest or oldest groups. maybe precareer and post-career with their retirements. in the middle people worried about economy and jobs in the age groups. something else interesting is a heat map. first let me show you. candidates who is getting most volume.

start with heat map of donald trump. he lights it up, wherever the intensity is, deeper, darker red, where the conversation is about him. whether it is positive or negative, he is really dominating. look at top five. this is overall who is getting the most buzz online across the country. we showed you donald trump. we can look again there, see within that gender breakdown, many more women talking about him. that is interesting, because again we don't know fit is positive or negative. many more women engaged in conversation who donald trump is, what he stands for. the age groups he skew as little bit younger. go back out to the person who has the second most wins in these early contests. that is senator ted cruz. he is more evenly split among the genders what they're talking about. and also in the age groups he doesn't hit as much with the younger conversation, but as you can see across the board he does have a lot of appealing conversations across all these different age groups. tonight we'll get data in real time. we'll also take people live on facebook during the debate.

other republicans who say anyone but trump. former speaker newt gingrich and 2012 presidential candidate warning republicans that it is either trump or hillary clinton. he is also a fox news contributor and he joins me now. thank you so much for joining us, sir. you know, it does seem like, as you see people within the republican party and leaders go out and sort of talk about how to circumvent what is going on right now in these primary elections, that it seems to be ignoring the will of voters and that goes against everything that our country is for and what it was founded on, doesn't it? >> it is a little ironic. look, first of all, trump is not the nominee yet. there will be a big fight for the next two or three weeks. marco rubio has every right to carry his open state of florida. john kasich has every right as governor to carry his o state of ohio.

ted cruz may pick up some more delegates in caucuses next couple days. none of these guys have to back off yet from being nominee, but this stuff is destructive and wrong. when i say to all the republicans that start down that road, you're really prepared to be morally responsible for hillary clinton being president and a left-wing supreme court being appointed and everything we know that leads to. i am astonished people going overboard and i think frankly mitt's speech today was going over board. melissa: seems like people like mitt romney maybe don't get that. a lot of what trump's support is basically rage against the machine. it is people out there who are sick of the republican party, what it stood for and what they have tried to do and, you know, as a result, sort of somebody like mitt romney gets out there, represents the machine. does it have the possibility of backfiring and making trump's support even that much more,

that is much stronger? >> very funny, a good friend of mine called laughing and said, that his mother, who is not particularly political, after she heard about the speech in utah said, oh, you mean the losers are going to tell us about what we should be doing? that is part of the risk mitt runs. we've had these guys around. they have lost a series of elections now. they are precisely what led to the tea party movement in 2010. melissa: yeah. >> they're precisely frankly led to the rise of donald trump. you know, i think, to them that come out -- again i don't mind if they say i'm against trump but for rubio. but to come out to have the harsh, vitriolic language we heard today, in the long run hurts the republican party. by the way i happened to have been in las vegas with romney and trump when trump endorsed romney was very generous, almost overboard in his gratitude to trump for doing it. melissa: you know, trump and the

republican party right now, that seems to be so much at odds, they do share the common goal obviously of trying to beat hillary clinton in november. is that enough in the end once the dust settles to unite these two groups, do you think in your experience, knowing what you know about everybody involved here? >> one of the people that will play pivotal role is speaker paul ryan who was very, very good this morning on "fox & friends" in outlining his job, which is to be the bridge to bring everybody back on the same team and i think paul understands this. he was a vice-presidential candidate for mitt romney. he likes romney a lot. at same time he is skeptical a lot about donald trump but also recognizes that if the american people nominate donald trump, then he has the votes that to wield some respect to the american people to work with the person they nominated. melissa: yeah. speaker gingrich, thank you so much for joining us. we appreciate your time as always. thank you. david: very interesting. joining us now, jamestown

associates vice president and fox news contributor tony sayegh who is in michigan. lizette senior political reporter ashley pratte. tony, you herd speaker just then. he said what romney did today was hurting republican party. do you agree or disagree? >> in large part i do. i think ironically helps donald trump which i don't think the purpose of governor romney's speech and remarks today. look the other aspects people are getting wrong is the analysis. this idea that donald trump is fatally flawed and can't be hillary clinton is seriously false. i have miss giveses about his conservative bonefides and his temperis in play is and his natural strengths, that can't be bought. those are greatest inabilities to clinton. all wall street and super pack dollars supporting her and 30-year institution in

washington, hillary clinton is poster-child of what romney is saying. david: ashley, what about mitt romney's comments, specifically going after donald trump? there were two mitt rom necessary. one was back in 2012 as newt was just saying talking about a wonderful success he was as a businessman. >> and this one. david: the other mitt romney today is saying what a disaster trump is as businessman. which one are we to believe? >> funny that you mention that, everyone on twitter today seemed to say where was this mitt romney back in 2012? there is point there, came out fiery, swinging ready to go after trump. i think it was completely unprecedented. we have never seen a party elder who was the former come knee come out and -- nominee and aggressively hammer away at the current gop front-runner and there is something to be said for that. the establishment is out there, party elites out there really last-ditch attempt to really make romney the sacrificial lamb

for the party to safe them. look we relately need to take down donald trump. i think ultimately will benefit trump. his speech today was fiery, feisty, same tone he always has. that seems to always help him. david: tony, how does all this translate -- you're in michigan. how does all this translate into the debate tonight? this is setting table beautifully for very fiery debate, right? >> naturally i think obviously be a topic, very timely story. look, i think the other aspect of romney's remarks that are unfortunate is comes on a day that we have a major breakthrough in the hillary clinton server scandal. david: yeah. >> we want to talk about the republican party but stomped on a very big story about hillary clinton's credibility, particularly on honesty and trustworthiness related to fbi investigation. this will be a part of this. i wish mitt romney devoted more of his time, has rightful place and in the party. i wish he focused internally, if there is anti-trump movement try to beaker that privately rather than air sour grapes what it

sounded like. david: we chewed over this enough. let me get to hillary's emails, ashley, if i can because i'm reading "the washington post" now, which had to admit by the way this is criminal investigation. for a long time as we've been saying it's a criminal investigation. we got a lot of heat for saying it. now "the washington post" is saying it. they have a piece, democrats have lot riding on hillary clinton which is why the word immunity should make them very nervous. we have a situation where if she is indicted, what happens? is she going to lose superdelegates right away? >> does she campaign from jail? i don't know. at this point, their front-runner is facing criminal investigation. great "the washington post" finally said so. this is something we've been saying all along. she was seriously incriminated in a lot of this stuff and something republicans need to stay focused on this election because sure enough, once the governments come off tonight at another debate they really need to hone in on the fact, nominee

you're from the hoover institute. i know you know math. let's go through it. first step he has to win his home state of florida on march 15th. you also say he has to pull off a win in utah as well, right? >> yeah. he has to do a couple of things, melissa. he has to obviously win florida, otherwise the rationale to stay in is gone. would help to utah and offset win in minnesota. mainly staying second and close to trump, limiting trump's delegates and moving ahead of cruz as the alternative to trump. melissa: he would have to have upset on may think in indiana possibly, may 3rd, oregon or maybe washington. one of the main things you talked about, he really has to finish second a bunch. that is almost as important as pulling off these big wins? >> exactly. you know, keep in mind trump has three times as many delegates as

rubio. rubio has won 10. cruz is in low 200s. there are 390 delegates, winner takes all. he would win those, more than halfway of 1237. rubio has to keep close second and keep proportionally collect delegates to bump numbers up to make him second person. the other race i point to other than indiana, april fifth in wisconsin. one thing changes in republican race, here on out, we'll get out of the south and away from evangelical vote and move to northern states. wisconsin is interesting for couple reasons. first comes after two week break in the action. a lot of expectations. one of the states in america with large catholic population. rubio is only catholic remaining in the race and getting support of scott walker who ran earlier dropped out of the race and had very unkind things to say out of donald trump. where rubio could spring an upset. melissa: your final point i thought was really interesting,
