twitter. my mom passed away last tuesday. the outpouring of support was amazing and i appreciate. i'll leave you have with the man himself, lou dobbs. you want to keep it right here on fox business. lou: good evening. i'm lou dobbs. the two big stories tonight. the presumptive nominees are in fire storms and controversies of their own making. some of the republican party elites are criticizing donald trump for noting a judge overseeing the university lawsuits is of mexican lawsuits. trump calling into fox and friends to say he has legitimate concerns about that judge. but he says the liberal mainstream media is blowing everything out of proportion. >> all i'm trying to do is figure out why i'm being treated

so unfairly by a judge. when i talk about how bad the job picture is and how bad our country is doing and how bad we are doing economically and people out of work, our real unemployment rate is through the roof, and people don't want to talk about it. that's a ridiculous number. you understand that. i talk about all of this, the on thing they pick up is the fact i'll say something about the trump university case. lou: include us in that. that's what we are talking about. newt gingrich is standing with establishment politicians and criticizing trump's comments and saying they are inappropriate. >> this is one of the worst mistakes trump has made. he has every right to criticize a judge and say certain decisions aren't right and his attorneys can file to move the venue for the judge. but this judge was born in indiana.

he's an american period. lou: the party he athletes on the democratic party in contrast to the republicans are acting as a fire wall for hillary clinton as the state department refuses to release her emails on the tpp trade deal. it seems the fire wall there is active as well on whether she'll be indicted. no ambiguity from the associated press which reports she is on the verge of punching the democratic nomination. clinton requires, according to the associated press, only 23 delegates to wrap up the democratic nomination. there is good news from trump and clinton. david french's big announcement

over the weekend to the intense displeasure of bill kristol, that he would not be playing the part of bill's fool. fears abound for hillary whether the prospect of indictment or a secret service agent's tell-all book about the clinton's lack of character while he was protecting them in the white house. the book is entitled "crisis of character." it's number one on amazon already. the author describes the clintons as appalling leadership style, volcanic, impulsive and distainful of the rules sit for everyone else -- rules set for everyone else. ed rollins, and michael goodwin.

we have a lot to talk about. i have been talking about a lot already. including reports that president obama is ready to endorse hillary clinton later this week. advisers say he's going to start campaigning on her behalf. if elected she would be effectively obama's third term in office. janet yellen affirming there won't be an interest rate hike until the economy clears. we'll be taking that up with wilbur ross here tonight. joining us now, co-host of "the five," kimberly guilfoyle, and author of "making the case."

there is one guy who's not afraid to do it, donald trump. now someone on the inside can speak to their character coming out and telling us. it is important and it does matter. this is somebody who wants to be commander-in-chief of the united states. is she fit to serve? does she have the character and competency to do so? lou: the answers to those questions seem straightforward. whether it be the prospect of the federal indictment. if you stop and think back to the clinton era, all of those controversies say the sexual controversy scandals were hillary's activities, not his. i mean, hers, not his. i mean, people don't think about it that way. it was her character at play in nearly all of that. whether you are talking about whitewater or the rose law firm. vince foster.

herself in that regard. lou: apparently also having some influence over the campaign. that's nice to know. a strong independent woman is standing up like that. a strong independent man like donald trump standing up against a backlash from not only the democrats piling on, i mean republicans led by newt gingrich. >> i found that surprising. i interviewed him friday night and he came right out, definitely showed he was not happy with it. he disapproved. this is somebody widely rumored to be on his list for a vice presidential pick for donald trump cop the convention. but people are saying this is the last thing you need. you have got to focus on hillary clinton. and there is so much material to work with. lou: you think he made a mistake strategically but you think it

was acceptable that he was talking about the judge's relationship to four hispanic associations. >> there are questions whether he will be able to get a fair trial and he and his lawyers could raise for a recusal. lou: kimberly guilfoyle is a former prosecutor. >> i think you have to go through the proper channels to do that. when you are as high profile as donald trump, don't be bringing -- let's not bring up trump university is what i would be telling him if i was in his camp. leave it alone. let sleeping dogs lie at this point. lou: he told his people and surrogates to double down on this because he feels slighted by this judge. and on it face, why is a federal judge permitted to belong to any

kind of association? it's outrageous that they are. >> they are not supposed to be. you are suppose to be above political ideology associations. lou: i know many judges do. why isn't there a rule -- >> i think there should be so you can have that sense of fairness. >> independent and impartial. >> especially with the role he's playing, such an important one to administer justice in an unbiased fashion. lou: should judge curiel have recused himself? >> i don't think he should have. i think it would be proper for trump's lawyers to bring a motion and lay out the facts. very few instances will you see judges or justices recuse themselves voluntarily. we have seen issues on the supreme court and they have don't in limited circumstances. it's a tough one. lou: kimberly guilfoyle. thank you.

we had in our long campaign, and they paled in comparison to the differences we have with the republicans. lou: an explosive new book by a secret service agent sending tremors through the campaign. the former secretary of state mired in controversy. on top of all of that will voters want to see another clinton or bush the white house anytime soon? the republicans have made that decision. democrats apparently they are willing. we'll see. will they put up with another harvard or yale grad? do we want to try another lawyer in the white house? how much more of this can the democratic party tolerate. to answer that question, former white house director trump's own ed rollins. is that fair to say?

lou: does he have a point? i talked with kimberly guilfoyle earlier. let's see the associations he's involved in as a federal district court judge. the la raza lawyer's association, the hispanic bar association, the latino judges association, the hispanic prosecutors association. who even knew. why in the dickens is there such a thing. i thought judges couldn't be associated with sore a yaitions, couldn't have outside interests. i really thought that was not done. and here we are. >> as the "wall street journal" point out, judge roberts is a catholic and he's ruling on little sisters of the poor. lou: he shouldn't be. i think we need to talk honestly about this.

>> i'm being honest. lou: we are not going to dismiss this catholic thing. we are not going to dismiss his hispanic thing. we are not going to dismiss judges who are involved in organization that potentially have an influence on their thinking and judgment as judges. >> i don't know you want to separate them from the world. lou: the world -- you have got hillary clinton and her husband picking up nearly $700,000 in speaking fees from one of the plaintiffs firms in this case. >> the groups that deserve scrutiny is la raza because it's an advocacy association on politics.

lou: what is the prosecutors organization? >> every cycle you have to have more clubs that you belong to. it used to be republican or democrat. and the bar association. now that's an example of an cantivist judge who used those connections to get where he is. what you did as you pointed out. this is an issue that's legitimate and his lawyers should have been making the case. my point is why get distracted on something nobody cares about. lou: i care about cleaning up the federal judiciary. >> right now -- lou: it probably assures -- >> to get some momentum for his campaign, he needed to be pounding her on the economy.

lou: i get, but at the same time they are basically tied in all of the national polls. that may change here. but there is the fact that there is this grudging idea, when newt gingrich steps up, this is a guy was considering for vice president. but suddenly there is a timidsy on a certain group of republican elites. if the democrats go after trump, they follow suit. what the heck is that? meanwhile the democrats are building fire walls around hillary. whether it's the state department refusing to release her emails regarding the trans-pacific partnership. >> what they should be doing. the bottom line is trump has to get his game going here. he is a leader, she is not. he is a leader on the economy, she is not. that's --
