7:00 pm
output rather in november, people are worried about that. >> votes count, not how loud you are about it f they show up at polls and cast their ballots that is what matters here. hillary clinton has very strong case for getting sanders supporters. they voted same way 93% of the time in the senate. they are not that drastically different. >> let's see how it shakes out. now our special with lou dobbs. lou: good evening, everybody, i am lou dobbs. it's a big night for presidential politics. we're one hour away from the first poll closings in the state of new jersey, one of six states voting. in some respects this race is already settled. late last night the associated press decided to report hillary clinton surpassed the magic number of 2383 delegates needed to clinch the democratic presidential nomination. in doing so she becomes first female presumptive presidential nominee after major political party in this country's history. >> i got to tell you, according
7:01 pm
to the news we are on the brink of a historic, historic, unprecedented moment. but we still have work to do, don't we? lou: that work is done now. her statement will be taken by her detractors as signal to vote for her simply because she is women but bernie sanders is still fighting for california and hoping superdelegates will flip their votes in his direction. >> there is nothing to concede. secretary clinton will not have the requisite number of pledged delegates to win the democratic nomination. she will be dependent on super delegates. lou: on the republican side when donald trump should be talking about the failure of obamanomics the millions of americans who can't find work or the scathing inspector general report on hillary clinton's email scandal,
7:02 pm
instead is beset not only by many of the republican establishment but also the republican and democratic orthodoxies that recoil at the thought of free speech. the republican elite in particular have been piling on over trump's attack of the judge presiding over the trump university lawsuit but trump tonight releasing a statement, saying it is quote unfortunate that his comments have been so misconstrued as categorical attack against people of mexican heritage. trump says he will no longer comment on the matter. why so many elites are afraid to talk about race ethnicity and group and identity politics. we'll take that up with some of our favorite politicos over the next two hours tonight. we'll talk with ed rollins, tony sayegh, charlie hurt. matt schlapp, tammy bruce, lee carter and more. later congressman darrell issa joins from us california.
7:03 pm
critics attacking trump might take a closer look at these revealing remarks from supreme court justice sonia sotomayor back in 2001 clearly admitting bias concerning heritage and gender. in a berkeley law speech she stated quote, i would hope a wise latina woman with rich he's he's -- richness of her experiences would reach a better conclusion that a white male who hasn't lived that life. we have a great strategist, fox news contributor, ed rollins with us. democratic strategist, hank sheinkopf, "washington times" columnist, radio show host, fox news contributor, tammy bruce. good to have you here. ed, this is a remarkable situation, trump backing off the whole thing saying he is done with it. i think a lot of people, republicans, leaders and elites,
7:04 pm
the establishment, donors are all breathing a heavy, heavy sigh of relief, reality this is the reflux now of the left being ascribed to by some of the right. he puts out a view, using shorthand not to be used in this day and age certainly that stifles free speech instead of provoking thought. your reaction. >> obviously the last three or four days have not been easy for him. some of the reasons you just stated but i think the key thing here he has to get focused. in two days the world will come at him, meaning democratic world. hillary will be the nominee. bill clinton, hillary clinton and obama obama will give him probably a day of rest, which will be wednesday or day for them to celebrate then they're coming full bore. he has to basically be careful what he says and has to make issues about them. oldest rule in politics, whether it is politics or my politics, you don't raise your own negatives. lou: yeah. >> i think he did in this one. lou: hank, your reaction to this
7:05 pm
issue though? sotomayor, i want to quote some other people here because there is a discussion going on in the national media right now that is wrong-headed as it can be. this is a, i mean you've got paul ryan saying his comment was quote, unquote, racist. i want to read a few things that will put in context, i believe, this time in which we live. and why it is so important to have free and full exchanges of views, even misstatements occasionally, if it is well-intentioned. and this is sotomayor's definition of, her words, and i think it is really important to listen to. she said, america has a deeply confused image of itself that is in perpetual tension. we are a nation that takes pride in our ethnic diversity, recognizing its importance in shaping our society, and in adding richness to its existence.
7:06 pm
yet we simultaneously insist that we can and must function and live in a race and color-blind way that ignore the very differences that in other contexts we laud. and that is the conundrum of, particularly for those in public life and those who are in the arena, right? >> that's exactly true, lou, but you know what, i'm kind of an i am ba aisle. i'm a political consultant. i don't pret lou: you are a political consultant but you can't play imbecile role here because you're here because you're as bright as you can be. >> the point you have to get on message -- come on, i would want to win the race. lou: i gotcha. everybody else gets it too, but we don't need to keep going down that same rabbit hole. if anybody doesn't understand messaging is important that is their problem but what is really important for this audience, for americans right now is to understand this tension that exists and be honest about that
7:07 pm
diversity and ways which we can recognize one another and speak about group and identity politics, as a nation, and as individuals. tammy? >> well, look for generations we have been told about it left, by people like sonia sotomayor ethnicity matters in how we view issues differently. that they have set up a dynamic where, the color of your skin, your background or youreth any necessarity informs how you look at the world. that is why it is important to have you be on the bench. what interesting they say it is diversity and it is noble. when a republican or conservative says, yes, that's happening and it is bad for me, it becomes racist. lou: that is precisely the point. >> that's the point. so what we have to do i think -- lou: that tension. >> this is good opportunity for mr. trump is this calls out the nature of what we're going to experience for the next five months is that he has to the, of course mr. rollins knows this with president reagan, the establishment is against him, the media is against him and democrats.
7:08 pm
if they don't pick apart words that he uses, they will make things up. and this is his chance to overcome that. he is going to have to, because no one is going to withdraw. lou: to ed's point, right now, donald trump has an inspector general's report on, on her conduct in the email scandal, putting straightforwardly that she lied, that she misrepresented a number of issues and elements and did not follow what had been precedent as secretary of state in her communications as secure. that's not being discussed, ed, to your point. what is also not being discussed is, you know, the the clintons not just a email scandal but a history of scandal. >> other part is his strength, his strength. we're not allowed to have political discussions anymore. we have to live in this age of politically correct, in course of campaign that may come out, his strengths are at this point in time, people look at him
7:09 pm
making choice who will be next president. the economy he clearly wins as all counts, businessman, builder, decisionmaker. that is what he ought to contrast with her. she can't make decisions. she made bad decisions on benghazi. she made bad decisions on syria. she made bad decisions on her email. that is what he should hammer her on. people will not make a decision on ethnicity, but who can lead the country effectively. lou: you have to have a persuasive convincing vision for the country which he articulated at this point. >> he has to do better getting articulated to people in states that are targeted. that is not about conservative versus liberal or democrat or anything else. how you win elections. he has not done that yet. he needs to do it quickly before she begins to pick up steam because she will. >> that is the point, he still seems to be thinking within a primary dynamic where he has to establish himself in his strength as a fighter.
7:10 pm
this is, the general though is different because there is no internal fight that is happening where he has to again, define himself differently but with what paul ryan and mcconnell are doing, they're now, there is no internal fight and yet they're turning into the donner party. they too are coming after him. mr. trump is going to have to come over the heads of all of them. lou: they're coming after him throughout. mitch mcconnell has been constrained and i think, taken the perfect posture as leader of the senate. his statements today i thought were unnecessarily strong. both -- it is interesting that the gop elites are talking because it as if they're running for something and guess what, ed, they are. >> they're running for the woods. i think at the end. day they're very concerned not just getting trump elected they're worried about holding the senate and losing seats across the congressional road map. lou: trump says he will have coattails. do you believe him? >> i believe he will have coattails in certain states.
7:11 pm
he is more helpful if gets this in the u.s. senate than people get him credit for. there will be losses in house. that is not reasonable. >> how could you not think that when your own leadership in the republican party telling america their chosen individual is racist yet they support him anyway. lou: to be fair, ryan said his comments were racist. >> some are saying racist. some are saying comments. it is messaging. lou: it is still not a party coming together, diffused interest and diffused remarks make for bad messaging. >> i'm sorry, real issue here elites are on the run whether sanders -- that is the whole point of this campaign that is what america is responding to, right or left. lou: at that point you say good for trump? >> i say good for america. lou: amen, brother. >> bravo. lou: tammy, thanks so much. hank, great to see you, partner. ed, always great to see you. >> thank you. thank you. lou: seems just like yesterday we talked. thank you. lou: ed rollins, hank sheinkopf and tammy bruce will be with us in the broadcast. much more on the busy election
7:12 pm
day. lots of nice and developments to take account of. we're going, we're doing a countdown on the first poll closures in new jersey. donald trump isn't backing down despite the attacks from all sides for his comments about the judge and in the trump university case. is trump now, bear with me, is trump possibly, is he possibly correct? >> i don't care if the judge is mexican or not, i will do great with the mexican people because he provide jobs. i don't care about mex can, we're treating unfairly, unfairly. is. >> is anybody defending trump? uh-oh, i'm starting to feel a little lonely here. we'll take that up next. a record number of voters expected to turn out for the final super tuesday of this historic election season. we'll have the very latest for you. we take it up with tony sayegh and guy benson here next. stay with us. we'll be right back.
7:13 pm
poor mouth breather. allergies? stuffy nose? can't sleep? take that. a breathe right nasal strip instantly opens your nose up to 38% more than allergy medicine alone. shut your mouth and say goodnight, mouthbreathers. breathe right.
7:14 pm
7:15 pm
7:16 pm
lou: new jersey governor and trump supporter defended donald trump, that his comments about a federal judge were not, not racist. >> i've known donald trump for 14 years and donald trump is not racist.
7:17 pm
the allegations that he is are absolutely contrary to every experience that i have had with him over the last 14 years and so, we're going to end it there. lou: joining me now townhall.com political editor, guy benson, republican strategist tony sayegh, both fox news contributors. great to have you here. guy, start with you. this is a race tonight in california is already decided by ap eve on the final primary elections. your take, what is at stake, who wins? >> will go out an him and predict donald trump will win the republican primary in california. lou: went to easy one right off the bat. >> very big of you, guy. >> i think hillary will probably win in california. might be embarrassingly close, she might lose but doesn't matter. she will be no knee. she will pick up a ton of delegates. apparently she already clinched it because of superdelegates. as of tonight officially
7:18 pm
democratic party gets nominee they deserve. someone who lies habitually, corrupt to high heaven and whose only apparent guiding principle is the pursuit of power. look, she is wildly unpopular and distrusted for a reason. that is one. biggest factors behind the close polling in this race and i think a lot of democrats set this thing up for her. they put it on a tee for her and let's see how that coronation pays off for them. lou: tony, guy says the democratic party getting what is deserves. your thoughts. >> absolutely. they're getting the most beatable democrat if you look at any poll. bernie sanders outperforms donald trump. granted that would narrow if the focus was more on bernie sanders. elizabeth warren would beat donald trump or any republican. joe biden would have better chance. yet democrats nominated most flawed, potentially fatally flawed depending what the fbi comes up with candidate. when you think about it tonight, we'll have six contests. bernie sanders is likely to win
7:19 pm
four for sure. she will win new jersey for sure. california is to close to call, yet the ap decided in act of journalistic malpractice, the night to one voted after talking to bunch political insiders in the democratic party, oh, hillary clinton has enough delegates. she is the defacto candidate. it has never been about the math. she always had the advantage. about the fact that he started a movement that is not going to end regardless of the outcome tonight. lou: yeah. talking to, about candidates, the republican party have got, still, every republican out there is talking about they didn't want, five million people are voting for the republican party this year, than, than in 2012, i mean, then, the democratic party this year, and it is the most votes since, well, ever for one fellow by the name of donald j. trump.
7:20 pm
attorney any, this looks like a, it is going to be a very close election when they make a pivot. i think they make the pivot tonight. >> they certainly will, lou. the reality is the republicans are getting nominee, the candidate, the people from the party grassroots wanted. the democrats are getting the candidate that the elites and the establishment wanted. and in the year like this, where there is much advantage to being an outsider, you know there is so much economic distress that frankly voters on both sides are blaming on this established order in washington, you have to give the advantage on some level, if donald trump could remain disciplined enough throughout the general election, to the guy who represents that change, that outsider disruption. lou: guy, very quickly, we're running out of time but i mean we have today paul ryan saying trump's comment were racist in his judgment. jeb bush weighing in for whatever reason today. saying that he should retract his statements.
7:21 pm
lindsey graham saying fellow republicans should unendorse trump, are these people ever going to get over themselves? >> i mean it is not just trump detractors who have been criticizing him, a lot of trump allies newt gingrich and others said it is completely unacceptable what he has done with the judge. lou: no, no my question is guy, at this point why are they pile on? >> because he is making racially charged attacks on a judge in a way not appropriate. you made the point, it's a good point, lou, so few people have been talking in the last week or so about the inspector general report about hillary clinton which is damning. if donald trump had the discipline to relentlessly pound her on the i.g. report instead of coming after this judge in this racial way he did, that would be so much more helpful to his campaign than -- lou: the racial thing you're saying, i don't want to get into this thing, we don't have time to litigate it here tonight, what i have quoted to you from sotomayor, acknowledges the
7:22 pm
growth of ethnicity in different cultural -- >> i ripped her for that. i ripped her for that. lou: you may have ripped her for that, but the fact of the matter is, it is a statement that stands in counterpoint to all of those who are criticizing donald trump. and the fact is, there should not be a closure of the public arena in my opinion, guy, just because controversy is upon us. we should be talking about these issues and in my opinion, it is very essence of what we are as a, a free republic. >> that's fine. i'm all for debate. lou: i'm sorry? >> i think be -- lou: this is not going to be fine, gentlemen. i have to call it here for the debate. somehow i got the last word. i apologize for that. but i won't retract it. guy benson, tony sayegh, we thank you. we'll be back with us. thanks for staying through the evening. follow me on twitter@lou dobbs. like me on facebook and follow me on instagram at everything

found at loudobbs.com. up next, donald trump set to hold a news conference. we're told shortly before 9:00 p.m. eastern. that's right, you are on the correct network to see that when it occurs sometime in the next two hours but donald trump says he won't be talking about trump university lawsuit any further. guess what? neither will we. the mainstream liberal media though, what will they do? ah-ha, yeah, i think so too. we'll take that up here next. i use what's already inside me to reach my goals. so i liked when my doctor told me that i may reach my blood sugar and a1c goals by activating what's within me

lou: we are now, you're looking at clinton campaign headquarters at the brooklyn navy yard in new york. we're going to be going there when hillary clinton takes the stage as she is expected to do within, within the hour. and a little later we'll talk with some of our favorite politicos about all that is transpiring in six primaries to
7:28 pm
not. lee carter, mike gallagher, among my guests. joining me now, "washington times" columnist fox news contributor, charlie hurt. great to have you with us. so much is going to be decided. it will be historic and unprecedented. that a major political party has nominated a woman as their presidential nominee. your take on what we can expect from her tonight, what you think will happen in the course of the evening in terms of votes? >> well, i think that you know, hillary clinton has the wind at her back, especially after the ap reported that has clinched nomination with the superdelegates. but what i think is so interesting here is that you have one party, the republicans, who have, has basically been hijacked by an outsider that, republicans should be excited
7:29 pm
about that. it is a very, you know -- lou: there are republicans that would suggest the party has been rescued and freed by an outsider. >> exactly but it is, it came at them kind of as a hostile takeover and i get it. the establishment doesn't like it. but what is so interesting to me is that, in the other party among democrats, that you can possibly conjure up in a hollywood script. you couldn't get more establishment than hillary clinton. lou: america has establishment choice. establishment versus outsider, change versus the same. it is just, i mean i think he democrats made a terrible mistake thinking they could put up somebody like hillary clinton, who also, someone who can't tell the truth to save her life. then another guy who can't shut up day saying the truth, saying what he is thinking. you would put those two side by side.
7:30 pm
a lot more people are going for the out of cider and truth speaker and all that. lou: despite what you broke over the weekend setting back the struggle, i think you say a fair judiciary. taking to task those who would interpret sotomayor and her comments on ethnicity and it is relationship to the to choices made by a judge or a justice, you doesn't see any positive in this for, in this exchange, no matter how wildly, incorrectly, donald trump may have framed his expression, he was getting to a point that raced -- race an ethnicity could influence a justice. she argued the same, what, 12, 13, 14 years ago. >> i think it was disgusting that she did it and i think it is disgusting, trump shouldn't do it.
7:31 pm
honestly lou, my big problem with donald trump, wading into this in such imprecise way is that it hurts his political campaign. he has a very important presidential campaign he should be focused on 100% of the time. he got this other case, this court case. i'm sorry he has it. i don't care about it. i don't want to hear about it but he can't try to pull things, do things in that department, that turn around and hurt him in, the only thing he should be doing, which is winning the presidency. lou: absolutely. and yet it is his, it is his plain speak, his plain talk which is american as apple pie, that has drawn some people to him. he has a point. he has said himself, time to move on. he has had a belly full, not only elite of the party, but as we look at this, this evening, we're also looking at prospect
7:32 pm
of obama entering the campaign against trump. it is becoming more a campaign against trump than a campaign for hillary clinton. do you think that is accurate description? >> i think you're exactly right. i say bring it on, because, contrast between donald trump, and stammering, stuttering barack obama, who doesn't know how to deal with what this republican candidate, you know, i think it is absolutely terrific for republicans. i think donald trump will make mincemeat out of the president, if the president wants to weighed in. i think we will see the president more involved than we have ever seen a sitting president. i also think that barack obama will, if he does this anything like the way he has done his presidency, he is going to do more to inject race into this race, into the political race, then we've ever seen before. perhaps even more than in 2008, because he is desperate now. i think, if donald trump plays
7:33 pm
his cards right, he comes out of that much, much stronger than the democrats. lou: somewhat ironically, the fact is a parallel between the republican establishment now and the president of the united states, who, injecting himself into the campaign, may be just exactly what the nominee of the republican party desired and that is a lot of help from his opposition. charlie hurt -- >> i think you're exactly right. lou: thanks very much for being with us. a lot more ahead tonight. busy election evening. both hillary clinton and donald trump are expected to speak in new york shortly. we will be going to them live. we're told trump may use teleprompter tonight, my goodness. a teleprompter. we know hillary clinton will. we recommend them by the way here. we're coming right back. much more straight ahead. stay with us, it will be a fascinating evening. hillary clinton rolling and
7:34 pm
bernie sanders defiant. >> if we can win here in california, win in south dakota, north dakota, montana, new mexico, do well in new jersey, we're going to go into that convention with enormous momentum. [cheering] clinton supporters accusing sanders of sexism for just staying in the race. we take that up and a lot more next and weil be right back after these messages. ♪ steak used to cost an arm and a leg. but now you can get new tender braised steak, and melted cheese, wrapped in a warm flatbread for just a buck forty-nine. taco bell's steak flatbread sandwich. eat it, for them. 7:38 pm
lou: we're expecting remarks from donald trump next hour or so. as you must as well. that is where we're being guided right now. and we will update. that is the headquarters for clinton at brooklyn navy yard where people are starting to get revved up. new reports say president obama is eager about to get into this campaign, hit the campaign trail and stump for hillary clinton. there could even be an official endorsement, we're told as early as tomorrow. why did it take so long? well that is another issue. issue comes as no surprise. mr. obama is reportedly most excited about going after donald trump. why ever would he be? this president has taken every opportunity to take a swipe at him over recent months, even while overseas, and joining me

now, host of the chris plante show, in washington, d.c., chris plante, republican strategist, former aide to secretary condoleeza rice. sara linde. good to have you with us. the prospect tonight we'll see a first female presidential nominee of any major party, how excited are you? >> i mean it is historic. it is exciting to see a woman rise to these rank, i wish it were a different woman, dr. rice, but i didn't have the option and it is a big night and congratulations to women across america i would say. >> chris, your thoughts? detractors, some are suggesting that she is relying too heavily on, if you will the madeleine albright prescription is, if you don't vote for a woman, you're going to hell? you have a special place in hell, i may have misquoted her slightly. >> special place in hell were the exact words for any woman that doesn't support.
7:40 pm
she is not a great great candidate, retail politician. she has terribly checkered past. she has a cloud over her, that is funnel cloud, out of oklahoma and the sky is turning green around her. we're waiting for the fbi to finish their investigation, and presumably, indict her, if there is any justice left in the world. so, congratulations to the democrat party in having a woman. another element, we had a african-american president, last two terms, it kind of takes the fun a little bit out of a woman becoming the democrat nominee and it being hillary, takes a lot of fun out of it for everyone i think also. lou: chris, sir, suggesting she has never been a good candidate. she only has to be good candidate once and this candidate would take place over the next five or so months?
7:41 pm
only, person she has got to beat is donald trump. do you think she will get lucky? >> do i? lou: sara. i think she has got an incredibly hard race ahead of her. bernie sanders just brought out, just started hitting her the fact that clinton foundation has been using money from foreign countries that don't have great human rights records for the clinton foundation, we're talking this is just the beginning. she has awfully hard race ahead of her. you better believe donald trump will stop focusing on his past business and focusing on her and economy and it will be a very different race. lou: now, chris, you were saying? >> i would like to see donald trump do that sooner rather than later, for that matter. certainly, look, hillary is utter at this defeatable. she learned how to dot fake cackling laugh. obviously it is insincere. lou: i am getting feeling her chris, that you don't like her. >> i am not a big fan of hers.
7:42 pm
no, i'm not a big fan at all. i would like to be cha charge of messaging from the trump and rnc on hillary clinton. i don't think they have been nearly ruthless enough. they need to be ruthless as clintons have been with everyone around them and really go to town on her. lou: phone may start ringing because i'm sure the ruthless has to fascinate donald trump if he hears you suggesting that. sara, do you agree trump has not been tough enough in his messaging. >> he hasn't. he has been very focused on business dealings and focused on some very huge issues, that around rhetoric and how he talks about people. so the focus needs to change to policy, economics, dying middle class, national security, and on taking on his opponent who is hillary clinton, not different segments of the american population. lou: as you say, there has to be balance here for donald trump, who after all is still
7:43 pm
responsible for vast business enterprises, now, it is all about a vast campaign for the presidency of this great republic. it is a rebalancing act that has got to occur relatively soon in the minds of most. chris plante, thank you so much for being with us. sara lymt. good to have you. >> thank you. lou: polls are set to close in new jersey in a little over 16 minutes. hillary clinton has clinched the democratic nomination, says the associated press but she still needs california to help make her case against first senator bernie sanders and then, donald trump. republican congressman darrell issa of the great state of california,, takes that up and great deal more. stay with us. next. i talked to my doctor and found a missing piece

university of california in san diego. bernie sanders will do very, very well there. he does well with young people. he doesn't do well with the establishment. and one of the reasons is, quite frankly, young people are, you know, drinking the kool-aid of free education, and a lot of things that, you know socialism, offers you everything for free until they run out of other people's money. that is working for bernie. it is unfortunate quite frankly, that the american people aren't able to respond to that, and have people understand that fixing our broken economy is not with more government, if more government would fix things, obama would be success and one of the worst performing presidents of our centuries. lou: fixing is one of the things we desperately need. we've had republican control of the house and senate now, without effect, is it your sense that donald trump in california, he said he can put california in

hillary clinton tonight, is she going to take. we heard darrell issa suggest she would take california handily, what do you think? >> i don't think she's going to take a handily. there's a chance she could take it, but i don't thinkle it be as big as she would like it to be. and everything that led up to this point is really going to have-- it's going to damage here. she didn't come in with the strength she needed to and didn't finish as strong as she wanted to. lou: and the post, it's one of the classic covers of the new york post, from the folks who brought us headless body found in topless bar. lou: right. >> what a great image of bernie sanders trying to hold onto her and sanders' supporters, listen, we see what they're capable of doing when they don't get their way. they're not going to go gently into that good night on the eve of their convention next month. lou: how effective is this going to be as a selling point for this candidate, the nominee, the presumptive nominee of the democratic party to say she is ate the first woman to be nominated by a
7:59 pm
major party. is that going to be a convincing persuasive and determining sales point, particularly with american women? >> no. i don't think it is. i think that there's all kinds of studies that have said that women under the age of 50, while they're excited there's going to be the first female candidate, it's not a reason to vote for her. women over 50, it's more urgent for them. for the most part, people want a candidate that's going to do something for them. while hillary clinton, it's exciting to have a woman in front of the ticket, i don't think that it's going to have as big of an impact as she would like it to have. i think it's a core part of the message, i'm with her, suggesting the most important part of her is being a woman. i think we saw the backlash we had when madeleine albright said there's a special place in hell for people that don't stand with women. >> that was rejected and a message that didn't land with those people and you're right, that's sort of, maybe 20 years

8:01 pm
history to top the ticket of a major political party. there is a caveat, it's on the superdelegates who don't technically vote until the convention, july 25th when that vote is taken and bernie sanders, senator sanders has vowed to stay in the race, reiterating that again today, in hopes of of convincing enough of those superdelegates to abandon clinton and support him instead. so, again, we're not projecting hillary clinton is winning new jersey. polls have closed there, but it's simply too early to call that race, but not too early to say our decision desk assures me, that she will win enough delegates to become the party's presumptive nominee. now, back with me now is lee carter and mike gallagher. mike, you know, it's
8:02 pm
interesting that we can't project a winner straight out because that means it's a little closer than what we had thought. your considerations? >> bernie sanders is like the uncle who won't leave after thanksgiving dinner and everybody wants him to go home and he won't go anywhere. he's just sitting there and it's like, when are you going to leave? he's not going to go gracefully and it's because, as lee said, certainly millennials and young people love this enthusiastic message of what's the government going to give me. what am i going to get out of this? and listen, this is not going to be easy for her. i wouldn't rule out superdelegates who are not unaware of the power of thousands and thousands of enthusiastic bernie supporters. anything could happen in the next month. lou: and the power of a federal indictment should it come, the persuasive nature of that inspector general's report in which she was roundly condemned and the e-mail scandal, lee,
8:03 pm
her difficulties are piling up, even as she becomes the party's presumptive nominee. >> that's right. i think that she's had a really-- there have been so many different attacks against hillary clinton and when you look at the facts, you look the a the polling data around her, she has a real trust gap. in fact, in some polls there's as much as a 15 and 20 point grosse pointe as far as trustworthy goes, authenticity goes. those things go a long way. she's more likeable than donald trump, however, trustworthiness is a big issue for her and each one of these things that comes out ekes away at her credibility as she moves closer to the general election. >> this is the year of the insurgent. everything that makes donald trump popular with republicans makes bernie sanders popular with democrats. the historic nature of a female isn't that a big of a deal for democrats, she's been around so long. she's part of the establishment and part of the machine and
8:04 pm
people are enthused about-- listen, i'm almost ready to do a run, bernie, run campaign because the excitement that people have for him is upending her confidence and the calmness that she has. lou: yeah, bernie sanders being foreclosed here, he's simply out of time. the clock has expired. this is the last opportunity for him tonight unless he can convince, lee, those superdelegates in sufficient numbers and it would take something like 70% of them, to switch to her-- for him to wrest the nomination if all, but impossible, unlike i. your thoughts. >> i think it's highly unlikely, but i think in some ways, i don't think his goal right now is to become the nominee. in many ways if you look at his messaging, he says this is your movement. i think what he's trying to do is make sure voices are head and people want a more left-leaning party. there are many, many polls that
8:05 pm
suggest that's what the democratic party wants. his perspective is the longer he stays in, the more support he gets, the more influence on the agenda that's going to happen and launched at the dnc. lou:. >> but as you've said, he's damaged her and her damage benefits donald trump in the general election. voters aren't going to forget that bernie sanders made this, despite the superdelegates, a race. lou: a couple of things is waiting in the wings is president obama who you were talking, mike, about the uncle who came to -- he's a lame duck. his time is supposed to be running out here, but he wants to get back on the campaign trail. there's a question of how that will influence the election. poorly for donald trump, lee, or will it be a lot of help? >> i think the timing for him to enter is actually really going to help hillary clinton and part of that is because we're in the center of a real issue around racism.
8:06 pm
and barack obama is a really great speaker on behalf of race. and i think that you know, we haven't seen donald trump in this bad of a position since wisconsin and people are having a hard time, even newt gingrich is having a hard time justifying the comments that he made. lou: are you saying newt gingrich. remember one thing about newt gingrich, that is he's got a history of doing precisely what he's done. he has a tendency to strike in some-- with some impulse. i'm not suggesting he's done so with impulse here, but he's got a history of it. >> don't forget according to "the washington post," newt is walking it back and saying that donald trump is just fine. lou: there's something funny about that, newt gingrich walking back his comments criticizing someone who is-- anyway, that's where we'll leave it. lee carter, mike gallagher, we thank you both. appreciate it, take care. fox news just confirmed hillary clinton does have now enough
8:07 pm
delegates to have clinched the democratic nomination, but she isn't celebrating until after the california results come in. fox news correspondent jennifer griffin now with the clinton campaign in brooklyn. good evening, jennifer. >> good morning, lou, it's a wild scene here in brooklyn, the crowd behind me just counted down until the polls closed in new jersey. fox news, basically concluding that clinton will cross the finish line in new jersey. she will speak about an hour before polls close in california. we may not have those results tonight and she will speak behind me about two hours from now. she's been very careful not wanting to look too presumptuous in the last 24 hours, even though ap called her essentially said she was the presumptive nominee last night. she didn't want to look too presumptuous.
8:08 pm
she will, we're told, talk about how she has broken through the ultimate glass ceiling, a somewhat bitter bit of irony since on june 7th, exactly eight years ago, she conceded to then senator barack obama. she foreshadowed, however, one more time that she may get another shot. and although we weren't able to shatter that highest, hardest glass ceiling this time, thanks to you, it got about 18 million cracks in it. >> and what could be the first female president-- >> your question implies that any woman, than any person, any woman who is running for president is by definition the best candidate. >> here opponent, bernie
8:09 pm
sanders still refusing to yield. bernie will be headed back to the east coast, to vermont, we're told. not clear what his next move is. he's under mounting pressure to step aside. even reportedly taking a call from president obama on sunday. democratic party organizers say they know of at least one bernie superdelegate who has switched to hillary clinton's side. another superdelegate who has pledged to hillary clinton just this morning. nancy pelosi of california, before those polls in california even opened. bernie would need 70% of the vote in the six primaries, unlikely to get that, but also unlikely to concede tonight. lou: jennifer, thank you very much. we'll be going back to jennifer griffin and back to the brooklyn navy yards when hillary clinton, as is expected, goes to the mode yum to give what we expect to be

course, when he wins. look at the two speeches in foreign policy, one in front of apac and the other traditional foreign policy. lou: very well-received, by the way, i think to the shock of many, to the dismay, ernl certainly, of the democratic party. >> i think that is what is the concern of the other camp, those ideas that appeared in his foreign policy speech and he responded to every single argument that has been made into a-- for the other camp and all of these relationships, he is proposing something different. she is proposing the same policies of the obama administration and voters are going to be seeing this. lou: it's remarkable, whether it's domestic policy or foreign policy, this is an issue of the outsider versus the status quo and it couldn't be much clearer that that is what we're going to see between now and november
8:32 pm
8th, election day, it's going to be quite a campaign. dr. walid phares, good to see you as always. >> thank you, lou. lou: donald trump wants to pivot jobs and the economy. not all of the republican elites will allow him to do that. what will trump say at his news conference upcoming here tonight within the hour? joining me here, next hstay with us. when they thought they should westart saving for retirement.le

>> the democratic race in new jersey still too close to call. hillary clinton is leading senator sanders now by almost 58 to 42%, opening up her lead. but as you saw, very few votes have been counted which is interesting because it's electronic voting, you would think it's much faster, but there you are. joining me now chairman of the american conservative union, matt from washington d.c. great to have you here. political columnist, kristen tate. soon to be released book "government gone wild" is that the american government? >> absolutely is, that's right. lou: let me start with what looks to be a certainty that she will be the democratic nominee. our decision desk has projected that, but it's not projecting her yet.
8:37 pm
they say it's still too early to call. matt, what do you make of this finish? we don't know what's happening in california yet and won't until 11 eastern. >> well, it's a big deal, obviously. she's really had to fight a pretty nasty fight with bernie sanders to get there, but i actually think the bigger story here is that even if she gets to the magic number, lou, these democrats, they're just not in love with hillary clinton being their nominee. bernie sanders is not going to go down easy and i feel a feeling this is going to to be certainly through the democratic nomination and i think she's going to have to make her case to the progressives through november. lou: it's interesting because he said he's going to take it all the way to the convention and looking for that last minute turn of fortunate that will make him the nominee. is that utter futility? what do you make of it? >> well, look, lou, everyone loves talking about how the republican party is in so much
8:38 pm
trouble. i don't see that. i see the republican party coming around donald trump. i think it's the democrat party that's in big trouble because bernie sanders has made it very clear he's stickening this race until the convention, he will not pull out and every day that he is in this race weakens hillary clinton. i'm a millennial. all of my friends are millennials, they love bernie sanders and they all tell me they will never vote for hillary clinton if he drops out. they're so angry at the democrat party, think the system is rigged and will not turn out for hillary clinton. the more bernie sanders stays in the race the more he turns other democrats against hillary clinton. lou: why would kristen and other millennials think it's figured when there's a swing of 5 to 600 superdelegates in the democratic party. >> why do thing it's rig when people get the ability to not listen to voters and pick
8:39 pm
anyone they want untethered. i don't blame them. if the republicans had a system that was rigged i think that people like lou dobbs might be upset about that. lou: we might take note of that. kristen, senator sanders, his appeal to millennials, extraordinarily popular with young people. it's an odd moment when you have a generational election, but the two candidates are near 70 than they are 30 or 40. and we're not seeing that happen in the so-called progressive party. i mean, that is a peculiar, to me, irony within the democratic party and creates some tension for the democrats. >> absolutely, but look, bernie sanders's success is all about the way he talks and the way he messages. he gets young people very excited about the future. and then you have hillary clinton who represents everything that young people don't like. she has bureaucracy seeping out of her pores. she's stiff.
8:40 pm
she's unlikable. this is a woman who will have trouble with mobilization when it comes to young people and i think a lot of other groups make minorities and independents. she'll have a lot of people getting people to show up at the polls. lou: donald trump having had a little trouble with the donor class and elites of the republican party. he says, he's putting all of that behind him and moving straight to messaging. what do you expect to happen? >> well, i think he spoke today about trump university and my favorite part of the statement was that he said i'm not going to have any more comments on this topic and i think it's the right way to approach this. he needs to take the fight to hillary clinton. now what? lou dobbs, the one unifier here, you know this, is that republicans that even don't like donald trump, they salivate at the opportunity to watch donald trump finally take the clintons down for 20 years of scandals, and i think everybody in the republican side is ready for that to start. lou: it seems like so many more
8:41 pm
years than just 20, but there it is. thanks so much. >> thank you, lou. lou: appreciate it. up next, hillary clinton caught in another lie about her e-mail scandal. bernie sanders may not care, but we do. and we'll have it for you. stay with us as we count down to the next round of poll closings in new mexico, north and south dakota, as we move to the big enchalada, california, we will right back. on stuff you bought from that airline? let me show you something better. the capital one venture card. with venture, you earn unlimited double miles on every purchase... not just...(dismissively) airline purchases. every purchase. everywhere. every day.

>> the state department today undercutting claims that hillary clinton made about her e-mail scandal sunday on abc news. >> everybody in the department knew that i was e-mailing from a personal address. hundreds of people knew it. >> really, no one among the senior staff had a full and comprehensive knowledge how much she was using personal e-mail. if they had they probably would have done it differently. lou: joining us is an election law council for the national committee. he worked as counsel for mitt
8:46 pm
romney's presidential campaign. great to have you with us. >> great to be here. lou: are you kidding me? this, the ig report, it's a waterfall. this isn't just drops, this is a waterfall of absolutely repugnent information now that she's lied, that she has absolutely misrepresented herself and her career at the state department. >> it's outrageous, it's illegal, and endangered our national security and what really bothered me is when she tried to compare herself to secretary powell and that he did it and he doesn't. lou: that's the earliest claim of who me? others had done it and she referenced general powell, straight away. >> at the time, he was secretary of state, their e-mail system wasn't allowed to send external e-mails, this is a totally different situation
8:47 pm
and offensive to compare it. lou: i wonder how offended the fbi is when they hear that sort of thing, the agents, the administrators, the executives of the fbi. i can't imagine we're sitting here now in june, james comey, the director said that we would have a decision in may. that's obviously gone. >> well, it makes you wonder. president obama hasn't endorsed hillary yet, and i wonder in the back of my mind if that's why he's holding off his endorsement. lou: we're told-- i'm sure you know, we're told that that endorsement of hillary clinton will come tomorrow which does raise the question, why has he waited so long? we're also told that he can't wait to get out on the campaign for hillary clinton or what's correctly constructed campaign against donald trump. what will be the effect in your judgment? >> it will help rally a little bit of the democratic base.
8:48 pm
she's got a big problem. bernie sanders is sticking around and she thought she would have this locked up by now. she's going to win with the superdelegates, but not with the acclimation or the love of the democratic base. lou: there is one or two-- there are one or two conveniences and advantages to incumbency and one is a sitting president to tell a senator who thinks he's going to continue this fight tearing down the party's nominee, to sit down, to shut up and we'll make our deals. do you expect that to happen? >> well, my understanding is that they spoke last week and bernie doesn't seem to be listening. so, i'm not sure he cares what barack obama tells him. lou: you really think he's operating as that much of an independent agent here that he will not be, well, in any way, he's not persuasive -- persuadable. >> the superdelegates are the establishment and party leaders and not one has switched from hillary to him.
8:49 pm
i don't think he cares. lou: so, donald trump's dreams are coming true. he will have hillary clinton then to campaign against. >> and that's what can unite republicans is the idea of going against hillary. lou: and the republicans, are they going to be at least nominally unified, effective enough to win this election? >> i know they're not going to get jeb bush in line. they're not going to do that, but they don't have voters anyway, but it is important that there be a core for the party to succeed. will they have it? >> i saw that trump's got teleprompters tonight. if he gets on script and can start making us give up something to support, republicans will rally find him. lou: what will it take for you to support him? >> he's going to have to be responsible and somebody that i would feel good supporting. i like what paul ryan said. lou: that he made racist comments? not that specifically, but that trump needs to get up to speed
8:50 pm
on policy and unite us. lou: and i think that that's what we're going to see. i can't imagine why else the man-- who would put the teleprompters out there? they look like alien objects, don't they. for donald trump and teleprompters. charlie, great to have you here. >> appreciate it. lou: up next, trump set to take the podium for his news conference, that's coming up in new york from the trump national, imagine that. we'll be bringing that to you when it happens. you know, you've got to love this, he's got his own golf course. you know, that's kind of special. poor president eisenhower, he had to go to augusta to play golf. well, actually camp david. we're also now minutes away from the next round of poll closures in new mexico, north and south dakota. and we'll take this up as we

>> the democratic race in new jersey is still too close to call. this is what we've got 58.8 to 41.2. clinton, she is extended her margin there, but it's early days, as you see by that 6% on the screen. joining us now columnist, commentary writer, kelly, write to have you on the show. >> thank you. lou: republican campaign strategist, fox news contributor, tony is back with us. kelly, let me turn to you. what do you expect to be the result of tonight? our decision desk has already projected on the basis of new jersey, which is too close too call a winner yet, even with that margin, then she will get enough delegates out of new jersey to be the presumptive nominee of the democratic party. >> yes, and i thought we-- expected for her. i mean, it's a large urban population, very diverse. not much of a surprise there. california is going to be the real target tonight and whether
8:56 pm
bernie sanders can pull off an upset. right now, hillary clinton is polling about 2% higher than he is, but if he gets the young vote, the youth vote activated on his cause, polled latino voters, he could pull off an upset and take his campaign to the convention which would be ruinous for hillary clinton. it's been a long, grueling slug for her so far. lou: and the finish line is here, tony. do you think, as kelly suggests, that she's going to -- is she going to limp across or is bernie sanders going to find a way to spark something anew? >> she's already limping, lou. she's last 15 of the last 20 contests. tonight, bernie sanders is likely to win north and south dakota, new mexico, montana. and those will bridge new jersey, likely going for clinton. interesting about california he's made significant gains among latino voters. latino vote, are the largest minority group in that state. it's an open primary, so independents get to vote and
8:57 pm
we've seen him overperform the polls in almost every single state. lou: that's a terrific point. >> and to make an example. lou: the role of the independents here is critical to his fortunes, one of the reasons he's been as successful. she has the majority of the delegates, the majority of the states, the majority of the votes. he has done very well when there is an open primary. what do you expect to happen tonight, kelly, in california? >> well, in california, you know, i think hillary clinton will pull off a victory just because of early voting and she has the organization. she will be named the nominee. you'll have obama's endorsement of her coming tomorrow or the next day and then he's going to hit the campaign trail hard to try to rally progressives around her. she's going to have a hard time rallying bernie sanders's base because he's not going to go anywhere, he has no reason to
8:58 pm
go anywhere. lou: and bernie sanders it showing no signs of tiring or disencouraging from the contest with hillary. >> i would be shocked if bernie sanders decides tomorrow that it's over. look, we saw ted cruz talk a lot about staying in the race and kasich and they eventually dropped out. i think that sanders is different. it almost seems that the nomination is secondary to the movement that he's created. and certainly the focus on the progressive issues. a lot of progressives, by the way, are disappointed with president obama. i don't know if his endorsement of her does the trick. when you think about the generational deficit that she has. even young women or women under 40, single women, she's losing that to bernie sanders. she has a lot of work to do regardless of the outcomes tonight. >> and to follow in that point, 5 million more votes for the republicans so far in this primary season than democrats. extraordinary. we'll see what happens tonight. tony, kelly, thank you very
