possible exit or referendum vote 23rd of the month. we're close to 18,000. now it is 18,000 one. we'll press confetti button. we'll see if we settle "after the bell." [closing bell rings] david: keep the confetti coming, stocks ending in the green. dow looks like it will settle above 18,000. s&p by the way is inching ever closer to record high. i'm david asman. melissa: i'm melissa francis. this is "after the bell." we have you covered on the markets. first what else we have coming up this hour. mad dash for cash now that the race for the general election is set. both hillary clinton and donald trump are focused on fund-raising. trump and the rnc are looking to kick it into high gear to compete with clinton's big bucks. tom trump fund-raiser, anthony scaramucci weighs in. bernie sanders not backing down,
4:01 pm
vowing to take his campaign all the way to the convention as another major media outlet warns reporters to be aware of violence from disgruntled supporters. david: the dow ending up 18,000 for the first time since april 27th. scott shellady of tjm investments is watching action in oil and gold. a lot of action in gold from the cme. lori rothman from the floor of the new york stock exchange. the dow making it happen. what were the bilge drivers? >> not a lot of confidence, david, not a lot of conviction. as you know the dow traded in narrow range, crossing epsychological milestone, 18,000, almost 60 times. yesterday hitting 18,000 crossing above and below 32 times. you have to question investor confidence. first time we have the dow closings above 18,000 for many months. all-time high for s&p is 2130.
4:02 pm
that puts large cap index, broad market averages within 1% of s&p's all-time high. story of a weaker dollar today, that powered oil prices above the 51 handle today. it also gave a nice lift to some of the multinational companies. one name in particular, nike. had a nice day. shares up 1% and companies do better under weaker dollar as their profits are booked in u.s. dollars. interesting note on nike, announcing it will continue its contract, agreement with maria sharapova, the tennis player banned for doping. nike said it wasn't her fault. she didn't know those substances were banned. latest from here. back to you. melissa: interesting. lori, thank you very much. oil climbing, ending above 51 bucks a barrel for the first time since last july this is a trend my friend, what is driving it higher today? >> in a word it is dollar. what is not to like about this? we have 38,000 jobs created. 4.7% unemployment.
4:03 pm
at those two levels, maybe 10 more months of 38,000 jobs, maybe we'll have 3% unemployment rate. this is ridiculous. you can tell by the way we're trading around 18,000 that investors think it is too. they're not behind the economy 100%. as soon as we get fed, it is not interest rate problem, it is legislative problem with all the things come down to square small business then we'll get the stock market going again. it is not about interest rates. it is a little bit about the dollar because we'll not hike them. other than that it is no-man's land. melissa: scott, you had me at beginning. you had me going. i thought you were being serious, he lost his mind. wait, he hasn't lost his mind. thanks, scott. david: didn't have enough time to talk about gold. i want to talk about gold with the next guest. dow breaking through crucial 18,000 mark, ending above the mark after falling short yesterday. here to make sense of hesitation, jonathan hoenig capitalist pig hedge fund, scott news contributor, scott wren, wells fargo senior global equity

strategist. john, everybody thinks i made a mistake when i say capitalist pig hedge fund, that is the real name of your hedge fund. >> proudly, proudly. david: feels like every time we hit the 18,000 mark we hit a ceiling and we fall back again. what is going to happen this time? go ahead, jonathan. >> well, david, i think the trend continues, even look at new 52-week highs and lows today, almost 300 new highs. only about 30 new lows. so as you said, i mean we move up, we move down. i think bigger picture trend is intact, especially gold. newmont mining new 52-week high, exxonmobil, new 52-week high, conagra, new 52-week high. i know 18,000 has come and gone. i think it stays and we move higher from here. david: scott, talk about gold. gold is up when the dollar is down. the dollar is down when the fed refuses to raise rates, that is
4:05 pm
what is happening now, correct? >> well i think there is definitely a relationship there and federal reserve, our call is that they make one move this year. we felt that the highest probability of that move is in december. certainly the last friday's employment report made us feel a little bit better about that. certainly fed is going to go very easy. gold is, you know, stretched i think. i would not be a buyer of gold. i don't think the dollar is going to fall apart or anything like that. what i would be a buyer of stocks because i think the s&p 500 is going to grind higher. it may not make it through the record high the first time or two which is 2134 but it will make it through. we want our clients buying stocks. david: scott, i'm not worried about dollar, i'm worried about all world currencies, because all central bankers all over the world have the idea they print more money and solution will be found to slow growth. it hasn't worked. talking about helicopter money. printing up all the money there

is handing it out to consumers to let them buy. that is the ultimate freebie. >> david, that is one of the reasons inflation, investors today, have no memory of inflation seen in this country in the late 1970s, early 1980s. when we talk about gold is moving up a few dollars, that is what really worries me moving forward, david, this rapid escalation in commodity prices. from my fund, that is where i'm putting my assets, whether it is in cotton, whether it is in orange juice or soybeans. these are markets you really start to see great gains in. stocks as well. melissa: can i ask you guys about lululemon shares ending up 5% after top line beat in the first-quarter earnings report but doesn't translate to profits for the leisure retailer, athlete leisure, what you call it, act leisure. i'm not sure i know what that is. i like lululemon but you know, what can you do? what do you think about this
4:07 pm
group because this is one of those groups that was totally on fire and now, jonathan? >> yep. the group is cooled but not lululemon, melissa. keep in mind remember, this is a stock that ran into trouble when its pants were a little bit more transparent than they wanted. >> right. >> it struggled for some time. it come all back around. this is a stock at new yearly high. i would not sell this short. given the size of this trend, athletic wear trend, this is the brand to own in the space and i wouldn't sell it short at these levels. melissa: scott, the group as a whole has really struggled. huge chains going under. we've seen under armour suffering as a result. the space is really crowded. the consumer, you know, is struggling. i wonder if the trend is strong as it is running out of gas? >> melissa, i have not bought any yoga pants lately -- melissa: really? >> my wife and daughter, my wife
4:08 pm
and daughter have and i can tell you, you know, businesses like that, you know, it is a fashion type of thing. you have to keep coming up with new appealing things. i'm looking at something like this from more of a consumer discretionary sector. in my opinion consumer spending is going to improve here. labor market is going to continue to improve. companies that are in that space, you know, they're certainly susceptible to the whims of consumer spending but they're also very susceptible obviously to fashion trends and that makes it a whole different ballgame but i do expect consumer spending to continue to improve slowly as we move forward over the balance of this year in 2016. david: jonathan, let's move over to health care, unitedhealth hitting lifetime high after the insurer announced it was raising its dividend by 25%. health care companies end the days in the green, obama
4:09 pm
administration making changes to health care market places to reduce losses incurred by insurers. jonathan, unitedhealth has been on a tear since it announced it was pulling out of obamacare. is there a connection? >> health care in this country almost completely become cronyism. that is what exactly obamacare has done. all the decisions, talk about marketplace, not a marketplace like we expect the new york stock exchange to be marketplace. this is marketplace controlled by government. manipulated by government. even as you said united healthcare stock at all-time high. we're meanwhile seeing coverage getting dropped and premiums up in 45 of 50 states this year. david: incredible. >> this is great example of cronyism. stockholders make out quite well. david: it is cronyism, scott, there is attempt on at least of united health to pull out of part of obamacare and i'm wondering if obamacare was a drag around it, albatross around united health it doesn't have to deal with?
4:10 pm
>> i think it was an albatross and it is an albatross obviously around a lot of company's profits and adding to their losses. i think what you are going to see, david the niche rush, the initial surge -- david: united healthcare up 17%. all other insurers one way or another still attached to obamacare are down significantly. >> because, those losses are going to continue and in the end, let's face it, the cbo and government, whoever totally overestimated how many people were going to end up signing up for this. we've already seen the surge. earnings may have been up, 15, 18, 20% for a lot of these health care companies in the initial stages of this but they're falling back down quickly. health care is going to act a lot more like a defensive sector, like it normally does but you know, we do like health care right now because of a valuation play. telecom went way up. david: okay. >> relative basis health care was down.
4:11 pm
you know, that, it went down too far. david: gotcha. scott, jonathan, great stuff, thanks, guys. >> thanks, guys. >> thank you. melissa: breaking news. update on a massive shooting at a mall in tel aviv. israeli police say at least three people are dead, nine people were wounded today in central tel aviv after a mass shooting carried out by at least two terrorists. sources say both attackers have now been quote, neutralized. we'll bring you anymore he details on the situation as they become available. david: awful. melissa: terrible. facebook under fire again for alleged censorship. this time the social media giant is accused of suppressing news from the gun industry. we'll speak to the ceo's of one company that says his business is taking a direct hit as a result. david: after "new york times" yesterday now now warning its reporters to be on guard after it received several harassing messages from bernie sanders

set up the private server, we've got to leave it at that. doug burns, former federal prosecutor, always great to you have on. >> my pleasure. melissa: by the way, hillary clinton will be sitting down with fox's own bret baier on special report, you can catch the interview at 6:00 p.m. eastern on fox news. don't want to miss that one. david: absolutely. melissa: encouraging violence against donald trump. why the liberal media says, quote, it's perfectly logical?

[bassist] two late nights in blew an amp.but good nights. sure, music's why we do this, but it's still our business. we spend days booking gigs, then we've gotta put in the miles to get there. but it's not without its perks. like seeing our album sales go through the roof enough to finally start paying meg's little brother- i mean, our new tour manager-with real, actual money. we run on quickbooks.that's how we own it. . david: the "huffington post" has published a piece from bloggers justifying violence from donald trump's supporters, sorry liberals, violent response to trump is logical and applauds anti-trump protesters, there is an inherent value in violent resistance accomplishes this.
4:46 pm
here to weigh, in ashley pratte, political reporter and jessica tarlov is back with us, what do you make of the "huffington post" publishing this? >> this is a real problem given the fact that tensions are so high, these are two of the most unlike candidates in history. i think we're going to see a lot of americans who are upset and when the liberal media plays into the firestorm, i really think it's dangerous because we have two conventions that are coming up on both sides of the aisle, and i do think that if violence is encouraged against trump, what is stopping the same thing from happening at the democratic convention as well, and at democratic events? they are setting a dangerous precedent. david: some democrats are subject to this kind of violence or threats. jessica, we have the "new york times" getting some violent threats because of some of their reporting. the associated press today had
4:47 pm
violence, and we have the vox reporter editor in chief of the vox website, and he tweeted last week if trump comes to town, start a riot. this is going on all over the place. >> and he was suspended nar. >> he was but he said it. there are a lot of people in those positions that have this feeling? >> absolutely. this is a rare moment of bipartisanship that we're going to see here, any sensible democrat would say this is absolutely wrong headed and only helps donald trump. we've been talking about that for months. the more he seems sane and stands there speaking to rallies while outside people are egging, throwing bottles, it looks terrible. a lot of the protesters identify as anarchists and not as democrats. >> it is being encouraged by the liberal media. david: the "huffington post" published this guy before, and ashley, i should mention, he is a journalism ph.d. student, is that the future of journalism
4:48 pm
in america? somebody who advocates violence? >> that's what scares me, they are fanning the flames which i don't think is appropriate. i do think you can talk about the ideas and the values that people have and respectfully disagree with the candidates on their policies and platforms. but to encourage and incite violence is dangerous and setting a dangerous precedent for the future of journalism. david: i hesitate to give these guys rationale. we have heard from other reporters that trump is a fascist or neofascist and therefore, like, if somebody in the 1930s, mid 1930s killed adolf hitler, that would have been justified. they're saying the same thing about donald trump. and if you just say, if you're like the "new york times" or something and hinted he is a fascist, that gives justification of this kind of violence. >> well, i'm not sure about that. i know the terms get thrown around and they're incredibly serious terms.
4:49 pm
>> indeed. >> i never called donald trump a fascist. david: the mainstream media does it all the time. >> the most powerful thing you can do is unpack what he says and his policies. show how dangerous and divisive they are for the country. i'm not in the business of name calling and hillary clinton spoke out about this. she did say donald trump's rhetoric adds to the situations and i agree with her there, i don't want to place blame anywhere but on the shoulders of the protestors and it's got to stop. and journalism like this is not right. david: it's not journalism at all. thank you very much, arbry and jessica. melissa: hillary clinton trying to capitalize on the rift in the republican party. her campaign launching and buying ads encouraging republicans not supporting donald trump to take a pledge vowing not to vote for him. if you sign the pledge, you will get free republicans against trump stickers. there you go. david: wouldn't be that nice?

. melissa: facebook under fire for alleged censorship. this time the social media giant accused of suppressing news from the gun industry. alien gear holster ceo believes that facebook has been hiding posts made by his business to nearly one million followers. thank you for joining us. how do you know this? what's your evidence? >> hi, melissa. i think that that's probably a little bit of a misquote. i don't believe that facebook is actively hiding our posts. we get a lot of traffic a
4:54 pm
significant portion through facebook interactions. in fact, facebook actually invited one of our guys out to california to their headquarters for extra training so i don't believe -- melissa: what do you think they are doing? straighten us out. >> it's not facebook, it's the algorithm. somebody is attacking gun groups. we believe it's an anti-gun group, and what's happening, if you mark a post the little check down box, you can select a spammer, if you launch a campaign that calls the posts spam, facebook penalizes us as spammers. our and other people in the industry, our posts have taken a dive, our reach and impressions have taken a significant dive, about 40% since february. no content has changed but everything is taking a die. so we've been in contact with facebook, and they say that they're trying to work out on
4:55 pm
their end what's going on, but confirmed with us we are being labeled by somebody as spammers, that's what's causing the dip in reach and impressions. melissa: numerous headlines that have said that facebook is, quote, suppressing the pro gun postings. is that an inaccurate headline? >> in my opinion, yes, they've been nothing but supportive of us. i don't believe facebook is actually behind anything that's anti-gun. i believe that there are some groups out there who are attacking the gun industry and facebook hasn't figured out how to counter that yet in the algorithms. they are refusing to remove penalties in the back end of our website. there are a lot of users and who are they to believe this or that, but i think their algorithms should be updated to combat against concerted attacks. you can pay people in indonesia for instance $100 and get 100 fake accounts to attack your
4:56 pm
competitor or disagree with politically and reach and users are dramatically affected. that's what we're seeing here, it's happening against not just us but conceal nation.org, truth about guns. melissa: we've got to go, obviously a big issue because it impacts your business, we've reached out to facebook. they didn't respond to our request for a statement. you know, it's difficult for the audience to understand and for us to understand if you don't know a lot about coding and algorithms and that, if it's impacting your business and others it's meaningful. david: glad we straightened that out, very interesting the way they attack the sites. americans are more obese than ever before, are celebrities to blame? to shut everybody else up about me quitting smoking. i was going to give it a try, but i didn't really think it was going to really happen. after one week of chantix, i knew i could quit. along with support, chantix (varenicline) is proven to help people quit smoking.
4:57 pm
chantix definitely helped reduce my urge to smoke. some people had changes in behavior, thinking or mood, hostility, agitation, depressed mood and suicidal thoughts or actions while taking or after stopping chantix. some had seizures while taking chantix. if you have any of these, stop chantix and call your doctor right away. tell your doctor about any history of mental health problems, which could get worse or of seizures. don't take chantix if you've had a serious allergic or skin reaction to it. y >> ou.

5:00 pm
deirdre: a group of researchers believe celebrities are make america fat. 40% of women and 30% of men are obese. david: . the celebrity food ads are for high- -- >> the people in charge say things can't change. we have to change. we have no choice. >> real change never occurred from the top on down. always from the bottom on up. >> if we stand together we'll rise together because we are stronger together. >> last thing we need is hillary cln
