only eat in restaurants with female chefs. kennedy: the identity politics are annoying, frustrating and insulting. how did she win california by so much. what happened? >> i don't know. typically if you have tight polling, bernie is usually the one who comes out ahead. i don't know what happened. my best guess, the older population turned out in a large number. there was a thought -- about half the votes there were mailed in and this is typically older voters. older voters ternldsed to go towards hillary. >> two weeks of it's over. maybe that's what it is. >> you know what else probably helped? her speech last week. it wasn't even a foreign policy speech. so i don't think they could have gone the that from it. i think it was a speech aimed at california all along.

and i think you will have to look at it and see how it develops. but i have a feeling that speech paid off for her. kennedy: i think she got high marks for that. the a.p., i felt that was so irresponsible. >> i thought it would hurt her. kennedy: i thought she was working with the a.p. because then every other news organization says the a.p. says she is the presumptive nominee. >> this is a woman who has been staying at or renting space in the white house since i was in college. and all of a sudden a woman. house this hillary clinton? i have never heard of her. she has been around a while. it's not that historic. we have been patting ourselves on the back ever since obama was elected. it is amazing. >> weir 50 years behind india

when it comes to electing a female leader. >> there are plenty of countries elected female leaders. it shouldn't be that big of a deal. i side with the and materials support horse say she is not necessarily a woman voter but very exciting. the email scandal, is bernie a protest candidate or is he banking on a clinton i am flowing? is he supposed to get out of the race and let joe come in when the cuffs go on? >> the cuffs are unlikely to go on. if they do go on then it's going to be joe anyhow. it won't be bernie even if the cuffs go on. kennedy: even though he's got pledged delegates. >> if he got superdelegate votes, i talked to a lot of the members of the dnc.

if that were to happen you would see that convention adjourned so it could go to the other process, they go to the dnc and they take the nominee. if they do it at the convention, though, obviously all those first ballot commit thes will go away. but i don't think it would be bernie. kennedy: i think that's an outrage. i think people should revolt if that happens. i don't think paul ryan or mitt romney or joe biden should parachute in at the last minute. >> in spirit you are right. the parties can do woofer they want. they are parties. so you have to let them do what they will. but bernie is smart. he should stay in. it's not just the indictment. it's all that coughing. she is still coughing a lot. kennedy: she gets so happy when

she is drinking something. i don't know what it is. that's it. i don't want to be anywhere near if some how he wasn't the nominee. she is indicted and bernie sanders isn't nominated. i don't think there is anything that's going to happen from the f.b.i. for one reason. because president obama has already come out and given one campaign speech for her. they made it very clear that endorsement is coming very soon. that's the piece that justice is not going to take its proper course. if this were happening on the republican side you would be apoplectic. >> i wouldn't. the f.b.i. will do its

investigation. kennedy: it's the justice department. >> that's a possibility. but the guy who runs the f.b.i. is straight air owe. if he recommends indictment and the justice department or the white house plays around with it, we'll know. this will not stay a secret. kennedy: his legacy is more important to him. >> i'm talking about the head of the f.b.i. kennedy: james comey will say she should be indicted and the president will say we are good. donald trump changed his tone in last night's speech. but will it be enough to calm those jittery republicans. closing the stage

kennedy: with primary season, president obama is look to get more involved. should mr. trump be sweating about the president and all of his tools? let's ask tim carney. the president is desperate to insert himself into the race.

he really can't help himself, can he? >> it's interesting. president obama is amazing at the primary skills of getting people to vote for him. but he hasn't proven any success with secondary political skills getting the public to support his legislation or getting people to vote for other people he tells them to vote for. he couldn't do this in 2010 or 2014. can he pass off some of that obama ballot box magic to hoik? if he does, it will be the first time he has done it. kennedy: donald trump will campaign against the failures of his administration. he's also more popular than donald trump or hillary clinton. how does that play into it? >> he's not just more popular than both of them.

if you look back over recent or medium term political history. we haven't had an exiting president who was close to this popular. george w. bush was far worse. you have to go back to ronald reagan to find a guy who's close to this popular. i think part of his popularity is how close he is to. overat does not come naturally to hillary clinton. obama, on the other hand, he can pull it off. kennedy: i think he's better at the sparring necessary to take on donald trump. hillary clinton has positioned herself as being tough and no nonsense. the president reached out to

hillary and bernie. he's resentful of both of them. he always had a contentious relationship with hillary clinton that goes back to 2008. bernie is running against the president's campaign as much as donald trump. of these two people who does he resent more? >> i think he'over the hillary thing from '08. he's a fierce competitor. people who play basketball with him talk about that. he wants to beat you. once he beat her he was fine with that. bernie sanders was saying obamacare was a mistake. this is his pride and joy. but the irony is obama is stronger with the left than hillary is. while obama is seen as, you know, not a total success. hillary is seen on the left as the establishment, the wall street type. so he might have a better reach into bernie's camp as far as

pulling people over to hillary. but bernie is running against a bit of obama's legacy. kennedy: hillary clinton is so confident about not being indicted. have you heard anything about that or am i creating conspiracies out of thin air? >> it's easy to guess what sort of conspiracy might be going on. when i talk to the f.b.i., they say justice doesn't like to get involved and interfere with a nomination. it would have been more likely to indict her if bernie had beaten her. but we don't know what's going on. at least i don't. hillary is acting as if she feels she is pretty safe from any prosecution. but, you know, why act any differently.

are between the ages of 16-24, and these businesses are not going the take a chance on a young worker with no experience if they have to pay them $15 an hour. kennedy: you shut young workers and minorities out of the job market. >> it's a hard conversation if you are trying to be objective. a lot of those restaurants will go out mated. they are going to automation because it's called progress, and that's what's happening in society. kennedy: we talked to restaurants owners and bookstore sell horse have to go out of business in the big cities because they can't afford it. >> let's look at what's happening. in seattle that's the problem. if you look at the original data in seattle it turned out to be completely inaccurate. i'd followed up for a piece and went and talked to some of those same restaurant owners. and they were saying yes be i

closed this restaurant because i was opening up two in these other parts of seattle. so the jury is out. i won't sit here and tell you it won't have a bad effect because it might. kennedy: it's an artificial imposition on the market that should determine wages. that's the most these people will make. somewhat do you do if the market is unreasonable as they are today when it comes to worker payments. >> if you look at the average full-time work at wal-mart, they make $13.50 an hour. but you also get benefits. kennedy: i want to bring tom in. >> it's all republicans' fault

because what you just said and what you just said were great concise arguments that republicans are unwilling to make. if they are unwilling to say that minimum wage laws get people fired, we say it on our shows but they don't say it. you actually made an honest point. you articulated it against the minimum wage and they won't do it. they are afraid of losing the issue so they don't make the case. >> all they want is unionization paid for byes seiu. you get $15 minimum wage and the unions say we can get you a pass on it if you have a collective bargaining agreement. that what's we are counting on. kennedy: then it turns into crony capitalism. then you have the businesses

like with obama care who are shielded from these regulations because they work with lawmakers and help write the laws and the smaller businesses are sham strung by regulation it's too expensive for them to comply. they go out of business or don't start up in the first place. that's how you get this economic stagnation. government and their overarching policies will never be the answer to creating jobs. >> i own a lot of small businesses. and i have never felt hamstrung by regulations. kennedy: because you are rich. >> it doesn't matter. >> my family ran a small wholesale grocery business and it's the central reason why they hate government. it was all the regulations that big companies could manage and big companies could manage but they couldn't with a small number of employees. >> you articulated a great

kennedy: a rape case in stanford university prompted an outrage.

like to go to prison because we all hear these numbers. just go in your bathroom all by yourself without your phone and tv, close the door and sit there for a half-hour. and see what it's like. when a young kid like this goes into the california prison system. he will be put in protective custody. you know how they protect people in jail? they isolate them. kennedy: if one of my daughters was the one passed out behind the dumbster, i would want them to go away for life.

defending his son. i don't think he meant sexual activity. kennedy: to have someone read your statement and edit your word. >> i was a prosecutor, i am a defense attorney. i have been on both side. we should vet judges to be the best judges they can be. he articulated it. we have the when criminal justice system. it's par from perfect. but thoughtful judge hearing the evidence said this is the reason why i'm giving this sentence. >> it seems like rich people get different justice in this country. >> 100%. it has to do with the representation you get. families who have money to hire
