but she is trying to look presidential. today it was donald's time to take a spin at the danceoff and he wasted no time on his on cal approach to unify the party, soil her already tattered state department reputation and make a case why she is corrupt and unfit to lead the free world. >> she is a world class liar. look at her pathetic email server statement or her phoney landing in bosnia where she says she was under attack. and and the attack turned out to be young girls handing her flowers. kennedy: he also tied her to the rise of isis. >> her invasion of libya handed the country over to isis, the barbarians. thanks to hillary clinton, iran is the dominant power in the middle east and on the road to nuclear weapons.

saying bosnia, he picks on such weird things. like that's the lie he's going to go for is the lie about bosnia? but that's the kind of thing that resonates with people. that's why trump is doing a lot better than everyone says and hillary is in trouble. kennedy: on the electoral map she has an advantage and a lead in two of the three big swing states. but this speech could reexpound with independents. did he make inroads? >> he did because it was ordered and more reasoned. he still communicated in the way he has using catch word. i love the way he uses the word rich. he talked about that when he declared his candidacy last year. that's not a dirty word to people. you need a bigger room so it doesn't sounds like he's standing in somebody's kitchen giving the speech.

but it does work and it will connect with people and hillary clinton's unfavorables are still high. kennedy: i thought it was smart of him to give specific numbers to saudi atraib yeah saying they donated $25 million to the clinton foundation. the problem i had with the speech wasn't when he was talking about her. it was when he was sounding like bernie sanders or elizabeth warren. when he's talking about infrastructure and bringing manufacturing by force back to this country. did you think that was problematic? >> seeing the two speeches side by side remind us the policy prescriptions are not that far apart. it's tough to make the case there is no difference between the two major parties. but yeah they are both standing up there saying blah blah, blah the infrastructure, blah, blah,

blah american manufacturing. and we are being taken advantage of in the global marketplace. and they are saying exang rated horrible things about each other, and it sounds like something bernie could say is not good news for people who like free markets and trade. kennedy: it shows you how incredibly effective his populism has been. this is not an election for rationale, civil liberties or the free market or free trade. >> at the state level a lot of those things are increasingly popular. but when it come to the executives, it's all blown up. every major politician who didn't drive out of d.c., even leaders like mitch mcconnell from a state that's been hard hit with nafta. this has been going on for 30 years.

this is where i grew up where the textile jobs and furniture manufacturing jobs. we are creating, designing in this country a more advanced economy, but there is an entire swath of people starting at the atlantic ocean moving to the west and they are angry. kennedy: it's been december made it, but i think -- it's been december made it, but more government is not the solution. you can even vote in out of office and they do the exact same thing. yesterday marked her 200th day since she held a press conference. so why is she so shy around journalists? she says she has a bunch of sit-down interviews but that's not the same thing as being challenged unscripted by a pool or a bunch of members of the

press whose questions can feed off each other. >> she won't do it. she'll arer have her sit-downs with journalists that love her and she does well with those. she doesn't want to answer questions. this thing about oh, trump is getting crushed. i think hillary is in huge trouble, and i think in swing states, it's unbelievable after the past three months of what trump has had to deal with and all the bad press he's getting and all the mistakes he's made. he's within 1 point in pence veins yeah and 2 points in ohio. kennedy: he has no choice but to clean up his act if he wants to win the presidency. i think she doesn't just with hold from press conferences because she is not good at it. i think she has an open disdain for the press. >> here is the thing. even if she has press

conferences, this is not the central piece that keeps democracy alive. elite members of the press is not the bull work. so the idea that somehow if but she could hold a press conference we could get to the truth of hillary, maybe a little self agrab dieing. >> that's when she makes the most mistakes. >> she makes the most mistakes when she is running the state department and setting up her email server. the key mistakes hillary makes are not gaffes. >> the persona is an egg held together with not so sticky scotch tape. when she gets in front of a room she is worried about them breaking apart. is the egg raw?

bigger issue is as a block, the european union is their biggest trading partner. so it does matter to us. i lived in england. i don't want people in britain to tell me bubbling sweet is delicious and i won't tell them how to vote. they have done okay not being fully integrated europe. they didn't get on the euro. they don't have the passport-free travel everywhere. i want to add one thing. you are right. if they stay in the e.u. it's better for us because they fight regulation and they promote a freer trading environment that other nations are not on board with. kennedy: my issue isn't the trade. why would you want to stay in the e.u., so you can prop up greece and portugal? >> for most people, when i go to europe.

great britain doesn't seem like it's in the e.u. to me the euro is the money. so when you go over there you get british pound. kennedy: i thought that was a dinosaur. >> i thought that was people applauding my point. trump said i think britain should leave but don't take my word for it because i don't know about that part of the world. kennedy: we are talking about what we should do inning this country. trump wants the brits to leave. hillary wants them to stay. and bernie sanders is i really don't care. >> you are with her. oh, my goodness.

kennedy: hillary clinton's former i.t. guy bryan pagliano facing questions about setting up that notorious private server. he invoked the fifth amendment and the judge referred to the f.b.i. probe as a criminal

investigation as opposed to clinton's characterization "security review." kimberly guilfoyle joins me. bryan pagliano, a man of mystery. the f.b.i. groontd form of immunity. the judge put it under seal. now here he is in the judicial watch case invoking the fifth amendment 125 times. >> he had a prepared statement saying they are going to assert their fifth amendment right against self incrimination so there is no messup what so and it's stated and repeated exactly the same way for each question. he will have it on a card. on advice of counsel i observe my fifth amendment rights. all the good stuff will be under seal. what are they going to be able to get? this guy is clammed up. shut down shop. that's what happened.

when you think about it, judicial watch is bringing it forward. wouldn't you think the government would have a healthy interest in monitoring their own behavior seeing if there has been transgressions or violations about people under the public employ? it has to take a group like this to get to the bottom of it. this whole administration said we'll be transparent. we won't play games like other people have done, and that's what you should expect and get. but instead, you have hoik rsh running for commander-in-chief, and everyone else is running for the fifth amendment. kennedy: they are running for high-priced lawyers and the exit. we hear bryan pagliano was a good witness for the f.b.i. one last thing about this very quickly. i know pleading the fifth in a civil case can be incriminating

versus when you do it in a criminal case. >> it's very tricky. but you want to try to cooperate if you can to avoid any further trouble in terms of a criminal investigation and him being in trouble or having to do some time. so you think okay, we'll take care of what we need to do, but if you have information you should give, some of that might be under seal. but could it be thin that are protected or secretive. kennedy: maybe he's squawking like a parrot. all we know is a hacker called guccifer claims to have stolen document from the democratic national committee's computers and published them online. >> people are making fun because maybe he should have consulted a p.r. firm with the name. but he says he was able to breach this repeatedly on multiple occasions and even a

low-level hacker would be able to access hillary clinton's secretary of state files which is such a huge flag for national security and foreign policy. the things he's saying ultimately if it comes to fruition we are able to get some of that information, but some of it may be top secret. can't be made public. kennedy: is donald trump going to get some of this information? kennedy: he knows hackers and he knows the right language to use. >> china has been able to get into it, russia has been able to get into it. that's why he was like, i have got the goods. he said let them bring me back here. you only do that if you have got something to trade. kennedy: i believe he does because the nsa and f.b.i. warned the dnc and other

so what i decided to do is on the appropriations bill is to find the gun-free zones. but speaker ryan doesn't want to let me have a vote on that. so maybe i'll sit in on the floor of the house as well. kennedy: what happened to your colleagues? they look like a bunch of minteddal patients. bill clinton tweets out, this is leadership. it's not leadership. it's distracting. most of those measures will do nothing but put innocent americans at greater risk. >> what they want is unconstitutional and it's not going to solve anything either. what's interesting is two years ago under boehner i was able to get an amendment to the floor of the house. but paul ryan is not allowing it. two years ago i offered a bill that defunded all of washington,

d.c.'s gun control laws. 20 democrats voted for it. and some of those democrats are sitting on the floor today demanding more gun control. so they need to figure out which side of this they are on. kennedy: they have to figure out what side they are on when you talk about lone tbhostles this country and figuring out in a safe and responsible manner that did not compromise american civil liberties. how to address some of these issues. making guns illegal doesn't address any of the issues brought up by the orlando shooting. these are empty gestures that make our country less safe. >> i want to have the debate. this is the best example where background checks can't stop everything. here is a guy who passed hour and hours of training to get a class g license in florida he had a psychiatric background check done on him an carried a gun as a condition of work.

and how are you going to keep somebody like that from getting a gun with another background check? kennedy: when do you deem someone a terrorist? people like nancy pelosi and elizabeth warren and hillary clinton run around saying we have to keep guns out of the hands of terrorists. obviously. but why didn't the f.b.i. deem him a terrorist and go to his employer where he was employed as a private security guard with a company that had government contracts and secures government buildings in this country. why didn't the f.b.i. go to them and say we think this guy is a terrorist. that might have do kept him from getting the guns in the first place. but we are not talking about motivation or private solutions to an ongoing terror crisis. we are not talking about any of that because you have a bunch of people who want to sit around and sing kumbaya.
