tunisian. we are keeping a keen eye on stocks, leisure stocks getting hit today and markets have taken a turn to the downside. london for the down one third of 1%. the german tax down 1%. stocks down, the s&p pulling back a little bit down 11 for the dow, s&p futures down to a half. amy kellogg has the latest from nice. >> reporter: the scene of the terrorist attack is a sea of people, a lot of gawkers, a lot of journalists, people clearly stunned by what happened and wanting to see the truck, it

still sits in the middle of the promenade, a horrible eyesore on the beautiful strip that runs along the mediterranean sea. french president françois hollande was quick to call this a terrorist attack even before people were talking about the identity of the attacker, before much information had come forward at all but it is a sign of the times, france is at war with radical groups. we still here 18 people are in critical condition so there is a lot of concern the death toll could rise, local businesses recounting their story last night, they took people in, the cries and screams and fear and panic, people tell me survivors

of this attack jumped one on top of another piled into restaurants and basements and bars, panic attacks and so much fear about what else could be involved in this attack, france had seen coordinated attacks, people were not sure what happened and people running and screaming in terror. people didn't feel safe. the french police told everyone to go home and stay inside but this morning they are out in large numbers trying to make sense of what happened. curious to see what the beautiful city of nice looks like in the aftermath of this horrible incident, still waiting for more details, those will be

forthcoming. nicole: we learned so far according to reports that he is a 31-year-old french tunisian who was shot dead by police after running this truck zigzagging through people for over a mile. one of our guests talked about posttraumatic stress disorder and you just hit it, people were screaming, running in terror and fear. we heard reports of blood and bodies. the feeling in france of the people today and going forward, your thoughts? >> i heard the chatter, what can we do to end this? people support -- a lot of people support military action in syria and iraq but a lot of people feel like that is not going to stop people who are willing to pick up some twisted cause and carry out their

violent dreams or their own anger, such a familiar pattern, in france and belgium, we saw the french terror attacks in november and we have seen it, the attacks on charlie have though, they start as petty criminals and at some point they switch over to this radical terror and they are fertile grounds for recruitment. what the pundits are saying is something needs to be done to make this a less attractive option for people on the edge of society anyway, religious young men start out many of them as thieves and petty criminals, and whether they get brainwashed in jail or something else there is a pattern and something needs to

be done to restore that bridge. otherwise i just think people in this beautiful part of the world are waking up to the reality that no one is safe anywhere. cities were considered the most obvious targets, dense populations, but in fact that is not the case at all, although this was densely packed last night with people celebrating their independence day. nicole: thank you for that. watching pictures of last evening we also have live pictures of the promenade, this is what we have been watching, this is now today, you can see only police at this time. last night hundreds of people were wounded, 14 in critical condition, families, children in the hospital, 84 dead after the

truck barreled through that crowd that was celebrating bastille day, today france has to unite and get past a difficult evening as we look at these pictures. lea: so many horrific videos of people walking along taking video of the carnage, pictures that are too graphic for us to show you on this channel, pictures nobody would ever want to see, children, men, women, whoever without there being mowed down by a truck, by horrible act of what is being called terror in france. the white house released a statement from president obama reacting to the attack, obama said he condemns in the strongest terms what appears to be a horrific terrorist attack in nice, france was killed and wounded dozens of innocent civilians, he has directed his team to be in touch with french officials and offer any

assistance they may need to investigate this attack and bring those responsible to justice. the president said we stand in solidarity and partnership with france, our oldest ally. >> donald trump weighing in on the attack with bill o'reilly, listen. >> this is war. if you look at it, this is war coming from all different parts and it is war and we are dealing with people without uniforms. in the old days we would have uniforms, you knew what you were fighting, these people, we are allowing people into our country and have no idea where they are, where they are from, who they are, no paperwork. >> hillary clinton was on the o'reilly factor with her reaction. take a listen. >> we need to strengthen our alliances and i include nato in that. we have got to do more to understand that this is a war against these terrorist groups, radical jihadist groups, it is a

different kind of war. we need to be smart about how we wage it but we have to be determined that we are going to win it. >> after the attack trump post posed a news conference to announce his running mate. terrorism analyst, we showed what is going on live in nice, france today and we saw people encouraged to stay home and stay away from the area so now what? >> we continue on. one of the issues is we can't live in societies where we are not willing to move about freely and experience our lives. the other part of that is we cannot interdict a threat that chooses to act at any time so it doesn't matter what barricades we put up, what stanchions we make people walk through, these attacks will continue to happen because they are based off of a belief system. we have to look at how do you change someone's core belief

system? >> we don't know if this person had connection to actual terrorist groups but this is a terrorist attack against these people and their way of life which is what terrorists typically do, they want to strike fear into hearts and minds. how do we fight little for tax? in the united states we had the patriot attack -- patriot act which allowed metadata to see who people were communicating with overseas and possible terrorist groups, we don't have that ability anymore. what capabilities do we have to protect against level for tax if people are connected to groups overseas? >> we don't have any. we look at that with san bernardino, the boston bombing, orlando. up on our radar s brought because they are backdoor from a larger mechanism. all of them are inspired acts, not legitimately directed acts. my point is none of that

matters, directed or inspired they are still occurring so we have to make it untenable for people who believe a certain way to continue to act on it. in this country for the past 150 years, we had the american confederacy and made it untenable for people to believe -- >> how do you stop them? what can we do? >> unless you change someone's core belief system, we are seeing the result of people who believe a certain way choosing to act on it. you can't put up a barrier or block the street to keep someone from choosing to kill someone based on their core belief system. you have to wipe it out at its core. nicole: when they are everywhere it is hard to detect each lone wolf and when and where they will attack particularly when they go to soft targets, any area. terrorism analyst matthew grimm, thank you for your insight. coming up is there any way to

eyewitness accounts from the people who were caught up in this horrific incident. police have been able to identify the driver of that truck, they found documents and a phone in the vehicle, 31-year-old french tunisian man. they haven't named him yet. the suspect drove a large heavy truck at speed through crowds of people celebrating best deal day. he drove over a mile intending to kill as many as possible. it and understood that driver was also armed and fired into the crowd as he drove. he was shot dead by police but only after he claimed many lives in this carnage. he was known to police as a petty criminal but not on any terror watch lists. france's been on high alert since the deadly attacks that claimed many live so there are

questions why intelligence services couldn't have done more to prevent this, questions whether this man acted alone or if he was part of a network. there were police present at this event but were not able to stop this truck charging through the crowd. it happened late at night, around 11:00, streets were full of people, watching a fireworks display. many young people caught up in it and you see these pictures, desperate scenes of people trying to escape, unable to in many cases, resulting in the loss of many lives, many children and only two americans now known to be among the dead. a father and son. the french president françois hollande calling an emergency meeting, extending the state of emergency france has been in since last year and france will hold three days of national mourning as the investigation

breakdown but what i would say from my experience in intelligence we are allowing the internet, cyberwar to be used at this point because they are telling people what tactics they can use to make acts with terror, how to make a bomb, there was the name of an article in a magazine, how to take a truck and mow people down. what do people know about cyber and what can be done to stop the attacks being spread online? >> we spoke in the last hour, a lot of these websites, social media outlets that have those kinds of things and allow people access to those things, if we went on google and did a search for making a bomb in your house you would get all kinds of hits, all kinds of places someone could go and learn how to make a bomb out of household materials. it out to be incumbent on google or yahoo or any other search

engine to make sure access to that kind of information is simply not out there for people to get. in the lone wolf attacks, we believe this to be a lone wolf attack at this moment, police don't find out until later where that individual has been going, who he has been talking to on social media. what's on the web he has been looking at. hard to predict before hand. nicole: we have seen terror in france, in the united states, we had orlando, what is the difference between the united states and other countries? >> in europe it is the muslim immigration problem. they have large communities of muslims, many unemployed, many disenfranchised, real hotbeds, places for radical islam to grow easily within a community and in the united states virtually all our muslim population is well integrated, part of communities,

window, accelerating, look at european markets, the cac quarante in france is the worst of the bunch off of earlier lows. the bank of england leaves rates unchanged looking to august for that and the german dax down 1/2%, us stock market futures continuing earnings season with breaking records yesterday for the dow and the s&p and jpmorgan financials leading the way but today down arrows, s&p down 2. fox news's amy kellogg joins us on the phone. what is the latest? >> reporter: i am standing on the promenade looking down from where the massacre began. there is a white curtain stretching for a quarter of a mile that appears to be covering debris from last night. i walked by an abandoned doll, a few of them have been

photographed, celebrating this national day. the french, their fourth of july, their independence day, it is just gruesome. there is a famous nightclub along here that turned into a triage center. i tried to go inside but it is all barricaded. a lot of these cafés and restaurants shelter people, some have been overturned, they have got to clean up on top of the injuries and deaths. there has been so much psychological trauma for people who did not know what was going on or if they were going to fall into the crosshairs of this attack especially given there have been other coordinated attacks in france. people were frightened, wondering who was involved on the loose. the mayhem, some injuries were

called by people running over each other and reports of babies getting swung over the barricade to avoid getting hit by that truck. there are 50 children treated in hospitals, we don't know how many children died in the attack last night. the streets are packed with people, some on vacation, not wanting to stay in their hotel room, wanting to see what the scene looks like, people are dazed, horrified and saddened and traumatized and wondering what it is going to take for this to end because it seems there has been an uptick in these sorts of attacks in the last couple years. since 2012, there have been 12 terror attacks in the eu, 7 of them in france. nicole: that is right on point,

a state of emergency has been extended in france after this attack. security that is in place. >> there were 12,000 police and army deployed after the attack in november of last year and president françois hollande said he would up that number, hard to know where all the manpower will come from, but extending this state of emergency, police extending powers, placing people under house arrest outside the normal legal process. in any democratic country that becomes very controversial but it is necessary. another burning issue is the number of people who slipped through the cracks of intelligence, the driver of the truck was on radar but not for terrorism but petty crime. they will be looking at ways to control the situation and keep a

have to wage the war and waited smartly. not very smart with her policy, if we can check them before we let them in, coming from syria, this doesn't make sense, tightening this concept down and the whole procedure down in order to save our country from similar acts, do a much better job at protecting these events but what is frightening with conventions coming up in cleveland and philadelphia there will be heightened security just looking for things like this. when you see something like the horrible crimes these barbarians committed upon us. >> the question for a lot of people is what would stop something like this from

happening in new york city when we have crowded places, you worked in new york city and i have the benefit of working surveillance operations and we have strong surveillance, what can you tell us that might give people a little piece of mind in the united states and our major cities? >> what you deccaed out, heightened surveillance by law enforcement, intelligence agencies to have a handle on what is going on. it is difficult, the united states has done an extremely successful job with these terrorist attacks in the united states. we have another one? no doubt we will but hopefully not as large as this. what gives me a problem is how can you have a vehicle of this size go one full mile at

excessive speeds before you get this, the whole idea of the security is broken down in this case and carnage. maria: there were reports police were powerless in this case, they stopped him overall, the difference between president trump -- between trump and hillary clinton, you mentioned clinton is not strong enough, will trump be worried about that as we worry about terror? >> we report the problem and has a plan to do something about that. >> thank you. all politicians need to be thinking about this in this day and age we live in, horrific attacks around the world as we will keep you up-to-date on the latest terror attack out of nice, france. and look at market action we have been seeing to the downside, dow futures 11, s&p

they do say he is known to authorities, has a criminal record for petty theft and violence. he has not yet been named but what we do know is he did drive this truck at high speed very deliberately through those crowds over a mile clearly intending to kill as many as possible, what the french president describes as a terrorist attack, understood this driver was also armed and fired into the crowd according to some witnesses, he was shot dead by police and you see in the windows those bullet holes but there was a police presence and police were powerless to stop him charging through the crowd causing that carnage and france has been on high alert since the deadly attacks in paris last year. there will be questions asked as to why intelligence services were not prepared for this, why they couldn't have done more to prevent it but also questions about whether this man was

operating alone. this will all be part of the ongoing investigation. there were hundreds of people on the streets when this happened in france. they have been watching a fireworks display as part of the celebration, national celebrations in france and the scenes of panic and eyewitness accounts are horrifying, people caught up in this incident unable to escape, 84 dead, many of those are children, there are still many people critically injured in hospitals, two americans dead, one texan father and his young son. the french president is organizing a series of emergency security meetings, extended a state of emergency in the country and he will declare three days of national mourning. nicole: security beefed up around the globe especially at the rnc convention.

what are your thoughts on the modernization of nato and how that could prevent this type of attack. we don't even know who the perpetrator was. >> we don't know who he was directly but we know indirectly what he believed in. the idea that if we can have a war on drugs it seems simple we could have a war on terror and make a declaration of war whether as a standalone united states or as part of nato and that gives us the ability to attack the core of what is going on, go after the money, material their leadership regardless what role they play if you have a hand in this. >> many of us who serve in the military serving the global war on terror, you are calling for this to be declared, war to be declared by congress. >> absolutely, we have a broader scope of what we are able to do. the little boy fell into the ape

enclosure and the only thing that could happen is to put the ape down and that is where we are. at some point we have to kill the ape. nicole: breaking news, this 31-year-old french tunisian man reportedly driving this unmarked truck through the crowd killing 84, now authorities are searching his home. what are they looking for, how long will they search? >> as long as it takes to find the answer about money, materials, leadership, what tangible and intangible things drove him to do this whether it is inspired or directed, formal declaration of war would cover all of those things. >> a formal declaration of war. with that assist in government like ours being able to look at what people are doing online if they are being inspired or looking for ways to commit attacks, what would a declaration of war really do?

>> it answers the fact they declared war on us decades ago, gives us the ability to sit at the table to bring every aspect of what we do whether that is as you explored in intelligence whether it is human or electronic, it is legitimizing what is going on. the only people who haven't accepted that we are in a formal war is the leadership in the government. >> no claims of responsibility yet for this horrific terror attack, catherine herridge suggested it could be al qaeda rather than isis but this is unconfirmed. in the meantime security is being beefed up around the globe. how will they do that when these are all soft targets? everything is a target from a movie theater to a shopping mall to a school? >> you have to target the core

belief system and in doing that you can't harden every target because what is going to happen when you make those rings of securities you stand outside those rings but france will use café in the street or use the grocery store attack and it continues to be we need to eradicate the core belief system of what is driving, directed or inspired in a formal declaration of war, allows overt and covert aspects of our response. >> you talked about explaining human intelligence, exploiting intelligence that comes from phones and internet, i know as working as an intelligence operator it is difficult to get that information but there is a lot of information on people's phones, what they are looking at on the internet and we have a big discussion going on, privacy
