[closing bell rings] we'll wait to see if it is a record for s&p. it is too close. i will wait for melissa and david on "after the bell." david: we're following a lot of breaking news for you this hour. stocks are back in positive territory again. s&p 500 closing at new record high while the nasdaq ends at a new high for the year. i'm david asman. melissa: i'm melissa francis. this is "after the bell." we have you covered on the markets but first here is what else we have for you coming up this hour. developing details on the shooting rampage in munich, germany, police are now calling a suspected terror attack. we're getting reports that several people are dead and at large, at a large shopping mall and suspects are still at large.

public transportation has been halted as munich police urge citizens to find a safe place and acrowd public spaces still. we'll bring you latest on all of that. david: meanwhile markets didn't seem to be affected at all by the munich attack. dow back in the green. phil flynn, price business futures and fox news contributor. watching action in oil and gold from the cme. nicole petallides from the floor of the new york stock exchange. nicole, s&p 500 hitting a new record close. wasn't there any concern what was happening in munich? >> very interesting. traders were watching very closely, dave. they keep that in mind. just like the last terror attack we noticed that the markets decided to put aside worries and concerns. while they kept focused on it, they didn't see big gyrations in the market. s&p 500 closing at a record. it really is close. the number was 2173.02. it's a point above that level.

there is intraday chart. for the week all major averages are higher. we saw nasdaq in particular as best of the bunch. tech earnings have really been great. look at verizon and yahoo! as well. we know two of them have been working on potential deal. you can see verizon feigned -- gained 1%. verizon has emerged as internet business buyer -- for yahoo! chipolte, that to the upside as well as stanley black & decker. it is winning week on wall street. as you noted really notable for the nasdaq best of the year and s&p with a closing record. great to be with you, david and melissa. long time no see. melissa: absolutely, nicole. good to see you. oil sinking again today. ending the week down 4%. what do you expect for next week as traders set up for the next week?

>> it is very interesting close today because $44, like 62% retracement from the peak we saw two weeks ago. we were trying to assault the number all this week. we did get a report about u.s. rig counts. they actually rose by 15 last week. so we're seeing some of the rigs come back online of the most of those are in texas in the permian basin and those rigs are trying to replace other rigs. so that is the best spot in the world for shale oil production right now. the rest of the shale patch we actually lowered them. gold was down today, really concerns about the rising dollar. so you can't keep gold up when the dollar is soaring. back to you. melissa: all right, phil, thank you for that. david: well the dow ending a week of new highs in the green as s&p finishes the day with a new record close after yesterday's down market. let's bring in today's market panel.

jack hough from "barron's" and monica meta. i have to go back to munich. in a way bothers me the market didn't react at all to what happened in munich. i'm wonder having markets grown a accustomed to terror? >> think i they have. i think this market has entered a perverse cycle where bad news keeps people rolling into u.s. stocks. if we're worried make interest rates stay lower for longer and people have fewer alternatives. they continue to have to chase after dividends. certainly not great earnings driving people into stocks. certainly not modest valuations. david: it is not great earnings, monica, but on the other hand other people say the earnings recession we heard about over the past few quarters is over. what do you think? i don't know what the long-term outlook is. i think earnings have definitely been surprising to the upside. that is good news. i appreciate comments both of you made which is, it is a

little bit odd markets are becoming insensitive to all the terror attacks. there are a lot of reasons to believe there could be a hiccup down the road at any moment that creates a lot of volatility. so i think that is not an optimistic point as you look at trading and investing. david: all right. >> let me point out, david, about 2/3 of companies reporting so far beaten estimates. david: yeah. >> that happens every quarter. if you want something estimated too low, call wall street analyst. they do it every quarter. david: i get you, jack, but are folks beginning to spend a little more, jack? >> i think the economy itself is okay. i think consumer is all right, not great. there is not a lot of growth around to be found. housing market remains strong. that is a good sign. employment numbers are okay. but you don't have any growth on wall street. and you have share prices above -- david: monica, you don't have growth of new businesses either. that is a concern. that the banks still aren't lending money they used to. pa people aren't borrowing money

to expand their business or start a new one. that is an issue down the line, maybe folks are spending a little more because they have a bit more change in their pocket. but real growth isn't happening. >> sure. i think this decline in liquidity for small business and growth of business in general, small businesses and big businesses growing their product lines is a trend we've been seeing for years. i think people have become a little bit numb to that. you saw a little bit of a spike from people getting more money in their wallet from low gas prices. i think we've become immune to that in general as well. i think the u.s. remains a safest bet in kind of a volatile world. seeing from europe into emerging market and it is not a sign that things are great for economy. just we're better than other options. david: jack, monica, have a great weekend. thank you very much. melissa? >> thank you. melissa: story continues to develop on shooting attacks in munich, germany, that left at least six people did we know so far. cheryl casone has the latest details.

chairman, what can you tell us? >> melissa, we're learning a few new things. police confirm six are dead at the olympic mall, excuse me the olympic shopping center in center of munich. it's a two-level shopping mall. it has 135 stores. this happened four hours ago it began. 6:00 p.m. local time in munich. it is just after 10 p.m. all three suspects according to police are on the loose. also, want to say here there are two reports coming out of german newspapers that one of the suspects has killed himself or herself but we're still trying to confirm that. also police saying they're calling it a terrorist attack but to be clear, police are also saying there is no indication of islamic terror. why is this important? the police are confirming this? because several reports come in from europe, particular sky news, our partner out of london, these men were white and

speaking in unaccented german, meaning clear native german as a language at the mall. now, the attacks started at mcdonald's at shopping center. you could see video of people. there it is. people running, fleeing for their lives. but, indeed those six dead confirmed did happen at the mall. there were reports of gunfire in other parts of munich. those reports have been backed away from. german police did say these three attackers basically shorthand guns, long rifles. all of this is being translated into english as we report this today and tonight. munich is on lockdown still this is active suspect situation. this is one of the images we have. we want to say here highways around munich are being shut down in particular north of the city. so, how did these gunmen escape? all transit system has been shut down. there are reports maybe they

might have used transit system itself to escape from the mall after this attack, melissa. incredible and sad news coming out of munich. we'll keep you posted out of the newsroom. melissa: wow, cheryl, thank you for that. david: joining us chris harmer for the institute of the study of war. chris, too early to tell who is responsible. we just got word by the way there was a witness in the mcdonald's who heard the suspect shouting "allahu akbar!" despite the fact now we think they may have been germans upset by foreigners so who knows. however the m-o, the modus operandi of this particular attack seems to be soft target, economic target, isn't that something isis has called for? >> isis has called for that. i want to refer to your viewers, little odd the reaction to the west is so muted. one hand that is good. we don't want terrorists to dictate how we live our lives. we don't want to become

desensitized to the threat that we allow them free rein. shooters struck simultaneously in different points. that indicates fairly significant amount of tax call expertise. germany since 9/11 has really escaped any sort of islamic or fundamentalist terrorism. if you look at history of terrorism between world war i and world war ii, it was active terrorist zone between all the communists, nazis fascists. david: it is rather ironic this is taking place in the olympic mall or olympic shopping center because it was 1972 we all remember the munich olympics. that was huge terrorist attack. one of the biggest before the era of al qaeda. >> if you look at history say from early 1960s through the end of the cold war through the berlin war falling, germany was ground zero for terrorism. david: palestinians, you name it. >> everybody was going to work there. there was a lot of communists, red army brigade, palestinian

separatist groups. this is not uncommon for germany. uncommon in the 9/11 sense. whoever did this clearly had coordination, tripping, tactical expertise. david: very quick last word, usually when there is terrorist attack president talks about gun control. gun control in germany is more stringent than anything we have in the united states. correct? >> gun control has nothing to do with it. isis will take it no matter what. if earthquake and san francisco fell into the pacific ocean they would claim credit. got to discount their claims. david: thank you. melissa. melissa: show you live look at united nations an newly appointed british foreign secretary boris johnson is set to make a statement any minute. it is his first official visit to the u.s. in his new role. johnson of course, you remember he has been very critical

david: monitoring reports coming in on horrific situation in munich this is what hillary clinton said about it. we stand with our friends in germany as they work to bring those responsible to justice. we're expecting hillary clinton to take the stage in tampa any moment. melissa? melissa: trump kicking off general election campaign. the republican presidential nominee faring well to cleveland and slamming bitter rival ted cruz. why not. peter barnes with the latest on this one. wow, quite a week, huh, peter? how do we cap it off here? reporter: boy it has, boy did donald trump leave cleveland, it

with some interesting comments. let's get to them. he was reading, thanking his supporters and volunteers at the westin hotel right down the street and for nearly an hour he was unscripted. no teleprompter. guess what's back? lyin' ted cruz, trump's nickname from the senator for the primaries. trump spent more time bashing cruz, in fact, than attacking hillary clinton for cruz's speech to the republican delegates at convention on wednesday. and as you know, cruz did not endorse trump during that speech and for that, trump said, this morning that cruz broke his promise, broke his pledge to support the party nominee. >> i like ted, he is fine. again, i don't want his endorsement. if he gives it i will not accept it, just so you understand. i will not accept it. [cheering] won't matter. honestly he should have done it

because nobody cares and he would have been in better shape for four years from now -- i don't see him winning anyway, frankly. reporter: trump went on to accuse, cruz of lying about some other matters and then, trump left town to go back to new york. he will take a break over the weaken and renew, start his general election campaign on monday as the democrats get underway in philadelphia. as for cruz, no comment from him today via twitter, rather or any other medium. back to you, melissa. melissa: pence is like a straight man back there. like ed mcmahon. smiling, laughing. think about that next time you see them. peter. appreciate it. david. david: joining me to talk about this but also to talk about the terror attack over in munich, governor mike huckabee. former governor of arkansas and former presidential candidate and also fox news contributor. governor, first of all, newt gingrich, we have been mentioning how the market barely

moved on the news of this terror attack in munich. the question whether we've become accustomed to this sort of thing. newt gingrich spoke to this point very eloquently at the convention. let's play the sound bite and get your reaction. >> we can not let ourselves grow numb to these accumulating atrocities. let's be clear. donald trump is right. we're at war with radical islamists and we are losing the war and we must change course to win the war. david: isn't there a danger, governor, we've already become a little numb to these terror attacks? >> oh i think we have become numb. let's face it, it doesn't mean just terror attacks but anything that happens over and over no longer is breaking news, it is routine. so even if it is man bites dog it is an unusual story, we report it. but if every three hours somebody bite as dog and that happens every day we just don't react to it anymore. that is really a sad commentary what is happening across the

globe, david. people just are saying, another one? okay. well, gee, where is it going to be next time? david: it really pinpoints what governments are there for. we think they're there to provide support, for health care, for this, for that, cradle to grave support, but they're there for safety. this is something donald trump spoke to last night in his speech. let me play the sound bite and get your reaction. >> the most basic duty of government is to defend the lives of its own citizens. any government that fails to do so is a government unworthy to lead. david: governor, we don't mow who is responsible for the terror attack but angela merkel is the one who brought this flood of million refugees a year over to germany. whether it's one of refugees or somebody reacting to the refugees, isn't the finger, the blame to be pointed at her? >> well, i think there is a role there. look, two things. number one, she has been all

about open borders and, sure, a million can come in, two million, why not. heck, the more the merrier. it is not very merry right now. the second thing like a lot of european nations they love to beat up on america because we let citizens arm themselves and defend themselves. they don't typically do that in europe. for all the talk about how dangerous it is to be in america, doesn't look all that safe in europe right now. whether it is nice or brussels or, what we've seen twice in the last two weeks in germany. so spare us the lectures, europe. spare russ the lectures. i want to say one thing. you were dead on when you talk about the protection issue because the purpose of government is not to provide for us. it is to protect us so we will be free and have liberty so we can provide for ourselves. david: good place to end it. governor huckabee, thank you very much, sir. have a wonderful weekend. good to see you. >> you too, david. thanks.

s. melissa: newly appointed british foreign secretary boris johnson making his first official visit to the u.s. in this new role speaking to the united nations. he just mentioned the shooting in munich saying there is a global sickness of terror around the world and we must tackle radicalization and extremism globally. johnson also noted that he spoke with u.n. secretary-general

about the crises in syria and throughout the middle east. johnson has been critical of donald trump's recent statements on nato. here is what he just said about the presidential race of the listen. >> it would be quite wrong of me to get involved in american politics or to, or to venture an opinion on the domestic election taking place here. it goes without saying we in the uk government will work with whoever is elected but i would draw a very, very strong contrast between "brexit" and any kind of isolationism. on the contrary. that is whole one of the reasons coming here, one of the message i want to get out here, "brexit" means we're more engaged, more energetic and more enthusiastic and committed on world stage than ever before. i -- david: that man, you might have been the prime minister of england but he kind of pulled himself out of that race.

we'll fix adam's mic. get back to him as soon as we get that established. melissa: let's go to kneel sorka, democracy of america communications director and losses a chief of staff for senator joe manchin. let me start with you. i don't know if you saw the list of contenders we think are vying for list of spot of vp a lot of people thinking senator tim kaine is the most likely but not everybody on the left is loving that idea. >> yeah. melissa: so you agree. tell me why you're not loving that? >> given his stance on the job-killing trans-pacific partnership, he voted for fast track authority for it this spring and more recently a letter that he wrote suggesting that he supports certain amount of bank deregulation. i think gives a lot of folks on the left real pause because at the end of the day what dfa is focused on uniting bernie sanders political revolution and the democratic political

establishment. melissa: right. >> the way we're going to do that not with a candidate like tim kaine unfortunately. melissa: chris, it does seem like he is literally the worst candidate out there to bring over the bernie sanders folks. in a lot of ways he is doubling down on the things that hillary clinton is known for and one of them has to do with nafta and trade that is going on, that you know, donald trump is running very much against and also the close ties to wall street and deregulation of wall street. isn't that a concern? >> i think it is going to be a concern for some on the left, i think there is no question about that. if you look at senator kaine's record in fairness to him, he is strong supporter of labor and strong supporter of women's rights. the notion somehow he is right-wing conservative democrat, that is not reality. now his positions on tpp, that is -- melissa: not that he is right-wing. he is very similar to hillary clinton. so he kind of offers almost

exactly what she has already. what do you think is the additive value of someone like him? >> i think they see him as someone who is ready to come in, god forbid, something would happen to her if she is president. i think that is the primary reason. that being said, that being said what i will say is, with any vp, short of somebody who is really well-known, they're going to go out there and aggressively introduce him not only to the base and also to the country in terms of what he stands for. that is always a challenge for any campaign. melissa: neil, he has idea that he would bring in white men and especially, especially people focused on labor. this is the group donald trump is picking off. >> so a few things. number one let me just say i think tim kaine is good and decent man. i had opportunity to meet him. i think he is a nice guy. i don't think he is the right candidate for this moment in 2016 this will be a base election at end of the day. who can get out largest amount

of their base in the general election. melissa: that's a great point. >> tim kaine will just make that job a little harder. we'll still farther as hard as we possibly can to defeat billionaire bigot donald trump. this will make it more challenging if she decides to choose him. melissa: i wishing we had time to drill the little nugget you got on at end. alas, we have to let it go. thanks for joining us. i'm sure everyone on twitter will take care of that. david: b and b. deadly attack in germany. we're following it very closely. at least six people dead after a shooting at a shopping center in munich. authorities now calling a suspected terror attack. that is what they're saying, not saying who but terrorism. new details on the horrific attack coming next. melissa: plus a big nod to cleveland law enforcement for a peaceful gop converges. we're going to talk to detective steve loomis, president of the cleveland police patrolmans association about the successful security practices. that's coming up.

david: another look at where the market ended the day. dew not setting record. the s&p 500 at brand new record he despite everything going on in the world. go figure. melissa? melissa: we're following the latest from the munich terror attacks. we're now hearing that the death toll has risen to eight. cheryl casone is in the newsroom with the latest on these attacks

in munich. cheryl, what are you hearing? >> we just got the tweet coming out munich police. they have been very active on social media, keeping everyone up-to-date here. eight can firmed dead right now. german special forces think of it, navy seals on way into munich. many highways have been shut down. at this point police are looking for three shooters. there was pictures of them that munich police and several witnesses put on social media showing the shooters with shorthand guns, basically like a short rifle. we learned munich is declared itself under state of emergency. we used the word lockdown earlier. that is now official coming from munich authorities. also, just to give you an update now, it is about 10:30, just after 10:30 in munich. it is now dark as you can see. the streets are empty. that is for a reason because they are looking for these shooters.

as far as who these people are, still we're going with what police have been telling us. police say, and i quote, no indication of islamic terror. that is a quote from munich police. also they're treating it as a terrorist attack, a terrorist situation but no indication of islamic terror. also, the images that we're starting to see of people fleeing the olympic shopping center, this is just after noon eastern time. so about four 1/2 hours ago are just incredible. this happened at a mcdonald's at the olympic shopping center where the shooters began to open fire again. witnesses are saying that they saw several victims on the floor. what we don't know yet, is how much they have been able to go inside of the mall and start to retrieve the bodies. also, dpa news agency saying they do expect multiple dead. so the death toll right now is at eight. earlier reports put it at 15. there is a chance, guys this

death toll could rise next couple of hours. munich police are focusing on activity at hand, which is finding, finding these attackers. we'll keep you posted as we learn more, developing every moment. back to you. melissa: thank you for that reporting, cheryl. david? david: on to some good news on law and order front, a job very well-done in cleveland, despite earlier concerns about the protests and all the unrest the city set a high bar for safe political convention. donald trump praising cleveland police and unified republican party. listen? >> this is probably one of the most peaceful, one of the most beautiful, one of the most love-filled conventions in the history of conventions. [applause] when they talk about unity, i tell you, that was unity. that was unity, right? david: here now detective steve loomis, president of the cleveland police patrolmans association.

detective, congratulations sir. high praise, everybody from donald trump and reporters on the ground couldn't believe how well you handled all these potentially volatile situations. what did you tell your officers to do before they went into the streets? >> talk to everybody like you're talking to your grandmother, initially. that is it. if you talk to people and you forge a line of communication, the sky is the limit as to what you can accomplish. so. that is the marching orders for me. david: wow. >> chief had a lot of marching orders. i can't be prouder of men and women from the cleveland police department. chief williams did a fantastic job. chief ed tomba he. he was in charge of operations. he did a fantastic job. men and women from the state police and other police agencies from across the country came here and were awe-struck at the response from the citizens, the response from protesters.

and we did. we set the bar very, very high. david: you set the bar and you have created in a sense a model for how to do it in other things like the convention coming up, for example. one thing i noticed was the use of bicycles. you used these cops on bicycles to separate the two sides which seemed like unintimidating way to do it. >> absolutely. a great model. our partners in seattle washington, came down and trained our guys up very quickly on the bicycles. those guys have been riding those bikes only for couple months. you couldn't tell. they were absolutely essential. the horses were, you know, fort worth came with their 10-gallon hats on and people loved it. and we loved it. david: that's great. detective i have to get to the democratic convention which of course is coming up on monday. i'm just wondering with what is happening in munich, again we don't know what's, exactly who is behind that, but there are

a republican convention. a lot of people said finally, thank goodness. for donald trump to reach out and say lgbtq when that wasn't included in the platform and people made that note when he went off script to do that, seemed inclusive. what is your reaction. >> look, i agree. the gop had to change or else the gop was going to die. trump is kind of leading the charge in that way. harping on things like traditional marriage, the sanctity of life, that will not broaden the republican tent. trump is kind of shifting the focus of the party to things like protecting mention from terrorism and bringing jobs back. even lgbt right. that would have been unheard of at an rnc just four years ago. by shifting the tone, trump is making the gop more palatable to other groups like the lgbt community. i thought it was a beautiful moment when he thanked the audience. melissa: hang on.

we want brad to get in here before we run out of time. i'm not sure we want to lump the sanctity of life into that conversation we just had there, because i think that is in a different group. that is obviously major tint pole of the republican party. one step at a time. that is closely-held belief. brad, what was reaction last night and was it a bridge too far and did it violate a lot of basic tenets of people in the republican party? >> the republicans like to think we live in a a teepee but we live in a big tent. i was proud of the lineup that showed the breath and scope of our party. you can be a member of rnc. you can be a member of the local republican club and not believe in every part of the platform. that is part of being a republican. part of the platforms i disagree with.

had up chanting, it seemed trump was trying to steer the crowd away from lock her up to defeat her but does she answer that at all? >> i was advising her i would say no. the reality, these conventions end up being, you're kind of like serving red meat to the base. there is i think one perspective, this will be a base collection. that is i think to large extent true but there is a significant block of voters that have serious concerns about both these candidates. to me if i was advising secretary clinton, that is the folks you want to speak to. donald trump's negatives are at 65, 67%. you will not get him to 100. focus on, focus on getting a positive message out, issues you will make the country for. make the contrast but don't get into petty games. david: brad, at the sail time as chris himself said you want to feed your delegates meat. face it, that is what happens at conventions.
