a knife, injured four people on a train and eventually shot dead by police, and then a syrian refugee kills a woman with a machete, injuries two others. and now, a syrian asylum seeker has killed himself and injured 12 others, blew himself up. he was trying to get to a music festival, ashley. ashley: he was, this was in southern germany and refused entry and this 27-year-old who was facing deportation, by the way to bulgaria, he had been refused asylum privileges and blew himself up. there were 12 people injured, of course, he killed himself. what's interesting about the outcome from this, stuart, is that the mayor of munich is now calling for a ban of backpacks for oktoberfest, there's a huge concern now about oktoberfest, which will kick off later, obviously, in the fall. and an mp in angela merkel's party to call, let's regain control of our own borders, our own party. angela merkel coming under pressure.

stuart: look at that the bottom of the screen, migrant crisis: europe lost. they got it right. the markets coming off the fourth straight week of gains. it's monday morning with a chaotic news selloff. a rollback of the recent highs and slightly higher opening for the dow and ever so slightly lower for the nasdaq. i call it flat. how about the price of oil, $43 a barrel, that's a story. oil directing further and further away from that $50 mark that it hit last month. that's why gas keeps falling. gas prices dropping to a 12-year low for the month of july. that's driving season, of course. i paid a buck 80 in huge this weekend. big deal got to tell you about it, verizon buying yahoo! for about $5 billion. there's a back story here, liz, marissa mayer is going to walk away with how much liz: more than 55 million

clintons, but it's amazing to watch it unfold here as the democrats are trying to come together and show party unity. stuart: you know, charles, our judgment on the republicans last week was that they emerged and it's not the republican party of your father or your brand father. now, we go into the democrats' convention and i think it is the party of your dad and your granddad. not in terms of policy, they're socialists, but in terms of the leadership. it's the same old-same old, it's your dad's party. >> i think that's a very shrewd observation and the other thing, obviously, the media went bananas, over the doom and gloom of donald trump's speech and there was a lot of doom and gloom there, but the truth of the matter is apparently that doom and gloom raised a lot of doubts in americans. and what we're seeing in the polls, donald trump has a healthy bump out of there and it will be interesting to see whether hillary clinton the democrat can somehow sort of try to take back the momentum

the latest. ashley: yeah, all very confused at this point, but we know two dead and 14 injured. the ages of the injured ranged from 12 to 27. this was billed as a swimsuit glow party for middle school and high school kids. but there was no i.d. required. it was kind of an open kind of a celebration, if you like, a school celebration. the shooting broke out as the nightclub was closing down and parents were showing up to pick up their kids. stuart: oh. ashley: so we don't know motives, we know that three people are being detained by police. stuart: real fast, tammy. after this, are we going to hear more about gun control at the convention, the democrats? >> yes, even before this. bloom berg says he's going to be speaking same night as joe biden. and bloomberg endorsed in 2012. and it's important people will

understand the difference between the two parties again. stuart: thank you very much. let's get back to the market. it's monday morning, we've got 15 minutes before we start the trading session and we're going to be slightly lower on the s&p 500, i'm going to call that dead flat frankly. how about individual stocks which will move, kimberly clark, the kleenex people and huggie's diapers, they'll be down slightly, theirs has been hurt by the strong dollar. it's not your father's party. and in terms of policy it's not your father's democrat party either. they've gone socialist is my opinion. and art laffer is here. and bernie sanders has done the heavy lifting here, they're a socialist party and i don't think they can come back in the next three and a half months to become a centrist party in terms of policy? >> just so you know i'm a democrat from the '60s.

i'm a kennedy democrat, pro growth, all the stuff that jack kennedy stood for and bill clinton, i supported and voted for bill clinton twice. i thought he was very aggressive on tax rate reduction, bringing prosperity back to the country and cutting government spending as a share of gdp and this is not either of those party. this is the antithesis, the party of stagnation and it's sad and i think that trump has finally brought the republicans into being pro growth, i hope, i hope, i hope. stuart: do you think this has got a lot of to do with income inequality. let's be honest, there is income inequality here we've known it for a long, long time. maybe the gap is getting wider. is that what's pushing the democrats left? >> i don't think it's pushing. i think it's opportunistic. what you're always going to have, stuart, one side and then the other side having to have differences otherwise you don't have a political contest and you know, one of the ones is income distribution and those

two views have been battling from time immemorial and this time it happens the republicans are pro growth and democrats are redistribution. stuart: we keep coming back to this. every time you and i get together on television, we talk about growth. i don't think the democrats have a program of growth. if their policies are put into effect, i don't think you have serious growth. but the trump-- >> and you get negative growth and the thing is, this is the time and place where growth is needed. yes, income redistribution is important and should be considered in all of these things, but now is the time to make sure that people have good, high paying jobs other than checks, and that's what is needed. stuart: will you stay there? in about 15 minutes the market opens and i want your commentary, are we going to get to 19,000 on the dow this week? save your answer, please. art laffer, see you soon. for you, 98 at the open today and they report their profits late tomorrow so not much, obviously, impacted today. we do have more subscribers, better sales at sprint and they will be opening higher. about 20 cents higher and in percentage terms, that's not bad. a member of the president's family says he's voting for trump. malik obama, the half brother of the president is coming back here to vote for donald trump. tammy, why is he coming here to vote for trump? >> and there are several reasons, one of the reasons he's upset that obama and hillary clinton killed his friend gadhafi. and he has a different point of view about the difference of marriage. he seems to be a confused person, but says he likes the positivity of mr. trump and how he's looking forward, but this is a fellow who is, i think, rather odd from the start. stuart: that would be true.

stuart: you know, for weeks in a row when the dow jones industrial average went straight up. four weeks in a row. closeout friday at 18,507. only starting to become in the question is ever going to hold those gains with the chaotic news background of politics and terror overseas. if we go higher, why? the answer to the question is in about 25 seconds will see the market over pretty much flat.

i've not read these e-mails, but i am told that some reporters, some journalists and media people were submitting stories to the need for approval to see if they are in the right track. has that happened? >> this one instance with the reporter named ken vogel submitting a story through the dnc official ricer agreement to get his dots on the complicated campaign finance story. i talked to a political executive denis says it was a chance to allow the dnc to comment and that this is not the normal this for this bullet to kill a reporter. some of these e-mails show a cozy relationship with anyone criticizing or the party. it's almost like they expect a positive coverage. stuart: fascinating stuff.

their stock prices down, what, two percentage points, something like that, and that's hurting the overall market as well. now, the democratic national committee will have a massive chain link barrier to protect their convention from protesters. i'm going to call it a wall. how big is it? >> huge wall. >> yes, the beautiful dnc border wall. it's a four-mile, 8-foot-hyphens, acres and acres surrounding the wells fargo center, that's the philly convention site for the dnc. this as thousands of pro-sanders supporters hitting the streets, they are fired up after the wikileaks disclosure basically indicating bernie sanders was iced out. so that fence has been put up. stuart: you know, you're right, liz, i should have asked joseph andrew who's a former dnc chair, i should have asked him, what about these protesters who are saying i'm not going to vote for hillary? be they're out on the streets

missouri, last year. allegedly he'd been attacking a cop, but he was shot. the mother, that lady right there, will be speaking at the dnc tomorrow night. jonna caldwell, republican strategist, joins us now. why did the democrats invite the mother of a victim of police activity, so to speak, but nobody was invited to represent those dead police officers at the convention? why not? >> first off, thank you for having me. i know this is an attempt by the democrats to do what they do best, paneledder to african-americans. they wanted to appeal, and they did not want to invite any police officers because in a lot of ways when we hear the rhetoric either from president obama, hillary clinton or anyone else, it is anti-cop, it's anti-police. further, and since this is a black issue and they want to appeal to african-americans, i found it to be very interesting with this wikileaks scandal that we saw that debbie wasserman-schultz and the democratic party were actively, actively looking to tear down a man in bernie sanders who has had a career of being supportive of african-americans and

african-american causes. we saw him at the university of chicago being chained to a black lady protesting for civil rights, and the democratic party, they want to pander and get the support because black lives don't matter, it's black votes that matter to them. they want to continue to get that support but not advance the agenda of somebody like bernie sanders who actually cared about african-americans. stuart: you know, you've used the word pander four times in the last 45 seconds. that's a very, very strong word. >> very strong. stuart: it's almost racial in its nature. you're pandering to the african-american vote, you're kidding them along. that's strong stuff. >> it is strong stuff, but we need to call this what it is, and it really disappoints me, it's really discouraging, the fact that there's a whole community of people who are not seeing this for what this is. i mean, even the bernie sanders folks, like some of the really hard core folks 15 minutes ago on fox news channel, they interviewed a lady who said i'm

disappointed about the wikileaks situation, and i'm going to vote for whatever hurts hillary clinton the most. the thing she's represented, the policies she's advocated for time and time again has been draconian to the african-american community, and we have to wake up and smell the coffee. because they've got plenty of cream and sugar, but it's the really not -- [laughter] stuart: that's good. okay. look, 90% of the african-american vote goes to democrats, and that's been true certainly the last two presidential elections. >> yeah. stuart: why are you bucking the trend? your a young -- you're a young black man. why are you a republican? >> well, for a number of reasons, one of which i grew up in a very religious family, and the republican party's all about protecting the rights and religious liberties and freedoms of those individuals. and that's something that's very, very big, being a christian. even being on your air right now, i know i couldn't be here if it wasn't for god's favor that placed me here. i acknowledge that. additionally, even if you don't like the republican party, you

journalists involved here. miss brazil, the lady who has taken over as chairman of the dnc, she's mentioned in these e-mails as well. it's not over. >> no. and debbie wasserman schultz has not had a problem-free career. i mean, they have wanted her -- various factions, including hillary at one point, wanted her out several years ago. she was co-chair of hillary's campaign, and in the final stretches went behind her back secretly to obama and said i'm in if you want me. so, you know, she's a very -- she's viewed as being very self-promotional, very tied up in her own career. stuart: she's now become the honorary chair of hillary's campaign. >> and i would say that is -- >> she has always credentials that she likes.
