8:00 pm
>> they didn't like it at all. but the bottom line is this. there is not a headline out there that is not about donald trump talking about hillary clinton's emails. that's the conversation. lou: it wouldn't have been if donald trump had not held that news conference this morning and says what the clinton camp considered outrageous statements. if he hadn't made those remarks, it still would not be. >> what's outrageous are the facts as described by the f.b.i. director james comey himself. hillary clinton and her team put together an stun secured server that was potentially hacked by some foreign born or domestic agent.
8:01 pm
lou: do you spoas suppose that gave hillary's campaign manager the idea to injects russians into this? >> they have to blame somebody. they can never be accountable it can never be their own bad judgment that leads to something like this to occur. even the dnc, the wikileaks emails, that was on their own server. so clearly there are i.t. issues with the democratic party. lou: there are issues of principle and ethics and legality and honesty on the part of the dnc. we watched a thousand bernie sanders youporters walk out of this convention hall because they had been betrayed by the democratic national committee. >> that's right. elizabeth warren was talking about the system being rigged against people. but what they are saying is it's rigged against the democrats.

8:04 pm
the democratic party, the dnc, and hillary clinton, the party's nominee, they are colluding. lou: is there a movement within the republican party to pardon julian assange based on the emails he leaked? >> not to my awareness. i'm not breaking news on that right now. you mentioned jill stein, the green party candidate. she stepped in to lead the bernie sanders movement as bernie sanders stepped out. he has been on this floor twice calling for unity. he detached himself from a movement that's going. lou: you used the word unity. i don't know if that's a serviceable word. he was calling for quite and calm. and there is not that -- i don't see that energy for unity, and i don't see resolution in the fissures that occurred in philadelphia the past three days.

lou: prosecutors today, as we return to the wells fargo center arena, night three of the democratic national convention -- prosecutors dropping all remaining charges against three baltimore police officers. last of those accused in the arrest and death of freddie gray. the decision follows the acquittals of three other officers and puts an end to this case brought by baltimore state southern marilyn mosby. freddie gray's death fueled the black lives matter. mosby remains defiant. she blames police investigators. >> we do not believe freddie gray killed himself. we stand by the medical examiner's determination that freddy grape death was a homicide.
8:13 pm
lou: donald trump responding to that news, blasting mosby during his press conference. >> i think she ought to prosecute herself. i think it was disgraceful what she did and the way she did it at the news conference where they were guilty before anyone even knew the facts. lou: joining us is juan williams, co-host of "the five" and mark simone, american radio talk personality and great american himself, great to have you with us, mark. let's turn to this case. i mean, zero percent. >> there is no way you can justify it at this point. mosby said today, the coroner said that this was homicide. the question is on what basis?
8:14 pm
obviously of what that basis was is not persuasive to the judge who threw out the previous three and now these three have been dismissed. what you see here is the politicalization of the death of freddie gray. first by miss mosby, and then by donald trump saying the police were right all along. you still have a dead young man and somebody should explain. lou: mark, there is something to be explained here. who should be doing it and what are your thoughts? >> i thought trump had an excellent point, the prosecutor is incompetent. look at the results. it was a trial by a june, not a jury. it's cold, hard facts. maybe she overcharged the guy. he was in the back of the van alone. so whatever happened had to be accidental. it might have been manslaughter.
8:15 pm
the mayor of baltimore in the crisis, the prosecutor is a bumbler. i feel bad for baltimore. lou: you were trying to mark up an acquittal. i have great confidence in the legal system. mosby, people on the left and the right believe she got way ahead herself. so emotions of the moment. but she was not alone. the mayor of baltimore, i mean, the city -- it leadership was disgraceful. >> way too emotion. she should recuse herself if she can't be objective. lou: baltimore didn't come out of this well. >> the rioting damaged community and business.
8:16 pm
there is no way to say that's good. emotion overcoming common sense, but the emotion is tied into what i believe is a legitimate grievance where you see black people feeling we are more often subject to violence or unjustified use of force by the police in this country. and i think then the young people, they are the ones who began the rioting. lou: that's a narrative that's dissipating quickly. it's taken much too long for it to do so. one of the latest stut studies shows there is no difference in the way in which law enforcement is treating people in this country. in terms of a constant here, the narrative of grievance is overwhelming. the simple fact. baltimore had a black police department leader.prosecutors.
8:17 pm
had a black mayor. and for there to be a grievance, there is no accountability. these people in positions of leadership it seems to me, juan, they should be held accountable to their community. the community wants to reach out to someone else. but the fact is right there in front of them, the power structure of baltimore, it's been democratic for 50 years. >> they had a real problem with leadership. but just as we want to hold the political leadership accountable. i think you should hold the police accountable. lou: the police have been held accountable. >> how were they held accountable? lou: they were arrested. >> there i a deeper more systematic issue of how police relate to poor blacks. lou: mark, get in here, juan is

8:19 pm
lou: it' unfortunate will be tragic surrounding the death of freddie gray, but the exoneration and the legal proceeding of all six officers charged in that incident, this is a divide between the democratic party and republican party it's a divide we have to recognize. it's a time for all people, and i love one word that reaches across all community. that's respect. >> if we do not understand the importance of all of our community and all ethnicities and races, you have got to respect law enforcement first and foremost. in each of these instances, it is a gun involved. especially in baltimore or

washington. yuan we just had a case in st. paul where a guy had a gun on him. he told the officer he had a gun and the guy shot him. i appreciated what you said in the sense republicans and democrats -- they are taking sides on an issue that does require respect. and looking at a black lives matter demonstrating here. black lives matter is effectively a hate group. it's discriminatory by its very name. what do you think, mark? >> if you want to do something about this problem, clean up these cities. what do they all have in common, chicago, baltimore, detroit. it's one party rule and it's often democratic party rule. they have not been good at cleaning up these cities. >> i don't have any argument with you or lou on that point.
8:21 pm
we have seen especially in baltimore poor quality leadership. but when it comes to black lives matter, in addition to white lives and upper income lives matter, black lives matter. lou: shorthand is not applicable in discussions of black and white. this country always celebrated a fundamental value, the value of life. and that means all lives, all americans. and i wouldn't tolerate something called white lives matter. >> you are not a minority. lou: i think we are. i will be part of the minority or majority as long as i'm an american. that should be the attitude of everyone.
8:22 pm
>> i think there is statistical evidence if you are black and unarmed, the police use force, the idea of black lives matter is to say -- i'll show you a "washington post" analysis. lou: i will show you a harvard study. >> the harvard study [inaudible] i'm telling you i think black lives matter is being undercut by saying all lives matter. lou: it ought to be undercut by office holders of local, state, federal, county who are leading and working for the people they represent. there should be no me for something called black lives matter. >> what happens when you have an inequity. lou: if there is a need in 2016. what the heck have we done the past 50 years in this country and we are talking about democratic rule.
8:23 pm
>> despite the progress we made on race relations, if you live in a poor or his andic community, education, healthcare, housing, we have problems. >> i think this is the saddest thing of the obama 8 years. he was uniquely qualified to deal with all of these tensions and did nothing to make them better. lou: we got a little sidetracked. by the many fundamental in the political decisions we have to make as a country between democrats and republicans. because i passionately believe that we have watched wasted time, money and lives in cities where so much more should have been done. i'm saying that as somebody who worked at a poverty program as a young man. it's disgraceful.
