some pull stein at 3.5%. that's 10 times what she got in 2012 and she ran as a green and oath contained to grow. in utah is as a three-point race according to congress data. johnson is three points behind donald trump at one point behind hillary clinton but what does that mean? if enough people flirt with the idea of a libertarian or green president in these candidates get 15% in five national polls they can be on the presidential debate stage and all bets are off. they would do a far better job at holding hillary speak to the fire than any milquetoast moderate or because they are bound to their respective ideologies and like the waffling heads of any major party paid the conventions left a lot of you feeling as empty as bill clinton's lofty and goats. he would bring back marijuana legalization in the constitution , i'm with him. on the show judge angela pollard napolitano joins me to talk about what hillary lied about

libertarians out there. gary johnson isn't quite the candidate we want him to be. we are projecting an awful lot onto him. this may not be there not be there but he's really our best hope in many ways. mitt romney is flirting with the idea of endorsing the former republican governor. could you vote for the same person that romney votes for? >> theoretically i could if mitt romney had a come to jesus, no pun intended but look at the libertarian party has attracted traditional republicans to me that's a sign they are going in the wrong direction but i like the idea boquet gary johnson is up to 77% in 7% and maybe if he gives to 15% he could get into the debates but then what? we have a libertarian guide rand paul the debates against rand paul and what did that do? but next question would be would be going to do if you do get on the debates? what positions are you going to own. rand paul had a deeper understanding of libertarian philosophy than gary johnson.

kennedy: what i would say about your term attracting too many republicans i think libertarianism is like a snobby restaurant filled with a bunch of foodies which is fine. i am a foodie but everyone out there starving and you can't fault them because they have got nothing to be and they want a case. they may not appreciate the depth of your culinary skills. >> i love your analogy. that's so good. the democrats right now, they hate jill stein. they are completely trying to suppress her. i would say they have more vitriolic for jill stein and i thought -- saw first-hand the republicans do. >> it's funny because i barely hear her name mentioned that i'd like jill stein. >> they are completely suppressing her and your friends on the left are not giving her her. >> they are however giving more to gary.

kennedy: they think kerry will pull votes away from donald trump. >> if you look at houthi pulse of shape that gary is pulling more votes away from hillary clinton and i think that may continue. gary is a cool guy. i've known for years and liked them a lot and love that he was standing on the train platform to catch the train with his knapsack on. he is an every man. if william well was at the top. kennedy: you can back me up on this he would have never got the libertarian party nomination. >> every time they talk to william well they think he's running with gary. if you want someone who supported the war in iraq some of the light kasich is who he endorsed at the beginning of the beginning of what you vote for hillary clinton? what is the difference between hillary clinton's policies and william wells well's policies of george w. bush's policies? they are exactly the same.

>> well supports marijuana. kennedy: if they get enough support there could be for people on the stage. is that a good thing for these presidential debates? >> yes, think so. a lot of people are going to tune and a lot of viewers and voters possibly people who think they only have two options. it's crazy that voters think they only have to and i understand the sentiment. if i vote -- vote for a third-party who will it help than what party will it help? will it help? would help hillary are what helped trump? i really do think of all these people are unhappy with hillary and trump were to vote for a third-party to vote for johnson he could actually pull ahead. unfortunately i don't think that's reality. kennedy: i think you are right and this will be one of those times where people do pay attention to the pre-presidential debates. i want to go back to the conventions though because you noted there was plenty of drama on nights one into it of conventions and i agree with

you. but the first night of the republican convention was so boring. it was so difficult for me to focus on the speeches are the exhaustion hadn't even sat in. >> the first two nights at the republican convention, had a very strange nonconventional feeling. on the third day people seemed more into it. maybe it was because her past the roll call. the democrats for all the negative towards the sanders people at least they set up drama and they got people engaged in by the third day that totally went away. kennedy: you didn't actually totally go away. i was watching the california delegation's bread i was spending time with them and talking to the delegation. the tv wasn't showing it. for those speeches when general john allen was speaking in leon panetta was speaking they were holding up their can science and

they were being chanted down. >> you are right that was happening and two a lot of things change when they sat are their hands are good. he wrote the civil rights movement, i was ticked off by that. kennedy: i was upset that they were chanting black lives matter's during a moment of silence for fallen police officers. >> what you think the media's reaction would have been every time donald trump's name was mentioned he was booed. the media would be having a field day with this. you don't see it on the tv but that's their choice. kennedy: they would have shown a protest going on outside as they were in philadelphia. when there weren't a lot of drud it's going to be boring in philly. you are processing every day. fox business was the only channel that showed those protesting give an honest view of what was happening inside and outside. we have so much more with the

kennedy: to the 33 presidential debates scheduled for this fall will be on the nights of primetime nfl. donald trump says the system is rigged. elizabeth warren to get less viewers for the debate criticism the sanders campaign charged in the primary. is trump on the something? might party panelists stephen smith and rick unger. let's talk about this a little bit to the nfl they are not too pleased about it either at the commission on presidential debates which is a dubious commission says they have had exporting events on in past years and still see nearly 60 million viewers. do you think donald trump is making excuses to skip out of the debates? >> no on its awful. september 26 is also my birthday. the first debate is on my birthday. people are not going to be tuning in. they will be tuning in to see what i'm tweeting about. i think he is trying to make something out of nothing really. i think they said this was

night and bernie sanders was like maybe they are trying to cheat me out of this. they were like you are crazy. then the e-mails leaked. trump is not trying to avoid this today. this is trump's only chance to win the presidency to take her out one-on-one in these debates. she is the one who doesn't want anyone to watch these debates. kennedy: a couple of things. she has gotten better as a debater and i think he can give her a hard time on the facts. i don't care what else, you could put this on against the academy awards and the golden globes and the s.b.'s. i think more people would watch the debates. they're only three of them and we have 75 presidential debates. >> keep something in mind, there sunday night football and there's monday night that paul anders thursday night football and their saturday night college game of the week. this is the problem. i think you have to be careful

>> you should probably ask one of the psychiatrist that comes on tv about why she has this natural inclination to lie. when she told chris wallace yesterday that director comey said she was telling the truth he was referring to the three hours of secret testimony sheet gave to the fbi which was unrecorded so we don't know what the questions of war or the answers were and which he said we didn't see any lies in their but in terms of her saying, i was saying all along what she has been saying all along has been lying. mainly she told the benghazi committee congressman gowdy who you saw interrogating director comey in another context that she didn't send or receive anything marked classified. not only were 110 e-mails top-secret but five of them were the select access privilege which is the highest secret the government has. kennedy: it's actually its own system. that's what's most unsettling.
