recover $14 1/2 billion in what they say, the europeans say is unpaid taxes, recovering 14 1/2 billion from apple. this is going to be a huge fight. who owes what to whom and which court will adjudicate. joining us is peter morici tenured at maryland. it looks like a shakedown to me. and you say what? >> well, the europeans are notorious for shaking down american companies, and that's one of the reasons why mcdonnell-douglas doesn't anymore. ireland has low corporate taxes and apple is an american company and i guess there's a third thing. tim cook is politically inept. instead of spending so much time backing hillary, he needs to spend more time learning how the european bureaucracy works. so he doesn't get himself into these jams. stuart: it opens up a pandora's box. which is the next american

company they'll take to the cleaners. it's going to happen, isn't it? yes and no. there's something else going on here. the u.s. department of treasury and justice department have been fining banks and fining european banks to the hilt just like american banks and they have angst about that. in a world of multinational corporations, if you don't have one single set of rules, things don't work very well. it's very hard to comply with laws in both places these days and that's what's happening here. the absence of some sort of agreement on taxation, because the democrats here want to have really high corporate taxes, keeps us from getting anywhere. stuart: okay. stay there, peter. there's a lot more for you coming up. we'll be back to you in a second. how about the rally for the dow jones industrial average, up 100 points yesterday. and we're what, 130 points away from an all-time high.

>> we know this company, hershey down roughly 10%. mondelez, which owns oil and many, many brands. they offered to buy hershey and down goes hershey's stock. new emmerson polls show a tighter race in three swing states, ohio, pennsylvania and michigan and a new monmouth university poll shows hillary leading nationally 46-39, but her lead there has been cut in half since the last poll, which was just a few weeks ago. i'm going to throw this out to you, ash, i think the new trump may be working. ashley: i believe so. the bump hillary got out of the democratic national convention, 13% lead in that monmouth poll now down to 7% and it's tightening and interesting. we've seen some polls where the independents are now shifting to donald trump. 47-30% by some accounts in ohio. this is a huge turnaround for trump. much more focused in the last

two, three weeks, given big speeches on the economy, on security, on, you know, he's going to have a big press conference tomorrow on immigration in arizona and i think that would be good. he's been good. now, let's not forget, he's getting out of his own way and concentrating not only on his own policies, but let's face it, hillary clinton has an awful lot of ammunition she's given him. that's true, but. ashley: i think that. stuart: been very quiet. ashley: and probably the best liz: to ashley's point. basically hillary clinton is spending a lot of advertising dollars on television. trump has not to this point, right? it's been twitter, tv and rallies. stuart: 200 million, i think in just a few battle grounds liz: and now rolling out a $10 million ad spent in nine states. stuart: and trump is using the anthony weiner scandal as an opportunity to attack hillary clinton. here is trump's quote. >> i only worry for the country in that hillary clinton has-- was careless and negligent in allowing weiner to have such close primity to highly

classified information. and he went on to attack colin kaepernick as well for sitting during the national anthem. roll that tape on trump. >> i think it's a terrible thing and, you know, he'll-- maybe he should find a country that works better for him. let him try, it won't happen. stuart: and that's donald trump there. that's an attack line. jeff dewitt is with us, a trump guy. first of all, jeff, deal with anthony weiner. why is mr. trump going on the attack with this? what is hillary's vulnerability with huma abedin? >> well, you know, anthony weiner is sort of the gift that keeps giving for republicans in one sense. as much much as we all don't want to think about anthony weiner's weiner, it keeps popping up every few years and we can't get away from it it's out there on twitter and amazing how he can't keep that things under wraps. stuart: but trump is attacker anthony weiner's proximity to

hillary clinton herself. i mean, only one step removed and that one step is huma abedin. >> right, who will have a prominent role in the white house should hillary clinton win. and i think that's important. it's to look at the judgment of the people around her. not only is that, it's a personal matter that, you know, but look at the professional matter of the e-mails that are coming out right now, and then some more were just released that shows huma's roll in the pay for play scandals and how close she was to those things. stuart: take me through the attack on the kaepernick affair if you like, and donald trump says find another country, that's what he said. where is the vulnerability of hillary clinton through the kaepernick affair? spell it out. >> well, i think one thing, it points out that donald trump is accessible to the american public and he's, you know, he's familiar with pop culture. he's out there. when you look at that, versus roughly 70 days left in the

election and for 270 days, hillary clinton has not had an unscripted moment. she has not had a press conference. she has not answered a question directly to the american public. and this underscores when donald trump shows he's one of us, he's a guy that tweets about every day life. when you look at colin kaepernick thing it's atrocious. here is a guy that is showing complete disrespect for the lives lost by our troops in-- for our country and there are troops out there that have had their legs blown off in iraq and get titanium legs and can still stand for the national anthem and for this guy to come out there, one of our national sports figures and saying he's not going to stand for the national anthem anymore. i'm sorry, i come from a time, you stand for the national anthem, you sing it with pride and you recite the pledge of allegiance for the good of our country for this guy to do this, i agree with donald trump if you're not going to stand for our national anthem, go somewhere else.

stuart: we hear you. jeff dewitt, a trump guy, see you soon. >> thanks, stuart. stuart: now there's a big, big meeting on obamacare, they're desperately trying to save obamacare. what they're going to do is tweak the rules, more ads trying to get more young and healthy people to sign up and maybe new rules so you can't sign up just when you get sick. those are two of the tweaks. and peter morici with us. i think that this legislation is finished, but my question to you is what's the end-game as we spiral down, what's the end-game? >> many, many counties in the united states will only have one insurer next year, and many more will only have two. which means there won't be competition and prices will keep spiraling up. for young people, that creates an enormous incentive just to skip insurance and pay the fine. find some way to buy medical services as you go. so the basic economics of obamacare are becoming unglued. hillary clinton wants to be

president and she wants a government alternative. what that would do is essentially drive private insurance out and give us the british national health service. it's kind of frighng. you know, what i would like to know is what mr. obama's going to do about that county in arizona that will have no insurers. those folks won't be able to sign up, but they're going to have to pay the fine. stuart: we are told that, yes, those people in pinellas, i think, the pronunciation, in arizona with nobody in a plan, they'll have to pay the fine. >> when the four challenge comes i'd like to see how the four knee jerk says some poor woman has to pay the fine, and somehow the four will keep the contraption going. stuart: i'm laughing, but it's not funny, it's not funny, it's a terrible thing.

that the apple has been shaken down by the europeans can't get out of a paper bag. >> they're doing what they're doing and 14 billion is meaningless to them. it's like you taking out a 20. stuart: a shakedown, i call it a shakedown, mike murphy. >> it's a total shakedown, not only is apple going to appeal this ruling, but ireland, the country, is also going to appeal this ruling. so, it's now the european commission overstepping, i would argue, overstepping their boundaries and telling ireland that they needed to collect more tax from apple when they're saying they didn't, they did exactly what they were supposed to do. i think this has much more far-reaching implications. ashley: 14 1/2 billion by the way, represents all of ireland's health care budget and 60% of its social welfare budget and they're fighting it because they realize how important investment is especially from the big tech

companies in their economy. stuart: the big tech companies will leave dublin liz: the eurocrats has aploweded fired. bono has applauded that. >> peter morici, there surely will be other big american companies which face exactly the same problem in europe. i'm thinking google maybe? >> well, absolutely, google. technology companies generally. because like apple they have the issue of where is their technology, their ideas, their patents and so forth going to the product tax. that's one of the big issues here. after all, the stuff is developed in the united states. they pay royalties to american companies or subsidiaries abroad so those taxes should belong to us not the europeans. in addition to the irish government coming down hard on this, look for treasury to weigh in liz: what does it mean belong

to us? i don't understand that, apple and the shareholders. >> hold on, liz, don't play games with me on words liz: i'm not, i'm asking you. >> if i develop a patent in the university of maryland and apple uses it, i think that we should pay american taxes on that not european taxes. part of this contest is not over whether apple pays taxes, it's which government gets the money, because if apple doesn't pay these taxes to europe, when it-- >> hang on, apple, sorry, tim cook says we do pay u.s. taxes and we pay a lot. he has said that and they actually pay a lot in the way of u.s. taxes. >> i understand that, the question is whether they get credit on this. stuart: the stock is virtually unaffected this morning and virtually dead flat, 106, it's down 50 cents. stuart: i want to get back to hershey, okay? the deal with mondelez, not going to happen. and nicole, hershey is really paying the price, is it not liz: liz: absolutely.

you see the stock down 11%. moving to the lowest level since june 30th where hershey rejected the mondelez bid. hershey kisses, mondelez, i get it, and basically the two of them together, a $23 billion deal would have made the largest confectioner in the whole wide world. there's talk, insider said, that the two ceo's got together and the deal at $107 a share that mondelez was willing to boost up to 115 and the trust of hershey said no way, they wouldn't accept a he penny less than $125 a share. they were nowhere near. stuart: hershey always wanted to stay independent. that's their whole goal is to stay independent so they put a very, very unreachable price on any potential deal. they know it's not going to be accepted. they want to stay independent and they don't care that much what happens to the stock price, in my opinion.

and nicole, thanks very much. ford motor company got new vehicle sales expected tomorrow. we'll get the latest numbers tomorrow and the stock is doing absolutely nothing. up one cent. ooh. ceasar's wins a brief extension being shielded from lawsuits, good enough for 3 1/2% gain. how about fitbit, two new trackers. up. and united continental, number two executive at american airlines, scott kirby, going to be the president of united, and that's a 4% gain. you wouldn't touch an airline stock with a 10-foot pole, would you? >> i like the setup for jetblue, had a pullback and i think that jetblue, if we get things settled out in the airline industry, i think that jetblue will come up higher. stuart: do you own jetblue? >> not yet. stuart: there's an intention to buy if i'm not mistaken.

nordstrom will start selling j. crew merchandise. i'm inclined to say, so what? [laughter] >> that makes no sense at all. >> that's right, so what? abercrombie & fitch, sales as we said down for 14 straight quarters. we're putting them on death watch? >> yeah, the sales are down for three years plus, more than three years. you know, they tried to change their strategy to appeal not to teens, but to 18 to 25-year-olds and that filtered down 4%. stuart: is there some in that market. 13 to 18 is different from 18 to-- >> to 25. stuart: that's true liz: look down 18%. >> the big story with abercrombie & fitch, there are start-up companies allowing you to shop on-line when you want to shop and you don't have to pay for it upfront. they'll give it to you. one of the companies, jack threads, you can order it, whatever you keep you pay for it at that point and not before.

it's kind of a free trion for clothes and that's affecting the bricks and mortar company. stuart: todd, i know it's not your field. but i'm going to ask you, would you buy any of the clothing retailers ever? >> well, ever is a long time, but now, today, absolutely not. i think what you have here you have amazon that knocks them out of the box when they go on-line. brick and mortar is just about crucified and dead because wal-mart's taking the brick and mortar business specialty shops eliminated. no way would i ever buy them today. ever is a long time, but for now i would not be a buyer. stuart: peter, would you buy any brooks and mortar retailer? >> no. they only have to lose 10 to 20% of sales to amazon and other on-line folks to really go into very negative territory and that's exactly what is happening. amazon has a more efficient supply chain. it can simply hold less inventory to service more customers.

inventory is a huge cost in retailing because of the markdowns at the season's end. people like abercrombie and j. crew doesn't make sense. that's why j. crew will sell in nordstrom's with a store next door. it doesn't make sense to me. stuart: it's a long time since i went to a shopping small. >> you're not alone liz: yeah. stuart: you've got a big family, don't you go to the mall or amazon. >> no, do it on-line and it's much easier and less expensive and the bigger concern, if you look past retailers, what happens to these malls? what happens to the big owners of real estate, that's the question. >> baby boomer-- >> like the old downtown. stuart: who said that. >> peter. >> they become like the old downdowns, and now the mall is being decimated by amazon. people live in a distributed frame work. 33% of the population works from home these days at least part of the time and take care goods at home. the idea of driving someplace to get something done is very 20th century.
