so long as you're peaceful you can stay out past midnight and march around and that's what they did under the presence of a lot of national guard and riot police who were staged all around the city in case things got violent again. one thing we did hear from the protestors chanting over and over again, release the tape, that is referring to the tape that was made by body cameras and dye dash cameras of when keith scott was shot. that is what has kicked off riots initially on tuesday night, was his shooting by police. the man has a rap sheet that goes back 20-plus years, was shot, police say, uh-uh he had a gun. they say other evidence points to the gun. >> you cannot see him making a

week for oil but we are seeing actually a slight loss this morning, loss of 1.6%, gold down as well. nicole: now for breaking news and protest in north carolina, we are going to leland, he's live in charlotte, leland, good morning. >> well, good morning to you, technically the curfew is still in effect but the police basically made a deal with the protestors, so long you stay peaceful you can stay out past midnight. the police made the deal with a lot of backup. the national guard and north carolina state troopers and dozens if not hundred of riot cops. the biggest chant that we heard was release the tape, release the tape. they were talking about the tape of the shooting of keith scott, he's the african-american man shot and killed by police.

he has a long rap sheet that goes back 20 years or so, also had a lot of issues in terms of run-ins with the police and according to police he would not drop a gun that they say he had in his hand, however, his family says it was a book. the police say that had they show it had video to the family, the family was not so sure about what the video showed, still the police are standing by their story. >> what i can tell you the video sas i said before, not the most definitive piece of evidence we would have hoped for. you can't really see what's in his hands and as i said before, it is -- you cannot him making a gesture like pointing the gun which could be much more definitive. >> three major issues facing the city of charlotte going forward, what happens with the investigation into the death of mr. scott, does that spark for protests to the economic implications, clearly the video over past three to four days
