ahead. nicole: we begin with this breaking news this morning, angry protestors taking to the streets of charlotte. mayor imposing a curfew but would not be enforced as long as protest remain peaceful. the family of scott was shown the dash board and body camera the lawyer for the family issuing a statement, it is impossible to discern from the videos what if anything mr. scott is holding in the hands. the police chief of charlotte on the kelly file last night. >> as i said, you can't really see what's in his hands and it is -- you cannot see him making a guess sure with a gun but the officers proceed based on everybody i have said before, failure to comply with commands, failure to drop weapon and him turn to go face officers as an

eminent threat. nicole: police say they won't do it while the investigation continues. we will have a life report from charlotte for you in just a few minutes. cheryl: meanwhile in tulsa, oklahoma the white female police officer now charged with manslaughter, prosecutors saying police officer reacting unreasonably. >> i determine that the felony crime of manslaughter against tulsa police officer betty shelby is warranted. officer shelby although now charged is presumed to be innocent until a judge or a jury determination others. cheryl: officer shelby turned herself last night. she was released 20 minutes later. convicted she faces four

years and life in prison. the victim's family saying they are pleased that the officer has been charged with a crime. nicole: new york,-new jersey bombing attacks, the wife of rahami is back in the united states. she returned yesterday. the fbi said she left the u.s. for pakistan in june and voluntarily gave interview while in dubai earl earlier this week. investigators have not suggested that she is suspected of any wrong doing. meanwhile rahami remains hospitalized after a gun battle and it's unclear when he might be taken to court to face terrorism charges. cheryl: donald trump is calling for a national anticrime agenda, the fight violent crime in u.s. cities. trump commenting following protest in charlotte, north carolina over fatal police shooting of african-american man.

three quarters of 1 percent. still a strong week for stocks, this morning u.s. stock market futures looking slightly to the downside but not by much. the dow pointing lower by 27 in the premarket. s&p down by just 4 points right now. nicole: oil four days, gold up four days, we have a meeting on oil and oil is down 45.52. down 1.7%. gold plunging backs 3.38 a troy ounce. cheryl: let's get you new information on protest in north carolina, let's bring in fox news leland, it looks like it was a different type of night for the residents of charlotte. >> much, much different night, good morning, ladies, to you as things stand right now the national guard came and went pretty quick and it only took them about 12 hours to lay town the law in charlotte. currently the city under a curfew.

so long as you're peaceful you can stay out past midnight and march around and that's what they did under the presence of a lot of national guard and riot police who were staged all around the city in case things got violent again. one thing we did hear from the protestors chanting over and over again, release the tape, that is referring to the tape that was made by body cameras and dye dash cameras of when keith scott was shot. that is what has kicked off riots initially on tuesday night, was his shooting by police. the man has a rap sheet that goes back 20-plus years, was shot, police say, uh-uh he had a gun. they say other evidence points to the gun. >> you cannot see him making a

week for oil but we are seeing actually a slight loss this morning, loss of 1.6%, gold down as well. nicole: now for breaking news and protest in north carolina, we are going to leland, he's live in charlotte, leland, good morning. >> well, good morning to you, technically the curfew is still in effect but the police basically made a deal with the protestors, so long you stay peaceful you can stay out past midnight. the police made the deal with a lot of backup. the national guard and north carolina state troopers and dozens if not hundred of riot cops. the biggest chant that we heard was release the tape, release the tape. they were talking about the tape of the shooting of keith scott, he's the african-american man shot and killed by police.
