the lesser of two evils. but people think we are in the depths of hell with these two candidates. i have said this before, donald trump and hillary clinton are not the only people running for president. gary johnson published an open n op-ed. he just because gary does things like this -- >> what is aleppo? >> you are kidding. >> no. >> i could go through the whole debate and not say anything. kennedy: it doesn't mean his ideas are crazy. he's the on person offering a

rational vision for this country. as gary points out. government does too much and costs too much. it's like a good stripper. the more you kit to do, the more you are going to pay. but this country has been overservicing itself for decades and neither main party candidate is talking about spending, infrastructure and defense. gary and his running mate are proposing cuts up to 20% for all federal programs, including the military. the last two administrations have doubled the national debt. only limiting the size and scope of government. cutting taxes and cutting spending will do that. it's the only solution. but you didn't hear lester pester the candidates about that monday night at hofstra. they bickered about the trans-pacific partnership.

after the word. millennials are another huge voting bloc that trump and clinton are trying to court. and larry johnson had -- gary johnson has made inroads with the under 30s. is it going to work? or will millennials see right through it? >> as they were tapping into millennials during the debate, they watched it for a little bit, then went back to pokemon go. kennedy: he read dirty, filthy hip hop. reading about this focus group of millennials, it seems like what was sad to me there will be always heavy emphasis on racial issues. this is was they were most intrigued by.

kennedy: house republicans grilling f.b.i. chief james comey over his agencies investigation over hillary clinton's use of emails. particularly over the immunity deals given to several of clinton's underlings. reporter: the f.b.i. director james comey said cheryl mills, a top aide was given an active production immunity so investigators could get her laptop. republicans questioning why that blanket was afforded to mills and why they couldn't get that

laptop by issuing a subpoena and they wondered why mills who was a witness in the case was also able to act as legal counsel to clinton during the investigation. >> i would be in big trouble and i should be in big trouble if i did something like that. there seems to be different strokes for different folks on this. and that's what americans are concerned about. i think there is a heavy hand coming from someplace else. reporter: comey said if one of his own colleagues did the same thing they would be disciplined and might be fired. but he said they would not be prosecuted. he testified his department throughout this near think four hour long hearing saying we are not weasles, we are honest people. kennedy: blake berman from

washington. thanks so much. joining me now judge andrew napolitano. i want to get into this relationship that hillary clinton has with cheryl mills. i think it's curious that sometimes she works for her at the state department, and sometimes she works at the state department and sometimes she is mrs. clinton's private attorney. what's going on here. >> the basic rule of thumb is a lawyer cannot be a witness in the same case in which she is a lawyer. there are some exceptions to it. but the theory is if you are a witness and a lawyer, you have your ownself to worry about and your client. if there is a conflict between the the two who are you going to favor? i suppose theoretically the lawyer could be a witness in the case and still have undivided loyalty to the client. but it looks very, very bad. and the reason as blake pointed out the f.b.i. did not serve a

subpoena is the f.b.i. doesn't serve subpoenas, grand juries do. the justice department must get a federal judge to convene a grand jury and begin presenting evidence. we know when there is no grand jury in the case the investigation is not a criminal investigation. that's what happened here. no grand jury, no subpoenas, no search warrant, no d.o.j. supervision. kennedy: d.o.j. shielded cheryl mills because she aloud her to sit in on mrs. clinton's testimony when she went before the f.b.i. >> she doesn't allly get immunity. she gets a letter from the d.o.j. saying if you give us your laptop we cannot use anything that we find in there in a prosecution of you, director comey admitted that they found classified materials, either confidential, secret or top secret.

is it a crime to keep it on a laptop out of a secure venue? you bet it is. did they prosecute her? of course not. kennedy: i understand what james comey saying no reasonable jury would convict mrs. clinton? but why not cheryl mills. if she orchestrated the email setup. it's not just a conflict of interest. she also set up this entire ruse. >> congressman gowdy point out that cheryl mills told the f.b.i. she learned about mrs. clinton's private server in the newspaper. yet the fine has produced emails upon emails from her orchestrating as you pointed out the creation of the secret system. >> the president saying he heard about it in the news and he was using a pseudonym discussing classified material.

>> ask martha stewart. if you lie in an official investigation from the f.b.i. you can be prosecuted as if you had been under oath. kennedy: lawmakers on capitol hill voted to allow 9/11 families to sue foreign governments. >> it's significant politically and more significant legally. a basic principle of our legal system is when there is a wrong, there is a remedy. of course, there was a wrong. there is tremendous amounts of evidence to lead to us believe the saudi government or people in the saudi government caused that wrong. to deny the survivors of the 9/11 victims the right to sue is against the constitution and against moral principles. now, why does the government shield the saudis?

talking to. she needs latina women and men to turn out in higher numbers than for trump. she needs to turn out that coalition that seems a little unenthusiastic about her. >> it's a defensive lay on his part, chris stirewalt. what does he do now and what does he do in the next debate? is it possible for him to set a similar trap for hillary clinton? >> well, sure, it would take lot of skilled campaign work and take a lot of forethought we hadn't seen from his organization. they focus on flying by the seat of the pants in instinctual gut play. but for trump he's saying apparently based on what he said in a rally yesterday and what he's talking about today. he needs to attack hillary clinton harder. she just has to be right in her face and talk about her husband's infidelity and sexual misconduct and burn it down.

i would just say for donald trump, the correct answer is, everybody already knows he can attack and fighter up. if he can demonstrate he has poise and say he's calm, his best moments in the first debate were when he was calm and dispassionately laying out his case saying you have been in this for 30 years and it's time for a change. he should steer away from these attacks. >> he can get her on the defensive on policy. that's where she starts to come apart. if he analyzes this and spends time doing that and not talking about miss venezuela's round hips, i think he will have greater success. thank you both have as much. the new show sunday on the fox
