fox reports that computers of two top clinton aides have not been destroyed. the fbi's got them and they are being checked. fox reports clinton e-mails are found on anthony weiner's laptop. so, hillary clinton's problems will stretch beyond the election, that will be an issue. it's certainly a political issue right now. to the polls. trump maintains his lead in arizona, georgia, missouri, he's increased his lead in four battle ground states and he's narrowed the gap in three others. this man is on a role. not stop. today, hillary concentrates on north carolina, two speeches there. trump goes back to florida, and look at this, ted cruz campaigns with mike pence, and melania goes to pennsylvania. it's all hands on deck, five days to the vote. how about taking a look at this. yes, we've got another takedown of big tech. a big hit coming for facebook. terrific profits, but slower

"varney & company" is about to begin. ♪ all right. the markets first, we've seen stocks come down a little as the election approaches and interest rates likely to go up in december. half an hour from now, you'll see a modest pickup for the dow industrial average. how about the price of oil, lots more of it in the supply chain. that took prices down to the mid $40 a barrel level yesterday. that's where they are now. $45. stock of the day, no question so far. facebook, you're looking at a very big selloff. i want to see if that things lasts. will that selloff last? good question. e-mack is here, i should say elizabeth mary regina is here. >> a lot of names. stuart: what's with facebook?

influence peddling. foreign agencies almost certainly hacked her server and her e-mails are on anthony weiner's laptop. attorney and fox news analyst eboni kay williams is with us now. it's a problem because it's not going away before the election, after the election or well into next year. this is hanging over all of us. >> it's a huge problem, stuart. here is the issue. when comey came out over the summer and said case closed, no indictment. that was a sticking point the clinton campaign could point to when any questions were raised. when comey reopened the question, for hillary and her campaign, it's a hue humongous problem. not only am i answering these, but put a president in the office with a pending investigation open, subject to indictment. subject to impeachment.

stuart: new poll numbers, they are from cbs, new york times, consider the source. this morning, they're out and they show hillary clinton's lead narrowing to three points. 45-42. remember, please, hillary led in this poll by 9 points just two weeks ago. later in the hour we have fresh poll numbers from the all important swing states for you. stay there, please. check the markets, where will the dow open this morning? we're going to be higher. 30, 40 points, okay. brian is here, business professor at kings college in new york. now, there's a good chance, from what i hear, that the fed will raise rates in december. what's the big point for the market? is it the fed raising rates or is it the election? >> no, the fed-- the markets believe the fed is going to raise rates in december. the question in 2017 how much they're going to raise rates. i think this will be moderate here. i think that the election is

the big here --. stuart: when? not yet? the issue is the federal reserve. >> we know the federal reserve, what's going to happen in the poll numbers the next few days, more likely that trump is going to win, if he is, that's going to affect markets, because markets believe after all of this scandal, that clinton will win the presidency. that's what they have baked in. stuart: you have got a forecast for me. you're not a market forecaster, but if trump wins. >> i think the market falls initially because they're not expecting that. if he wins, after the election, he has to get clear what his policy priorities are going to be, he won't do it before election day, but he has to do that. stuart: if trump win, the markets go down and wait to find out what donald trump is going to do. >> too much uncertainty there. stuart: what happens, now, if hillary clinton wins, with all of this stuff that's going on, the potential for an indictment of a president elect, what happens to the market? >> the market moves more there

not on her election, but news coming out of that investigation. stuart: up or down? >> it's going to move down if we see big problems with the election because again, they're expecting her to be in office. if the news gets worse there, you see markets drop because, again, the prospect is where do we go from here politically. stuart: bottom line, you see markets dropping whether it's trump wins or hillary wins? >> short-term with trump, if clinton the news gets worse. this election creates so much uncertainty. stuart: okay. and the best decision for investors would be a split decision, hillary wins and congress stays republican? >> that's what they're expecting. stuart: okay. you're all right. stay right there. actually, you can leave the set, but come back at 9:30. season is better for them. zumiez is going up. iran claims they're sending special forces to infiltrate america and europement-- saying that we will be in the u.s. and europe soon. why? we have to defend to protect iran's supreme leader and that has no border nor any limits. now, we know that they're using a ton of the money that we gave them through the nuclear arrangement of the deal because they're bolstering up their military hardware right now. they're becoming very aggressive and they make these claims, we're going to have fighters in europe and so on. stuart: sure. ashley: but a lot of this is they've been em boldened with the money that they can use to start ramping up their military hardware. stuart: here is the question, who was new york's city's police commissioner on 9/11? bernard kerik. welcome.

is this an idle threat they're send revolutionary guard to america? >> this is posturing for their people. they're trying to let their people know they're in charge and running stuff. the reality, can they get them in here? no. stuart: it would be an act of war? >> it would be extremely difficult for them to get here, number one, and number two, it would be an act of war to, you know, to put their troops on our soil for the purpose of fighting our people. so, you know, it's-- i think it's a bunch of rhetoric on their side. i don't think it's something we have to worry about, however, the intelligence community has to stay on top of it. stuart: we've just signed a nuke deal with the iranians. >> we keep giving people money to come back and fight us, so it's crazy. stuart: let's move on, shall we? i want to talk about those two iowa police officers killed in the ambush-style attack. president obama went to a

raucous rally for hillary clinton and he didn't mention this, and then he had a written statement later in the day. you're law enforcement guy, what do you make of that? >> if you watch the trump statement about the two iowa cops and you read the president's statements, it's completely different. you know, donald trump made it very clear an attack on those two cops, the executions of those two cops is an attack on society. the only time i hear the president say anything about an attack on society is when there's a questionable police incident. very different statements. very different, disturbing. i was bothered by the fact there was nothing said all day. you know, and he puts out a written statement. i think-- i urge people watch donald trump yesterday when he talked about the two cops and look at the president's statements. leadership, completely different leadership and i

think we need somebody in the white house that supports the cops, gives them the benefit of the doubt when there's a question and makes sure this they have resources and the manpower they need the job to secure this country. stuart: what is morale like in police forces around the country? i presume it's rock bottom? >> well, we feel, the cops in this country feel they're not being supported by the leadership and that's from the president on down. you know, you have governors, you have the president, you have mayors, that have gone against the police. they support hate groups like black lives matter and all of these other groups. it's not good for the cops. they need to be supported. stuart: they do, indeed. bernard kerik, a pleasure, thank you for being with us, sir. >> thank you. stuart: we've got anthony weiner, basically he's at the center of one of the investigations into hillary clinton. go he is what? he's checked himself into a rehab for cyber-sex addiction. if about you really want the

experts say, the market has to deal with that. with five days away from the election and donald trump has some real momentum. got to deal with that. not to mention facebook, which is a huge technology company, which will be down right from the get-go in morning at opening bell. that's unusual, but you're going to watch it happen starting now. 9:30 eastern time. a lot of green on the left-hand side there and we're up 20 points for the dow industrials. let's move on to the s&p 500, broader market indicator, we'll tell you that, up again only slightly, a fractional gain there. how about the nasdaq in the very early going, those technology stocks are ever so slightly down. the price of oil, i think it's still around $45 a barrel. yes, there it is, 45.33. no impact. i'll call that flat. gold has flipped below the $1300 per ounce level, and who is here on a thursday morning? i'll tell you, ashley webster, liz macdonald, larry levin,

brian and dr barton. i'm talking about facebook, there's concern about the growth rate in the future and it's getting hurt. it's down. dr, would you buy it at 121? >> i like facebook at 121, the little pullback, a chance to buy it on sale. facebook is going great things, year over year, average revenue per user almost almost 50% in the u.s. saying we can't sustain that has a pullback here and it's down less than 4%. it was down 8% on the news. i think we're going to get a snapback here. stuart: larry levin, you are the virtual reality guy on this program. i know you're big into it and now, facebook has its own virtual reality operation going. do you think that could supply some growth for the future? >> yeah, it's going to take some time, stuart. like me, you've got to be an early adopter if you get into oculus, which is facebook. and i'm long at 128. i believe in that company, but

good at all. stuart: i don't use a fitbit. i have an apple phone that tells me how much stairs i've climbed and how much walking, 2.2 miles over the past week. do you have a fitbit? >> i have a garmin. i think i'm going to upgrade to a smart watch. that's the problem. apple's smart watch is waterproof and the s-2's and s-3's, are waterproof and why get into a fitbit. stuart: larry, you're an early adopter, a fitbit, anything around your wrist? >> no. >> i had one for a while, but i'm not a big fan of those and i agree with dr. it's apple 2 watch has a lot of the same functionality or the popular fitbits. >> have you got one, an apple 2 watch? >> no, i don't like them. stuart: okay. >> there you go. sales declines are not as bad. okay. john macky is going to be the sole ceo, but i'm intrigued, sales declines at whole foods, liz? liz: the first annual sales decline since 2009. that's not good. you pointed out amazon fresh and kroger is getting into the organic food space and john macky is going to take sole control and restructuring. stuart: competition? >> also people make jokes about whole foods all the time. let me give you within tweet. a woman said this woman at whole food is choosing a bundle of asparagus more closely than i chose my own husband. there are whole foods jokes out there. stuart: the competition is doing in whole foods, correct? >> whole foods, the competition, they need to refresh themselves. they need the 365 store, the lower end store. the markets are responding positive because of one ceo, the market likes that.

stuart: the competition for whole foods? >> amazon and blue apron, a lot of people can replicate what you're doing. stuart: i heard about blue apron, delivers the whole meal liz: it's just the ingredient, you have to cook it. it's potatoes in a box. stuart: totally outside of these conversations. check the big board, we're-- stop laughing at me. and the dow stills are up 20 points. higher revenue, qualcomm, they make the chips that go in, and it's nearly up 2%. remember them, remember phantom pigs? they're losing money at the number of active users falls, but nonetheless, they're pretty much dead flat. the teen retailer anything, but flat. zumiez, better for the holiday, up 2 1/2%. big names, we check them all the time.

especially apple. they've snapped a five-day losing, what's the story? >> they were down a bit and now they're up a bit. you're right, five days of selling and gained so slightly. and today now, just over 1/10 of a percent. the analysts are looking at the holiday quarter and apple are keeping on track and saying they are looking at at that in particular. they're worried they can keep up with the demand and the stock broke to that 50-day moving average. you want to stay above that, right? if you're trending higher. so we saw that last week, you don't want to see that, certainly, but overall, big picture, 111.19 right now for apple. stuart: we've got it, okay, nicole, thank you. take a look at papa john's and buffalo wild wings, you indulge in a football game. nfl ratings are down and that's reportedly hurting pizza and wing sales.

>> it is, the two go hand in hand. get your buffalo and pizza, you pick it up or deliver it. not only is the nfl ratings down, but because of that, the trigger on the ripple effect has been buffalo wild wings down 1 1/2% and papa johns reporting weaker sales. the bigger question is, everyone seems to have a different answer, why is the nfl not getting as many viewers, a good question. stuart: i can tell you, you want to hear. >> i do. ashley: i'll give you one, you give me one. stuart: the rules are so incredibly technical. ashley: no, no. stuart: the game stops all the time. nobody knows what a catch is any longer. ashley: then the ratings would have been down years ago under that premise. the reason that a lot of people are giving, it's an amazing political race and more people are watching news channels than nfl. stuart: we've got two guys with british accents arguing about american football in the rules liz: you're an american. >> stuart, seton hall did a

see more of that. stuart: to the brexit story breaking fresh this morning. the british government must consult the british parliament before beginning the process of leaving the european union. that sounds like there's a possibility here of a brexit being reversed. i can't believe it liz: it could start into political turmoil. however, theresa may, prime minister, saying respect the people's vote and we will appeal it. and she's plan forging ahead. the high court didn't spell out what the parliament should do or the government should do here. stuart: no impact here whatsoever in my opinion on the financial markets, on the economy or our politics, zero impact? >> know the a lot of impact here unless the uncertainty really ramps up. if they can find a path forward through this, fine. the problem is there's so much uncertainty and trade implications here especially for great britain. stuart: larry levin, i'm sorry, i'm moving on. i've got to talk chicago, larry, that's where you are. you're right in the middle of it.

another clinton campaign e-mail dump. this time it's about new york city mayor bill deblasio e-mailing john podesta about hillary's wall street speeches. what's this? >> interesting, it shows that mr. deblasio was on morning joe, pushed hard whether hillary clinton should release the transcripts of speeches she was paid well to give to wall street companies. so, he kind of deflected in the interview, as it comes to the e-mail he sends this to john podesta about trying to protect hillary. he says, i'm trying, brother, but this one is just hard to defend. stuart: in other words, deblasio, the leftist mayor of new york city is saying, those hillary speeches-- that's awfully hard to defend, mr. podesta. ashley: yes, campaign manager. stuart: okay, now we know. as hillary's scandals mount. donald trump seems to have momentum. five days to go. the latest cnn poll, however, shows hillary leading in two key swing states, in pennsylvania, 46-44 to hillary. in florida, it is 48-45 to

hillary. jeff dewitt is with us this morning. you've got five days to go, cnn says you're behind in two key polls, you know, nobody outside fox with a possible exception of the wall street journal, nobody outside fox is reporting on these latest e-mail drama, the scandal drama reported by bret baier. you've got an uphill road to climb still. >> it's unbelievable. when you see the media and we talk about it a lot the media bias nmy job in particular, i watch multiple channels all the time. different tv's up. it's amazing to see how the media can-- one channel can report one thing about a story and to see the slant that we put on it, and i wish the media would-- i think that fox is, by the way, the channel that does report the most fairly, report the facts. stuart: you're fighting almost the entire media establishment because they are just not reporting all that's going on here? >> when you look at james comey, revelations of last week and this could lead to an indictment and fox is the only one reporting that as well.
