8:15 on election night i think that is the case and pennsylvania holds the key. >> must-wins with the exception of florida panhandle are in eastern times. we'll know about north carolina. we'll know a lot about ohio and know a lot about pennsylvania and we'll know early on with pennsylvania if the results from philadelphia come in, obviously trump will not win there, see how he is doing, he does well enough there, looking for a big win in the western part of the state. we'll have very early indications how this this is going, there are these states, florida, ohio, north carolina where it is extremely hard for trump to win without winning them. stuart: byron, i don't know if you were watching trump's presentation today in tampa, florida, we ran it throughout, it was i thought a dramatically good speech. he had the crowd going with him. if you saw it, will you pass

if hillary clinton is elected? will you comment on the constitutional crisis, we heard a lot of that expression. what say you, sir? >> let me say that hillary clinton's use of a private server to go the government's diplomatic and intelligence business for the four years that she was secretary of state has done grave damage to our country and that to me is one of the single biggest issues, despite these other, now known investigations that are going on against the clinton foundation, this whole issue with anthony weiner, the 650,000 emails that have been discovered, likelihood of having 33,000 were destroyed, using some type of bleach, and potentially other devices that they have found. i mean the damage that she has done will create conditions of extortion and espionage unlike we have seen, even, i would compare this to even to snowden to a degree. stuart: whoa.

>> the kind of damage she has done. stuart: let me jump in, general. if she is elected, i know the intelligence agencies are staffed with professionals, i got that, but will they trust her with this history, will they trust her? >> yeah. i can tell you from the intelligence community and, every person serving in the military that hold as clearance, that has the privilege of being able to read, secret or top secret or even more sensitive information, the fact that she could, if she were ever to be commander-in-chief, i mean it would being absolute joke and nobody would take seriously her role in that job. this is how bad it is. >> general, that is very serious stuff. >> it is very serious. this is, you know, i've been watching this for years now, not just for the last week and this is a very, very serious issue. in addition to all of the other potential criminal behavior that hillary clinton has been

surrounded by, with the foundation, people like huma abedin, anthony weiner, who were likely both look for deals through their lawyers to be able to get out of jail free cards here, partly why i think anthony weiner absconded the 650,000 off of his former wife's laptop. so there is really serious issues in play here and the jury, the jury, stuart, the jury in this case will be the american public on tuesday. that is who is going to be jury because we have essentially run out of time here, and you know, because of just the way things work in the legal process with running these kind of things. the american public, i actually think has a very easy choice to make between hillary clinton, which, she is is the dark cloud of the past where donald trump who is sort of the bright future, the bright light of the future. stuart: can i just raise one issue which to me is the most important issue of all these

security concerns. it appears that hillary clinton and president obama were emailing each other and those emails were going through hillary's private server. >> exactly. stuart: to me that means if that server were hacked it is quite possible, russia, china, whom sorry was reading in real time the emails, the messages of the president of the united states. have i got that right? you were chief of military intelligence. have i got that right? that is right, that is accurate, that is a disaster. >> you don't -- not just that you have it right. let's not say probably, maybe, might have been hacked, i can guarranty you it was hacked. president of the united states and secretary of state, like other world leaders, they all know this, this is not something that is new, everybody at that level is a target of spying around the world. we all know this. this is the way that game is played. so to be performing her role as

neil: battle for the battleground states. welcome, everybody, i'm neil cavuto. fox business continues round-the-clock coverage when we get into the key vote what are key states. we're looking right now at hillary clinton and her running mate blitz the likes of florida and pennsylvania. pennsylvania is interesting, that the democrats even have to consider doing this, considering the fact it usually been such a safe democratic lock. certainly by this stage of campaign no one would be paying any heed. they're paying heed now. donald trump and his running mate blitzing six of those battle ground states. paul ryan is joining pence. has yet to join donald trump.

joining him in wisconsin to protect senator johnson facing a devil of a time in these polls, whether he will be one of those vulnerable republican senators who could lose his job. we continue now, "coast to coast," this time starting in the state of florida where it is even-stevens. adam shapiro now, with what the candidates are doing today. adam? reporter: as you can see, they are on the campaign trail in this last-minute push to get their base to the polls or convince what they call in florida, dixie kratz and in case of donald trump cross the democratic party to vote republican. and hillary clinton in republicans might be concerned with mr. trump to crossover to vote for her. talk about mr. trump. because he gave a very rousing speech here to 5000 supporters which he hit themes that they are championing. for instance, the 35% tax he would impose he says on

companies which move jobs out of america and want to bring products back into the united states, a loud roar in favor of that. also talking about building the wall, to stop illegal aliens from coming into the united states. but take a look how this is resonating in the latest polls here in florida. the latest average of polls from "real clear politics" shows that hillary clinton has, this is within the margin of error of polls, roughly one-point lead over donald trump. gary johnson has fallen to 2.4% of those polled. jill stein 1.3%. this is neck-and-neck. in florida, but donald trump, when you talk about the polls, here is what he had to say. >> you know they do these phony polls, right? some of the polls are good. i only real acknowledge them if i'm winning so what. i about the way, we're winning in a lot of polls.
