john: i'm in shock still. i believed the polls, the experts, mainly the betting. i was resigned to suffering through four more miserable years or 8 more years of this. >> raise the federal minimum wage. make sure women get equal pay. john: the democratic left is so smug and entitled. but i assumed we would have to suffer under their rule for many more years, and yet now we don't. we have a fresh new voice. so now what? what will trump do? sometimes he scares me. he said some horrible things. but he's also said good things. who tbheets he really believes or would do. let's talk to a republican democrat and libertarian. charlie kirk is the republican,

part of a wave of young people supporting trump. jessica tarlov is a democrat and hillary supporter. are you miserable? >> i like being with you all but electorally i'm miserable. david boaz warned me years ago, never fall in love with a politician. >> they will always days points you. they promise to cut spending and stop the war. this time i can't be disappointed by trump because i don't expect much. john: why do you back him? >> he wasn't my choice in the primary but i'm glad i backed him. i'm more libertarian than conservative. i thought the supreme court was a 40-year decision, not a 4-year decision. i believe:private property rights and states rights. the list donald trump put forward is more on the constitutional libertarian time.

john: we'll get to that later. you believe in property rights. i'm not so sure trump does. trump says things about war that hillary clinton and most republicans would never say. >> we are losing billions and billions of dollars. we cannot be the policemen of the world. john: this sounds libertarian. >> it's very new and something that didn't get enough attention. the republican party nominated and elected a cad who rejects global intervention. the reaganite, the knee owe con foreign policy. he said some crazy things too like let's go in there, torture them and take the oil. he talked about this theme of getting rid of global interventionism since 1987. >> this is part of what can we believe about him. i thought that was smart since he was trying to target -- when you are reaching out to

disaffected democrats, and a lot of people across the democratic party, there is recognition the iraq war was a mistake. when you have hillary clinton who voted for the war though she said she was sorry. and donald trump supported it on howard stern for 20 minutes. john: it wasn't 20 minutes. it was a quick response. >> i totally agree with you he said we could torture the families of terrorists which you can't commands the military to do. no doubt he would put knee so cons in his -- he would you put neocons in his cabinet. john: donald trump also promised big spending. >> we'll build the roads, bridges, tunnels, airports and the railways of tomorrow. john: who wants to take that? >> i think infrastructure has been a big thing, obviously point of his agenda. john: we are broke.

>> one of the big issues is talking about the national debt and the need to balance the budget. john: he talked about that? >> he said we have a debt completeley out of control and we have to balance the budget. he can't play dictator for a day. he has to work with paul ryan. john: he won't cut entitlements and spend more on the military. >> he said he will find fraud and abuse. john: they always say that. >> everyone here doubted donald trump including myself for a long time. we all said he wouldn't win the primary and said he wouldn't win the general. maybe he will surprise us and do what he said he will do. >> he wants to cut taxes, increase spending on the military and infrastructure and not touch entitlements. >> it's impossible. >> do you think he will sign a

budget if paul ryan puts slight reforms to entitlements? i would say yes. >> he told paul ryan when i'm president you are in big trouble, buddy. >> i think we want to advance the cause of freedom and liberty, cut taxes and go after bad regulations, we are more likely to do that with donald trump than hillary clinton. >> explain the difference between freedom and liberty. john: what scarce americans about trump is what he said about immigration. >> we have to build a wall. we have to. john: the terrorists don't come in from the mexican border. and a wall doesn't stop people. they go over, they get advisas and fly in. so, look -- >> he said he wants to increase border security and that's something a vast majority of americans believe in. he changed his position where he

said we won't ban muslims, we'll have a temporary restriction on individuals where isis is occupying the countries. i don't know exactly what he's going to propose in 70 days. but we do have problems on the southern border and hillary clinton 8 years ago said we need increased border security. >> so the premise is what can we expect. he said he's going to dedicate more resources and funding towards the southern border and that's a good thing. john: the immigration comments you would think would turn off latinos and minorities. you pointed out more blacks and hispanics voted for trump than voted for romney. >> an expert at lee recollection data said county level data on hispanics don't back up what the polls showed. >> the vote isn't done yet. they are still counting.

donald trump has -- he has done bert than i expected with the attitude he has taken from the start with minorities with criminals and rapists. the mexicans, the what do you have to lose strategy. he has stunned in he possible category. john: why didn't gary johnson stun? he didn't get the 5%. >> it's tough. he won three times as many votes as any libertarian presidential candidate has gotten. i think he may have raised $10 million. that's 1% of what hillary had and .5% of trump's free media. when the election appears to be close, people drift back to the candidate they dislike the least. he didn't get any kind of lead yeah. >> he got the what is aleppo media. >> that may have helped him by

raising his name i.d. by the many very tough. he got more percent and than any third party candidate since the billionaire celebrity ross perot. john: i hate trump's scream against trade. trade is voluntary exchange. globalization and free trade have been giant choices for good. a billion people are no longer poor because of trade. a billion people have lifted themselves out of poverty says the up n. and that's mainly due to trade. >>s not my candidate. he's our president-elect trump. i'm a big free trade guy. it will be interesting to see. when president trump gets in office he will be presented with compelling data that free trade

has lifted more people out of after i domestically and internationally. how, it's impossible to argue that certain trade policies have devastated parts of america and not enough has been done to at least lift those individual, give them the attention they need, whether it's scranton pennsylvania to scranton pennsylvania. the second thing i'll say is donald trump went after these individual. if you look at the votes he got, the republicans have not won these types of voters in a long time and trade was an issue. >> that's why bernie had any legs in the democratic primary. bernie sanders went out there and hit economic issues solely which is why he struggled so much with minority voters. he said today i looked at what donald trump is proposing, if he's going to talk about trade, maybe this won't be so bad.

john: popular doesn't mean it's right. >> these guys are both 70 years old, trump and bernie. >> 70 years old and they haven't learned econ-101. now, it may be that his age will be able -- his aides will be able to tell him, every economist in the world agrees that trade makes the economy better, you are going to be held responsible for the state of the economy. maybe he will shape up. john: i hope so. on the stupid polls and media, how did we get the election results so wrong. on election day the "huffington post" said there was a 98% clinton would win. >> the consortium has a 99% clinton-win?

>> i'm confident we have a massive mobilization. john: i embarrassed myself by assuming a hillary victory many times. i have a syndicated column that runs on wed days. this week i had to submit my column before the election returns were in. so i wrote about president-elect hillary how she would rule as a queen. we were so wrong. i also wrote how state was freedom-loving senators like ron johnson loss to command and control bureaucrats like russ feingold. commenters had fun track me at townhall.com. another commenter said i always liked stos the but obviously

he's as clueless as the liberal media. i have come to trust the people who bet. look what happened in the republican primary. ben carson surged to first place in polls but the betters new better. they even predicted when saddam hussein would be cap secured the day before he was captured. it correctly predicted results in he state but one. >> most of these markets are based overseas. even though they are super useful, american law calls them illegal gambling. my producer and i converted to this easy to understand website. because the betting is more accurate and pundits and polls until election night and brexit, too. what happened. how did polls and pundits get

this so wrong? >> i did predict that michigan would turn and donald trump would win. i traveled the country the last 60 days. i went to michigan, pennsylvania and ohio. people were saying i have never voted for a republican in my life. i am going to vote for donald trump. it was the brexit effect. john: states legalized weed. but california banned plastic grocery bags and other states did stupid things. later, how trump's election could change america for many years. >> supreme court justices. all you have to think. that's all you have to think. hey look, it's those guys.

does this bother you? >> take it government out of stuff. i like that. everybody happy? i'm happy. >> very happy. >> with president trump we may need marijuana. john: california voters voted on a ballot measure to forbid stores from giving out plastic bags. protesters claim it will save the environment. tuesday california voters band the bags. >> that's insane. the number of times i forget my grocery tote bag at whole foods. i think that's going a little far. >> people wash the bags and get sick from the bacteria. washington state voters were smarter. they voted against a carbon tax

and to repeal a tax exemption for electric cars. david, is there finally some environmental wisdom? >> there probably is. people have been resistant to things if they thought it would cost them time or money. the plastic bag thing, i'm surprised a majority of people would want to give up plastic bags. but taxes people voted against except when it was a tax on other people. if you said you are going too tax the rich, it turns out you can get a majority of the rich to go for that. john: we told but the massachusetts proposal to give farm animals more space. supporters climbed into a cage and screamed nobody wants to live without space. >> if you have space. yes.

>> government shouldn't get involved:that sort of thing. >> and you support donald trump snow's the biggest spending republican on the planet. >> get government out of stuff and i'm happy. john: colorado legalized assisted suicide. the death penalty was restored in nebraska, preserved in california and oklahoma voted to put it in their state constitution. >> the death penalty is impose on people possibly for good reason. assisted suicide allows people to make their own decisions. >> with the aging population this is swog my mother's parents we struggled with as they got older. it's hugely important that people who are sounds of mind are able to make decisions about their own life. reporter john: the colorado vote was big. >> i hope more states are

talking about that as a referendum issue. john: then the children will say, doc, let him go. >> that's a risk and that has to be guard against so there have to be safeguards to insure sound mind. >> that's what they do in europe. you have describing evaluations. >> people say they are letting children or doctors make those decisions. that's why i do worry. we have to be careful that it is a rational decision made by the person. but to the extent we can safeguard that they ought to be able to make that decision. john: donald trump's election may change american law for a long time. john: supreme court justices. that's all you have to think.

>> supreme court justices. that's it. that's all you have to think. >> one thing that scared me most about a hillary clinton presidency was she would be able to pick as many five court justices. now my head is still spinning. trump is president-elect. he says emchoose justices to respect the constitution. >> we have to replace judge scalia with justices of the supreme court like him. john: are you happy? well, i don't believe he understands the constitution. but somebody gave him the list and i think. john: the federalist society. >> they might be good. when he says justices like and to anyone schoolial. on and lot of issues he believed he was sticking to the law and the constitution. on the other hand he went froght

at the mouth new time gay people asked for their rights. even the right not to be arrested. he supported federal power over the use to use marijuana if you are sick. he says there is no right to raise your children way you choose. john: he was a conservative judge. >> it's beyond conservatism. it's obviously frightening to those of us on the left. i don't identify as a progressive. i consider myself a centrist democrat. john: all the progressive democrats consider themselves centrists. where they pushed hillary clinton in the end is not where i am naturally planted. the platform did not speak to me. it was an exaggerated version of things i believe. the idea that the constitution is not a living, breathing document which is what a lot of

strict constitutionalists believe is extremely disturbing to me. it means women don't have the right to vote or the right to choose. but they can be rolled back. we talked about this before. just thinking about abortion. the idea that my rights in texas could be different than my rights in california. we are one nation under god, is fundamentally disturning. >> you were just praising the states rights to choose the right to die. but i'm a constitutionalist. i love the fact that donald trump won. we have the possibility toll shape the court for a generation. i think that's very profound and important. i think we need more justices like clarence thomas, people who respect the constitution. john: he does not seem to be a friend of the first amendment. he sues people to shut them up.

he says he will change the libel laws. >> when the "new york times" writes a hit piece that's a total disgrace, he will sue people like you have never seen before. >> that's campaign hyperbole. he was saying personally. if someone is going to come after you saying you are going put them in court for libelist behavior. i think that's not going to be a top priority. but i think that's campaign hyperbole. and he does believe in the first amendment and he will appoint justices who do as well. >> he did sue an author for saying he's not as rich as he said he was. >> i didn't represent him in that so i won't be an apologist for everything he has ever done. the list of justices he put

forth is a very good list. if you look at clarence thomas and justice kennedy, that's a little bit different than scalia. there was a mix of more libertarians. there were civil liberty libertarians. there were some civil liberty libertarians and conservative justices. >> on the first amendment he's no bigger an enemy of the first amendment than hillary clinton. john: next, how can trump govern? he's been souped for groping women and cheating people. >> you were forced to file for bankruptcy four times.

jaw * our president-elect has done things that would make it impossible for normal people to be elected. he has a history of shady business deals. some workers claim he stiffed them. some of his businesses have gone bankrupt. what really gets people upset is the sexual stuff. he bragged about groping them. >> when you are a star they let you do it. they will let you do anything. grab them by the [bleep]. you can do anything. john: he can do anything to women. yet tuesday 42% of america's women voted for him. why? going back to our panel, charlie kirk, jessica tarlov, and.

>> donald trump was by an 83% margin considered the change candidate. >> people hate hillary more. >> people said they disliked both candidates. they broke for donald trump by a 20-point plus margin. when you were making a choice between the two, you are going for the change. i'm sure he said no way on this. what i found so fascinating is the number of women who backed him. and what pollsters we have to deal with, the effect we were

unable to deal with was the shy trump voter. the democrats made a huge mistake and i'm guilty of this as well making it so impossible for people, especially women to articulate to outsiders this is why i'm backing him. how can you back a misogynist. some weird things he said about ivanka. john: it's part of the political correctness movement. objecting to a trump sign. but objecting to someone saying i can grab her by the -- it's not political correctness. john: objecting to speech is. >> i think this was a change election. as jessica says, a large number of people who said he's not qualified to be president and doesn't have the character to be president voted for him because they wanted to drain the swamp, they wanted change.

maybe they didn't like the clinton dynasty. he was given two foils in this campaign. first the third bush candidate, then the second clinton candidate. for him that was a perfect opportunity to punch back at the elite -- the permanent government and family dynasties. john: in a few weeks he may have to go to court to defend one his legacies, the trump university. >> it will be a tremendous venture. john: it was shut down after someone who paid $60,000 tuition claimed trump's promises were were empty and the school was a scam. >> it's a civil case, i believe, not criminal. secondly he has been in a lot of business ventures. he has taken risks, i appreciate that. but the one attack i will defend

him on, people say he's not a good businessman. that's not true. he is the envy of many entrepreneurs around the world. john: carly fiorina tried to spin it that way. >> that's the way you ran your casinos. you ran up montanas of debt as well as losses using other people's money, and you were forced to file for bankruptcy four times. a record four times. why should we trust you? >> i'm not sure why we should trust him 6 times. but the argument was he has never filed for personality bankruptcy. his businesses have gone down. but that's just happens in business. >> this is a missed opportunity. we tried to hammer this and there were a number of effective ad for a couple of days using the contractors he stiffed. but it didn't resonate for long

enough. that's the problem. the clinton campaign did a spectacular job in two, three-day pockets. but we didn't get one this weekend. i was waiting. where is my gift basket and i got nothing. >> thanks to bill clinton's treatment of women, we have a unanimous court decision that says a citing president can be hauled into court. john: for doing things unrelated to the presidency. >> donald trump in particular, he would not have gone the the post office approved if his finances were that bad. the washington, d.c. post office building if he was up a bad business guy they would not have approved that very, very desirable project. john: maybe he bribed the commissioners.

>> that would be illegal. john: the and shares their worst and best moments of the election and best moments of the election season.

john: this has been a long, ugly election campaign. now that it's finally over i ask our panelists to pick their best and worst moments. jessica you say your fast it moment was this one. >> he was totally out of control. i said there is a person with a temperament that's got a problem. >> secretary clinton. >> okay. >> why was that your favorite moment. >> her shimmy. it was a moment of hillary clinton's uncensored human. everyone rails she has no personality. she stoodth and went like -- there is a great -- my twitter panel was about it. it was a moment of levity. and i thought -- i like it. i connected with it. i move around too much myself. john: jessica said her worst

moment was when donald trump made this announcement. >> donald j. trump is calling for a total and complete shutdown of muslims entering the united states until our country's representees can figure out what the hell is going on. john: that was one of the worst moment for lots of people. charlie, you said seeing the he athletes get it so wrong was your worst moments. >> it gave me a lot of satisfaction, it was a humble be experience for a group of people who consider them accepts always to be right and it was cool to see. john: a feeling of glee that something unexpected happened. >> in a change election. this is important for the democratic party to get blown up like this and rebuild. john: charlie? >> the divisiveness and collousness.

in the prior mary i supported governor walker and ted cruz because of ideas and principles. i'm a principles conservative constitutionalist. i just don't like the divisiveness and name calling. i would like it to have been more about big ideas on the left. john: we have differences. there will always be divisiveness. >> it was name calling. >> on both sides. john: david boaz says the worst moment of the campaign was this. >> ladies and gentlemen, the next president of the united states, donald trump. john: this is your worth moment? >> i thought donald trump was not a fit candidate to be president of the united states. i worry about his protectionism and racial and religious scapegoating during the campaign.

john: people say he's going to appoint good people. >> i don't believe that preview list. >> i believe in the federalist society that gave us cal yeah and thomas. john: last week president obama scolded a crowd for shouting down a pro-trump protester. >> everybody sit down and be quiet for a second. i'm serious, listen up. we live in a country that respects free speech. >> my other best moment was when hillary clinton lost. i didn't like trump winning but i was happy to see hillary leave. but what was good about the obama thing is it was such a callous and divisive campaign.

here is the president of the united states giving a speech and somebody jumps up to protest him and defend trump, and people booed him, and the president took two minutes to stay stop that, stop that. he has a right to free speech. he deserved respect. everybody has a right to free speech. john: he told the people don't boo, vote. but booing is okay. >> but booing with it many shouting somebody down is not good. >> it's a turnout tactic he used in speeches all over the country. people were going to his rallies, he is i think we, all agree, an amazing speaker. when he told that fired up, ready to go story again, i was not the only person crying. maybe on this panel. he communicates incredibly well. don't boo vote message needs to

[bleep] themselves. i don't remember. lots of powerful expensive ads. if money rules elections hillary would have won in a landslide. she didn't. another thing we learned that mainstream newspaper endorsements don't matter much. trump got two endorsements, hillary got 57. people voted for trump. now what? in the hit musical "hamilton" king george tells the colonists, "you are on your own. awesome. do you have a clue what happens now? will donald trump do reckless things, start a depression by anti-trade laws. silence newspapers? stop all immigration? trump scares people. i know hillary would have been a bad president. i hope trump will be great, but i fear he will do terrible

things. but at election time when people put so much importance on who will be president. a president isn't the cause or answer to most of our problems. thanks to this thing, the constitution, a president's powers are limited. my ancestor the founder explained to me, we wrote that to protect people from oppressive government. to make that extra clear we added the tenth amendment. powered not dell gate to the united states by the constitution, the powers are reserved to the states or the people. the people. the president in fact, the whole federal government doesn't run our lives. i get annoys when people talk on tv about politicians running america. >> these are the people running this country. >> someone who can actually one our country. john: a president doesn't run

our country. 3 plus million people mostly run our own lives. thank goodfest more that. good d thank goodness for that. scientists, artists, entrepreneurs do much more. despite the horrible growth of government under republicans and democrats, americans are richer today then we have ever been. don't bleach the no questionsies. the rich get rich and everybody else is getting poorer. john: that's a lie. the top 1% gain more, but the poor and middle class got richer, too. middle income people earn 40% more than they did 47 years ago. even americans who didn't gain in income gained in other ways. we have air-conditioning, wash machines, all the world's music in our phones. fresh fruit in winter.

we take this for granted. but the fact we can have all this at reasonable prices. poor americans live better than kings and queens in versailles. would you change places with king george? george didn't have antibiotics, netflix, flush toy lets. the whole world at his fingertips via the internet and more. so much much what makes our lives bert has lit toll do with who the president is. we got here because individuals were allowed to create usually without government getting in the way. let'skeep it that way. don't like trump within don't like clinton? fear what politicians might do? we, too. it's another reason to keep government small. government is best that governs the least. that's our show. see you next week.
